Kenya ministers 'boycott cabinet'

Kenya is polarised by conflicting loyalties to the two leaders


Allies of Kenyan Prime Minister Raila Odinga have said they will boycott cabinet meetings until a dispute with President Mwai Kibaki has been sorted.

The two men clashed on Sunday after Mr Odinga suspended two ministers accused of corruption - only for Mr Kibaki to reverse the decision hours later.

A spokesman for Mr Odinga's party says the prime minister can no longer function properly in the government.

The two rivals formed a coalition to end riots following the 2007 election.
Some 1,300 people died in the violence and tens of thousands were displaced.

Missing funds

The BBC's Will Ross in Nairobi says vital reforms, intended to prevent a repeat of the post-election violence, have not been put in place yet.

And he says the current situation is worrying because there is a risk of the coalition government collapsing if the dispute is not resolved.

The US ambassador, Michael Ranneberger, has called on both leaders to work together to tackle corruption.

"My government feels very strongly that this is a time for dialogue in the interest of the nation, not a time for finger-pointing or mutual recrimination," he said.
"At the same time it is important for everyone to avoid manipulating ethnic tensions."

Mr Odinga and Mr Kibaki are from different ethnic groups, a divide which fuelled the 2007 violence.

On Monday, Mr Odinga called for former UN Secretary-General Kofi Annan to intervene in the dispute

But the political situation is further complicated for Mr Odinga, because his own party - the Orange Democratic Movement - is split.

Some members are expressing solidarity with Agriculture Minister William Ruto - one of the ministers Mr Odinga tried to suspend.

Mr Ruto, under suspicion after a recent audit into a maize scandal revealed that $26m (£16.5m) had gone missing, was an ally of the prime minister but the pair are now fierce rivals.

Education Minister Sam Ongeri, from Mr Kibaki's Party of National Unity, was targeted for suspension after more than $1m earmarked for schools went missing.

The discord in Government took a surprise turn when Prime Minister Raila's Orange Democratic Movement resolved to boycott Cabinet meetings until the dispute is resolved.

The altercation between President Kibaki and Raila over the suspension of two Cabinet ministers over corruption allegations was yesterday characterised by a flurry of meetings and press conferences, with the two principal's lieutenants going on the attack. Their parties took hardline positions.

This was happening amid mounting pressure for Agriculture Minister William Ruto and his Education counterpart Sam Ongeri to quit over the maize and Free Primary cash scandals.


At a meeting attended by more than 20 MPs, party Secretary General Anyang' Nyong'o read a statement in which he said that all ODM ministers would keep away from Cabinet meetings.

The statement was read after a National Executive Council meeting at the party headquarters at Orange House.
President Kibaki's advisor, Kivutha Kibwana, told a press conference Raila did not have the powers to suspend ministers.

He spoke soon after President Kibaki met ministers from his PNU wing of Government.

However, several lawyers pointed out the grey areas in the National Accord that could have given the PM the leeway to suspend Ruto and Ongeri .

Nyong'o called for disciplinary action against members who do not abide by the party position.
"We call upon ODM ministers not to attend Cabinet meetings until the crisis is resolved," said Nyong'o.
Party members asked Chairman Henry Kosgey who is out of the country to ensure clear disciplinary mechanisms are put in place.

The action is seen to target Ruto whose suspension by Raila was reversed by President Kibaki.

On Monday, Ruto claimed that the PM was behind several attempts to oust him from his ministerial position.
Although Cabinet can continue with its sittings in the absence of ODM ministers, it would put pressure on the PNU wing and Kibaki to listen to the PM's party.

Wrong advice

Political parties under the aegis of the Centre for Multi-party Democracy and civil society organisations called on the suspended ministers to keep off their office until investigations are complete.

They expressed concern at the incoherence between President Kibaki and Raila, saying the bickering is threatening the National Accord.

Kibwana said the President was not equal to the Prime Minister in terms of the powers in the Constitution and the National Accord.

He accused the PM's advisors of misleading him that he has equal constitutional powers with the President, which also gives him powers to discipline, suspend or interdict public officials, including ministers.

"This is wrong advice. Indeed the Attorney General has clearly stated the correct legal position," he added.
Kibwana accused the PM of transferring ODM's internal problems to the Government.

Comprehensive plan

Those who attended the PNU meeting included the Vice- President, Internal Security minister George Saitoti, Energy Minister Kiraitu Murungi and Head of Public Service and Secretary to the Cabinet Francis Muthaura

In his statement, the Prime Minister's Advisor on Coalition Affairs Miguna Miguna said Section 4(1) of the National Accord gives the Prime minister exclusive mandate and authority to discipline Government officers, including Cabinet minisers that he co-ordinates and supervises.

