Kwa wale waliofuatilia suala la mfungwa kupata shahada yake ya kwanza ya sheria chuo kikuu huria ,

Taarifa zilisema kuwa huyu bwana alihukumiwa kifungo cha miaka 50, na tayari amekaa huko miaka 26, swali muhimu la kujiuliza ni kuwa je?alitenda kosa gani?

Ukizingatia huyu mtu alifungwa wakati wa utawala wa nyerere kuna haja ya kujua kosa la huyu bwana kwani kwa kipindi kile makosa kama kuhujumu uchumi ilikuwa ni kifungo kirefu , si ajabu huyu naye alihujumu kiasi fulani na kapewa kifungo hicho ama ni kosa gani mbona halitajwi hata siku moja?

Naomba wenye majibu wayaweke hapa kwani kumezuka maneno mtaani kuwa huyu jamaa alifungwa kwa amri ya mkuu wa kaya wa wakati huo,

Je?kwa nini hapewi msamaha tangu wakati huo wakati wengi walishapewa misamaha mingi kwa kipindi hicho?

ALL is possible in the land of all possibilities and Huruna Pembe Gombela proved just that when he became the first ever convict in Tanzania to be awarded with a bachelors degree while serving a prison term.

Gombela was conferred with a Bachelors Degree in Law (LLB) from the Open University of Tanzania (OUT) by the university's Chancellor, Mr Samuel Malecela, in a colourful ceremony held at the Ukonga prison in Dar es Salaam yesterday.

The 54-year-old convict was sentenced to 50 years in prison in 1998 and was admitted at OUT the following year but could not start his studies until 2004 for what he referred to as legal obstacles. He declined to comment on the crime he committed that landed him in jail.

In a feat worth envying and emulating by perceived incorrigible prisoners, Gombela was congratulated by Mr Malecela before handing him his certificate and a copy of his research paper.

Elegantly clad in a black suit, white shirt and grey and red striped tie and a black gown and hat with purple stripes, Mr Gombela walked graciously as though he was walking through the gates of freedom kingdom.

The cost for his education was met by his family and the university upon realising the uniqueness of their student. His two daughters, Halima and Leila, were present to witness their father's brief moment of freedom. His wife died two years after he was imprisoned in 2000.

He later said he was very happy of his achievement and that with his degree he would be in a better position to help fellow inmates appeal their cases, many of whom know little about litigation matters.

"When I was first brought here, I realised that there were many problems in the appeals processes and that motivated me to pursue the law degree. With support from OUT and the prison administration, I can now help prisoners in their appeals," Mr Gombela said.

Meanwhile, the Vice-Chancellor of OUT, Prof Tolly Mbwette, offered Mr Gombela an opportunity of a lifetime to pursue a Masters Degree at the university on a full scholarship if he was interested in further studies.

The Principal Commissioner of Prisons, Mr Augustino Nanyaro, said education for prisoners was top priority and that Gombela's success was evidence that prisons were places for rehabilitation and not just locking up criminals.

"The Dean of the Faculty of Law, Mr Paul Kihwelo, said that Mr Gombela's performance had been generally good and that for his research that was based on the legal and practical problems of processing appeals for prisoners he got a B+ and had so far successfully processed appeals for over 90 prisoners.

OKTOBA 31 mwaka huu, ilikuwa siku ya kihistoria katika Gereza la Ukonga, Dar es Salaam, wakati mfungwa Haruna Pembe Gombela, alipotunukiwa Shahada ya Sheria kutoka Chuo Kikuu Huria cha Tanzania (OUT), baada ya kuhitimu elimu yake aliyoianza mwaka 2001.

Gombela, alitunikiwa shahada hiyo kwa heshima na Mkuu wa chuo hicho, Balozi John Samwel Malecela, katika sherehe za mafahali hayo zilizofanyika gerezani hapo.

Sherehe hizo zilizopambwa na bendi ya magereza pia ilishuhudiwa na binti wa mfungwa huyo; Halima Gombela (28) na Leila Gombela (23).

Akizungumza katika ukumbi wa bwalo la Gereza la Ukonga, Mwenyekiti wa chuo hicho, Profesa Simon Mbilinyi, anasema siku hiyo ni muhimu katika historia ya chuo hicho.

Sherehe hizo zimefanyika siku nne baada ya kumalizika kwa mahafali ya 19 ya chuo hicho yaliyofanyika Oktoba 25, 2007 Uwanja wa Taifa.

Akimtunuku shahada hiyo, Balozi Malecela anasema: "Kwa mamlaka niliyokabidhiwa, ninakukabidhi Shahada ya Sheria kutoka Chuo Kikuu Huria cha Tanzania, yaani Bachelor of Law," anasema Malecela.

