President Kibaki successfully lobbied for Ocampo 4 to face trial in Arusha

His new frontier is a diplomatic campaign to have the accused — Deputy Prime Minister Uhuru Kenyatta, former head of Public Service Francis Muthaura, Eldoret North MP William Ruto and radio journalist Joshua Sang — tried by the Arusha-based East Africa Court of Justice.


President Kibaki on Saturday successfully lobbied his peers during an Extraordinary Summit of Heads of State of East African Community in Tanzania which he chaired, to pass a resolution to extend the jurisdiction of the court to cover crimes against humanity.


A dispatch by his press team said the summit welcomed the resolution to extend jurisdiction of the court and “directed the Council of Ministers to consider the matter by the end of May 2012 and report to an extraordinary summit to be convened immediately thereafter”.


The effort comes barely three days after members of the East African Legislative Assembly sitting in Nairobi passed a resolution to have the cases pulled out of The Hague and transferred to the Arusha-based court, though it has no jurisdiction over criminal matters. The regional MPs expressed confidence that their resolution, plus a push to amend the clause in the East Africa Community Treaty forming the regional court, to allow it handle criminal matters, will be ratified in Saturday’s meeting at Ngurdoto in Arusha.

Another very dumb move by President Kibaki in trying to save Uhuru Kenyatta and his old friend Muthaura.

Huyu mtu anaharibu hela ya walipa kodi na ishu ambayo kwamba tayari imeshashindikana.

P.S....hio title kwa kutumia neno "successfully lobbied" inaleta dhana potofu....kwa makusudi fulani.

...Wala hawana haja ya kuwahonga majaji, hakuna namna ya kuwatia Ocampo 4 hatiani kwa kesi weak kwa kiwango hiki, ni vile tu threshold ya ku-confirm case ipo chini sana,lakini kumtia mtu hatiani kwa ushahidi wa kuungaunga vile, no way...
 
Kama AU hawakufanikiwa what makes Kabaki think that nchi 5 tu zinaweza kubadilisha?

Then why all the circus? Let them face Ocampo and prove their innocence as they have nothing to fear.

A kenyan who killed/perpetuated killings of Kenyans should be tried by Kenyans.
Don't you guys have judiciary? If you do, then why the hell can't you use your own judicial system?
Someone plz explain this stupidity to me.

It is not stupidity but your reasoning that is flawed.

..Hata usianze na Kenya, anza na hapo Bongo kuuelewa who gives people those high ranking
jobs in the Judiciary...from the Chief Justice, to the Attorney General and the Judges....Its the Executive!

That right there sets a dangerous precedent about how cases will be adjudged.

...Please familiarize yourself with the workings of the ICC and how cases get there.

Mahakama za Tanzania zimetoa haki kwa wananchi tangu zilipoanzishwa. I personally know a lot of killers that received capital punishment for example. Sasa hiyo siyo justice? On the other hand, kama wananchi wanajua kuwa mahakama zao hazitoi haki, what's the solution? Running to the ICC?
I can understand somalia, Darfur,Liberia.Ila Kenya ina functioning government na ina mahakama zake kwanini hawa try hao kina Uhuru? Just trying and see what kind of judgement they will receive. They didn't even try.
Kuhusu mimi kufamiliarize with ICC, I'm familiar with na naiona haina maana yeyote.
Anywhere in this world, the judiciary is appointed by the Executive. May be you are the one who needs to familiarize yourself with these things.

Must they face a mzungu to prove their innocence?Since when did the burden of proof shift to the accussed....Ocampo's style of justice or this time the procedures have been bent to teach Africans a lesson?
