The ban of a weekly newspaper in Tanzania has heightened concerns among observers that the government of president John Magufuli is intent on exerting pressure on journalists and stifling freedom of expression.

The privately-owned Mawio paper was banned for 24 months on June 15, with the government suspending both its print edition and online platforms. Tanzania’s information minister Harrison Mwakyembe said in a statement (in Kiswahili) that the paper was suspended for publishing the photos of two former presidents—Benjamin Mkapa and Jakaya Kikwete—on its June 15-21 edition and linking them to a government probe into allegations of misconduct in the mining sector.

A recent government committee estimated that the UK-listed Acacia Mining underpaid Tanzania tens of billions of dollars in gold and copper exports since 1998—but stopped short of mentioning the former presidents.

This is the second time in two years that the government has banned Mawio. In Jan. 2016, the government invoked the 1976 Newspaper Act to deregister the weekly saying it engaged in “inciteful” coverage of the tense situation in Zanzibar following the 2015 general elections. Observers now say the ban shows that all is not rosy for the fourth estate in Tanzania and that the government is getting increasingly intolerant of criticism in the press and social media.

“We are extremely concerned that Tanzania is using public order as an excuse to frustrate the flow of information and public debate,” Angela Quintal of the Committee to Protect Journalists, said. “A two-year ban is tantamount to closing the publication.”

Over the last decade, as the media space in Tanzania has opened up, the slew of laws that give officials a broad discretion to restrict media organizations on the basis of national security or public interest has increased too. In 2015, former president Kikwete signed a controversial cybercrime law that gives authorities sweeping powers to jail those who offend the president , contradicting legal and international human rights standards. The passage of the Statistics Act in March 2015, which made the publication of any data not approved by the National Bureau of Statistics illegal, also drew condemnation from critics .

In Nov. 2016, Magufuli signed the Media Services Bill into law, replacing independent media oversight mechanisms with a government-controlled one, and requiring all journalists to get accreditation from a government-appointed board .
All these laws have coalesced into creating an unfriendly environment for the Tanzanian media, where the constitutional guarantees for freedom of speech does not necessarily equate with freedom of the press. Last year, the weekly paper Mseto was closed for publishing a story linking Magufuli to corruption during the elections. The Nairobi-based The East African newspaper was also banned from the country in 2015 for a year, for what some said was publishing a cartoon depicting cronyism in the east African nation.

On his end, president Magufuli—who is also known as “the Bulldozer” for his strict leadership style—has not inspired much confidence in the media. He has instead warned them that press freedom has its limits. During the appointment of Mwakyembe as information minister, he said: “I would like to tell media owners—be careful, watch it. If you think you have that kind of freedom, (it is) not to that extent.”

She also appears to have attended the dinner at Safari Park Hotel where supporters of the President were reported to have raised Sh1 billion for his campaign as she took a selfie with him.

What caught the attention of many, and which seemed odd, was that Ms Njoroge had access to not only the information on Mr Menya’s arrest, but photographs taken at what appeared to be the headquarters of the Directorate of Criminal Investigations.

Ms Njoroge is not a police officer, at least judging by what is on her Facebook page.

In her profile, she says she works for the Government of Kenya and is a former communication manager at The National Alliance party.

She says she is the founder and former director at the Eagles Leadership Foundation and a former programme assistant at the Martin Luther King Junior Africa Foundation.

With the maximum 5,000 friends Facebook allows and 62,251 followers, she certainly has a lot of people interested in her.

She does not disappoint them, keeping them informed about the Jubilee campaigns, with photos over the past week from Tharaka-Nithi, Chogoria, Kahawa West and Machakos with the Mbele Iko Sawa team.

On Monday evening, State House Director of Digital Communication Dennis Itumbi questioned the manner in which the “arrest” was carried out and the involvement of Ms Njoroge.

“My only question on the arrest of Journalist Walter Menya, is why was it necessary to leak photos of the arrest to bloggers? Why? It makes it look like a staged action. Many people are arrested and arraigned in court—their pictures from CID HQ in handcuffs do not go public...” he said.

“That alone trivialises the arrest and the accusation,” he added.

