Wanajamii, ninaomba msaada wa kueleweshwa kuhusu kodi iitwayo "Withholding" (Withholding Tax) kwenye nyumba za kupanga.Nimempangisha mtu kwenye nyumba yangu iliyopo Magomeni jijini Dar es Salaam - Tanzania. Tumekubaliana kuhusu kodi na kusainiana mkataba. Malipo aliyonipa ni pungufu na matarajio yangu, nilipomuuliza akasema amepunguza "withholding tax" ambayo atailipa TRA.Swali langu kwenu wanajamii;1. Ni nani anayepaswa kulipa hii kodi? I mean ni mwenye nyumba yeyote au kuna baadhi?2. Nisipolipa madhara ni nini? - asipolipa huyo mpangaji nani ataulizwa?3. Hii kodi ni asilimia ngapi ya kodi ya jengo?4. Hii kodi ni kwa baadhi ya maeneo au ni kila sehemu?Natanguliza asante kwa majibu yenu.

Kasri, With holding tax according to TRA kwa Residential houses ambazo kodi yake kwa mwaka inazidi laki tano, mpangaji anatakiwa alipe with holding tax, kwa residents ni 10% na kwa Non-residents ni 15%. Ila huwa naona wengi wa wapangaji wanaolipa kodi hii ni wa kwenye commercial buildings, lakini kwenye residential sioni ufuatiliaji wa hii kodi, so naona kama haina ulazima wa kuilipa hasa kwa watu ambao accounts zao haziwi audited.

Ila huwa naona wengi wa wapangaji wanaolipa kodi hii ni wa kwenye commercial buildings, lakini kwenye residential sioni ufuatiliaji wa hii kodi, so naona kama haina ulazima wa kuilipa hasa kwa watu ambao accounts zao haziwi audited.

Kwani kwenye mkataba kuna clause yoyote kuhusu yeye kulipa kodi hiyo? Kama hakuna basi lazima akupatie pesa yote na kama atabanwa na serikali basi ataonesha mkataba na wewe kudaiwa. Na kama kweli analipa basi akupatie nakala ya malipo hayo. Hakishindwa basi ujue huyo uwezo wake mdogo kuishi kwenye nyumba yako na aondoke kwani amekiuka mkataba.

Kwani kwenye mkataba kuna clause yoyote kuhusu yeye kulipa kodi hiyo? Kama hakuna basi lazima akupatie pesa yote na kama atabanwa na serikali basi ataonesha mkataba na wewe kudaiwa. Na kama kweli analipa basi akupatie nakala ya malipo hayo. Hakishindwa basi ujue huyo uwezo wake mdogo kuishi kwenye nyumba yako na aondoke kwani amekiuka mkataba.
This is a gud advice, lazima kwenye mkataba ionyeshe mlikubaliana alipe withholding tax, if not, amevunja mkataba, au akupe risiti aliyolipia TRA, akishindwa mwondoe tafutab anayekidhi vigezo vyako.

Pili, withholding tax on rental ni 10% kwa residents na non-residents. Kuna utofauti kweny wtax on service fees tu.

Sheria inayokufanya ukatwe hiyo 10% ni ile ya sheria ya fedha ya mwaka 2004 (ITA 2004) kifungu cha 82(1)(a) na Schedule 4 ya sheria hiyo hiyo.

Pia kifungu cha 84 cha sheria hiyo kinamtaka withholding agent kupeleka kodi hiyo kwa kamishna ndani ya siku saba baada ya mwezi wa makato. Hivyo basi mwenye wajibu wa kukata na kulipa kodi hiyo ya zuio ni mpangaji wako na sio wewe mwenye nyumba.

Kumbuka kodi hii kwa watu binafsi (individuals) ni final, huwezi kuja offset anywhere lakini ungekuwa na business, ingekuwa treated kama advance tax halafu mwisho wa mwaka ingekuwa offset against the final liability ya mwaka mzima.

Asante mkuu kwa kuwaelimisha hawa landlords, kwa kuongezea tu ni kwamba according to sheria tajwa ..mpangaji anatumika kama agent wa kuikusanyia kodi TRA. Hivyo sheria inampa mamlaka mpangaji wako kuikusanya hiyo kodi na ukitaka atakuletea evidence ya malipo.
