Police have cancelled with immediate effect all political rallies and processions until further notice.

Inspector General David Kimaiyo said Tuesday the ban is in line with the Public Order Act, chapter 56 Laws of Kenya.

"Criminals may take advantage of such gatherings," he says.

Inspector General of Police David Kimaiyo: Police have banned all political rallies until further notice.

Police have cancelled with immediate effect all political rallies and processions until further notice.

Inspector General David Kimaiyo said Tuesday the ban is in line with the Public Order Act, chapter 56 Laws of Kenya.

Announcing through his twitter account Mr Kimaiyo said: "I have cancelled all political parties rallies until further notice due to security reasons."

"Criminals may take advantage of such gatherings," he says.

The Public Order Act regulates public gatherings and states in the first subsection that ‘No person shall hold a public meeting or a public procession except in accordance with the provisions of this section.'

The IG's directives come in the wake of Cord's rallies in the city that have been preparing their supporters to welcome their coalition leader Raila Odinga on Saturday.
The former Prime Minister was scheduled to address a rally at the KICC grounds on arrival.

On his part, the former Vice-President Kalonzo Musyoka was set to address a political rally in Mathare on Wednesday to drum up support for the opposition candidate in the coming by-election.

'RALLIES WILL GO ON'

Cord has said the scheduled rallies will go on as planned, terming the ban as a cowardly act by the government.

Addressing a press conference outside the IG's office in Nairobi soon after Mr Kimaiyo's order, Siaya Senator James Orengo said the ban was an attempt by government to introduce dictatorship similar to what happened in the 1990s.

Former Deputy Speaker of Parliament Farah Maalim said they would hold a rally at Uhuru Park on Saturday, since they had been told that the planned Kenyatta International Conference Centre (KICC) venue had already been booked.

The press briefing was also attended by Bungoma Senator Moses Wetang'ula.

Mr Wetangula said by banning political rallies due to terror threats , the Inspector General of Police “is telling Kenyans and the world that the terrorists are winning”.



He described the ban as a “cowardly act” saying the rally now scheduled to be held at Uhuru Park will go on preceded by another one at Dagoretti North on Friday.

The National Security Advisory Committee, chaired by Head of Public Service Joseph Kinyua, met at Harambee House yesterday morning and after evaluating the security situation advised cancellation of the rallies.

Kimaiyo: Hold rallies far from Madaraka venues

Inspector-General of Police David Kimaiyo disowned his earlier statement in which he banned all political rallies.




In a telephone conversation with the Nation, Mr Kimaiyo cited security concerns and refined his earlier directive by asking that political rallies be hosted away from venues of Madaraka Day celebrations.




“We can allow them to hold rallies outside these areas we are planning these functions. We are just saying that rallies can continue as long as they don’t interfere with preparations of 1[SUP]st[/SUP] (of June), that is the Madaraka Day. You cannot go and hold a rally next to where celebrations are being held” he said.

With all due respect, I think this country has one of the most incompetent police chief ever. How do you wake up one day and decide to prohibit all rallies and blaming it on insecurity. The police are supposed to provide that security in the first place. When the Somalia boys will hear this, they will be very happy knowing they have been able to scare the hell out of the country until we are afraid to attend rallies and meeting. I smell political plays in this saga!

Just like the tinted windows ban, this is not solving the insecurity issue by any extension.

The police are supposed to provide that security in the first place. Sometimes you need to accept the truth.
Kenyan security have been defeated by Al shabaab. trying to cover up by pretending the situation is clear won't help.

Mkuu this was all political, uliona leo police walipogundua Uhuru is going to Ruto home to calm some fears due to some appointments, wakaondoa ban immediately. The question is, within 24 hours, what changed? Soon Kenya will go back to Moi era where everything was directed from state house(A dictatorial president somehow!)

Article 1 of the Kenyan Constitution is very clear on the sovereignity of this country. It states:

(1) All sovereign power belongs to the people of Kenya and shall be exercised only in accordance with this Constitution.

Article 37 of the Constitution is also very crystal clear as it states "Every person has the right, peaceably and unarmed, to assemble, to demonstrate, to picket, and to present petitions to public authorities."

These rights are not for the privileges few and should be enjoyed by EVERY KENYAN. A few months ago President Uhuru reminded Kenyans that "the pursuit of happiness is not a preserve of the few in this country"...I want to tell him that the rights inscribed in our constitution isn't a preserve of the Jubilee supporters/sycophants.
