First off, what does the KE Constituion say about such appointments?...they are illegal and against the doctrine which clearly points out that politicians cannot be appointed to such posts. The son of Jomo violated this when he appointed Balala and Ngilu to Cabinet positions. With reackless abandon he continues to trample on this precious document while being applauded by the Jubilee retrogrades. The Jubilee doctrine was, cabinet secretaries are to be sourced out to 'civilians', Ngilu and Balala having been expedient and unavoidable rewards, also to buttress Kamba and perceived coastal support. The nomination of Nkaissery is therefore readable as full of mischief. Questions to be asked....

1. Did he consult with the ODM fraternity, or is this a roadside broadside. A blatant attempt to weakening by poaching an opposition stalwart and use him, simultaneously, to buy goodwill for Jubilee in his grassroots area (where the fallen Lenku hails)? A bandage of a stone that kills two birds at a go?

2. William Ruto has made it repeatedly clear there is no room for a coalition government. When Raila talked of dialogue, Jubilee kingpins laughed, saying Agwambo was angling for cabinet posts, which would under no circumstances be availed. So are the government guys eating their words today?

3. This can also be read as an opening gambit for the rejected dialogue with CORD! In which case Kenyatta would be wisening up, to the fact that the Jubilee social base, regardless of all hype of the tyranny of numbers, is too narrow to face the security situation as it now unfolds. Security is an important docket, surrendering it to the opposition is brave --even desperate, but clearly, a statement of yes, a coalition government is negotiable.

NB: It is a dangerous admission of inaptitude and failure for the commander in chief to look for a General, retired or not, from the much-dismissed opposition benches, to hold the national fort against marauders from across and abroad.
It means within the government side, only minions and incompetent buffoons are on the cards.

4. The terrorism is Shabaab by all intelligence available. Shababus are the army's cup of tea. It is the KDF stirring the hornet's nest across, and failing to deal with the dispersed wasps. It aint a Kenyan Police primary responsibility. So Kimaiyo is an easy pick to sacrifice; the real incompetent man is of course the leader of KDF, the
General Karangi. --His army is in Somali pacifying terrorists, well, he has left the belly of kenya wide open for terrorist massacres!...while at the same time benefiting from the illicit trade in charcoal as pointed out in an earlier report.

You all saw Karangi in action at Westgate, you think he is any better in Somalia proper? The problem is that he is too powerful to sack! And the son of Jomo better beware the limits of prince's power, even if a make-believe president.

I hear you but at the same time, that is what we are trying to get away from. We are championing for the rule of law and respect for established institutions of governance. I long for the day when countries in Africa will start gravitating to such. Giving jobs to pals who can't deliver is what has put Kenyans in the situation we are in right now. Kenyans are getting killed allover the place and no one is held accountable. Infact our clumsy president came and told us that security begins with us...so guess what, yesterday in parts of Ukambani guys wanted to kill some innocent Somalis bouyed by what the President said and their anger.

God forbid!

If the President choses to nominate an elected leader as a Cabinet Secretary, he or she will be required to resign from the post.

Any Kenyan can serve as a CS as long he/she has what it takes, this is not a coalition government, the duo did good job by picking Kenyans without political considerations. Just an FYI, no one is bitter...may be you are, because you can't just believe what is happening after all the fake promises from this duo. The country is under attack both from the outside and inside. Al-Shabaab is killing Kenyans all over the place while local thugs are having a field day on the citizenry...and what is the tribal security outfit doing?..Not a damn thing!

I understand the statement you are making but the fact still remains, Uhuru Kenyatta is playing politics with the life of innocent Kenyans. Nothing will change with the current situation unless the President himself wills it...even if Nkaissery comes will an immaculate CV, we all know that all power rests with the Presidency and his side kick...General Karangi!! Corruption abounds and the police apparatus have no choice but to fall for bribes mainly because they are paid poorly and their bosses are a bunch of semi-illiterate people who are knee deep in corruption.