Mr Itumbi said that while the case would be decided on facts and evidence, “the perception is that it was a scripted narrative that must be pointed out.”

Mr Menya is supposed to be released by 5pm today after Senior Principal Magistrate Martha Mutuku on Monday allowed a police request to hold him for one more day to allow investigators to gather more evidence.

A Sunday Nation journalist has been arrested for reportedly soliciting a bribe for a story.

Walter Menya was arrested on Sunday and is currently at the Kiambu CID headquarters.

Inspector General of Police Joseph Boinnet confirmed the arrest of the Nation Media Group writer.

Boinnet said Menya was arrested in the city centre when receiving a Sh50,000 bribe from a person he did not disclose.


He said the journalist will be charged in court with the offence of extortion on Monday.

At the time of going to press, it is not clear which story the journalist was following.

Nation, in its story of the arrest, said Menya was booked over a story implicating civil servants actively involved in Friends of Jubilee Foundation.

The story was published in the Sunday Nation edition of June 18.

Sir, here we talking about totally different things. The president of Tanzania has ordered the closure of a newspaper, for whatever reason, that was a disproportionate action to take against the paper.

Unlike the case above, prosecuting a rogue journalist, accused for soliciting for bribes in order to publish/ not to publish a story ( it is not clear which) does not amount to stifling of the freedom of the press.

All of that whether arresting journalist or a ban on newspaper is classified under media censorship!

This demand directed at me, is not sensible. I am not the one making the allegations.

The govt of Tanzania, under Magufuli has ordered for the closure of the newspaper, for two years, ( the reasons, we can only conjecture) truth or false?

This sorts of things should not be happening in a country claiming to be free and democratic.

Rights groups put Kenya govt on the spot over rising attacks on journalists

The media in Kenya is increasingly finding it difficult to conduct its operations due to rising threats from government.

A new report written jointly by the Human Rights Watch and Article 19, which monitors threats to free expression across the globe notes that Kenyan authorities have committed a range of abuses against journalists reporting on sensitive issues.

The groups note that threats against journalists have increased to levels not seen in the past decade, a factor that is critical at a time the country is preparing for general elections slated for August.

“Journalists and bloggers reporting on corruption, disputed land acquisitions, counterterrorism operations and the 2007-2008 post-electoral violence, among other sensitive issues, have faced intimidation, beatings, and job losses,” the report notes.



Abuses

Titled Not Worth The Risk: Threats To Free Expression Ahead of Kenya’s 2017 Elections, the 53-page report catalogues abuses by government officials, police, county governors and government officials against the media.

“For Kenya’s August elections to be credible and fair, the media needs to be able to report on pressing issues of national interest without fear of reprisals, ”said Otsieno Namwaya, Africa researcher at Human Rights Watch. "President Uhuru Kenyatta should publicly underscore the importance of free expression and condemn threats and attacks on journalists and bloggers."

Investigations were conducted over a period of four months involving interviews with 92 journalists, human rights activists, bloggers and government officials in Kenya.

The groups list 17 incidents in which 23 journalists and bloggers were physically assaulted between 2013 and 2017 by government officials or their allies.

At least two journalists have died under circumstances that may have been related to their work.



Death threats

The groups also documented 16 incidents of direct death threats against journalists and bloggers across the country in recent years, and cases in which police arbitrarily arrested, detained and later released without charge at least 14 journalists and bloggers.

For example on September 7, 2016, unidentified assailants forced themselves into the house of a photojournalist, Denis Otieno in the town of Kitale in Kenya's Rift Valley and demanded photos on his camera, then shot him dead.

Mr Otieno had photographed police officers shooting and killing a motorcycle taxi rider at a Kitale bus station days earlier.

A family member said that before his murder, Mr Otieno had expressed alarm about death threats.

No one has been arrested in relation to his killing.

“We must stem the tide of increased violence and impunity against journalists in Kenya. No policy to address the situation can be successful if measures to prevent aggression against and to protect journalists are not accompanied with thorough and timely prosecutions of all crimes committed against them,” said Henry Maina, regional director at Article 19 Eastern Africa.