Malecela alimsifu mhitimu huyo kwa kazi nzuri anayoifanya gerezani kwa kusaidia wafungwa kukata rufaa, hasa baada ya kuelezwa kuwa ameshatoa msaada wa kisheria kwa wafungwa zaidi ya 90 ambao wameachiwa.

Mtoto mkubwa wa mfungwa huyo, Halima Gombela, mkazi wa Temeke, anasema amefurahishwa na kitendo cha baba yake kupewa nafasi ya kusoma akiwa kifungoni na kusema kuwa sasa amejifunza kuwa gerezani si sehemu ya mateso pekee.

Anasema baba yake alikamatwa wakati yeye akiwa mtoto mdogo. Ameisifu serikali na Jeshi la Magereza kwa kumpatia baba yake fursa ya kusoma.

Mtoto huyo ambaye sasa ameolewa, anaiomba serikali kutoa msamaha kwa baba yake, ili aweze kuungana nao katika familia kwani ni muda mrefu wamemkosa.

"Tumejisikia vizuri na tumefurahi kwa Jeshi la Magereza na serikali kumruhusu kusoma…tulikuwa tunaomba kama kuna msamaha wamruhusu atoke kwa kuwa tumekosa mapenzi ya baba yetu siku nyingi," anasema Halima.

Gombela, akizungumza na waandishi wa habari anasema kwa muda wa miaka 16 aliyokaa jela na kwa kipindi ambacho alianza kujisomea, tayari amefanikiwa kuwatoa wafungwa 92 gerezani kwa kuwawezesha kukata rufaa na kushinda.

Anasema tangu alipopata nafasi ya kusoma amekuwa akiamka mapema kwa ajili ya kufanya shughuli za gereza zinazomhusu, kisha hujikita katika kusoma hadi usiku.

Mfungwa huyo ambaye alisindikizwa na mfungwa mwenzake ambaye naye ameanza kusomea sheria, anasema amefurahi kuwa mfungwa wa kwanza Tanzania kutunukiwa shahada ya juu.

"Nimefurahi kwa sababu nimekuwa wa kwanza kupata digrii hapa Tanzania nikiwa gerezani," anasema.

Naye Kamishna Mkuu wa Jeshi la Magereza, Augustino Nanyaro, anasema uongozi wa gereza hilo ulimuandalia ratiba nzuri iliyomwezesha kusoma baada ya kumaliza kazi zake gerezani na kusema kuwa alitengewa sehemu maalumu ya kujisomea mchana.

Nanyaro amekishukuru chuo hicho kwa kujitahidi kumusomesha mfungwa huyo hadi kumaliza na kuwataka wengine waige mfano wa chuo hicho.

Hata hivyo, Kamishina wa Magereza, anasema suala la elimu katika Jeshi la Magereza limekuwa likitoa kipaumbele kwa vijana wenye umri wa miaka 16-21 kwa kuwasomesha kuanzia darasa la tano hadi la saba na kufanya mtihani wa taifa, wale wanaofaulu huombewa msamaha kwa Rais, ili waendelee sekondari.

"Na wale ambao hukosa masomo hayo hujifunza fani mbalimbali za ufundi kisha kufanya mtihani wa VETA huku wakiendelea na vifungo vyao katika Chuo cha Ufundi Luanda, mkoani Mbeya," anasema.

Anasema Gereza la Wami la vijana lililopo Dakawa, wilayani Mvomero, Morogoro, hutoa elimu ya msingi kuanzia darasa la tano hadi la saba.

Kamishna huyo, anasema tukio la mfungwa huyo kutunukiwa shahada limekuwa la kihistoria nchini na kusema kuwa jeshi hilo lilikuwa halina kumbukumbu ya mfungwa aliyepata mafunzo kama hayo akiwa gerezani.

Naye Makamu Mkuu wa chuo hicho, Profesa Tollys Mbwette, anasema chuo hicho kimeanza kutimiza lengo lake la kuwafikia Watanzania wote wasioweza kufikiwa na vyuo vikuu vingine.

"Chuo chetu ni chuo pekee ambacho kinatoa elimu kwa majeshi ya ulinzi na usalama popote pale walipo nchini bila kulazimika kuhama vituo isipokuwa wakati wa mitihani, majaribio na mafunzo ya ana kwa ana yasiyozidi mwezi mmoja," anasema.

Anasema iwapo tukio hilo litawahamasisha wafungwa wengi katika magereza mbalimbali nchini kusoma halitakisumbua chuo, kwa kuwa chuo hicho kina vituo vingi katika mikoa yote nchini.

