Jamani kuna jambo limenisibu nahitaji busara zenu.

Mimi nafanya kazi katika kampuni moja ya Wahindi,mkataba wangu huwa ni mwaka mmoja mmoja na nipo kazini tangu mwaka 2013.Katika majukumu yangu ya kila siku nashughulika sana kukidhi/comply matakwa mabali mbali ya sheria kama vile OSHA,NEMC,TFDA n.k

Wakati wa kurenew mkataba wangu wa mwaka huu,mwajiri ameniongezea kipengele hiki nakinukuu"You will be responsible for company penalties like fine that will come up due to your neglegence or failing to do the needful"kwa maana kwamba nitawajibika kwa faini zote ambazo kampuni itapigwa kutokana na uzembe wangu au kushindwa kufanya inavyopaswa.Kwa kweli kipengele hiki kimekuwa mwiba mchungu kwangu,nimegoma kusaini huo mkataba na mwajiri ameshikiria msimamo wake huo.

Sasa jamani naombeni ushauri,hiki kipengele ni halali kuwepo kwenye mkataba?,je sheria za kazi zinaweza kunilinda kwa lolote linaloweza kutokea?
 
Wahindi ni shida tupuu...nakushauri ujitahidi kama hicho kipengele kisipoondolewa basi kiwe very specific. Njia mojawapo ya kukifanya kiwe specific ni kuhakikisha job description yako (kwenye mkataba) ipo very clear. Scope ya responsibility na authority yako itamkwe waziwazi na kazi yako itakuwa ni kutenda kulingana na unachotakiwa (scope). Otherwise, naona risk ya kubambikiwa loss au penalty which is not within your area of jurisdiction.
 
Ni halali kabisa na sio halali. Iko hivi:
Unapopewa jukumu ukazembea na kuchelewesha kuwasilisha maombi na ikazalisha penalt hiyo ni yako. Kama ukiwasilisha maombi wakachelewa kutoa pesa hapo tarehe ya madai yanapoiva yaani due date aliyechelewesha malipo hilo ni lake.
Kwani dereva akiendesha vibaya akapigwa faini hawezi kuleta ofisini kwani huo ni uzembe wake wa kutokuwa makini. Labda uwe ni ubovu alioutolea taarifa akaambiwa we nenda !!
 
Kwa hiyo unataka ukifanya uzembe alipe nani?
tatizo ni kwa kiwango gani na ni nani atathibitisha kuwa huo ni uzembe wangu?,nafikiri hiki kipengele kinatakiwa kuwa more clear.

ukisoma section 28 subsection 1-7 ya Employment and Labour Relation Act (ELRA) of 2004 in inaelezea right ya employer kureduct employee wage as a renumeration kutokana na circumstances zilizo kua subscribed kwenye sheria.

as an employee it is your duty to follow lawful instructions provided by your employer and perform your duties as defined in your job description with due care by complying with company procedures and laws

Hicho kipengee cha mkataba ni sahihi kabisa. Kama umefanya uzembe na kuisababishia kampuni hasara inabidi wewe mwenyewe uwajibike. Kwa mfano mtu ameajiriwa kama dereva wa basi na akashikwa na trafiki kwa kosa la kuendesha gari kwa kasi au kuvunja sheria nyingine ya trafiki, kampuni inaweza kulipa faini hiyo ili basi lirudi kazini lakini dereva atakatwa mshahara kufidia faini hiyo kwa kuwa ilikuwa ni uzembe wake uliosababisha faini hiyo. Lakini kama basi litapata ajali au kupata pancha hiyo ni gharama ya kampuni kwa kuwa gharama haikutokana na uzembe wa dereva.

Otherwise, naona risk ya kubambikiwa loss au penalty which is not within your area of jurisdiction.

The contract states clearly that the employee will be responsible for any costs incurred by the company due to the employee's negligence or failure to execute his duties diligently. That is correct! Tusiwalaumu Wahindi tu kwa kila kitu hata kama wanayoyasema ni kweli. Ndiyo maana serikali iliyopita ya JK ilikuwa inaingizwa harasa kubwa tu kwa uzembe wa mfanyakazi ambaye wala hashughulikiwi. Tuachane na kasumba hiyo.

It is either huelewi au unajifanya huelewi. U-specific wa contract nimeuandika very clear kwenye comment yangu.
 
Kwakweli hicho kipengele nimekipenda sana. Ifike mahala wafanyakaz wa serikali yetu wawekewe hicho kipengele kwenye mikataba yao
