Three publications published by the Media Council of Tanzania have been launched at a colourful ceremony held at Kisenga Hall in Dar e s Salaam.

The Chairperson of the Ethics Committee of the Council, retired judge, Juxon Mlay, launched the publications - -State of the Media Report 2017/2018;Common Ethical Transgressions in Media and Ruvuma: A case of compromised journalism.

Retired Judge Mlay commended the Council for publishing the three publications and also underscored that the main reason for protecting the media was to ensure that the public is informed.

Citing the Report on Ruvuma: A case of compromised journalism, Judge Mlay said the journalists who were reported to be used to refute a report by another journalist - their act was akin to an attempt to balance an unbalanced story.

The original story in the report by Journalist Geofrey Nilahi that reported on bad shape of schools and bridge in some villages of Peramiho constituency, was not balanced and likewise the stories by other journalists who went to the villages later were not balanced as well.

The State of Media Report was written by Dr. Joyce Bazira, Ally Uki and Henry Muhanika while Common Ethical Transgressions was written by Pudenciana Temba and Attilio Tegalile and Ruvuma ; a case of compromised journalism was written by Hamis Mzee, Lucas Liganga and Florence Majani.

The three books were reviewed by Pili Mtambilike, Absalom Kibanda and Attilio Tagalile respectively.

Earlier, the Executive Secretary of the Media Council of Tanzania, Kajubi Mukajanga said the Council was committed to publish the state of the media every year for the last nine years.

The report on state of the Media reflects on the media landscapes in the country.

As for the publication on investigation of the Ruvuma case, he said the Council is mandated by its constitution to carry out investigation on matters of interest to media development and make the report public.

As for the Common Ethical Transgressions, Mukajanga said related it to media monitoring which is conducted by the Council on daily basis.

We want everyone to use the book and be able to observe and note transgressions committed in the media.

MCT dismayed by House Speaker order barring scribes

The Media Council of Tanzania (MCT) has expressed dismay over an order by House Speaker, Job Ndugai barring journalists covering the on-going session of the National Assembly in Dodoma from interviewing Members of parliament who had walked out in protest from the august house on April 5, 2019.

The MCT position was posted on online platforms immediately after Speaker announced the order.

The MPs mainly from the largest opposition party CHADEMA walked out in protest after Bunge passed a motion of barring MP for Arusha, Godbless Lema who was blamed for repeatedly confirming the statement that Bunge was ‘weak’ which is taken as affront to the house by House Speaker and Members of the ruling party- CCM.

The statement was first made the Controller and Auditor General Prof. Mussa Assad and was initially repeated by Chadema MP for Kawe, Halima Mdee.

Bunge has moved a motion not to work with Prof. Assad and Mdee was suspended from attending two session of Parliament while Lema has been suspended for three sessions.

When the opposition MPs waklked out from Parliament, first the Speaker ordered to shut them for the whole of the day and also ordered journalists not to interview them.

He warned that any journalists who would talk with any of the MPS who boycotted the Hous session will have his identity for covering Bunge withdrawn and will be prohibited from covering it.

CoRI discusses pertinent pressing national issues

The Coalition on the Right to Information (CoRI) met on April 25,2019 under its chairperson, Kajubi Mukajanga discussed pertinent issues including the Statistics law and how it affects the operations of its member organisations.

Other issues discussed at the meeting which is the second for the Coalition this year, included engagement with government on amending the Media Services Act of 2016 following the ruling by the East African Court of Justices that most of its provisions violated the Agreement of East African Community suppressing freedom of Information and Expression.

The meeting was briefed on the recent visit by a delegation from the International Press Institute (IPI) which met various leaders including the Prime Minister, Kassim Majaliwa, Speaker of the National Assembly Job Ndugai, Minister for Information, Culture, arts and Sports, Dr. Harrisson Mwakyembe and the Director of information and Chief Spokesman of the Government, Dr.Hassan Abbas.

The CoRI meeting which was well attended also discussed the Coalition’s participation in the Commemorations of the World Press Freedom Day to be held in Dodoma on May 3, 2019.

The issue of the disappearance of journalist Azury Gwanda was also discussed and members considered different options to pursue the matter on his whereabouts.

The meeting, the second for CORI this year was attended by representatives from Tanzania Editors Forum (TEF) , JamiiForums, Tanganyika Law Society (TLS), Legal and Human Rights Centre (LHRC), Tanzania Human Rights Defenders Coalition(THRDC). Twaweza Sikika and Media Council of Tanzania (MCT) was held at the boardroom of the Council.

During its first meeting which held on February 7, 2019 the Coalition resolved to strengthen its activities for year 2019 including increase its membership base, a move that is expected to boost its public engagement.

Editors, Human Rights Defenders and Lawyers spent almost the whole day on Saturday March 30, 2019, to deliberate their roles in curbing Press Violations and Freedom of Expression in Tanzania.

The event organized by the Media Council of Tanzania (MCT) brought together 40 participants.

Raising public awareness through mobilization and promoting solidarity among the different actors were among the crucial steps proposed during plenary sessions and group discussions during the encounter.

Media Consultant Pili Mtambalike and Neville led discussions on the Role of Editors and Media Owners in curbing the violations on press freedom and freedom of expression while discussions on the role of lawyers in curbing the same were led by Advocate Geline Fuko.

Kucheleli Machumbana from Tanlap led group discussions on the role of Civil Society Orgaisations.

Advocates Humphrey Mtuy from MCT and Jones Sendodo from the Tanzania Human Rights Defenders (THDRC) presented an overview of the state of Press Violations in Tanzania what has been so far.

Sendodo told the gathering of many instances where journalists have been harassed and arrested and steps taken by some organizations like MCT and THRDC in providing attorneys to defend those charged in court.