The whole security outfit needs to be overhauled for any meaningful change to be seen. These bandaid solutions to deep cuts will not suffice. Imagine the militia in Mandera used to raid these camps on a daily basis and nothing was done....until the day they came and killed 36 innocent souls did we see a sleeping government react. Or was it because a huge number of the deceased came from the presidents backyard? Did I mention they weer airlifted to Nairobi?...while the cops who were brutally murdered in Kapedo were transported by road? That speaks volumes about this government.

Then Wiliam Ruto comes along muttering hogwash to the effect that the people in the quarry had been warned to leave the place pending attacks. What rubbish is this? Isn't the statement self incriminating?...That the government knew of the attacks, warned the people to leave and they didnt...why didnt the government buffer up security and arrest the would be attackers? Stuff like this is what makes the spin doctors say that the government is orchesterating these attacks so they use it as defence at the Hague...that the country is burning!

URP is said to be unhappy with the nomination of ODM's Kajiado Central MP Joseph Nkaissery as Interior Cabinet Secretary. Corridors has it that a number of URP heavyweights from the Rift Valley are demanding explanations from Deputy President William Ruto as to why he accepted Nkaissery's nomination at the expense of his URP Party. They are now questioning Nkaissery's loyalty and allegiance to the government given his opposition links, and have now warned Ruto to tread carefully.

The TJRC Report which Uhuru Kenyatta trashed, says this about Nkaissery...

On page 131 of the fourth volume of its final report, he is named, alongside one Peter Langat (then a District Commissioner), as having allegedly engineered human rights violations in the present-day West Pokot county.

"From 22nd February to 22nd May (1984), he spearheaded Operation Nyundo where many people lost their lives and over 20,000 animals starved to death. Operation was also punctuated with rape and beating of the locals. The disarmament exercise resulted in deaths of civilians in what has come to be known as Lotiriri Massacre," the report says.

For Rev. Simon Alew – who appeared before the TJRC - the Pokot community's two experiences in the hands of security agencies, these days known as the Kacheliba Massacre and the Lotiriri Military Operation of 1984, are never to be forgotten.
"The operation of 1982/1984 was the major one, where the Government of Kenya led by former President Moi declared that the Pokot community should be disarmed. The disarmament turned into kind of a communal punishment. I am calling it a communal punishment because everybody, even if you were a peacemaker, a bishop or a professor; you were treated equally. So, if it was beating, you were all beaten. There were some people who were beaten and tortured. Over 25,000 herds of cattle were taken to Kacheliba Police Station. Over 10,000 cattle died in the same police station and the remaining 15,000 were just transported to unknown places," he narrated in Kapenguria.

The government, he recalls, gave a back-handed compliment to those suing for peace.

"When the Government went round to collect firearms, they announced that: ‘If you surrender your gun, you will be given a certificate of confirmation.' People were informed that when the helicopter comes, you should raise that certificate so that they will know that you are a peaceful person and some people did the same. Mzee Atoligole Losute became the first person to surrender his gun, but when he tried to raise the certificate, the helicopter dropped down and then he was told: Because you are a good person, we will take you round to be an example to other people. So, when that Mzee was flown off by the helicopter, his wives saw him go inside the helicopter and after going round, he was seen hooked or tied on his neck to the helicopter and then he was flown off and went round the helicopter and after about 30 minutes, that old man died. He was thrown away at the border of Kenya and Uganda. Another person who was treated the same way was Mzee Achelo. When he raised his certificate to show that he was a peaceful person, he was sprayed with bullets by the helicopter and three others died at a place called Karamel in Nikunyau Division, which was a location then," he recounted.

The report notes that summons for him to appear before it notwithstanding, "Major (Rtd) Nkaissery failed to appear before the Commission for hearings on 23rd February 2013 and again on 8th April, 2013."