Anasema uongozi wa chuo hicho umejitolea kumsomesha mfungwa huyo shahada ya pili ya uzamili kwa kumlipia gharama zote kama atahitaji na utafiti ataufanyia magerezani, jambo ambalo mhitimu alikubaliana nalo.

Naye Makamu Mkuu wa Serikali ya Wanafunzi chuoni hapo, Vincent Mgendela, ambaye alikuwa akimpelekea vitabu vya kujisomea gerezani, alimpongeza mfungwa huyo kwa kumaliza elimu yake akiwa gerezani.

Naye, Mshauri wa Wanafunzi, Daphina Mabagala, anasema amekuwa akimtembelea mwanafunzi wake huyo na kugundua kuwa amebadilika kabisa na ameonyesha tabia njema kwa jamii na kumuombea serikali kama itaona kuna uwezekano impatie msamaha.

Mfungwa huyo ambaye ameshatumikia kifungo hicho anatarajiwa kumaliza adhabu yake mwaka 2025.

Hata hivyo, Pembe alikataa kueleza kosa lililomsababishia kifungo, na kusema kuwa amekata rufaa kupinga adhabu hiyo.

Inaelezwa mfungwa huyo alisomeshwa na aliyekuwa mfungwa mwenzake, baada ya kumsaidia na kushinda rufaa aliyokata.

HATIMAYE Mahakama ya Rufani nchini imemfutia adhabu ya kifungo cha miaka 20 jela yule mfungwa aliyepata Shahada ya kwanza ya Sheria katika Chuo Kikuu Huria(OUT) akiwa gerezani,askari mpelelezi wa Jeshi la Polisi E.6937 D/C Haruna Pembe Gombela baada ya kubaini huku zote zilizotolewa na mahakama za chini zilimtia hatiani kimakosa.


Uamuzi huo wa Mahakama ya Rufani nchini unatokana na rufaa Na.44/2006 iliyokatwa mahakamani hapo na mrufani Gombela ambaye alikuwa akiishi katika Gereza Ukonga dhidi ya Jamhuri aliyoomba mahakama hiyo ya juu nchini itengue hukumu ya ya Mahakama Kuu Kanda ya Dar es Salaam iliyotolewa na Jaji Katherine Orioyo Oktoba 31 mwaka 2005, ambayo pia nayo ilikubaliana na hukumu iliyotolewa na Mahakama ya Wilaya ya Ilala katika kesi ya unyang'anyi wa kutumia silaha Na.1426/1990 ambazo hukumu zote hizo zilimtia hatiani kwa kosa hilo na kumhukumu kwenda jela miaka 20.

Jopo la majaji watatu wa mahakama ya rufani waliokuwa wakisiliza rufaa ya Gombale ambalo lilikuwa likiongozwa na jaji Eusebio Mnuo,Steven Bwana na Sauda Mjasiri walisema hawana sababu ya kutofautiana na upande wa Jamhuri kwasababu jopo hilo limeridhika kuwa gwaride la utambulisho lilofanywa kumtambua mrufani halikuacha mashaka.

Jaji Mnuo alisema mahakama za chini zilimtia hatiani mrufani huyo kwa kuegemea ushahidi maelezo ya onyo yaliyotolewa kama ushahidi dhidi ya mrufani na ambapo mshtakiwa huyo wa tatu alishachiwa huru na mahakama za chini, ambapo jaji huyo alisema kwa mujibu wa kifungu cha 33(2) cha Sheria ya Ushahidi ya Tanzania ya mwaka 2002, vinasema ushahidi utakaotolewa na mshtakiwa mmoja dhidi ya mshtakiwa mwenzake ambao wanakabiliwa katika kesi mmoja, haupaswi kutumiwa na mahakama kumtia hatiani mshtakiwa mwingine ambao ushahidi huo ulimtaja.

