    Habari zenu wakuu,
    Mimi ni mwajiriwa na nina mkataba wa miaka miwili ambao unaisha tarehe 01/10/2016.
    Hivyo, naomba kufahamishwa haki zangu au malipo yoyote baada ya kumaliza mkataba huu wa kazi kabla sijasaini mkataba mwingine. Mfano, kiinua mgongo na malipo mengine.
    Nisaidieni wenye utaalamu wa mambo ya sheria na haki za mfanyakazi.

    Kama hujaamua kuacha kazi huwezi lipwa chochote,utarinew mkataba na kuendelea na kazi,ila ukisema hutaweza endelea na hyo ofc utatoa notice wewe mwenyewe ya kutokuendelea na kazi na mala nyingi utapaswa kutoa notice miezi mitatu b4 na ofc ikaanza kufanya taratibu za malipo yako na barua ya kukabidhi kila kitu chao na then watakupa end of contract later utakayopeleka ktk mifuko ya kijamii kama NSSF ili pia uvute chako.Kwisha

    Nje na mifuko ya hifadhi ya jamii mwajiri hatoi chochote kama mkono wa kwa heri/kifuta jasho?

    Utapata kitu kinaitwa gratuity (kama hicho kipengele kipo kwenye mkataba wako. mara nyingi huwa kipo) ambayo mara nyingi ni 15% ya malipo yote ulolipwa kwa miaka 2. Mfano kama mshahara wako (basic) ni 1M then kwa miaka 2 utakuwa umelipwa 24M sasa tafuta 15% ya hiyo fedha ndicho utakachopewa. Ila kumbuka gratuity in kudi tena kubwa tu so TRA hapo lazima wachukue chao pia

    Na kama kipengele hiki hakipo kwenye mkataba inamaanisha sitolipwa? Na Gratuity ipo kisheria au ni mpaka mwajiri aamue kulipa?

    Sina utaalamu sana wa kisheria ila nachofahamu ni kuwa hili linatgemea na mkataba unasemaje na sidhani kama mwajiri anawajibika kisheria kuweka hiki kipengele. Kama hakipo kwenye mkataba naona itakuwa ngumu sana kulipwa hiyo gratuity ila kama ipo basi hapo inakuwa ni haki yako. Vp mkataba wako hauna hicho kipengele?
