Vile vile ni Mkurugenzi wa Benki Kuu ya Tanzania na anashikilia nafasi ya ukurugenzi katika kampuni ya kigeni ya Tangold Limited ambayo maelezo yake tumeyatoa kuhusiana na ufisadi unaomhusu Gavana Balali na Andrew Chenge. Law protects Chenge from assets disclosure: Media, opposition leaders effectively stonewalled at Ethics Secretariat

A CONTROVERSIAL law passed over a decade ago when Andrew Chenge was the country�s Attorney General is now effectively shielding his assets declaration records at the Public Leaders Ethics Secretariat from public scrutiny.

Local media and opposition leaders pursuing the assets disclosure forms of the former infrastructure development minister have suffered a major setback, thanks to the Public Leadership Code of Ethics Act of 1995 and its regulations.

A key confidentiality clause was inserted in the Public Leadership Code of Ethics (Declaration of Interests, Assets and Liabilities) Regulations of 1996, when Chenge was serving as the government’s chief legal advisor. This clause gives anyone the basic right to inspect assets declaration records of public leaders - but then restricts them from releasing to the public any information so obtained.

The regulations describe the disclosure to the public of any particulars on the assets declaration forms as an illegal ’’misuse’’ of the information.

This much-criticized limitation, otherwise known as a ’clawback’ clause, therefore makes it illegal for the public release of information on Chenge’s assets disclosure records by the media or political opposition leaders.

According to Section 7 (2) (c) of the regulations, information obtained from the register at the Public Leaders Ethics Secretariat shall be considered misused if it is ’’used wholly or partly for publication or broadcast to the media, or is communicated to the general public.’’

This means that even if members of the media get to peruse the former minister’s assets declaration records, existing regulations make it illegal for them to publish any omissions and commissions in their newspapers.

And opposition leaders are also not allowed to use any information gained from the records when addressing public rallies and other forums.

’’Any person who commits an offence against these regulations is liable on conviction to a fine of shillings ten thousand, or to imprisonment for a term not exceeding two years, or to both,’’ say the controversial regulations.

Opposition leaders Prof. Ibrahim Lipumba (CUF) and Augustine Lyatonga Mrema (TLP), along with dozens of their supporters, yesterday visited the headquarters of the Public Leaders Ethics Secretariat in Dar es Salaam and demanded access to the assets disclosure forms of Chenge and other public leaders both past and present.

Assets disclosure records of other individuals targeted by the opposition leaders include President Jakaya Kikwete, former president Benjamin Mkapa, former prime minister Edward Lowassa, ex-Bank of Tanzania governor Daudi Ballali, and Igunga Member of Parliament Rostam Aziz.

The assets declaration forms of former cabinet ministers Nazir Karamagi and Basil Mramba, and Permanent Secretaries Gray Mgonja (Treasury) and Patrick Rutabanzibwa (Water, formerly Energy and Minerals), have also attracted opposition interest.

However, the CUF and TLP leaders and their supporters were told to follow a bureaucratic process stipulated in the regulations for people wanting to access such records at the secretariat.

This includes submitting a written request to the ethics commissioner and specifying reasons for wanting to see the assets disclosure forms.

The regulations require any person wishing to inspect the records to first file an official complaint against a public leader.

’’Where the (Ethics) Commissioner, on assessment of the complaint lodged, is not satisfied with the genuineness or is otherwise dissatisfied with the intention of the complainant, he may refuse to grant permission for inspection or may require the complainant to furnish to him more information relating to the complaint,’’ stipulates part of the regulations.

After officially lodging their complaints against Chenge and other public leaders yesterday, opposition leaders will now have to wait for the Commissioner of the Ethics Secretariat, Judge Stephen Ihema, to decide whether or not they may inspect the register.

But even if they manage to pass through all the red tape and bureaucracy, and are eventually given access to the records, the opposition leaders will legally not be allowed to announce anything they find in the forms.

Chenge was forced to resign from his cabinet position on Sunday over corruption allegations linked to the 28 million pounds sterling (approx. 70bn/-) military radar deal.

He had initially refused to quit, saying he would fight the allegations that he received a hefty kickback from Britain�s arms manufacturer BAE Systems to approve the radar deal sometime between 1999 and 2002, when he was still AG in ex-president Benjamin Mkapa�s administration.