"Kwa hiyo jopo hili linatamka wazi kuwa linatengua hukumu ya Mahakama Kuu iliyomtia hatiani Gombale kwasababu mahakama hiyo ya chini ilimtia hatiani kimakosa kwani mahakama hiyo ilimtia hatiani mrufani huyo kwa kuegemea ushahidi wa maelezo ya onyo ya mshtakiwa mwenzake na mrufani kwasababu kifungu cha 33(2) cha Sheria ya Ushahidi, kinakataza mshtakiwa mmoja kutiwa hatiani kwa ushahidi wa maelezo ya onyo ya mshtakiwa mwenzake ambaye anashtakiwa naye kwenye kesi moja na tuna amuru mshtakiwa huyo aachiriwe huru. Gombela na wenzake ambao siyo wahusika katika rufaa hiyo, walifikishwa katika Mahakama ya Wilaya ya Ilala na kufunguliwa kesi unyang'anyi wa kutumia silaha Na.1426/1990 ambapo yeye alitiwa hatiani na wenzake kuachiliwa huru. Lakini Mkurugenzi wa Mashtaka nchini alidai adhabu hiyo ni ndogo na hivyo DPP alikata rufaa katika Mahakama Kuu ambayo ilipewa Na.155/1992 kwamba kosa walilotiwa nalo hatiani kisheria inapaswa wafungwe jela miaka 30 lakini akadai anashangwa na mahakama hiyo kuwafunga miaka 20 jela.

Wakati Mkurugenzi wa Mashtaka akiwasilisha rufaa hiyo Mahakama Kuu, pia Gombale alikata rufaa dhidi ya hukumu hiyo ambayo ilipewa Na. 84/1992 ambayo hata hivyo mahakama Kuu iliitupilia mbali ili kuruhusu warufani waudhulie katika rufaa Na.155/1992 ambayo nayo pia haikufanikiwa.

Ndipo Gombela alifikia uamuzi tena wa kukata rufaa katika Mahakama ya Rufaa ambao alitoa sababu nane za kukata rufaa ambapo alidai hukumu zilizotolewa dhidi yake na mahakama za chini ambazo zote zilimhukumu kwa kutumia ushahudi wa mshtakiwa mwenzake, mahakama ya wilaya ya Ilala haikufanya usikilizwaji wa awali wa kesi hiyo (PH) jambo ambalo ni kinyume na cha kifungu cha 192 cha Sheria ya Makosa ya Jinai ya mwaka 2002.

Itakumbukwa kuwa miaka ya hivi karibuni Gombale aliandika historia mpya ya kuwa mfungwa aliyefungwa gerezani lakini wakati akitumia adhabu yake katika gereza la Ukonga alipata fursa ya kujiendeleza kielimu ambapo alikuwa akijisomea Shahada ya Sheria katika Chuo Kikuu Huria (OUT) jijini Dar es Salaam, na kutunikiwa shahada hiyo, hali iliyofungua ukurasa mpya katika Magereza ya Tanzania, kuwa mtu kuwa mfungwa siyo kigezo cha kushindwa kujiendeleza kielimu.

MUNUO, J.A.:
The appellant, Ex-B.6937 DC Haruna Pembe Gombela was in Ilala District Court Criminal Case No. 1426 of 1990 jointly with others who are
not parties to this appeal, convicted of robbery with violence and sentenced to 20 years imprisonment. Aggrieved by the sentence, the Director of Public Prosecution challenged the same in Criminal Appeal No. 155 of 1992 resulting in the sentence of 20 years being enhanced to 30 years, the scheduled statutory minimum sentence for armed robbery. The appellant had meanwhile lodged Criminal Appeal No. 84 of 1992 which through oversight was not consolidated with Criminal Appeal No. 155 of 1992 as ordered by the High Court. Later, Criminal Appeal No. 84 of 1992 was struck out to enable the present appellant's appeal to be determined in Criminal Appeal No. 155 of 1992, though unsuccessfully. Thereafter, the appellant lodged this appeal to challenge the conviction and sentence.

On the 27th August, 1990 the complainant, P.W.1 Shabani Alli had parked his taxi Registration No. TZA 9743 at Mwembechai, Dar es Salaam. At about 8.10 p.m 3 bandits hired the material taxi to Sinza. At Sinza the bandits ordered the taxi driver to take them to Ubungo and to Mabibo. When they reached Mabibo, the bandits threatened PW1 with a pistol and forced him to sit between the two bandits at the rear seat. The bandits then drove to Mikocheni where they dropped P.W.1 from the taxi,abandoning him there. P.W.1 and reported the matter at Kijitonyama police station. The following day, the police recovered a gear box, engine and tyres suspected to have been dismantled from the stolen taxi. P.W.1 identified the tyres by silver marks he had placed thereon. The present appellant was implicated by the 2nd accused who was acquitted.

The appellant filed eight grounds of appeal complaining that he was wrongly convicted on the statement of his co-accused and that the trial court failed to conduct a preliminary hearing under the provisions of section 192 of the Criminal Procedure Act, Cap 20 R.E. 2002. He further challenged the identification evidence adduced at the trial saying the complainant did not give the descriptions of the bandits so the visual identification at night was unfavourable and uncertain to sustain a conviction considering that he was implicated by a co-accused who was himself acquitted by the trial court.

