The Arusha High Court will decide the fate of the election petition against the ArushaUrban Member of Parliament, Mr Godbless Lema, on September 26.

This follows Wednesday's closed session between the presiding Judge, Aloyce Mujulizi and the lawyers representing the petitioners, in this case Mr Mussa Hamis Mkanga and two other claimants and the defence attorneys.

The Judge will rule whether there is a case to be heard or the court should drop the suit as pleaded by both the defending lawyers led by Mr Method Kimongolo and State Attorneys Mr Timon Vitalis and Mr Juma Massanja.

The Civil Case number 13 of 2010 pits the three petitioners against Lema of the Chama Cha Demokrasia na Maendeleo (CHADEMA) who was declared the winner in the General Election last year.

The complainants, Mr Mussa Mkanga, Happy Emmanuel Kivuyo and Ms Agness Mollel, contest that the CHADEMA candidate's victory was "ill-gotten," citing irregularities which include the use of abusive language by Mr Lema and his team to tarnish Dr Batilda Buriani's (CCM candidate) image before the public.

The State Attorneys asked the court to dismiss the suit because it was of no public interest and would cost the government a lot of money to conduct fresh election.

"The taxpayers have already paid for the billions used to run last year's election and can't be burdened to foot the bill of post-election cases," argued Mr Vitalis.

The petitioners, through their attorney Mr Alute Mughwai, pointed out that as long as the general election was of public interest so was the related case regarding any irregularities that arise from its process.

But the defending lawyer, Mr Kimomogolo, said filing petition against an already concluded election was more of a personal interest than public affair, especially because majority of the public had voted for their candidate.

Mr Lema won the seat by getting a total of 56,569 votes against his closest rival, Dr Buriani, who got 37,460 votes.

A total of 99,313 people voted in the last October elections in which Chadema, CCM, TLP and CUF parties fielded candidates. Those who had registered to vote were 204,828, according to the Returning Officer, Mr Estomih Chang'a.
