    RIPOTI ya Mdhibiti na Mkaguzi Mkuu wa Hesabu za Serikali (CAG), imeanika madudu ya mkataba wa Chuo Kikuu cha Dar es Salaam (UDSM) kwenye mradi wa Mlimani City.

    Madudu hayo yanaonyesha namna chuo hicho kinavyopoteza mamilioni ambako amependekeza mkataba huo ufanyiwe marekebisho.

    Kwa mujibu wa ripoti hiyo iliyowasilishwa bungeni hivi karibuni, ujenzi wa mradi wa Mlimani City ulianza Oktoba Mosi mwaka 2004, ukikadiriwa kukamilika Septemba Mosi mwaka 2016.

    Hata hivyo, CAG ameshauri yafanyike marekebisho katika baadhi ya vifungu vya mkataba huo.

    Ripoti hiyo inaonyesha kwamba moja ya sababu ya kukiukwa maeneo ya mkataba wa wabia hao wawili ni uzembe wa menejimenti ya chuo.

    Ripoti inasema: “Tulibaini kwamba mradi mdogo wa hoteli ya nyota tatu (ambayo ina vyumba 100 kikiwemo chumba cha mikutano kinachochukua watu 1,000) na uboreshaji wa bustani ya botania, ikiwa ni sehemu ya mradi wa Mlimani City, haujakamilika kwa kipindi cha miaka 10 tangu tarehe ya makubaliano ya kumaliza mradi.

    “Mtazamo wangu ni kuwa hakuna ufuatiliaji wa karibu, usimamizi na tathmini ya mkataba huo kwa uongozi wa Chuo Kikuu cha Dar es Salaam.

    “Kwa sababu hiyo kuna uwezekano wa kushidwa kumalizia kazi iliyobaki kwa sababu ya ongezeko kubwa ya gharama ya kumalizia mradi tangu kipindi kilichopangwa kupita.

    “Menejimenti ya Chuo Kikuu inashauriwa kuuangalia upya mkataba iliouingia na Mlimani City Holding, kuharakisha umaliziaji wa miradi,” ilieleza ripoti hiyo ya CAG.

    Ripoti hiyo pia inaainisha ukiukwaji wa ulipaji wa ada ambayo mwekezaji anatakiwa kuitoa kwa Chuo Kikuu cha Dar es Salaam.

    Kwa mujibu wa kifungu cha 1.1(j) cha mkataba pamoja na kifungu 10.1 cha hati ya ukodishaji wa uwanja, Chuo Kikuu cha Dar es Salaam kinapaswa kipate asilimia 10 ya mapato ya kodi ghafi.

    “Kinyume na kufungu tajwa hapo juu, Mlimani Holding Limited (MHL), hufanya hesabu za gawio la kodi ya Chuo Kikuu kwa kuzingatia asilimia 10 ya mapato ya kodi baada ya kutoa gharama za uendeshaji badala ya kujumuisha gharama za uendeshaji.

    “Ukiukwaji huu unakifanya Chuo Kikuu cha Dar es Salaam kuwa katika hatari ya kupoteza kiasi kikubwa cha mapato kutoka katika mradi wa Mlimani City,” inasema ripoti hiyo.

    CAG anaishauri menejimenti ya chuo hicho ifanye upya hesabu za gawio lake la asilimia 10 kutokana na mkataba na kuomba kulipwa na mpangaji kiasi kilichokuwa kimekosewa.

    Pia alishauri kuwasiliana na mpangaji na kufikiria kubadilisha mkataba kuweka vifungu ambavyo vitaruhusu idara ya ukaguzi ya ndani ya chuo kuangalia mapato na gharama za uendeshaji za mradi.

    Ripoti hiyo pia imeainisha udhaifu wa ufuatiliaji na usimamizi wa mapato kutoka kwa wapangaji wadogo kwenye mradi huo.

    Inasema kifungu cha 11.2(l) cha hati ya makubaliano, mpangaji (MHL) anapaswa kutopangisha mtu yeyote ambaye hajathibitishwa na Mpangishaji (Chuu Kikuu cha Dar es Salaam), ikiwa ni njia ya kudhibiti mapato yake.

    Kinyume na makubaliano ya hayo, ukaguzi wa CAG umebaini kwamba MHL amepangisha majengo kwa wapangaji wengine bila kupata kibali cha Chuo Kikuu cha Dar es Salaam.

