A 42-year-old Kenyan nurse has pleaded guilty to healthcare fraud, aiding and abetting healthcare fraud, conspiracy to pay and receive kickbacks, and multiple counts of lying to American federal investigators.

Winnie Waruru admitted that he was part of a scheme which defrauded at least $100 million (KSh12 billion) from Medicare and MassHealth.

Waruru, who worked as a licensed practical nurse at Arbor Homecare Services LLC, committed the crime in cahoots with business partner Faith Newton.

The United States Department of Justice records that the pair billed and received huge chunks of payments for performing unnecessary procedures.

"Newton and others, including Waruru, failed to train staff, billed for home health services that were never provided or were not medically necessary and billed for home health services that were not authorised," reads part of the statement.
According to the prosecution, Waruru also fraudulently received $1.2 million (KSh 144 million) from MassHealth for fake nursing visits.

She also admitted to offering cash payments to her partner to Newton to give her two patients to allow them continuing offering services to Arbor Homecare Services.

Waruru faces up to 15 years in prison​

Having pleaded guilty to several counts of crime, Waruru will be sentenced in January 2023 and faces up to 15 years in prison.

Her 52-year-old partner, Newton, pleaded not guilty and is awaiting trial for initiating employment relationships with patients' families to create an avenue for fake bills, visits, and procedures.

She also faces charges of paying kickbacks to the patients, who are mostly from poor families, have disabilities, or suffer from addiction and depression, to participate in the fraud scheme.

Newton supposedly used the proceeds of fraud to buy five homes, a Maserati, put money in investment accounts, and lead a lavish lifestyle.

According to the US law, healthcare fraud, conspiracy to commit health care fraud, money laundering conspiracy and money laundering each provide for a sentence of up to 10 years in prison.

It also proposes three years of supervised release and a fine of up to $250,000 (KSh 30 million) or twice the amount of the money laundered.

The conspiracy to pay kickbacks and making false statements in healthcare matter each have a sentence of up to five years in prison as well as three years of supervised release.

It's just a form of repatriation for all the resources the West has stolen from this continent.