Speaking earlier and in between contributions, the Executive Secretary of the Media Council Kajubi Mukajanga emphasised the need of having a nation that talks adding that a nation that does not talk is a dead nation.

Touching on the victory gained by the ruling of the East Africa Court of Justice (EACJ) in ordering the Tanzania government to amend the Media Services Act (MSA) of 2016 to make it comply with the Treaty of Establishment of East African Community, Mukajaga said under said that rule will usher positive change.

There is no way; the authorities would dismiss the ruling from that court whose rulings prevails over that of national courts.

At the end of the one day engagement of editors, activists and lawyers, Mukajanga said bad journalism cannot be treated by bad law.

Likewise he said bad journalism is not a right and that good laws should be put in place but not laws that subject journalists to ridicule.

Tanzania Govt ordered to make MSA 2016 comply with EAC Treaty

Three organisations – The Media Council of Tanzania (MCT), Legal and Human Rights Centre and the Tanzania Human Rights Defenders Coalition (THRDC) have succeeded in their challenge of the Media Services Act 2016.

The East Africa Court Justice (EACJ) ruled on March 28,2019 that provisions over 16 sections of MSA violate articles 6(d) and 7(2) of the Treaty for the establishment of the East African Community.

Reading the ruling on before of a panel of five judges, Justice Charles Nyachae also said that the Court directs the Tanzania Government to take necessary measures to bring the Media Services Act into compliance with Treaty for Establishment of the East African Community.

Judge Nyachae said in most instances, the Applicants presented sound and compelling arguments on freedom of expression, press freedom and many other contested issues regarding the MSA 2016 including the excessive powers bestowed to the Minister for Information while the Respondents, the Tanzanian government did not largely convince the Court and it dismissed some of their arguments as vague or inappropriate.

Article 6(d) of the East African Community Treaty states that the fundamental principles that shall govern the achievement of the objectives of the Community by the Partner States shall include (d) good governance include adherence to the principles of democracy, transparency, social justice, equal opportunities , gender, equality as well as the recognition, promotion and protection of human and peoples rights in accordance with the provisions of the African Charter on Human Rights.

On its part Article 7(2) states that Partner States undertake to abide by the principles of good governance, including adherence to the principles of democracy, the rule of law, social justice and the maintenance of universally accepted standards of human rights.

The provisions and sections of the MSA 2016 which were declared by the court to violate the East African Community Treaty are 7(3)(a),(b),(c),(f),(g),(h),(i) and (j).

Others are section 19, 20 and 21, Sectyions 35,36,37,38,39 and 40, Sections 50 and 54m 52, 53, 58 and 59.

The court also dismissed arguments that it had no jurisdiction to hear the case and also claims by the respondents the applicants had filed the case beyond the requisite legal period

Judge Nyachae said the EAJC has exclusive jurisdiction to interpret and apply the Treaty.” This is consistent with article 32(2) of the Treaty that provides: “ Decisions of the court on interpretation and application of this Treaty shall have precedence over decisions of national courts on a similar matter”.

The panel of judges was led by Principal Judge Justice Monica Mugenyi, Justice Dr. Faustine Ntezilayo,Justice Fakih Jundu and Justice Audace Ngiye.

”This is historic decision”, declared the Executive Secretary of the Media council of Tanzania, Kajubi Mukajanga after the court decision.

He said that democracy has prevailed adding that the ruling was good for press freedom and that media practitioners should now exhibit professionalism.

All along we were saying that this law was bad, the court justifiably proved our case, he said.

Advocate Fulgence Massawe for the Applicants said that “we have successfully reached the end of our journey that we had started on January 11, 2017 when we filed the case challenge the MSA 2016”.

It has ended with huge victory and we are now awaiting for the implementation of the court ruling.

Other advocates for the applicants who were in court during the ruling were Mpare Mpoki and Jebrah Kambole .

A delegation from the International Press institute (IPI) visited the Media Council of Tanzania on April 4, 2019 and held talks with the Council’s Executive Secretary, Kajubi Mukajanga.

The IPI delegation comprised Board Vice Chairperson, Khadija Patel , who is also Chief Editor of the Mail and Guardian of South Africa, Carsten von Nehman a member of IPI and Head of Training Department of Deutsche Welle Academy of Germany, IPI Deputy Director, Scott Griffen and Director of Advocay Ravi R Prasad.

Mukajanga said talks with the IPI delegation centred on the media situation in the country and its future.

Media engagement with the government was emphasised with the aim of promoting quality media in the country.

They also discussed how IPI can contribute in the development of media and promoting further engagement with the government.

The IPI team is reported to have been impressed with the r recent ruling of the East African Court of Justice (EACJ) on the Media Services Act of 2016 ordering the government to make it comply with the Treaty establishing the East African Community (EAC).

The ruling faulted 16 sections of the law and ordered they be amended.

The Media Council of Tanzania, Legal and Human Rights Cente (LHRC) and the Tanzania Human Rights Defenders Coalition (THRDC) successfully contested again the law in the EACJ which they claimed was retrogressive as it suppresses freedom of expression and the media in total negation of human rights.

During the talks with IPI delegation Mukajanga was accompanied three officials of the Council – Humna Resources Manager, Ziada Kilobo and Programmes officers, Paul Mallimbo and saumu Mwalimu.

The delegation was accompanied by their hosts, the Acting Chairperson of the Tanzania editors Forum (TEF) and Secretary, Neville Meena.

On Friday April 5, 2019 the IPI delegation held talks with members of the Coalition on the Right to Information (CORI) made of 11 institutions, chairmed by MCT.

During the meeting held at the Holiday Inn in Dare s Salaam, the two sides discussed on how to continue engagement with the government on amending media legislations to improve them for the better.

IPI pledged support in these endeavours.