Ms Angela Lushagara, learned State Attorney, represented the Republic. She supported the appeal on the ground that the visual identification evidence gave no description of the attire, and, or apparel of the bandits so the complainant might not have identified the bandits during the night. She, furthermore, faulted the courts below for grounding the conviction of the appellant on the caution statements of DW3 and DW4 who were acquitted. Hence the learned State Attorney urged the Court to quash the conviction and set aside the sentence thereby allowing the appeal. The issue in this appeal is whether the identification of the appellant was watertight.

The learned judge upheld the conviction of the appellant on the ground that the complainant identified the appellant. The learned judge
stated, inter-alia:
"...Three independent testimonies visually identified the appellant, the 3rd accused who stole the car from the complainant; 4th accused who bought the stolen taxi's engine and other spares. I find that this is the type of evidence the Court of Appeal had in mind in requiring the evidence of visual identification must be watertight before a court can convict on it. I am satisfied that the visual identification of the appellant was watertight, and the trial court cannot be faulted for convicting the appellant on the strength of the evidence tendered..."

In this case, the complainant was the sole eye witness. Three bandits pretended to be innocent passengers in need of hiring P.W.1's taxi to Sinza, Ubungo and Mabibo Peninsular only to turn out to be armed robbers who threatened P.W.1 with a pistol and seized the taxi from him after throwing him out of the cab at Mikocheni in Kinondoni District. The Republic declined to support the conviction on the ground that the identification evidence was weak in that P.W.1 gave no description, names or attires of the bandits who robbed him. Even the identification register of the police parade was not tendered at the trial to prove whether or not the taxi driver identified the appellant. The learned State Attorney faulted the trial court for convicting the appellant on the caution statement of the 3rd accused who was acquitted. On the evidence of a co-accused; section 33 of the Evidence Act, 1967 Cap. 6 R.E. 2002 states, inter-alia:

"33. (1) When two or more persons are being tried jointly for the same offence or for different offences out of the same transaction, and a confession of the offence or offences charged made by one of those persons effecting himself and some other of those persons is proved, the court may take that confession into consideration against that other person.

(2) Notwithstanding subsection (1), a conviction of an accused person shall not be based solely on a confession by a co-accused.

(3) In this section "offence" includes the statement of, or attempt to commit the offence charged, and other offences which are minor and cognate to the offence charged, which are disclosed in the confession and admitted by the accused..."

It appears to us that the appellant was wrongly convicted on the incriminating caution statement of the 3rd accused who was acquitted by the trial court. There is no sufficient evidence to support the conviction of the appellant. Moreover, under the provisions of section 33 (2) of the Evidence Act cited supra, the conviction of the appellant cannot stand because the incriminating statement of accused No. 3 who was acquitted requires independent corroborating evidence as stipulated under the provisions of the said section 33(2) of the Evidence Act, Cap 6 R.E. 2002. In view of the above, the Republic rightly supported the appeal. we have no justification to differ with the Republic. We are satisfied that the identification of the appellant was not watertight. Hence we accordingly quash the conviction and set aside the sentence. The appellant to be set at liberty forthwith if he is not detained for other lawful cause. The appeal is hereby allowed.

Ninavyojua kutokana na habari hizo za magazetini, ni kuwa adhabu za jamaa zinakwenda pamoja, kwa hiyo atatumikia miaka 25 tu. Shida ni moja, kafungwa kwa kosa gani? Maana kama ni kubaka alistahili kufungwa miaka 30.
Wana JF mlio na taarifa za mfungwa huyu tunaomba ufafanuzi wa makosa yake.
 
pamoja na hongera zake kupokea digrii ya sheria akiwa chumbani (jela) ningependa kufahamu alimkosea nini pilato hadi akamhukumu miaka 50 yote hiyo? Labda wanasheria watueleze miaka 50 iliyopita kuna makosa gani ambayo penal code yake ni maximum miaka 50?? au manslaughter? au kwa manufaa ya umma akahukumiwa? mwenye data alete ili tumweke ktk sala zetu apate msamaha mapema maana amesaidia wengi huyu mtu.....

Kuna haja ya kujua kosa alilotenda na baada ya kujua kuna haja ya kuangalia kama tuanzishe kampeni ya kumtoa huko ama laa , kwani tayari amekaa kwa zaidi ya nusu ya kifungo chake hivi sasa na kaweza hata kujipatia elimu hadi kufaulu kitu ambacho wanasiasa wengi wameshindwa.
 
Mimi naanza kususpect kitu kimoja.