In its findings and recommendations, the TJRC observed that the Director of Public Prosecution needed to prosecute Nkaissery.

In the year following the release of the TJRC's report, fewer public figures have been more visible in pressing either for its revision or delay in implementation than the good general, often aided by Majority Leader Aden Dualle.

The received wisdom in some quarters is that the bar has already been set low by the ascension of both President Uhuru Kenyatta and his deputy, William Ruto, to the nation's leadership, their "personal challenges" at the International Criminal Court (ICC) notwithstanding; performance over human rights, some even say.

Victims of State-sponsored terror, however, will look forward to Nkaiserry's tenure with more than passing interest.
 
Is Nkaissery unfit for the role or did the president err in nominating him? If he is unfit for office isnt that an insult to the people who elected him and to the ODM party that fronted him? I think people are very good at criticizing without offering viable solutions, why go to the streets and demonstrate that the president is doing nothing and when something is done change tact and criticize the choice? What can be done to appease the increasingly critical mass?

Bottomline, if the president violated any part of the constitution there is parliament and judiciary to keep him in check. If somebody wanted to be nominated instead, why not explicitly say so? Nobody is going to be universally accepted, Michuki did a wonderful job and rid the society off the scum that mungiki was but how many innocent Kenyans were killed as a result?

Cord leader Raila Odinga yeterday accused President Uhuru Kenyatta of trying to weaken the opposition's numerical strength in Parliament by nominating Kajiado Central MP Joseph Nkaissery to be Interior CS.
Raila faulted the President for failing to consult the opposition before "poaching our member".

He was speaking during the ODM National Governing Council meeting at the Bomas of Kenya, called to approve new party officials. The new leadership was approved, ending months of internal struggle that weakened the party and ODM.

"Nkaissery is not an angel but an MP. You cannot poach our member elected on an ODM ticket without consulting the leadership of the party," Raila said.

He said poaching an ODM member to head such a critical ministry at a critical time of insecurity shows that Jubilee has run out of ideas.

'We will not deny you the expertise that you need if you asked properly. But it is not fair to reduce our numerical strength through the back door," the Cord leader said

President Uhuru on Monday named Nkaissery, a retired major general, the new CS for Interior and Coordination of the National Government.

Nkaissery was elected on an ODM ticket and will have to resign his position once Parliament approves his nomination to take over from Joseph Ole Lenku, whose future remains unclear.

Raila asked Jubilee not to field any candidate in Kajiado Central constituency to guarantee ODM keeps the seat.

"As ODM, we don't want to be subjected to an unnecessary by-election in Kajiado Central. If we are, then we want to go unopposed to recapture our seat," the former prime minister said.

Parliament has asked Kenyans to present their memorandums about the Interior CS nominee by Wednesday, before he appears fon Thursday for vetting before the Parliamentary Committee on National Security.
At the Bomas meeting yesterday, Raila was victorious after the NGC approved new party officials.

Delegates unanimously approved Budalangi MP Ababu Namwamba as the new secretary general, with Elizabeth Ongoro and Agnes Zani as his two deputies. Suba MP John Mbadi (Chairman) and governors Hassan Joho (Mombasa) and Wyckliffe Oparanya (Kakamega) were also endorsed as Raila's two deputies .

The meeting also created the Director of Elections position under Suna East MP Junet Mohammed, in an effort to address nomination challenges that have often overshadowed party primaries.

"The new officials and changes will help strengthen and revitalize the ODM party as the country's largest movement ahead of 2017," said Embakasi East MP John Omondi.

Delegates included senators, governors, MPs and 47 party county chairpersons.

A reenergised Raila asked party members to forget the ghosts of the February 28, when goons disrupted party elections at Kasarani. The young generation was poised to take over, posing a threat to the old guard.

"Every party has its low moment. And February was our low moment when journalists started to write the obituary of ODM. Let us forget that day forever," Raila said.