The ongoing investigation into suspected improprieties related to the deal has led to the discovery of at least $1m (approx 1.2bn/-) in offshore bank accounts owned by Chenge in Jersey, UK.

After Chenge, who's next?

Two days after Infrastructure Development minister Andrew Chenge resigned from the post, the question that now lingers in peoples� mind is: who's next?

Political analysts forecast more resignations among top government officials accused of being directly involved in the radar deal.

Details made available to The Citizen this week indicate that at least one Cabinet minister and several other top public servants could follow Mr Chenge�s path should the UK�s Serious Fraud Office (SFO) declare that they are also under investigation.

Opposition leaders are already pressuring more officials allegedly involved in corrupt deals to follow suit.

Yesterday, Opposition leaders demanded to be given access to wealth declaration forms for at least 11 key government officials at the Public Leadership Ethics Commission.

Led by Civic United Front (CUF) national chairman Prof Ibrahim Lipumba, Opposition leaders wanted to be provided with the forms of all public leaders mentioned in the �List of Shame� compiled by Karatu MP Dr Willibrod Slaa.

Addressing a public rally at Mwembeyanga grounds in Temeke Municipality last September, Dr Slaa claimed that top government officials and prominent businesspeople had pocketed $1 billion in various shady deals.

Tanzania Labour Party (TLP) chairman Augustine Mrema and representatives from Chadema and NCCR- Mageuzi were among Opposition leaders who went to the Commission yesterday.

After their arrival at the office, an officer with the Commission identified as Mr Augustine Kiria told the leaders to direct their demands to the Ethics Commissioner before they handed over their letter to the secretary of the body (a copy of which The Citizen saw).

However, Mr Kiria said the commission would respond to the Opposition�s demands through a letter.

At the political rally held in Dar es Salaam last weekend, Prof Lipumba pledged to storm offices of the ethics commission to peruse the asset declaration forms of certain prominent government officials.

They had planned to put pressure on Mr Chenge, which included a demonstration in Dodoma had the minister appeared for the ongoing Bunge session. However, Mr Chenge tended his resignation to President Kikwete on Sunday, a request the latter accepted immediately.

Minimal involvement

However, few days before his resignation, Mr Chenge insisted that his involvement in the deal was very minor, saying the deal was okayed by the Cabinet during the third phase government.

At least three key ministries namely Finance, Transport and Communications; and Defence and National Service were involved in procurement of the nearly Sh70 billion controversial radar system.

�I was only involved in the minor aspects of the radar deal which was promoted by other ministries before being approved by Tanzania Cabinet,� Mr Chenge told The Citizen.

Mr Chenge believes that this was a well-calculated move targeting him personally for either political or other reasons.

The embattled minister hit the headlines since last week after The Guardian newspaper of UK reported on the SFO�s investigation on his involvement in the nearly Sh70 billion radar deal, exposing weaknesses on the country�s financial systems.

However, despite the facts that so far there�s no any evidence that link Mr Chenge with the $12 dubious payments paid to BAE system, the $1 million found in his offshore bank account raised more questions than answers.

Unanswered questions

While Mr Chenge has distanced himself with the radar deal, he has not been able to explain how did he, as public servant in one of the poorest countries in the world, accumulate such wealth.

Equally going unanswered so far is whether the sum exposed last week was mentioned during under wealth declaration process as required by Public Leadership Ethics Code Act.

Even then, country regulations require that Bank of Tanzania governor must clear Tanzanians wishing to own overseas accounts.

No nonsense

With four resignation in key posts and at least the sacking of BoT governor Daudi Ballali, analysts are skeptical that the radar deal would claims more public officials.

Sources at the State House say President Kikwete, who has been in office for over two years now, is not ready to sacrifice the good public image he is building with his voters, by protect public officials accused of corruption.

However some questions still haunt Kikwete�s regime: What next after resignation? Are they taken before the court of law?

MPs reactions

Some Members of Parliament (MPs) have said the their relentless efforts to speak against graft and embezzlement in the country is having an impact if the rate of high placed public figures resigning is anything to go by.

Speaking to reporters at the Bunge grounds in Dodoma yesterday in various occasions they said Mr Chenge and others who resign on graft allegations should be taken to court and appropriate steps taken.

Mr Aloyce Kimaro (Vunjo-CCM) cautioned President Kikwete to be very careful with the people he appointed to help him achieve his agenda of better life for all Tanzanians in new vigour, new speed, and new zeal.

