Kuna bwana mdogo kaniomba ushauri, katika ofisi anayofanyia kazi ilionekana kuwa alitenda kosa fulani, akaandika barua ya kukana kosa hilo, ila ofisi ikasema imefanya uchunguzi ikabainika kuwa ni kweli kosa hilo alifanya (JAPO YEYE AMEKANA)

Sasa amepewa option mbili,

1. Aandike leo barua ya kujiuzulu (kuresign) ili apewe/alipwe na mshahara wake wa mwezi huu. Ama

2. Asubiri uongozi/mwajiri amuandikie barua ya kufukuzwa kazi, na akifukuzwa kazi hatapewa mshahara wake wa mwezi huu.

Wajuvi wa sheria, hizi optional mbili mnazionaje? Tumshauli nini huyu ndugu.......?

Hiyo imeshakula kwake. He has to go. There is no way he will stay... Cha kufanya aandike barua ya kujiuzulu kwa kuwa inawekwa kwenye file lake. Ili huko mbele wakitaka reference wakarefer kwenye file inaonekana ali resign na sio kufukuzwa.
Pia angalau huo mshahara utamsogeza sogeza...
Mwambie aandike barua ya ku resign...

Ukiacha kazi wewe ndio unailipa taasisi, taasisi haiwezi kukulipa kwa wewe kuacha kazi, napata wasiwasi Kama ushahidi upo wazi kwamba katenda kosa why wampe option ya kuacha kazi yeye badala ya taasisi kumchukulia hatua?

Au wanataka kumfukuza kiaina, na Kama jamaa hajatenda anajiamini ana haki ya kusimamia ukweli kutetea haki yake

Kwa sheria ipi ya wafanyakazi ambayo kmukiacha kazi unalipwa? Huo ni mtego Kama kweli kaambiwa hivo
Mshahara wa mwezi mmoja wa muajiri ni pesa ndogo sana. Believe me. Atalipwa... Ila pesa itatoka mwisho wa mwezi pamoja na mishahara ya wafanyakazi wengine...

Sasa lengo lako ni kubishana au kuelewa? Hakuna sheria ila waajiri wengi hawapendi mambo ya migogoro ya wafanya kazi ya kupelekana mahakamani. Ndio maana wengi wanatoa mshahara kama favor ili wewe mwajiriwa uchukue option ya ku resgin badala ya option ya wewe mwajiriwa kufukuzwa kazi...

1. Mkataba wake ni wa muda gani (chini ya miezi 6 au zaid)?
2. Kuna sababu ya msingi ya kumfukuza
3. Watafuata taratibu wa kmwachisha kazi?

Kwani kwny suala la mwajiri kumwachisha kazi mwajiriwa wake mbaye mkataba wake ni zaidi ya miezi 6 tume huangalia mambo makuu 2
(a) Valid reason for termination
(b) Fair procedure for termination

Swali je, kuna mashtaka ya kinidhamu yamefunguliwa n mwajiri dhidi ya mwajiriwa ndani ya uongozi wa mwajiri?. Iwe ndiyo ama hapana "ASIJIHUDHULU"

Una evidence na hiki unachokizungumza? Yaani taasisi ikukute na kosa then ikubembeleze uache kazi ili ikulipe?, Unajua hakuna ushahidi mbaya Kama wa maandishi?, Akikubali kuandika barua ya kuacha kazi rasmi, mwajiri atasimamia sheria maana ushahidi anao tayari hata mahakamani hatoweza kuyakana maandishi yake, hapo atategemea huruma tu ya mwajiri ambapo sheria haiitambui. Lakini Kama Yuko kwenye haki asimamie haki yake aache wamfukuze halafu aende mahakamani Kama hajafanya kosa mahakama itaamua na atarudi kazini.

Akijiroga kuandika barua ya kuacha kazi atakuwa amejimaliza mwenyewe, huo ni mtego hakuna mwajiri mjinga

Ana mkataba, mkataba ni renewable, ulikuwa unaisha 30.09.2019 then kila tarehe 1 october huwa n kurenew
Ana mkataba wa kazi? Kama anao unaisha lini, kama anao asiandike barua ili wao wamwachishe kaz wamlipe .

Lakin aliemwambia hvo n mtu mmoja na c bodi ya kinidham, na aliemwambia akamwambia asimwambie mtu kuwa ameshauliwa kufanya hvo.
