As some of the post-election violence suspects flew out of the country on Tuesday night to face their destiny at The Hague, they left behind an opinion poll showing that most Kenyans believe the ICC offers the best chance for justice.

Finance minister Uhuru Kenyatta and Public Service head Francis Muthaura were expected to fly out on Wednesday.

Former Police Commissioner Hussein Ali had taken an earlier flight Tuesday and was already in the Netherlands.

A poll, released Tuesday by research firm Synovate, showed that 61 per cent of Kenyans preferred the suspected masterminds of Kenya's post-election violence to answer to the charges at The Hague-based court.

This is a marginal increase from a December 2010 poll where about 60 per cent polled backed the ICC.

The December poll was conducted soon after chief prosecutor Luis Moreno-Ocampo made public that he intended to charge the six over the post election violence.

In the latest survey 24 per cent of those polled said they favoured a special local tribunal to try the suspects of the chaos that left 1,133 people dead and a further 650,000 people uprooted from their homes.

They, however, want the international community's participation in the local trial even if it takes a year to prepare.

The poll, carried out between March 27 and April 1, this year from 2,000 respondents, also showed a strong preference among Kenyans for justice, with only three per cent supporting amnesty being granted to the suspects. In the December poll, 14 per cent wanted forgiveness.

The poll was released on the day some of the Ocampo Six were due to fly to The Hague to honour summonses of the Pre-Trial Chamber.

Mr Ruto, Mr Kosgey and Mr Sang will make their initial appearance at The Hague at 9.30am (10.30am Kenyan time) on Thursday.

Mr Kenyatta, Mr Muthaura and former police chief Ali are scheduled to appear at 2.30pm (4.30pm) on Friday.

Charges against the six include murder, deportation, rape, inhuman acts, persecution and other acts of torture.

According to Synovate's lead researcher Tom Wolf, the rallies Mr Kenyatta and Ruto held in recent weeks have not changed the public's perception.

"In December when we asked the same question, the figure was 60 per cent, which is within the margin of error. That tells me that over the last three or four months, notwithstanding all the activity, there has been, statistically, no change in Kenyans' position on this except for the fact that in December, 14 per cent were in favour of amnesty," Mr Wolf said on Tuesday.

"My advice to anybody running a campaign of any kind is to have your rallies but not to judge how much support you have among the Kenyan people through rallies. That can be misleading unless you hire a researcher of your choice to do a survey for you."

Aside from the Ocampo Six, almost half the respondents favoured a special local tribunal to try other perpetrators of post-election violence.

The Hague option is supported by 80 per cent of respondents from Nyanza while Central and Rift Valley have the least support at 46 and 43 per cent respectively.

The journey to justice for the victims of Kenya's election violence starts on Thursday when three of the six key suspects appear before the International Criminal Court's pre-trial judges.

Suspended minister William Ruto, Tinderet MP Henry Kosgey and vernacular radio presenter Joshua Sang will be in the dock of courtroom 1 at exactly 10.30 am Kenyan time.

It will be a brief session during which three Pre-Trial Chamber judges will identify the suspects, read each of them the charges and inform them of their rights as per the Rome Statute which established the ICC.

With the world watching the proceedings on internet, the suspects will be escorted to the ICC building at The Hague by 40 MPs.

Mr Ruto, Mr Kosgey and Mr Sang will not be required to take pleas during the session that will be held in an open court.

Anxious Kenyans who will want to join those who have flown to The Hague in following the proceedings can turn to the web streaming on the internet; thanks to the ICC.

Apart from the MPs, civil society members, human rights activists and Kenyans abroad have gathered at The Hague to witness the court appearance.

Judges Ekaterina Trendafilova, Hans-Peter Kaul and Cuno Tarfusser will also use the initial appearance to set a date of the hearings to confirm the charges that ICC Prosecutor Luis Moreno-Ocampo has filed against the suspects over the 2008 poll chaos.

The Ocampo Six are not under obligation to attend the hearings, during which the two sides will argue out the charges.

"The confirmation hearing is held in the presence of the Prosecutor, the person being prosecuted, and his or her counsel. The suspect can waive his or her right to be present at this hearing," said Mr Fadi El Abdallah, the ICC associate legal outreach officer.

