Hatimaye ushirika wa Vyama vya Upinzani nchini leo umetinga rasmi katika Mahakama Kuu ya Tanzania kuishitaki Tume ya Taifa ya Uchaguzi (NEC).

Ujumbe wa kwanza unaowakilisha vyama hivyo, ulitinga kwenye Mahakama Kuu leo asubuhi majira ya saa 10:30 ukiwa na wajumbe wawili kutoka vyama vya CUF na Chadema.

Wajumbe hao ni Bw. Wilfred Lwakatare (CUF) na Singo Benson ambaye ni Mkurugenzi wa Mafunzo na Organization wa chama cha Chadema.

Wakiongea na gazeti hili nje ya Mahakama Kuu, wawakilishi hao wamesema wenzao kutoka vyama vya NCCR-Mageuzi na TLP wangeungana nao muda si mrefu.

Wamesema katika kesi hiyo watawakilishwa na wakili maarufu, waliyemtaja kwa jina la Mpare Mpoki.

Katika malalamiko yao, wanataka mahakama itangaze kusitisha uchaguzi mdogo wa madiwani uliopangwa kufanyika Oktoba 28, mwaka huu.

Hatua yao hiyo wanasema inafuatia NEC kusisitiza kuendelea na uchaguzi huo kwa maelezo kuwa wanafuata taratibu na sheria zilizopangwa.

Uchaguzi huo mdogo unaofanyika katika kata 16 za mikoa kumi ya Tanzania Bara, lengo lake ni kujaza nafasi za madiwani waliofariki dunia, kuachishwa udiwani, kujiengua uanachama wa chama walichogombea au kuhama chama.

Pia wanataka mahakama iilazimishe Tume kuhakikisha inawaandikisha raia waliofikisha umri wa miaka 18 katika Daftari la Kudumu la Wapiga Kura kabla ya kufanyika kwa uchaguzi huo.

Waliomo kwenye daftari hilo ni wale walioandikishwa mwaka 2004, na hivyo, wapinzani wanadai kuwa katika kipindi cha miaka mitatu kuna Watanzania wengi wamefikisha umri huo na hivyo kufanya uchaguzi bila kuwaandikisha ni kuwanyima haki yao ya kikatiba ya kuchagua viongozi wao.

Hali kadhalika, wapinzani katika madai yao wanataka yafanyike marekebisho ya Daftari la Kudumu katika kata zitakazohusika na uchaguzi huo ili kuwapa shahada za kupigia kura wale wote waliozipoteza pamoja na utaratibu wa kuondoa majina ya watu waliokufa au kupoteza sifa za kupiga kura.

Hata hivyo Tume imeshasema kwamba Sheria ya Uchaguzi wa Serikali za Mitaa ya mwaka 1979, kifungu cha 13 (1) hutoa siku 90 kufanywa kwa uchaguzi tangu nafasi kuachwa wazi, hivyo kusitisha uchaguzi mdogo ni kuvunja Sheria.

Hali kadhalika, wapinzani katika madai yao wanataka yafanyike marekebisho ya Daftari la Kudumu katika kata zitakazohusika na uchaguzi huo ili kuwapa shahada za kupigia kura wale wote waliozipoteza pamoja na utaratibu wa kuondoa majina ya watu waliokufa au kupoteza sifa za kupiga kura.
Ndio hasa ambacho tumekuwa tukikisema hapa, mabadiliko ya kisiasa na kisheria ili kuweza kuwa na uawajibikaji zaidi kwa taifa na wananchi,

Kuanzia wananchi wenyewe, serikali, na viongozi wetu wote tuwajibike kisheria, kusiwe na walioko juu ya sheria au kutowajibika kabisa na sheria kama Kara!

Huu ndio uendawazimu wa sheria zetu. Upande mmoja unasema kuwa kila mwenye umri wa miaka 18 na ana akili timamu ana haki ya kupiga kura, halafu upande mwingine unasema ni lazima uwe na uchaguzi ndani ya siku tisini tangu kiti kuwa wazi (miezi mitatu). Na zaidi ya yote unatakiwa kisheria kutumia daftari la wapiga kura kwa kuhakikisha wenye haki ya kupiga kura wanaandikishwa, sasa itakuwaje?

Ndio hasa ambacho tumekuwa tukikisema hapa, mabadiliko ya kisiasa na kisheria ili kuweza kuwa na uawajibikaji zaidi kwa taifa na wananchi,

FOUR opposition political parties yesterday filed a petition at the High Court in Dar es Salaam to block 16 counselors’ by-elections which are scheduled for October 28.

The parties are asking the court to restrain the National Electoral Commission (NEC) of Tanzania to hold the by-elections till all eligible voters are registered and allowed to participate in the elections.

They are seeking for an order to ensure that all eligible voters in the wards were not registered in 2004 are entered in the voters register.

The parties are also asking the court to declare unconstitutional the decision by NEC of not registering possible voters who are 18 years of age and above in the temporary voters register.

