Umekwisha pewa mkataba wa kazi tayari mkuu,maana usije kua unasema umeajiriwa na mkataba hauna,kama ushapewa mkataba tayari,wajibu wa kutoa kazi anaomwajiri,kuwe kuna kazi au hakuna unapaswa kulipa,kama watakunyima kazi wanapaswa kukulipa ,maana kwanza unakua usumbufu labda ndani ya huo muda ungeweza kua ushapata kazi sehemu nyingine.

Hata mimi nina mdogo wangu alipangiwa kituo na utumishi ila alipoenda kuripoti wakampa mkataba wa kazi na kumwambia arudi watampigia mpaka sasa ni miezi 2 imepita yupo tu hapa nyumbani kwangu na kazi aliyokuwa anafanya mwanzo aliacha ili ajiunge huko.

Labda developed world....bongo sijui.....! Mimi nimeshabadilisha ajira kama mara tatu hivi tangia ni graduate, lakini hakuna hapa Employer mmoja aliye nikabidhi msahafu huu....nafikiri kwa sababu waajiri wengi hawapendi kufuata hizi sheria za kazi so sitashangaa kuona hawawapi copy waajiriwa wao!
Kubadilisha aijira mara tatu imetosha sasa ujiajili

wanajamii naomba kuuliza hivyi ikitokea mwajiri kakulipa msharaha kimakosa (yani kazidisha amount fulani katika mshahara wako kwa mda wa zaidi ya miezi 2) je ni sahihi mshahara wako kushushwa tena kama hilo kosa lilikuwa la mwajiri. je sheria ya kazi inasemaje kuhusu hilo wanasheria tunaomba mtutafsirie.

Nimesikia kuna labour law(mpya) inasema kuwa mwanamke anaruhusiwa kwenda martenity leave ya miezi mitatu hata kama hajamaliza miaka mitatu toka martenity leave iliyopita. Mwenye kujua naomba aniambie ni kipengele namba ngapi.
Hamna kitu kama hicho,kinachofanyika ni Fair ya mwajiri.

Je sheria inasemaje mtu alieajiriwa serkalin badae kusitishwa ajira yake bila yy kukosa ila tu ni kwa taratb zao na kwa muda usiojurkana? MF ndg zetu wa Mahakama waliositishiwa ajira zao toka June mpaka leo November! Je wanahaki yeyot kisheria? Waanzie wap? Wameenda wizara kuuliza hatima yao wamefukuzwa kama mbwa wakiambiwa wasubr! Bila muda maalum na wamekaa mtaan miez 5 sasa!

Wadau kuna kitu kinaitwa Gratuity,hii upewa mwajiliwa wa mkataba wa mwaka mmoja baada ya kufikia mwisho wa mkataba kabla ya Ku renew mkataba mpya . hivi hii kitu inastahiri kukatwa kodi?

Hivi ni section gani inazungumzia malipo baada ya mkataba kuisha? Sec 42 ya ELRC 2004 inasema severance pay ni hadi uwe terminated sasa mimi mkataba umeisha na sikuwa terminated, natambua section 42.1 inasema malipo yapo ila section 42 iko chini ya heading "other incidents of termination" naomba msaada jamank
Unapewa Gratuity 25% of total amount you accumulated during entire contract period

Ni swali kidogo. Mfano ulipewa mkataba mwenye gratuity baada ya miaka miwili. Ila mkataba huo kila mwaka ukiisha unasaini upya. Mwaka mmoja ukaisha vema. Mwaka wa pili unataka usaini gafla kipengele kimeondolewa. Je kuna haki yoyote muajiriwa anaweza kupata hapa?

Nina swali wakuu, Mimi ni mhanga wa kuachishwa kazi katika kampuni moja hivi hapa Tz, inajishughulisha na uchimbaji wa madini aina ya dhahabu! Kitengo changu kilifutwa chote,zaidi ya wafanyakazi 136 tuliachishwa kazi, wakati huo tulikuwa na mikataba ya kudumu! Kesi ilienda CMA matokeo yake mwajiri akatunukiwa ushindi na arbitrator, kama mjuavyo maamuzi ya arbitrator yanatekelezeka immediately! Ndipo akatekeleza adhima yake! Chama cha NUMET-TZ kinachoshughulika na watu wanaofanya kaz migodini kilikata rufaa kwenda mahakama kuu na kesi bado haijasikilizwa wala kupangwa kutokea January mpka sasa!

Sasa swali kwenu wadau, naweza kusimama Mimi kama Mimi nikafumgua na kumshitaki huyu mwajiri kwa kitendo chake hicho? Mwanasheria naomba tuwasiliane 0764811295 plz!