Miguna was speaking at a press conference in Nairobi where he responded to Attorney-General Amos Wako assertion that only the President could suspend ministers.

Wako had said the power to suspend under the constitution as modified by the Act, can only come after full consultation.

"The authority to co-ordinate and supervise does not in itself confer a power to suspend," Wako's statement read in part.

Yesterday Miguna said: "Wako must surely know that without the power to discipline, supervision would be meaningless."

Kibwana said President Kibaki has a comprehensive plan to tackle corruption, which he would unveil soon.
Separately, Ruto who is also a deputy leader of ODM said there was no crisis."In my capacity as a deputy leader of ODM, I believe that it is wrong to claim that there is a crisis and those out to raise the political temperatures should stop," he said.

And in a statement, Foreign Affairs Minister Moses Wetang'ula said the suspension of the two Cabinet ministers by the Prime Minister was irregular and against the spirit of the National Accord and the Constitution.
Impotent whip

The minister said there was nowhere in the National Accord where the president relinquishes or delegates his constitutional power to appoint or sack Cabinet ministers.

Ikolomani MP Bonny Khalwale blamed Justice Minister Mutula Kilonzo for the current crisis.

Khalwale said Mutula had failed to introduce a Bill to give Raila powers as agreed in the power sharing deal.
"At the moment what Raila has is an impotent whip and which he cannot use to crack on wayward ministers. What is needed is an Act of Parliament to grant him the powers,"said Khalwale.

The United States on Tuesday welcomed calls to have Mr Kofi Annan help the grand coalition resolve its wrangles.


Ambassador Michael Ranneberger said his government was keenly watching the events taking place in the country, noting that the former United Nations secretary-general and the Panel of Eminent African Personalities were free to mediate on matters affecting the Grand Coalition Government.

Ethnic tension

“The National Accord was a watershed that helped Kenya rise from the bloodshed. Nobody should manipulate his position to enhance ethnic tension,” Mr Ranneberger said.


Addressing a press conference at his residence, the envoy said highly placed government officials in the US, including President Barack Obama, were keenly watching events in the country.

He urged President Kibaki and Prime Minister Raila Odinga to act to ensure that constitutional reforms and unity were achieved.

Mr Ranneberger called for stiffer penalties for people found guilty of corruption in the government regardless of their status.

“Thorough, transparent and independent investigations should be carried out expeditiously,” he said.

He said government officials at all levels must be held accountable for the actions.

The envoy said the coalition government’s action constitutes an important first step to address corruption, adding that Kenyans and the international community were waiting to see action being taken.

However, Mr Ranneberger said the two principals were committed about asking those mentioned in the maize and education scandals to step aside to allow for independent investigations.

The new vigour to fight corruption, he said, marked a turning point in the reform process and would restore confidence in Kenyan leaders’ ability to govern effectively and deliver growth, justice and prosperity.

He said they would work with the government to promote and support efforts to fight corruption.

Can Mr Raila Odinga lead his Orange Democratic Movement out of the coalition government? And what happens if he does?
These are some of the questions being asked amid the acrimonious power play between President Kibaki and the Prime Minister.

ODM parliamentary group secretary Ababu Namwamba said his party was walking "a tight rope" and blamed the drafters of the National Accord and Reconciliation Act for not providing an express conflict resolution mechanism.

Stand dissolved

According to the Accord, the coalition shall stand dissolved if the 10th Parliament is dissolved, coalition parties agree in writing to go their separate ways, or one partner withdraws.

But Mr Namwamba said if the Orange wing decided to pull out of the coalition, President Kibaki's Party of National Unity "would continue ruling as if nothing happened".

Contrary to public perception, said Mr Namwamba, the Accord does not force the country to hold elections if one of the parties walks out.
"The ODM's choices are quite limited. The dissatisfied party can only appeal to chief mediator Kofi Annan or call mass action and I don't think Kenyans are ready for that," the lawyer told the Nation yesterday.

Mr Namwamba said the drafters may have acted in haste to reach a political deal and restore peace following the violence that broke out after the 2007 polls.
The Accord seems to favour one of the parties, raising questions on whether ODM had negotiated a "watertight deal", said the Budalang'i MP.

Constitutional scholar Githu Muigai agreed that if ODM decided to leave, the coalition would collapse but not the government.

"Constitutionally, a government would be in place conceivably until the next election or a new constitution is enacted," he said.

