Punish Countries Blocking Free Movement of Goods

Reports that East African Community member states have not complied fully with the provisions of the region's customs union protocol are to say the least disheartening.

After a decade of emotive negotiations, one would expect the implementation of all stages of the customs union to proceed without any resistance from national institutions.

When traders complain of slow clearance because of application of different quality benchmarks, red tape and under-staffing at government departments, governments should not expect to get away with explanations that these are normal and excusable teething problems.

More so when the complaints include allegations that tariffs are still being levied on goods produced within a fully fledged custom union.

Kenya stopped charging tariffs on goods coming into her territory from the EAC partners five year ago on the understanding that the neighbours would fold their tariff walls gradually over the period, affording them ample time in which to cushion their nascent industries from being swamped with Kenyan products and being suffocated out of the market.


It, therefore, wreaks of mischief that after one partner has met its side of the bargain the other sits back ostensibly on administrative bottlenecks that for all intents and purposes appear to be effective barriers to market access.

Generally, the whole idea about economic integration in the region was to loosen border controls to promote free movement of goods, persons and factors of production.

In other words, EAC countries agreed to merge their markets to transform from a region that preferred to trade with outsiders to one that encourages its 126 million people to trade among themselves.

To some extent, EAC has been true to this dream.
Over the five years of implementing the customs union protocol, the intra regional trade has improved from five per cent in 2005 to 13 per cent by end of last year.


But this is still very low compared to EU where intra regional trade accounts for 60 per cent of total trade volumes or ASEAN countries which have elevated trade among themselves to 40 per cent of trade volumes.

This is why the EAC's Directorate of Customs and Trade must move with speed to investigate and punish countries that block free movement of goods from other member states.

To do this, however, the directorate needs some teeth which it doesn't have at the moment.

The EAC states must therefore go back to the drawing board and reconstitute the directorate with powers that allow it to play its role effectively as an independent arbiter in the intra regional tariff rows.

The department must also investigate rising claims that numerous non tariff barriers - mostly caused by failure to harmonise national laws with the community treaty (the East African Customs Management Act) have cropped up to replace the collapsed tariffs.

It is confusing for traders to operate in a region which claims to be a single territory when national standards bodies are still applying different quality benchmarks at entry points.

The loose ends must be tied immediately to foil possible disillusionment that could jeopardise public support for the integration programmes that lie ahead such as the transition into a common market protocol expected from July.

A common market can only be built on a solid customs union.

Failure to implement the customs union in full also provides grounds for mistrust among citizens of the five partner states - Kenya, Uganda, Tanzania, Rwanda and Burundi - that could poison the political climate so much that a political federation proposed for the future would become virtually impossible.

WHY DID TANZANIA SIGN THE AGREEMENT IF IT KNEW THAT IT WONT IMPLEMENT IT, WHY IS THIS COUNTRY TAKING OTHER NATIONS FOR A RIDE ON ISSUES CONCERNING THE E.A. COMMUNITY?
 
tanzania has no hurry to implement anything coz she doesnt need federeration more than its neighbours specifically kenya which is dying to have breathing space form its capitalist economy which brought hardship to majority kenyan whereas all land and big industries are owned by foreigners, so if kenya or any other eac country for that matter is unhappy with tz they can quit the federation all together, we dont need it that badly! hence saying so we are goin to take all the time in the world to implement changes with great care!
 
Then quit already, there is no need of dragging the implementation on matters discussed and agreed on, or was Tanzania forced into joining the community? I think it will be fair if Kenya rolls back the tariff walls, and imposes unnecessary bottle necks in its entry points and see who is likely to suffer. Tit for tat, but diplomacy cant allow this..SMH

Stop whining like a kid, you don't have to be a surgeon to realize that Watanzania don’t want to be part of this gimmick. There is an old saying that goes, you may drive a cow to the water but you can’t force her to drink. We told you guys, from the get go, that we are not going to comply with nonsense. Our president bamboozled you guys, signing a protocol was just another photo-op that enabled Kikwete’s administration to get loans from EU! Last, if you think that EAC can survive without Tanzania then there is something profoundly wrong with you.