The President should ask himself if the people he appointed to hold public office have the same agenda as he has or they are just seeking better life for themselves, he said.

Mr Athuman Janguo (Kisarawe-CCM) said a cabinet minister resigning is not uncommon in Tanzania, adding that Mr Chenge's move was wise and prudent and an example for others to follow. This will pave way for independent investigations.

Mr William Shelukindo (Bumbuli-CCM) commended Mr Chenge for his wise decision but said it is time for a re-emphasis of ethics of leaders in high government positions. He said it seems now there is a downgrade of morals among leaders something that is dangerous for the future of this country.

Ms Grace Kiwelu (Special Seats Chadema) said even as they met with great hostility when they took the government to task in Parliament over public fund mismanagement their persistence has allowed the public and the government itself see the truth of the matter.

John Cheyo (Bariadi East-UDP) said Mr Chenge's resignation has been a great relief to President Kikwete who will now have an opportunity of choosing a trustworthy minister.

�But the President should take legal steps and ensure justice is done to Chenge to serve as a lesson to others, he told reporters.

Ms Fatuma Maghimbi (Chake Chake-CUF) said Mr Chenge's decision to resign has come too late. He was supposed to resign when allegations resurfaced for the first time.

�President Kikwete knows who is clean and who is dirty in his team. Let him take the first step to force them to take responsibilities. This will give him an opportunity of working with only trustworthy people, she told reporters at the Bunge grounds in Dodoma yesterday

Mr Ali Khamis Seif (Mkoani-CUF) said the opposition camp is not surprised to see Mr Chenge resigning because a lot of shoddy contracts were entered when he was attorney general.

RAIS Jakaya Mrisho Kikwete ameelezwa kukerwa na jinsi mawaziri wa serikali yake wanavyofanyakazi bila uangalifu. Watu waliokaribu na Rais Kikwete na walioongozana naye katika ziara ya India, China na Marekani, waliliambia gazeti hili kuwa kukwerwa huko kulitokana na baadhi ya mawaziri kuharibu mkataba.
Walisema kuwa mkataba huo uliokuwa kwa upande mmoja usainiwe na waziri wa Tanzania na upande mwingine waziri wa China, uliharibika baada ya kusainiwa na mawaziri wawili wa Tanzania, hivyo kuharibu itifaki.
Wakizungumza kwa sharti la kutokutajwa majina gazetini, walisema kuwa mkataba huo ulikuwa batili baada ya kusainiwa na mawaziri hao waandamizi, hali iliyomfanya Rais Kikwete kuja juu kutokana na uzembe huo.
Vyanzo hivyo vya habari vilidai kuwa mkataba huo ulisainiwa na mawaziri hao wawili kutokana na jinsi ulivyokuwa umeendaliwa licha ya ukweli kwamba ulikuwa ukihusu zaidi wizara moja.
Walidai kuwa mkataba huo uliokuwa ukihusisha masuala ya wizara ya miundombinu, katika mazingira yasiyoeleweka ulianza kusainiwa na Waziri wa Mambo ya Nje na Ushirikiano wa Kimataifa Bernard Membe na kisha kusainiwa na aliyekuwa Waziri wa Miundombinu Andrew Chenge.
Vyanzo hivyo vilidai kuwa Waziri Membe alisaini mkataba huo baada ya kuwepo kwa sehemu yake ya kusaini, huku nyuma kukiwa na sehemu ya kusaini Chenge.
Kulingana na vyanzo hivyo, inadaiwa kuwa baada ya kusainiwa, mkataba huo ulikuwa batili kwa kuwa ulipaswa kuhusisha waziri mmoja wa Tanzania na mwingine wa China.
Hata hivyo haikuweza kufahamika mara moja aliyehusika na uzembe huo katika mkataba huo ambao unadaiwa uliandaliwa mapema tangu kuwapo kwa taarifa ya safari ya Rais Kikwete nchini China.
Pia haikuweza kufahamika hatua ambazo Rais Kikwete anaweza kuzichukua dhidi ya mawaziri wake hao kutokana na uzembe wa kuandaa mikataba kama ilivyojitokeza.
 
Kama nahodha anaona mabaharia wake wanazidi kuzamisha jahazi anapaswa kuwajibika, ama kujiuzulu au kuwawajibisha wao na kuwaambia wajiuzulu, ili waje mabaharia wazuri zaidi wenye uwezo na umakini wa kikazi.