The charges can either be confirmed or not. Should the charges be confirmed, the case will move from the Pre-Trial stage to the trial stage where the Ocampo Six or any of them who will not have been acquitted become the accused.

However, they remain innocent until the final ruling declares them innocent or guilty

Only if charges are confirmed by a Pre-Trial Chamber, a case is committed to trial before a Trial Chamber, and the person is considered as an ‘accused', but benefits still on the presumption of innocence until a final sentence on the guilt or the innocence of this person," said Mr El Abdallah.

Mr Ruto, Mr Kosgey and Mr Sang who were summoned to The Hague on March 8, flew out on Tuesday night in the company of MPs and family members.

On Friday, it will be the turn of Deputy Prime Minister Uhuru Kenyatta, Civil Service boss Francis Muthaura and former Police Commissioner Hussein Ali to take to the stand in the same court at 4.30 pm.

While Mr Kenyatta and Mr Muthaura flew out separately on Wednesday, Maj Gen Ali arrived at The Hague on Tuesday in the company of Attorney General Amos Wako and Chief Public Prosecutor Keriako Tobiko.

Lawyers for the Ocampo Six will be handed documents relating to the charges and testimonies of witnesses against them.

Defence lawyers have vowed to appeal a decision by the ICC not to reveal the identity of the witnesses.

Mr Ruto, Mr Kosgey and Mr Sang are facing charges of murder, evictions and persecution in Turbo town, the greater Eldoret area (Huruma, Kiambaa, Kimumu, Langas, and Yamumbi), Kapsabet town, and Nandi Hills town.

Mr Kenyatta, Mr Muthaura and Maj Gen Ali face five counts of murder, evictions, rape, persecution and other inhumane acts that were committed in Naivasha and Nakuru.

However, Justice Kaul disagreed with the majority ruling arguing that the crimes committed during the post-election violence were outside the mandate of the ICC and should be tried by Kenyan courts.

The government has filed an application to challenge the admissibility of the case and the ICC jurisdiction. However, its request to be heard either on Thursday or Friday as the Ocampo Six make the initial appearance was rejected.

Mr Kenyatta has hired British lawyers led by Queens Counsel Steven Kay to defend him. He will be assisted by Gillian Higgins and Benjamin Joyes who will manage the case.

Mr Kioko Kilukumi will lead Mr Ruto's defence assisted by Mr Katwa Kigen and Dr Kindiki Kithure. Mr George Oraro leads Mr Kosgey's defence team which has on board lawyers Julius Kemboy and Allan Kosgey.

Mr Muthaura will be defended Mr Karim Ahmad Khan (counsel), Kennedy Ogeto (associate counsel) and Muriuki Mugambi (associate counsel).

Maj Gen Ali has hired Mr Evans Monari (counsel), Gershom Otachi ( associate counsel) and Gregory Kehoe (associate counsel) to represent him.

Mr Katwa Kigen will also represent Mr Sang. He will be assisted by Mr Joel Kimutai Bosek and Philemon Koech-Busienei.

International Criminal Court chief prosecutor Luis Moreno-Ocampo has sought tough new conditions against three individuals summoned over the post-election violence.

A warrant of the arrest is to be issued to Deputy Prime Minister Uhuru Kenyatta, Head of Public Service Francis Muthaura and Postmaster General Hussein Ali if they ignore the conditions.

In a request made to the court, the prosecutor wants the three to be appearing in person before the Chamber at least once every six months. The suspects have to certify before the Chamber, under oath, that they have complied in full with all the conditions.

Mr Muthaura, Mr Kenyatta and Major General Ali should also submit complete financial information.

They are to further not make any public statements that contain or can be construed as containing "an open or veiled threat to actual or prospective witnesses or victims"

"Based on the authority set out below, the Prosecution asks that the Chamber add additional conditions to ensure that the suspects comply with the obligations," Mr Moreno-Ocampo stated.

The prosecutor further wants the court to order Mr Muthaura, Mr Kenyatta and Major Gen Ali to provide the Chamber with all residential and office addresses, email addresses, and telephone numbers.

