NTC: Sharia to be source of legislation

Head of Libya's National Transitional Council (NTC) has called on the Libyan nation to build a democratic state, in which Sharia will be main source of legislation.

Addressing a cheering crowd of thousands in the center of the capital, Tripoli on Monday, Mustafa Abdul Jalil urged the revolutionary forces to avoid any reprisal attacks on the remnants of fugitive ruler Muammar Gaddafi, Reuters reported on Tuesday.

"We need to open the courts to anyone who harmed the Libyan people in any way. The judicial system will decide," he told the crowd, adding that the Islamic Sharia law would be the basis of legislation under the new government.

Nadhani kwa hilo NATO wataelewa sasa rebels ni kina nani na watawasaidia kujenga a democratic state (unlike Ghadafi's) under sharia laws. Hongereni sana. Nilisema haya yatatokea sasa wa Libya ndo wamejiamulia aina ya Serikali wanayoitaka. Si mmesema rebels ndo wa Libya wenye uchungu na nchi yao? USA and UK - you are yet to see things. Kiranga kitatoka Libya kitakuja majumbani mwenu. Wa Libya watawalaumu milele. Shame on you-all rats and snakes!

Under the Great Socialist People's Libyan Arab Jamahiriya, Libya has moved towards a legal system based on sharia, but with various deviations from it.

Yaani hili manaliona kwa wenzenu? wahenga walisema ukiona mwenzio ananyolewa tia maji, sasa hapa kwetu juzi tu umesikia mbunge anasema waisilamu wa bara wanaonewa hawaruhusiwi kuona bint wa miaka 13, sasa na hawa wakijitenga(kuvunja muungano) kama wanavyotaka si utasikia wanataka sharia, after all serikali yao ni ya Kiisilamu.

sidhani kwamba ghadafi alikuwa anatumia sharia.... coz alikuwa anaweka walinzi mabody gurd wa kike... wenzetu hawa mtoto wa kike hawezi akawa mlinzi ... yangu macho...

lakini kama walibya wameamua inabidi NATO waje kuheshimu maamuzi yao
 
Sharia Law = kukata mikono, kupiga mawe? Poleni sana wana-Libya!

wakifanya makosa sheria lazima ichukuwe mkondo wake... watoa pole .....Kwani sheria zingine hakuna kunyongana... ???! wawapi weye ??! mara ngapi kibaka anachomwa moto..?
 
Libya's legal and governmental structure is based on two constitutional documents: the Constitutional Proclamation of December 1969 and the Declaration of the Establishment of the People's Authority, enacted in March 1977. The Declaration embodies many of the ideas expressed in Col. Qadhafi's political tract, the Green Book. According to the civil code, the hierarchy of legal sources is, in descending order: legislation, principles of Islamic law, custom and principles of natural law and equity.

Reflecting its diverse heritage, the Libyan legal system is influenced by Islamic law as well as civil legal regimes in Italy and France. Under Ottoman rule, one court system addressed secular matters while another was responsible for deciding disputes involving religious law. The secular courts were organized according to the Napoleonic Code. Islamic judges applied shari'a law in the religious courts. There is no provision for judicial review in Libya's constitutional arrangement.
