Serikali imetoa hoja 3 kwenye kesi dhidi ya matumizi ya Kanuni za Maudhui ya Kimtandao, kuendelea Mei 28

1. Kwamba walalamikaji hawakuwa na maslahi kwenye maombi waliyofungua

2. Kwamba viapo vya walalamikaji vilikuwa na kasoro

3. Kwamba walalamikaji walikuwa na namna nyingine ya kulalamikia zile Kanuni nje ya Mahakama

The Application for Judicial Review that was filed earlier on 30th April 2018 by Jamii Media, Legal and Human Rights Centre, Tanzania Human Rights Defenders Coalition, Media Council of Tanzania, Tanzania Media Women Association and Tanzania Editors Forum was due to proceed today the 10th May 2018.

Prior to continuation of the case, the court delivered a ruling attached herein to the affect that, Tanzania Communication Regulatory Authority which is the second applicant in the application for injunction be restrained from enforcing the deadline of 5th May 2018 for registration of online bloggers, TV and other online forums following the promulgation of the Online Content Regulation, 2018.

Afterwards, and to the surprise of the applicants, The government through AG came with three preliminary objections:
1. That the applicants have no locus stand (not interested in the case)
2. That the affidavits by applicants were defective and
3. That the applicants had other remedies to opt for and not to go to the court foe judicial review.

The presiding judge had to dispose off the POs before embarking on the main application. Both counsels were heard for more than 9 hours. The court then ordered that the ruling on the POs raised will be delivered on 28th May 2018.

It is interesting to note that in the main application, applicants are seeking orders of certiorari (quashing the Minister's decision to make such Regulations) and Mandamus prohibiting him from making such decision going forward.

More updates on the ruling will follow on 28th May 2018 and the date of hearing of the main application will be set on the same day.
 
3. Kwamba walalamikaji walikuwa na namna nyingine ya kulalamikia zile Kanuni nje ya Mahakama

Kaaz kwelikweli, nilisikia TCRA kwa kushirikiana na wizara waliamua kutengeneza kanuni huku wakipuuza maoni ya wadau wote ikiwemo wananchi, sasa walitaka wahusika wakalalamike wapi kwengine kama wao hawakutaka kuwasikiliza!
 
Sasa si JF wameshinda? Halafu nashangaa, inakuwaje mtoa taarifa asokotwe badala ya taarifa yake kufanyiwa uchunguzi ili hatua kuchukuliwa?

Kama taarifa hazikuwa na ukweli, kwa nini wasingeshauriwa kufungua kesi ya madai?
 
Ungedadavua zaidi ingependeza sana. Lakini hapa umeeleza juu juu sana.

Je, una maana kwamba huu ndiyo utetezi wa mshitakiwa (serikali) kwa yale anayopingwa nayo mahakamani?

Na una maana kuwa, wao (washtakiwa) kwa hoja hizi wanaishawishi mahakama itupilie mbali pingamizi/kesi dhidi yao? Ndiyo maana yake siyo?
 
Kesi hii inafurahisha sana.

Kimsingi kanuni zinatungwa kuelekeza utekelezaji wa sheria iliyopitishwa na Bunge. Ikumbukwe hata wadai wanaiomba mahakama iziangalie kanuni kama zinaendana na taratibu za sheria, sio kuizuia sheria isitumike. Sasa zinapolalamikiwa kanuni wakati sheria yenyewe bado iko palepale sijui hii imekaaje.

Kanuni za utekelezaji sheria Mara zote zinaandaliwa na wizara husika kwa kushauliwa na Mwanasheria Mkuu wa Serikali, leo walalamikaji wanapinga hiyo si kazi ya Wizara.