If the court agrees with the prosecution, each suspect shall verify in a signed statement, under oath, the accuracy of the information given to the registry on a monthly basis. They are to report to the Registry any change in the information.

"Any misstatement in a report, or any failure to provide timely, accurate, and complete information shall result in the issuance of a warrant and revocation of the conditions of the suspect's release," Mr Moreno-Ocampo said.

The financial information, given under oath, is to enable the Chamber to determine the appropriate bond and to ensure its enforceability; and that the suspect can then post bond or provide real or personal security or surety in an amount sufficient to guarantee his future appearance at all required hearings of the Court.

Due to their senior positions of authority in Kenya, the prosecutor said any statements that the suspects may make concerning the violence or their cooperation with the Court could, intentionally or unintentionally, be regarded by actual or potential witnesses as pressure to cease cooperation with the Court, or impact future witnesses' willingness or desire to cooperate.

If given, the order would mainly affect Mr Kenyatta who, with Mr William Ruto, have been traversing the country discussing the ICC cases. The two had even organised a rally in Nairobi on their return from The Hague.

The appearance within six months is to enable the Chamber to determine if a suspect did not comply in full within a timeframe set by the Chamber and/or made a false statement of compliance either in person or in a written statement, so that a warrant of arrest can be issued and the conditions of his release revoked.

The information given by the suspects shall be verified with the Registry the first day of every month. Any change in the information provided shall be reported to the Registry within 48 hours of the change.

Mr Muthaura, Mr Kenyatta and Major Gen Ali are also supposed to disclose the identities of all to whom they owe money or property.

The prosecutor further requires he suspects to post bond in a sum to be determined by the Chamber, for the purpose of guaranteeing their appearances at the Court.

On March 8, 2011, ICC Pre-Trial Chamber II summoned six individuals to appear before the court. The others are Tinderet MP Henry Kosgey and broadcaster Joshua Sang.

The Chamber said the suspects' arrest was not necessary, so long as they complied with certain restrictions imposed on their conduct.

In particular, the Chamber directed that the suspects shall have no contact, directly or indirectly, with any person who is or is believed to be a victim or a witness of the crimes and that they shall refrain from corruptly influencing a witness or tampering with or interfering with the Prosecutor's collection of evidence.

Miongoni mwa washukiwa hao sita ni naibu waziri mkuu Uhuru Kenyatta, aliyekuwa waziri wa elimu ya juu William Ruto na mkuu wa utumishi wa umma Francis Muthaura.

Mashitaka
Mahakama ya ICC imeeleza kwenye wavuti wake kuwa washukiwa wanatakiwa kufika mbele ya mahakama kwa ajili ya kuthibitisha utambulisho wao, kuhakikisha wamefahamishwa kuhusu uhalifu inaodaiwa waliufanya, na pia kuhusu haki walizo nazo chini ya sheria ya mkataba wa Roma iliyoanzisha mahakama ya ICC.

Ruto, Kosgey na Sang wanatazamiwa kufika mbele ya mahakama leo saa tatu asubuhi kwa saa za Uholanzi, ilhali Bwana Kenyatta, Muthaura na Hussein Ali wanatazamiwa kufika mbele ya mahakama siku ya Ijumaa saa nane alasiri.

Baadhi ya mashtaka yanayowakabili ni mauaji, kuwahamisha watu kwa lazima, ubakaji, udhalilishaji na kuwatesa watu wakati wa ghasia hizo.


Ghasia hizo za nchini Kenya zilizuka kufuatia madai kwamba wafuasi wa Rais Mwai Kibaki walikuwa wanajaribu kuiba kura.

Hali ilitulia baada ya makubaliano ya kuunda serikali ya umoja wa kitaifa, ambapo Bw Kibaki alichukua nafasi ya urais huku Bw Odinga akishika wadhifa wa Waziri mkuu.

Kwenye makubaliano hayo yaliyoongozwa na aliyekuwa katibu mkuu wa Umoja wa Mataifa Koffi Annan, washukiwa walitakiwa kushtakiwa katika mahakama za nchini Kenya, na ikishindikana kesi zipelekwe katika mahakama ya ICC.

