Today Robert Amsterdam has issued the following open letter to Winston Charles, the Director of the National Electoral Commission (NEC) of Tanzania, on behalf of his client the presidential candidate Tundu Lissu.
The letter states: “We write to express our growing concern about the National Electoral Commission’s (“NEC”) systematic disqualification of opposition candidates, particularly members of the CHADEMA party, in the October 2020 general elections. We are deeply troubled by the National Electoral Commission’s disqualification of these candidates in breach of the National Elections Act and international human rights law.”
Amsterdam’s letter continues: “It has come to our attention that 1,020 CHADEMA candidates for chancellorships were disqualified by the National Electoral Commission out of 3,574 CHADEMA potential candidates. This represents an appalling disqualification rate of 28.5%. So too, the Commission has disqualified 53 CHADEMA candidates for Parliament out of 244 nominees, a 21.7% disqualification rate.
These troubling disqualifications are not just limited to CHADEMA candidates and include other opposition parties as well. We note that 47 ACT-Wazalendo candidates were also disqualified. In contrast, the vast majority of governing party Chama Cha Mapinduzi (“CCM”) candidates were approved. The shocking disparity of treatment in the approval of CCM and opposition candidates is blatant and deeply problematic.”

Unataka kusema kuwa iwapo ulikuwa na mapato ya Sh1000 lakini ukajaza fomu yako ya kodi kuwa ulikuwa na mapato ya $100 utajitetea kuwa hilo ni kosa dogo TRA wasikuchukulie hatua ya unadanganyifu? Kumbuka kuwa fomu za serikali zinafungwa na declaration under the penalty of perjury kuwa ulichoandika ni sahihi; sasa kikiwa na makosa utachukuliwa kuwa umedanganya. Sheria ina outcomes mbili tu; kutekelezwa na kutokutekelezwa, hamna intermediate result. Ukishahsindwa kutekeleza sheria, basi subiri hukumu.

We all know that the electoral commission is not independent and we all know too that Mr. Magufuli is breathing down the cheek of the commission's chairman.First and foremost, the letter is the work of Lissu who uses Amsterdam as a "frontrunner"! I am wondering why Lissu is doing this, as he has all the rights and ability to write straight to NEC. Further, all disqualified candidates have the right to appeal to NEC and to other appeal organs as stipulated in our different laws and regulations and that is what they have done. Lissu is doing this as a means of trying to "force" NEC and other Appeal bodies to favor their disqualified candidates. Whichever way, the laws pertaining to this exercise will be followed to the letter and justice will be done without caring what Amsterdam or Lissu writes. We are a free and law adhering State.