Unajua at the end of the day economies of the scale determins the political fedaration. Rejea falsafa ya Karl Marx na Sub structure vis a vis superstructure. Tz tumekuwa skeptical na political federation (which a concur wth it), ila on EAC may be tumechukua wrong lead. Why?

Huwa naona it doesnt make sense kuwa na obnoxious tarrifs kwa products toka nchi majirani (although as the matter of fact product za Kenya zimejaa Kkoo kama utitiri), wakati China and otha tiger economies countries they are flooding our markets wth their junk stuffs! Achilia mbali 'wawekezaji' wa Kichina wanauza yeboyebo pale Mkunguni Street, Kkoo!
What is take, kuweka tarrifs za juu za Mkenya na sabuni zake pale Namanga au kufanya hivyo kwa products za China bandarini Dar?...too much protectionism cant push us ahead khvo.
 
majority of tanzaninas are fine without this federation simply for the following reasons
1. kenyans are immoral
2. we will open the gate for criminals from kenya the likes of mungiki etc
3. we will open robberers e.g most of tanzania's bank are robbed by bandits from kenya and to make the matter worse they come with powerful war weapons e.g AK 47's, boobtraps etc
4. we will open the scrambe for our lovely land
5. because in kenya getting a job is a nightmare they will steal our jobs with half of salaries of what we are getting coz they will accept no matter how low it will be.
6. floods our market with their low quality products, we all know they havent reach the stage of producing quality product, we have enough from china but the diff is at least china can rub off our debt ect

With all due respect I beg to differ with your assertions. Watanzania are not scared of Kenyans, Ugandans or Rwandese, but rather skeptical of EAC. They have been through this road before and, as a result, suffered the consequences; do you remember what happened in 1977?

In any democratic society, one has to respect a decision made by the majority. From the beginning Wananchi have said loud and clear that they don't want Tanzania to be part of this gimmick called EAC. These people are not cowards, as many in here would prefer to portray them, but rather astute citizens who are cautious and concerned about the future of their country.

Our leaders are making the same kind of mistakes they did in 1977 by ramming this federation down our throat without our consent! This is similar to building a structure in a porous soil, and that is why I believe that this federation will not stand the taste of time.
 
So called majority(sijui nani kawadanganya),FED is here na hamna kitu mtafanya na sio lazima mkubali..mtawekwa line tuu hata kwa viboko,peasants wengi sana wasiojua kitu kwa hiyo hatuhitaji vote kuamua hili,na pls spare us na ancient arguments za 1977,tumechoka na artificial borderlines za kikoloni...fungua border zote!!!

..Take an example of Lake Victoria: Uganda controls 45% of lake Victoria, Tanzania has 49%, and Kenya has the remaining 6%. Under such circumstances Kenya has to come up with very convincing reasons as to why there should be no borders in Lake Victoria.

It will be totally wastage of time to debate with you about EAC, it seems you are closed minded, and worst of all, naive. Let me tell you this, simply because a person is peasant doesn't mean he/she shouldn't participate in a political process.

The article below is the reason why I am against this federation; these people (members of parliament) want to enrich themselves on the expense of East African impoverished Citizens. At the end of the day, it's the regular citizens, you and I, who are going to suffer while these goons will be laughing all the way to the bank.

Make no mistakes, federation is not there to build economy power house that many people have envisioned, but to create lucrative jobs for few elites! This is the question that ought to be asked: if these people can't respect the constitution they created, few years ago, how can they then guide us to green pastures ?

Rufiji usihangaike bure!. Hujajua tu kuwa kuna watu aina ya 'Koba' wanaopiga kelele za kufungua mipaka ili wawe huru zaidi? Kuna watu wanataka kutumia mwanya huu kuwa huru zaidi. Yaani kuna watanzania ambao asili yao ni nchi jirani na tukifungua mipaka itawasaidia sana...Au hujui kuwa kuna warundi, waganda, wanyarwanda n.k ambao ni watanzania lakini fikra zao ziko kwenye nchi za asili zao? Kuna baadhi ya wanyarwanda walizikimbia kazi zao Tanzania baada ya kuwepo serikali mpya Rwanda....Kama wakenya walivyokwapua mali za iliyokuwa East African Community baada ya kuvunjika mwaka 1977!!!