Advocate Mpale Mpoki is representing the parties in the matter - Chama Cha Demokrasia na Maendeleo (Chadema), Civic United Front (CUF), National Convention for Construction and Reform (NCCR-Mageuzi) and Tanzania Labour Party (TLP).

The parties alleged that they decided to seek court's intervention after NEC informed them that the elections would be conducted in the wards to fill vacancies left vacant as a result of death or resignation of incumbent councilors but without registering new voters.

They alleged that the refusal by NEC denied eligible voters, who were not registered in 2004 their constitutional rights as enshrined in Article 21 (1) of the Constitution and Section 13 of the National Election Act

Nawapongeza wote waliochukua hatua hizi za kwenda mahakamani, kwani kama wanawanyima haki hao vijana ambao tayari wametimiza umri wa kupiga kura hii ni kinyume na haki za msingi kabisa za kikatiba.

Kuna haja ya kuendeleza mapambano haya hadi yawe jina langu.....

Mahakama Kuu imetupilia mbali ombi la vyama vya upinzani dhidi ya Serikali la kutaka kusitisha uchaguzi mdogo wa madiwani katika kata 16 unaotarajia kufanyika kesho.

Mahakama hiyo ilisema walalamikaji walishindwa kutoa ushahidi wa kutosha dhidi ya watu 50,000 wanaodaiwa kuwa hawajaandikishwa katika Daftari la Wapiga kura.

Aidha, ilisema serikali ndiyo itakayoathirika kwa kupata hasara kubwa kwa sababu imetumia fedha na gharama kubwa kuandaa uchaguzi huo.

Uamuzi huo ulitolewa jana mbele ya jopo la majaji watatu wakiongozwa na Jaji Njegafibili Mwaikugile.

Walalamikaji katika shauri hilo ni, ushirika wa vyama vinne vya siasa vya upinzani vya CUF, TLP, NCCR-Mageuzi na CHADEMA. Aidha katika uamuzi huo, Mahakama ilisema hakuna madhara yoyote watakayopata kwa kutoshiriki kwao katika uchaguzi huo bali serikali ndiyo itakayopata hasara.

Mapema Mahakamani hapo, vyama hivyo vilifungua kesi dhidi ya Mwanasheria Mkuu na Tume ya Uchaguzi ya Taifa (NEC) ya kutaka mahakama hiyo kuzuia uchaguzi unaotarajiwa kufanyika kesho, kwa madai kuwa kuna wananchi wenye sifa ambao hawakuandikishwa katika daftari hilo mwaka 2004.

Ilidaiwa kuwa kitendo cha watu hao kutokuwaandikisha ni kukiuka katiba na kuwakosesha haki yao kikatiba ya kupiga kura na kuwachagua wawakilishi wao.

Hata hivyo, NEC ilipinga madai hayo kwa kuwa imepewa uwezo wa kuandaa uchaguzi na kukamilisha zoezi hilo ambalo limeighairimu serikali Sh. milioni 500.

The High Court yesterday threw out an application filed by four opposition parties seeking to stop by-elections in 16 mainland Tanzania wards lined up for tomorrow.

It ruled that the Government would suffer a heavy loss if the elections are not conducted as planned.

The four parties were seeking an order to have the National Electoral Commission (NEC) shelve the by-elections until about 50,000 eligible voters are registered and allowed to take part.

However, a panel comprising judges Njengafibili Mwaikugile, Robert Makaramba and Aisha Nyerere said the petitioners had failed to prove to the court how the 50,000 people would suffer by not participating in the by-elections.

Delivering the ruling, Judge Mwaikugile said the applicants had also failed to give the court convincing evidence that there were indeed 50,000 people who had not been registered for the by-elections.

He said that, given such a glaring lack of crucial evidence, it would be improper and unfair to block a process on whose preparations the Government had spent a lot of money.

The panel consequently ruled that the Chama cha Demokrasia na Maendeleo, the Civic United Front, NCCR-Mageuzi and the Tanzania Labour Party application was untenable and that the by-elections should proceed as scheduled.

The counsel for the applicants, Mpale Mpoki, had earlier submitted that they had advised the electoral commission on the importance of registering all eligible voters not registered in 2004.

He told the court that, despite the warning, NEC went ahead with preparations for the by-elections without registering the said 50,000 people.

The counsel further submitted that NEC confirmed to the applicants on October 2, 2007 of its desire not to update the Permanent Voters Register so as to accommodate those people.

The applicants argued that the commission`s decision would violate the country`s constitution by denying the 50,000 the right to participate in the by-elections without reasonable cause.

Counsel Mpoki said the country\'s constitution gives NEC powers to register voters and organise elections but that does not mean the commission is also vested with powers to violate the law.

State attorney Joseph Ndunguru pleaded with the court to dismiss the application, saying the Government had spent 500m/- to ensure the by-elections were held as planned and would incur a big loss if the process is blocked.

He also submitted that there was no link between the holding of the by-elections and the updating of the register.

The by-elections are being held to fill vacancies resulting from the death of councillors in the 16 wards in mainland Tanzania.
