The Application for Judicial Review that was filed earlier on 30th April 2018 by Jamii Media, Legal and Human Rights Centre, Tanzania Human Rights Defenders Coalition, Media Council of Tanzania, Tanzania Media Women Association and Tanzania Editors Forum was due to proceed today the 10th May 2018.
Prior to continuation of the case, the court delivered a ruling attached herein to the affect that, Tanzania Communication Regulatory Authority which is the second applicant in the application for injunction be restrained from enforcing the deadline of 5th May 2018 for registration of online bloggers, TV and other online forums following the promulgation of the Online Content Regulation, 2018.
Afterwards, and to the surprise of the applicants, The government through AG came with three preliminary objections:
1. That the applicants have no locus stand (not interested in the case)
2. That the affidavits by applicants were defective and
3. That the applicants had other remedies to opt for and not to go to the court foe judicial review.
The presiding judge had to dispose off the POs before embarking on the main application. Both counsels were heard for more than 9 hours. The court then ordered that the ruling on the POs raised will be delivered on 28th May 2018.
It is interesting to note that in the main application, applicants are seeking orders of certiorari (quashing the Minister's decision to make such Regulations) and Mandamus prohibiting him from making such decision going forward.
More updates on the ruling will follow on 28th May 2018 and the date of hearing of the main application will be set on the same day.
