Malawi to take border dispute with Tanzania to ICJ

    Malawian President Joyce Banda on Tuesday said her country will take a long-dormant border dispute with Tanzania to the International Court of Justice for arbitration.

    "The issue has gone too far and Malawi will seek international help to ensure that justice prevails," Banda told a news conference.

    Malawi and
    Tanzania have been bickering over a largely undeveloped swathe of Lake Malawi, where Lilongwe has awarded a licence to British firm Surestream to explore for oil in northeastern waters near Tanzania.


    "I have decided to take to the International Court of Justice to determine and resolve this wrangle," Banda said.


    She said her country had cancelled a fresh round of talks in
    Tanzania last month after Lilongwe discovered that Tanzania has produced a new map.


    "We decided to call off the follow-up dialogue meeting over the lake issue after we discovered that Tanzania had issued a new map with part of our lake."


    Last month's talks hosted by Malawi ended in a dead-lock after the two neighboring states said they had failed to reach a common ground and differences still remained.


    She said tensions were rising with reports that Malawi fishermen were being "abused and harassed."


    "It is serious now. We have been informed by Tanzania that our boats should stop sailing on the lake otherwise they will blaze them up," said Banda.


    Malawi claims ownership of the entire lake under a 1890 accord whose validity is disputed by Tanzania and wants a halt to the oil exploration currently under way to pave way for a diplomatic resolution.

    And the ICJ will rule as it did in the past that "It will be for the Parties... to fix the position of the [lake] and to define two points lying on the same parallel of latitude, such that a straight line drawn between these points will divide the expanse of the [lake] in equal proportions between the Parties."

    In this issue Tanzania needs to be a bull and stand her ground. There's nothing the ICJ can do if the parties involved in the dispute can't agree. Besides, this isn't the only border issue. The Japanese and Chinese haven't resolve their problems. So do the Chinese and the Philipines. There are territorial claims in the Arctic and Antactic, and the list goes on and on.

    Rais wa Malawi Bi. Joyce Banda ametangaza rasmi Nchi yake kujitoa kwenye mazungumzo na Tanzania kuhusu mzozo wa mpaka katika ziwa Nyasa.

    Sababu kuu ni kuwa serikali ya Tanzania haina nia ya dhati ya kufikia muafaka kutokana na:

    1/Kuzindua ramani mpya ya Tanzania inayoonyesha mpaka upo katikati ya Ziwa.

    2/Unyanyasaji ulioanza kufanywa na Tanzania dhidi ya wamalawi wanaotumia ziwa hilo kwa sasa.

    3/Upotoshwaji wa hali ya juu uliofanywa na Kikwete dhidi ya wamalawi kwenye hotuba yake kwa taifa mwisho wa mwezi wa september.

    Nadhani amesema kuwa analipeleka suala hili katika mahakama ya kimataifa. Hajazungumzia vita. Bado anatafuta majawabu ila kwa njia ya mahakama yakimataifa. Chamsingi ni sisi kujipanga kujibu hoja za wanasheria wake kule katika mahakama zakimataifa.

    Anasema anaendelea kuchukua ushauri kabla hajaenda mahakama ya kimataifa, mahali ambapo wadadisi wengi wanahisi ana nafasi kubwa ya kushinda.

    Na tayari amesha shauriana na Ban kim Moon kabla ya kutangaza kuvunja mazungumzo.

    Ni kweli suala la mpaka halina mjadala labda kama anataka kujadili jinsi ya kujiunga EAC au SADC, wakati dunia inafikiria kuungana yeye anafikiria mipaka tena iliyowekwa 1800 zama za biashara ya utumwa! Huyu mama ashukuru angekuwa amepakana na Sudan tayari angekuwa ameshapokea kichapo kutoka kwa Al-Bashir.

    Mazungumzo kwa serikali ya JK maana yake ni kuchelewesha muda ili upepo upite lakini sio kutafuta suluhu ya kudumu.
