Kumezuka tabia ya baadhi ya Waajiri ikiwemo Sekretarieti ya Ajira kupanga usaili siku za Jumamosi ( hususani Usaili wa Mchujo).

Kitendo hiki ni Kinatafsiriwa kama Ubaguzi (Discrimination) kwa waumini wa Kanisa la Waadvetista Wasabato ambao Jumamosi ni siku ya Ibada therefore, by doing so, their opportunity in employment is nullified and impaired. Naomba nieleze kidogo swala ya ubaguzi katika ajira katika tafsiri ya Kisheria kwa ufahamu wangu mdogo nilionao.

Article Na.1 of the Decrimination (Employment and Occupation) Conventions, 1958 which then rectified by Tanzania ni 2002, this practice can be termed as Employment/ occupational Discrimination so “Any distintion, exclusion on preference made on basis of race, sex, colour, religion, political opinion, national extraction or social origin, which has the effect of nullifying or impairing equality of opportunity or treatment in employment or occupation”. Meanwhile, discrimination employment and occupation is not allowed under Section 7 (4) of Employment and Labour Relation Act No.6 /2004 as follows

“No employer shall discriminate, direct or indirectly against an employee in any employment policy or practice or any of the following grounds; colour, nationality, tribe or place of origin, race, natural extraction, social origin, political opinion or region, sex ,gender, pregnancy, marital status or family responsibility, disability, HIV/AIDS, Age or station of Life”

According to Section 7(9) of of Employment and Labour Relation Act No.6 /2004

“An “employment policy or practice “ includes any policy or practice relating to recruitment procedures, advertising and selection criteria appointment and appointment process, job classification and grading, renumeration, employment benefits and terms and conditions of employment, job assignments, the working environment and facilities, training and development, performance evaluation systems, promotion, transfer, demotion, termination of employment and disciplinary measures”

Kwa msingi wa maelezo hayo ya Kisheria, kwa heshima kubwa, naomba Sekretarieti ya Ajira ifikirie upya na kusitisha mara moja tabia ya kupanga usali siku za mapumziko ya mwisho wa juma (Weekends) ikijumuisha Jumamosi ili kuwa na mchakato wa ajira usiokuwa na ubaguzi. Aidha, nawashauri wafanye utafiti kwa njia ya maoni wa sababu zinazofanya baadhi ya Waombaji wa kazi kutohuduria Interview wanaweza kupata sababu nzuri za kuboresha mchakato huo.

Nina imani ombi litaapokelewa ili kuwapa Haki sawa wale ambao Jumamosi ni siku yao rasmi ya Ibada.

Ukianza kudai interview kufanya jumamosi utadai unanyanyaswa then utatwambia ukipata kazi let say ya udaktari ukiambiwa uende kazini jumamosi utsema unanyanyaswa.Hutufai kanisanihutufai msikitimi na hufai kutumikia jamii Bora Mungu akupende zaidi ukamtumikie huko kwake

Hakuna siku za juma zile 7 hakuna mtu hawi kwenye ibada , labda kama unataka wakupendelee wewe , Uzi wako unatakiwa usomeke mnipendelee siku ya jumamosi, na tunaweza kukupendelea na jumamosi tukaibadilia jina ikawa ijumaa
 
Kwasababu ni wachache ( minority) ni ngumu kuona athari zake. Haipendezi kila Interview inapangwa Jumamosi kwanini hazipangwi siku nyingine kwa kurududia. Kwanini mara zote na mara nyingi ni Jumamosi, hata kama hatujali kwakuwa ni wachache hawana sauti lakini wanaumia sana.
 
Hakuna siku za juma zile 7 hakuna mtu hawi kwenye ibada , labda kama unataka wakupendelee wewe , Uzi wako unatakiwa usomeke mnipendelee siku ya jumamosi, na tunaweza kukupendelea na jumamosi tukaibadilia jina ikawa ijumaa
Hakuna hoja ya upendeleo issu ni kwamba kwa imani ya Waadventista Wasabato, Jumamosi ni siku ya ibada so kupanga Interview mara kwa mara au kila wakati siku hiyo kuna waumiza waumini hawa wachache ambao pengine kwa uchache wao hawana sauti ya kutosha kujitetea.

Hoja hapa sio Jumamosi, hoja ni kwanini kila wakati iwe Jumamosi kwanini isiwe kila wakati Interview ya Mchujo iwe siku nyingine? Nashawishika kuhisi kwamba pengine ni kwakuwa ni wachache (minority).
 
Unajisumbua kuleta hoja hii hapa, majibu ya watu wanaosnesha hakuna anaejali sana sana wanajibu kwa kejeli, lakini siyo haki kuwatendea hivyo kutokana imani yao. Serikali inapaswa kuheshimu imani ya kila Mtanzania hata wanaoamini usabato ni watanzania kama wengine na wanahaki kama nyie mnao kejeli hapa. Usaili ni sehemu ya kazi hivyo ni bora ufanyika siku za kazi na zisiwe za ibada za watu na hata ijumaa hakuna haja ya kufanya hivyo kuna jumatatu mpaka alhamis haiingiliani na imani ya mtu. Kazi inayofanyika ni sehemu ya kazi na kuwaumizia wengine siyo haki.