This means that if Mr Odinga walked out, President Kibaki would re-constitute government and finish his second term. According to Prof Muigai, the challenge will not be constitutional but political.

"There would be issues on whether it could resist a no-confidence vote and whether it would be effective, viable and legitimate," he said.

Formed after the 2008 political crisis, the coalition was meant to be a partnership with commitment on both sides to govern together and push reforms.

But disturbing political events touching on the handling of graft allegations in the Education and Agriculture ministries strained the relationship between the partners who seem to be working together but at cross purposes.
Attorney-General Amos Wako has cautioned that the power play between the two principals could yield what he termed "disastrous results" for the country.

"If unchecked it could lead to the breakdown of the coalition government, developing into a political and constitutional crisis," he said.

The government's chief legal adviser also warned that the battle could adversely affect security and precipitate a premature General Election.

Some in PNU have claimed that Mr Odinga plans to quit the coalition government immediately he returns from Japan, where he is on official duty.


But it is not that easy; such a decision must be a resolution of ODM's highest decision-making organ, and it must be in writing.

Given the division in ODM in which a cabal of MPs allied to Agriculture minister William Ruto are opposed to Mr Odinga, it is unlikely that the Prime Minister can achieve consensus for the party to pull out.

But Mr Namwamba thinks such a move is possible.

"It would only require a simple majority of the National Delegates Congress," he said.

And even if Mr Odinga were to resign or be thrown out by Parliament through a no confidence vote, his party, if it continues to retain majority in the House, will be required to nominate a replacement.

The accord says that the PM can be impeached if the National Assembly passes a resolution which is supported by a majority of all the members, excluding the ex-officio members.

The fight is against corruption which very few Kenyan leaders have been willing to do. Raila peke yake ndiye ameamua to confront this mongerel face to face for the love of his country and whatever happens so be it.

Rais Kibaki on the other hand anajulikana kama mwizi na ameunda genge lake la wezi na kuwapa nafasi nyeti serikalini kuiba hela. Kwa akili yake fupi anadhani hizi ni siku za Kenyatta na hakuna mtu atasema kitu. Kutoka ashinde zile kura za '03 mpaka leo imekua skendo baada ya skendo mtindo mmoja na mabilioni ya hela yanapotea kila kukicha.Kwa nini mtu asimconfront on that issue?Wale waliompa Raila kura believed they had a leader who would do this na if Raila did not then it would be a betrayal of his followers and many Kenyans who did not vote for him.

Responding to that I am right in saying that PM Raila Odinga is a 100% right on the issue of getting rid of corrupt in ou system.
The question however is, was he and is he allowed to do that under the accord ?. depending on ones political inclination it could go either ways yes and no.The accord is very silent about that issue.Yes it touches on issues to do with co-ordination and supervision but those two words are too generic.During the negotiations a proper description of what supervision and co-ordination would entail ought tohave been stated.otherwise as it is everyone can interprate these terms anyway they want to suit their convictions.

If you have followed Kenyan politics you'll have realised by now that Kibaki is one cunning, calculating old man, you can be shocked to find out that Raila really consulted him on the matter regarding the suspension of the two ministers, then Kibaki went ahead and blocked the suspensions so that he can gain political millage at the expense of the Kenyan people whose coffers are being wiped clean by the rulling elite. He usually pretends to be aloof and sickly, while the real fact is that he is a very active (politically), calculating geezer. So to me, you cant blame Raila, for what its worth atleast Raila tried to take a shot at the corrupt minister only to be blocked by the president. If we would go for an election right now, Raila would become the president.

He usually pretends to be aloof and sickly, while the real fact is that he is a very active (politically), calculating geezer. So to me, you cant blame Raila, for what its worth atleast Raila tried to take a shot at the corrupt minister only to be blocked by the president. If we would go for an election right now, Raila would become the president.

Some in PNU have claimed that Mr Odinga plans to quit the coalition government immediately he returns from Japan, where he is on official duty.


But it is not that easy; such a decision must be a resolution of ODM’s highest decision-making organ, and it must be in writing.

Given the division in ODM in which a cabal of MPs allied to Agriculture minister William Ruto are opposed to Mr Odinga, it is unlikely that the Prime Minister can achieve consensus for the party to pull out.

But Mr Namwamba thinks such a move is possible.

“It would only require a simple majority of the National Delegates Congress,” he said.

And even if Mr Odinga were to resign or be thrown out by Parliament through a no confidence vote, his party, if it continues to retain majority in the House, will be required to nominate a replacement.

The accord says that the PM can be impeached if the National Assembly passes a resolution which is supported by a majority of all the members, excluding the ex-officio members.