    “Kuna upungufu wa utekelezaji wa vipengele vya mkataba kwa upande wa Chuo Kikuu cha Dar es Salaam hivyo kusababisha Chuo kushindwa kujua kwa usahihi mapato ya kodi kutoka kwa wapangaji wote.

    “Menejimenti ya Chuo Kikuu cha Dar-es-salaam inashauriwa kutekeleza vifungu na vipengele vyote vya hati ya makubalian ya upangaji kikiwamo kifungu 11.2 (l) cha hati ya makubaliano ambacho kinakitaka Chuo Kikuu cha Dar es Salaam kuwathibitisha wapangaji wadogo wadogo,” anashauri CAG.

    Ripoti hiyo pia inaonyesha mapitio ya mkataba wa upangishaji wa ardhi kati ya Chuo Kikuu cha Dar es Salaam na Mlimani Holding Limited yamegundua kwamba mkataba haumpi mmiliki wa ardhi haki ya kukagua kazi zinazofanywa na mpangaji.

    “Katika hali hii, mpangishaji, ambaye ni Chuo Kikuu cha Dar es Salaam hawezi kujua endapo mpangaji, Mlimani Holding Limited, anakiuka mkataba katika uendeshaji au kuna baadhi ya wapangaji wa nyumba hawawekwi wazi na mpangaji huyu,” inasema ripoti.

    CAG anashauri Chuo Kikuu cha Dar es Salaam kuwasiliana na Mlimani Holding Limited kupata haki ya kukagua shughuli za miradi kwa manufaa ya pande zote mbili.

    Ripoti hiyo inasema pia kwamba mapitio ya mkataba yamegundua mkataba huo hauelezei hali halisi ya ugawanaji mali mkataba utakapoisha (miaka 50 au 85 kutokana na makubaliano ya pande mbili).

    “Hakuna makubaliano yoyote yanayoelezea mgawanyo wa mali na miondombinu itakayokuwapo wakati mkataba unaisha.

    “Kwa hali hii, kuna uwezekano wa kutokea mvutano wa sheria mwisho wa mkataba. Hali hii ikitokea, Chuo Kikuu kitakosa msaada wa sheria.

    “Uongozi wa Chuo Kikuu cha Dar es Salaam, unashauriwa kuingia katika mazungumzo na Mlimani Holding Limited kuweka vifungu vitakavyoonyesha haki ya kila upande wakati wa mkataba utakapoisha,” anaeleza CAG.

    Ripoti hiyo pia inasema Chuo Kikuu cha Dar es Salaam ( kiliingia katika makubaliano na kampuni ya Ernest and Young kufanya ukaguzi maalumu kujua kiasi cha mapato ambacho kinaidai kampuni ya Mlimani Holding Limited katika kipindi cha Mei Mosi mwaka 2006 mpaka Juni 30 mwaka 2014 na kubaini kutolipwa dola za Marekani 57,607.

    “Wakati wa ukaguzi niligundua kuwa kiasi cha Dola za Marekani 309,458 kilitakiwa kipokelewe na Chuo kutoka MHL, lakini usuluhisho wa hesabu ulionyesha MHL ililipa Dola za Marekani 213,850 kupitia uhamisho wa benki kwa njia ya eletroniki na kubakisha Dola za Marekani 57,607.

    “Kuna ufuatiliaji duni kwa upande wa menejimenti ya Chuo Kikuu cha Dar es Salaam katika kukusanya deni hilo. Menejimenti ya Chuo Kikuu cha Dar es Salaam inashauriwa kuongeza nguvu katika kufuatilia na kukusanya deni wanalolidai MHL,” inasema ripoti hiyo.

    Report nzima inashauri tu, inashauri tu wakati watu wamezembea mpaka tumepigwa, ujinga huu. Tena ushauri wenyewe ni kua tuanze kufuatilia sijui mikataba, why isishauri au kuamrisha watu wafungwe kwa kusababisha Chuo "Kupigwa"??
    Sijaona popote CAG aliposhauri mtu ashitakiwe au achubguzwe, huku ni kuleana huku.

    THERE are 170 legal cases involving different government institutions pending in various courts whose settlement would cost ministries and its agencies a colossal 850bn/-, it has emerged.

