A parliamentary report prepared five years ago sensationally claims former Foreign Affairs Minister Robert Ouko was killed at State House, Nakuru.

The report, prepared by a team of MPs led by former Kisumu Town East’s Gor Sunguh, says Dr Ouko was assassinated after he fell out with a powerful minister in the regime of retired President Moi during a tour of the United States.

The report was tabled in Parliament on Wednesday. It proposes that key personalities in retired President Moi’s government, who were involved in the disappearance and killing of Dr Ouko, be investigated.

The committee zeroes in on four individuals including Mr Nicholas Biwott, a former minister, for their role in the murder.

The report claims that Dr Ouko had already been sacked and his security detail withdrawn a week before he disappeared.

Dr Ouko is said to have fallen out with Mr Biwott, a powerful ally of Mr Moi, while on a tour of Washington with the former president.

The two were involved in a confrontation on the visit after Mr Biwott sarcastically referred to Dr Ouko as “Mr President”.

The report says that the committee received evidence to the effect that Mr Biwott and former Nyanza PC Julius Kobia were present as Dr Ouko was abducted by police and intelligence agents.

It further alleges that he was bundled into Mr Kobia’s car and driven to State House, Nakuru, where he was killed in the presence of Mr Biwott among others. His body was then dumped near his Koru home.

A herdsboy identified as Mr Shikuku discovered the body at the foot of Got Alila, on February 13 and the matter reported to the Provincial Administration.

However, the report says the government announced the “discovery” on February 16 — three days later — “allowing for the burning of the body and interference with the scene”.

The report says that the trip to Washington worsened relations between Dr Ouko and the former president and his attempts to see the latter over the issue were futile.

Dr Ouko finally secured an appointment with Mr Moi at State House in Nairobi on February 5, eight days before his disappearance.

“Dr Ouko visited State House and met the former president who gave him off-duty and directed him to rest at his Koru farm; apparently Dr Ouko had already been sacked,” says the report.

The report adds that Dr Ouko’s official car was withdrawn and returned to the ministry and his bodyguards were also recalled.

His passport had been withheld at the airport after the Washington trip, the report claims.

The Parliamentary Committee recommended that the government investigates the incidents and people at the ministry at the time, naming former PS Bethuel Kiplagat and a Mr Malacki Oddenyo.

The report claims Mr Biwott was among people who should be investigated over their role in Dr Ouko’s death.

Others are Hezekiah Oyugi who was Internal Security PS and has since died, Mr Kobia (also dead) and former Nakuru DC Jonah Anguka.

The report claims that the Got Alila scene of crime was tampered with and items brought there to simulate suicide.

One of Kenya's most high-profile murders - of Foreign Minister Robert Ouko - was carried out in one of then President Daniel arap Moi's official residences, MPs have been told.

Three previous inquiries into the 1990 killing have ended prematurely and this one was presented to parliament five years after it was written.

It calls for further investigations into top officials, including one of Mr Moi's closest allies, Nicholas Biwott.

Mr Biwott has denied responsibility.

Several key witnesses have since died in mysterious circumstances and the report calls for their deaths to be investigated.

Mr Ouko was well respected internationally but fell out with Mr Biwott and other key officials.

Rush of reports
The authorities initially said he had gone missing, before saying his body had been found by an animal herder near his home shortly after he returned from a trip to the US.

But the report by the parliamentary select committee says Mr Ouko was bundled into a government car and driven to State House lodge in Nakuru, where he was killed.

It said his bodyguards had earlier been withdrawn and that the delay in announcing that the body had been found was to allow time for the body to be transported to Mr Ouko's home and then burnt.

"The perceived foreign support of Dr Ouko to ascend to the presidency to weed out corruption and human rights abuses was perceived by the leadership as a threat to the presidency and that this could be linked to his death," says the report, according to the East African Standard newspaper.

Mr Moi has not made commented on the report.

Some of those involved in previous investigations have complained of official interference in their work.

The BBC's David Ogot in Nairobi says several parliamentary reports into previous alleged injustices have been finally made public recently.

He says the reason for the sudden rush is not clear.

"The culture of impunity is slowly being assaulted," Gor Sunguh, who chaired the committee told the BBC.

He said he was confident that the report would be adopted by parliament, meaning the call for investigations would be acted upon.

The clamour by Western countries to have a say in the country's leadership could have led to the murder of former Foreign Affairs minister Robert Ouko, a parliamentary report indicates.

The findings by a House select committee that inquired into the death of Dr Ouko shows it received evidence that showed that the United States had urged then President Daniel arap Moi to let his Foreign Affairs minister steer the country out of corruption.

Similarly, the report states that the United Kingdom had, in 1988, urged Mr Moi to ensure that the late Ouko was re-elected with a view to succeeding him when he gets out of power.

The select committee was of the opinion that Mr Moi and his inner circle must have been led to believe that his then Foreign Affairs minister was seeking external support to become the President of Kenya.

"The committee is of the considered view that misconstrued perception by the Kenya leadership, that Dr R J Ouko was seeking foreign support to accede to the presidency would be sufficiently supported as a motive to cause his death," the report stated.

The report, which was released five years after the committee chaired by former Kisumu Town East MP Gor Sungu sat, indicated that the evidence was given by Superintendent John Troon of the Scotland Yard, Mr Barrack Mbajah, a brother to Dr Ouko and Mr James Onyango K'Oyoo.

Dr Ouko was killed in February 1990 and his charred remains were found in Got Alila on February 16, 1990 in circumstances that pointed a finger to those in government at the time.

The three witnesses told the committee that during a meeting in Washington DC in late January 1990, then US President George Bush (Snr) urged Mr Moi to vacate State House and allow Dr Ouko to take over and fight corruption that had reached untold limits at the time.

"The committee, recommends that the government investigates the above (evidence) with a view to ascertaining their being the circumstances leading to the death of Dr R J Ouko," states the report.
