Immigration officials at the Namanga border post have been instructed not to allow Tanzanians into the country without permission.

The enforcement team is under instruction to ensure foreigners crossing the border have permits.

The new requirement seems to target Tanzanians following what Kenyans living in the neighbouring country underwent in early March.

"Immigration officers at the Namanga border began implementing the new rules on Wednesday," Kajiado county commissioner Harsama Kello told The Star by phone on Thursday.

He told The Star on Thursday that all foreigners must pass through immigration offices at the border.

"This is not a new law. It has been there and we now want to enforce it," he said.

"We have been reluctant to our neighbours because of the cohesion that has been in existence until they (Tanzania) decided to kick out our people."

Kello said the decision to apply the law was agreed upon by various stakeholders in government.

This was after President John Magufuli threw out Kenyans working and doing businesses in the country for lacking the requisite documents.

The county commissioner said Kenya will not arrest Tanzanians working in the country.

"We give them one week to seek requisite documents such as passports, work permits and residence permits as is specified by law."

Police have been instructed to take action against those found to have broken the law.

Kello said employers found to have engaged aliens who lack work permits will be fined Sh5 million.

The administrator said while Tanzania is charging East African residents Sh60,000 for work permits, Kenya will issue out the same freely.

It is estimated that there are more than 500, 000 Tanzanians living and working in Kenya, including those in their embassy in Nairobi.

Kello said Tanzanians control 80 per cent of businesses in Namanga town hence should not 'harass' Kenyans.

DOOR TO DOOR EVICTIONS

Alex Mutua, the Namanga assistant county commissioner, said the police and immigration officials will move from door-to-door to evict foreigners who lack permits.

This came after most bar owners at the border town released their workers back to Tanzania for fear of legal implications.

Kenyans prefer engaging Tanzanians because they accept lower wages compared to Kenyans.

In January, Magufuli introduced new work permit requirements for foreign nationals. The move caused unease in the region and saw the East African Business Council (EABC) call on Dar to reconsider measures.

The council said the directive contradicts the EAC Common Market Protocol.

The Tanzanian Prime Minister's office issued a circular requiring foreigners to obtain separate work and residency permits.

Lilian Awinja, EABC executive director, said EAC states should observe the protocol which allows free movement of people, goods, and services.

"Tanzania should reconsider the step of introducing the work permit fees in addition to the resident permit fees," he said.

"The government had progressively reduced and finally zero-rated these fees like the other East African countries," Awinja said.

As per the notice, work permits for those employed in Tanzania under Class B will now cost an additional $1000 over the usual $2,050 (Sh212,482).

Those with dependents will pay an extra $500 (Sh50,000) to obtain the dependents' pass.

The new requirement does not differentiate between EAC nationals and citizens of countries outside the region.

While Uganda, Rwanda, and Kenya have waived work permit fees for East African Community citizens to encourage free movement of labour, Tanzania maintains the restrictions for EAC citizens and other foreigners.

Work permit fees in Tanzania range between $2,000 (Sh200,000) and $3,000 (Sh300,000), a tidy sum for small and medium enterprise companies with low turnover.

In Burundi, it ranges from $60 (Sh6,000) to $84 (Sh8,400), Uganda charges $250 (Sh25,000) per year for work permits for missionaries, volunteers and $1,500 (Sh150,000) for businessmen and consultants.

Kenya, charges $1,976 (Sh197,600) for foreign workers.

Two Tanzanian companies have already been penalised for going against this requirement.

Textile firm Sunflag Tanzania was penalised $12,560 for having employees without work contracts while Lodhia Industries, which manufactures plastics and metal products, was fined $14,355.

The two companies were also penalised for employing foreign workers whose permits indicated different types of jobs contrary to what they are doing.

Awinja said longer and costly process of placing workers will impact negatively on businesses already grappling with high operational costs.

She said Tanzania should be pursuing policy reforms that reduce the overall cost of doing business.