Mauaji
Mahakama ya ICC inadai kwamba Bw Ruto na Bw Kosgey ambao walikuwa miongoni mwa viongozi wakuu wa chama cha Orange Democratic Party ( ODM) wakati wa ghasia hizo walipanga njama za kihalifu mkoani Rift Valley za kuwashambulia watu waliotambulika kama wafuasi wa chama cha Party of National Unity (PNU).

Mtangazaji Joshua Arap Sang naye anatuhumiwa kushiriki njama hizo kwa kutumia kipindi chake cha redio kuwakusanya wafuasi na kutoa ishara kwa washiriki wengine wa mipango hiyo kuhusu wakati na mahali pa kufanya mashambulizi.

Bw Kenyatta, Bw Muthaura na Bw Hussein Ali wanatuhumiwa na mahakama ya ICC kwa makosa ya mauaji, kuhamisha watu kwa lazima, kuwatesa watu na ubakaji.

ICC inadai nguvu za kupindukia zilitumika katika kujaribu kuzima machafuko, na kwamba mpango ulifanyika wa kuagizia kundi lililopigwa marufuku la Mungiki kufanya mashambulizi ya kulipiza kisasi.

Wakati huo huo, mahakama hiyo ya ICC imekataa ombi lililowasilishwa na serikali ya Kenya la kutaka hoja ya kupinga uhalali wa kesi zinazowakabili washukiwa hao sita isikilizwe kwa wakati mmoja na kesi hizo.

Kwa niaba ya serikali ya Kenya, mawakili wawili kutoka Uingereza Sir Geoffrey Nice na Rodney Dixon waliwasilisha mbele ya mahakama hiyo hoja ya kupinga uhalali wa kesi za washukiwa hao sita, kwa madai kwamba idara ya mahakama nchini Kenya haijashindwa kushughulikia kesi hizo.

Serikali ya Kenya
Serikali ilitaka ipewe fursa ya kuzungumza mbele ya mahakama wakati wa kufikishwa kwa washukiwa hao sita.

Lakini majaji watatu wa mahakama hiyo Ekaterina Trendaflova, Hans-Peter Kaul na Cuno Tarfusser walitoa uamuzi kwamba serikali ya Kenya haimo katika kesi hiyo, na kwa hivyo haiwezi kupewa fursa ya kuzungumza wakati wa kesi za washukiwa.

Badala yake waliitaka serikali ya Kenya kuandaa taarifa ya maandishi inayotakiwa kuwasilishwa mbele ya mahakama kabla ya tarehe 28 mwezi Aprili.

Kenya inataka kesi hizo ziahirishwe ikidai hatua hiyo itaipa muda wa kuunda idara ya mahakama itakayoweza kufanya uchunguzi na kuwashtaki washukiwa kufikia mwezi Septemba.

Mkuu wa ofisi ya Kenya ya shirika la kimataifa la kutetea haki la International Centre for Transitional Justice Njonjo Mue ameiambia BBC kwamba hakuna uwezekano wa Kenya kufaulu katika hatua hiyo.

"Kulingana na mkataba wa Roma, hoja kama hiyo inaweza kukubalika tu ikiwa serikali imeshafanya uchunguzi na kuwafungulia washukiwa mashtaka yanayowakabili mbele ya ICC. Kwa sasa Kenya haijafanya lolote, imepoteza nafasi nyingi.'' Alisema Bwana Mue.

Karibu wabunge 40 kutoka Kenya wamesafiri kwenda Uholanzi kuwasindikiza washukiwa hao.

Mahakama ya ICC imetenga viti 70 katika ukumbi wa umma kwa ajili ya idadi kubwa ya Wakenya wanaotazamiwa kufika mahakamani kushuhudia kesi hiyo.

Badala ya kuruhusu vyombo vyetu vya habari kuripoti live matukio ya jambo la kihistoria na nyeti zaidi ndani ya mipaka ya nchi yetu tena inayotuhusu zaidi ndio unakuta serikali ya CCM inagoma.

Lakini kwenye kuruhusu anga ya Tanzania kupokea mawimbi ya matngazo ya wauaji wa raia wenzetu wa nchi jirani ya Kenya walikonyofolea muswada tata sasa matangazo kurushwa live kwenye TV zetu ruksa ...
