In a move likely to inflame tensions between the United States and China, the Trump administration said Wednesday it will ban all commercial passenger flights by Chinese carriers.

The change, announced by the Department of Transportation and beginning June 16, is in response to China’s refusal to allow U.S. carriers to resume service to China.

The rule would impact operations of seven carriers, including Air China and China Eastern Airlines. The department noted in its rule filing that the ban could take effect sooner at President Trump’s discretion.

U.S. airlines halted flights to China after the Trump administration citing concerns about the spread of the novel-coronavirus, imposed a travel ban that took effect in early February. Delta and United had hoped to resume service in early June, but rules imposed by Chinese authorities effectively prevented them from doing so.

“Our overriding goal is not the perpetuation of this situation, but rather an improved environment wherein the carriers of both parties will be able to exercise fully their bilateral rights,” the rule says. “Should the CAAC adjust its policies to bring about the necessary improved situation for U.S. carriers, the Department is fully prepared to revisit the action it has announced in this order.”

The order does not impact cargo flights between the two countries

Civil aviation operations between the U.S. and China are governed by a 1980 agreement that establishes among other things, the right of carriers to provide air service between the two countries.

The agreement also notes that, “each Party shall take all appropriate action to ensure that there exist fair and equal rights for the designated airlines of both Parties to operate the agreed services on the specified routes so as to achieve equality of opportunity, reasonable balance and mutual benefit.”