"Today I feel delighted with the new 'collabo' that has brought us here. It is our new face of the fresh ODM. It shows democracy and that no one is indispensable in our party."

Ababu described the new line-up as a "team that will send shivers down the spines of the jubilee' administration," as it new leaders set their sights on delivering the Presidency to ODM in 2017.

"The battle we go into is no mean battle. The opponents have perfected the art of stealing from the public but we shall approach them not with fear but courage," Namwamba said acceptance speech, laden with Biblical allusions. At the same time, he extended an olive branch to those who in the old guard had objected to the new list. He called for joining hands and working together.

Most of the new officials stressed the need to clean up nominations and strengthen support at the grassroots to ensure their party forms the next government.

Kajiado Central MP Joseph Nkaissery faces a major hurdle in his nomination to replace Joseph Ole Lenku at the Interior Ministry - he was accused of gross human rights violations by the Truth, Justice and Reconciliation Commission in connection with a 1984 military operation in West Pokot county.

Nkaissery denies the charges, saying he was carrying out an authorised disarmament operation in a lawless region, an operation authorised by the National Security Council headed by then President Moi.

The MP will face the House Committee on Appointments next Thursday, following his nomination by President Uhuru to take over following the sacking of Joseph ole Lenku for widespread security failures and recent terrorist attacks.

The committee, chaired by Assembly Speaker Justin Muturi, will vet Nkaissery and report to the House by December 16.

The report on the disarmament operation by the TJRC casts a shadow on the nomination.

It recommended that Nkaissery be investigated and possibly prosecuted over his role in Operation Nyundo.

Nkaissery, then an army major, is among the senior military officers the TJRC accused of gross violations of human rights, including torture, sexual violence and murders.

He also is accused of having sold Nkaissery thousands of cattle and transported them in army vehicles to Kitale, Eldoret, Nakuru, and Nairobi.
Soldiers are accused of confiscating animals, which they either shot dead, ate or sold.

"The result was that many were killed and others maimed," says the report.

"In some cases, security agents starved animals, numbering approximately 30,000 cattle, that had been confiscated, as a way of compelling their owners into surrendering guns." notes that these actions were overseen by the then area DC, a Lang'at who also fired from their jobs chief and assistant chiefs, whom he accused of conspiring with the raiders and being beneficiaries of the raids.

The operation ordered by President Moi between 1982 and 1984 was a major undertaking to disarm the Pokot community.

The report says more than 50 security operations have been conducted in the region but none were as devastating as the one in Lotirir, which resulted in a massacre.

The government had launched the crackdown to disarm Pokots and restore law and order in the region.

Helicopters were used for about six months to locate cattle rustlers and stolen cattle and to search for arms caches.

"It is from the sound of the helicopters, lotiriri, that the massacre that followed got its name. During this massacre, many people are said to have been brutally killed and many injured by the state security agents carrying out the operation," the report states.

Nkaissery has defended himself ,saying he couldn't be accused of committing a crime while leading an operation ordered by the National Security Council chaired by then President Moi. He has also disputed that there were killings.

"TJRC should have started with other top army chiefs and provincial administrators who coordinated the operation," he said.

Nkaissery has said he was ready to be investigated, but he also threatened to sue the TJRC for adversely mentioning him without giving him an opportunity to defend himself.

"I am consulting my lawyers to determine the next cause of action," he said.

You can go cry in the mountains with your gimmicks, but what we need is a fighter. We don't care wherever he will come from, even from your region as long as he is a Kenyan.

You're right but don't forget they wouldn't have approved, they are capitalizing on the current chaos and any meaningful plans to stabilize the country is bitter pills for them.

You dont give a damn about a report that was sanctioned by the government using tons of tax payers hard earned money and it should just go to waste?....typical brazen mind you have there mate. The government you support is wanton on this carelessness and wastage and the likes of you propagate the same. Where is Kenya headed to, if the elite minds like yours think like so?