    The Controller and Auditor General (CAG), Prof Mussa Assad, warns that the cost of running the civil service – from Ministries, Departments and Agencies (MDAs) down to the regional secretariats would have significant financial impacts. In his Central Government Annual General Report for FY 2015/16, the CAG says that some cases were at hearing, and others at mediation stages.

    Of the 207 audited entities, he says, 15 MDAs and regional secretariats were facing what he described as “contingent liabilities” amounting to 850,740,035,053/13 in pending court cases.

    The entities with the value of outstanding legal cases in brackets include Prime Minister’s Office (8,728,170,711/49). Others are Ministry of Agriculture, Livestock and Fisheries (5,851,314,597/); Ministry of Education, Science, Technology and Vocational Training (1,189,624,889/04) and Ministry of Lands, Housing and Human Settlements Development (67,439,500,000/-).

    Yet others are: Ministry of Energy and Minerals (660,767,521,003/-); Ministry of Natural Resources and Tourism (24,774,534,809/-); Ministry of Works, Transport and Communication (78,295,901,881/-); Ministry of Agriculture, Livestock and Fisheries (42,109,407/) and Rukwa Regional Secretariat (50m/-).

    Also in the same league are: Ministry of Works, Transport and Communication Ministry (317,824,034/- ); Tabora Regional Secretariat (114m/-); Tanga Regional Secretariat (39,582,421/60); Kagera Regional Administrative Secretariat (90m/-); Mara Regional Secretariat (13,429,300/-) and Mtwara Regional Secretariat (3,026,522,000/).

    “There is a risk of nugatory expenditure being incurred by the MDAs or RS as a result of fines or penalties which may be charged by the court in case the MDAs or RS lose these cases. In addition there are lots of expenses that are incurred by MDAs or RS in making follow up of these cases,” he said.

    He adds: “Taking into account of my prior year’s recommendations, I further recommend the government to emphasize on each entity to have appropriate risk management strategies in place to ensure that the entity’s exposure to contingent liabilities is contained and minimized at manageable level.”

    Msomi mzuri ni yule ambaye kila siku anajifunza, Tanzania kwetu ni tofauti ukishamaliza chuo GPA 3.8 above, ukishapata kazi yako na vitabu vyote unatupa, uhangaiki kutafuta knowledge kutoka vyanzo mbalimbali na utakuta ana bonge la jumba lkn kutenga chumba kama library yake ya kusomea na kuhifadhi vitabu anashindwa, sometimes sisi watanzania tunasoma ili kufaulu mtihani na si kutafuta knowledge kwa ajili ya kutatua matatizo yote yanayotuzunguka. Bado vile vile wasomi wetu wana tamaa, walafi, mafisadi na wala rushwa wakubwa, utakuta anajua kilichofanyika ktk mkataba lkn 10% inamfunga mdomo na ndio maana nikiangalia mchango wa wasomi kwa taifa letu ni mdogo sana, kwani wao ndio wanaongoza kulitia hasara taifa. Sasa najiuliza zaidi ya asilimia 95 ya malecturer wa vyuo vyote tz, wametokea UDSM, mpaka hapa utajua Tanzania tunazalisha wataalam wa aina gani.

    Tunatakiwa kutofautisha kuwa wahadhiri (wachumi, wansheria na wengineo) wa UDSM hawahusiki na mikataba ya uwekezaji isipokuwa management ya Chuo Kikuu inayoongozwa na VC. Na mkataba anaupiga mawe CAG uliingiwa wakati wa uongozi wa Prof. Matthew Luhanga, the brightest professor in Africa. Kwa hiyo inawezekana ni tatizo la vipanga kudharau masuala wanayofikiri wao kuwa kama si electrical engineering (unajua Prof. Luhanga alipata first class first degree in electrical engineering) the rest are immaterial and simple, therefore negligible. Nnakumbuka wakati alipopewa u-VC (1991) alikuwa anauliza iwapo ma-professor kutoka vitivo/idara nyingine nao walistahili kuitwa professors kwa kuwa yeye aliamini kuwa professors were only from electrical engineering department. Sasa ndio tunaweza kubaini maneno ya wahenga waliposema mdharau mwiba mguu huota tende!

    Wapi professor luhanga! Nakumbuka wakati naanza chuo hapo mwaka 2004 makamo mkuu wa chuo wakati huo injinia luhanga aliupamba sana huo mradi, kumbe ni ile mikataba ya kina chief mangungo.
