Mara kibao nimeona ukitumia maelezo haya:- Ikiwa local government itawatoza kiasi, blaa... balaa!
tafadhali nakuomba unipe somo hapa kidogo maanake navyofahamu mimi hizo levy zimepangwa ama hupangwa na serikali kuu. Local government hawana sauti kabisa ktk miradi hii ila hupokea kile wanachopewa kama ilivyoagizwa toka huko juu.
Ndio maana hata ktk mikataba yote hawakuhusiwa kutoa madai/maamuzi ya aina yeyote. Kwa hiyo tunaposema local government kuwatoza wawekeshaji wa madini nadhani tunatafuta njia ya mkato kupunguza uzito wa scandal nzima ya madini.

Mkandara ninachojaribu kufanya ni kutafsiri mkataba "incontext" ya mkataba wenyewe siendi nje ya hapo unless kwa reference ambayo nayo imerejewa na mkataba mfano (mkataba unaposema kodi itatozwa kulingana na sheria ya income tax ya 2004 etc, basi hapo naichungulia hiyo sheria inasemaje halafu naendelea kwa vipengele vingine).

Sasa iwapo Barrick wameukubali mkataba huo basi ni kwamba wamekubali kulipa kiasi hicho kisichoexceed dola laki mbili kwa local government( hapo usiulize serikali zamani ilikuwa inafanyaje au huwa inafanyaje, bali angalia ndani ya mkataba, mkataba unasema nini?).nadhani(sina uhakika) ndo maana serikali labda inasema mkataba huu wa buzwagi ni tofauti na mikataba mingine. (ila sijui kama katika mikataba mingine wameweka limit ya kiasi kitakachotozwa na local government au kama serikali kuu ndo itakusanya kodi yote halafu iigawie hiyo local government kiasi fulani)

1. Kazi ya Bunge ni kutunga sheria na kuhoji serikali kwenye mambo yote ikiwa ni pamoja na kutofuata sheria zilizotungwa na bunge!.

2. Serikali yetu na zingine duniani hazilazimiki kila zikitaka kuingia mkataba wa mkopo au wa madini au etc... kuliarifu bunge,,, tofautisha hivyo vitu viwili...

3. Bunge lina haki, kama sheria na kanununi hazikufuatwa kwenye kuingia mkataba kumhoji waziri!

Ukiona mtu mzima na akili zake anatetea mikataba kama hii ya serikali lazima ufahamu anatakiwa kwenda kuangaliwa akili zake kama ni timamu kule Mirembe, kama si hivyo anakubali kupewa pipi na vikaragosi ambao wakati wa watemi walikuwa wanatuita black monkeys. Cha kushangaza hizo peremende hata haziwezi kumuhakikishia kutokwenda Segerea au Ukonga.

Did Zakia Meghji lie to the Parliament?

The announcement by one of the Tanzania's largest gold mines that it expects to pay corporate tax for the first time in 2011 indicates that the Finance Minister misled the Parliament earlier this year.

Anglo Gold Ashanti Ltd stated in London this week that Geita Gold Mine (GGM) will start paying corporate tax by 2011, 11 years after the giant mining firm started operating in the country.

The company's Country Manager for Tanzania Hatibu Senkoro reaffirmed that GGM was set to start paying corporate tax in the next four years.

This contradicts the Finance minister's claims in Parliament in February, in which she said three Gold Mines - Geita Gold Mine, Barrick and North Mara were already paying corporate tax to the government.

�We know that there are some companies that have already started paying taxes, for example, corporate tax. One example is Bulyanhulu which, during 2006, paid corporate tax of Shs1.12 billion.

North Mara Gold Mine also paid Shs9.0 billion,� Minister for Finance Zakia Meghji told the Sixth Parliamentary Session of the House earlier this year.
Geita Gold Mine, she further said, paid Shs1.0 billion in 2006 as corporate tax.

Contacted to explain why she misled the august House, Meghji told the Sunday Citizen on Friday: "I know the matter, but at the moment I can't say anything... I have just arrived from Singida, call me later."

Thereafter, her phone kept ringing without being answered. It was thereafter switched off the whole of yesterday.
Earlier in the year, soon after her goof in Parliament, Meghji insisted that what she told the House was correct.

She told the Sunday Citizen in March that the figures that she presented in Parliament were provided to her by Large Tax Payers Department of the TRA. She had then showed this paper the said documents, which listed Bulyanhulu and Mara Gold Mine as having submitted corporate tax in 2006.

But it has come to pass that even Barrick Corporation, which owns both the Bulyanhulu and Mara Gold mines, has not paid any corporate tax.
Meghji claimed that in 2006, the mines started making profit. But Barrick indicates it recorded loss in 2006.

The company has only been paying royalty, income tax and �goodwill tax'. Barrick Corporation Public Relations Officer at the time, Sauda Simba Kilumanga, told the Sunday Citizen then that the company has been paying �goodwill tax' of US$7million as response to President Kikwete's concern that the nation was not benefiting from the mining industry. In any case, �goodwill tax' is meant to offer some kind of compensation for not contributing significantly to the government coffers. If corporate tax was being paid, the very idea of �goodwill tax' would not emerge.

GGM, on the other hand, paid Shs33.6 billion (US$25.85 million) to the government as taxes and royalties, excluding corporate tax during the year that ended in December 2006, following a major production setback experienced by the mine during that period. The production fell down to 308,000 ounces, down from 600,000 ounces recorded in 2005. �Anglo Gold Chief Executive Officer Bobby Godsell has described GGM as one of the most profitable mines among the more than 20 owned by the company globally.

The mine is one of the biggest open pit mines in Africa and has the capacity to produce 660,000 ounces of gold valued at US$363 million (at the company's gold price of US$550 per ounce).

But it will only start to pay corporate tax in the next four years to come.

In fact, Commissioner for Minerals Dr Peter Kafumu told Sunday Citizen in March that no corporate tax had been paid by mining companies last year.
�Corporate tax will be paid when they (the mining companies) make profit, otherwise they cannot pay,� he said then.
�A review of mining development agreements and fiscal regime for the mineral sector, undertaken by the Ministry of Energy and Minerals in June 2006 states: �Despite the fact that the major gold mines have been operational in Tanzania for over five years now, and the gold price in the world market has recorded a steady rise over the time, none of the mining companies has declared taxable income.''

Corporate tax is the major source out of which the country benefits from the mining sector. Once a mining company starts making profit, under the Income Tax Act 2004, its total income must be taxed at the rate of 30 per cent. This is the standard corporate tax rate in Tanzania. To check the credibility of the mining operations, the government in 2003 contracted a foreign audit company, Alex Stewart (Assayers) Business Government Corporation (ASA) to monitor gold mining companies.
Their report, published first by the Sunday Citizen last year, showed that gold mining companies were notorious for
under-declaring profits so as to dodge paying corporate tax.
Earlier this year, the Parliamentary Public Accounts Committee (PAC) undertook to verify these allegations and presented a report to the House in February substantiating claims of tax cheating.

Responding to that report in Parliament, Meghji said the ASA report was a preliminary one and since Exit Meeting had not taken place (where auditor sits with those being audited to provide an opportunity for explanation of discrepancies in the accounts), PAC assertion that the government had lost Shs1trillion from gold miners was not correct.
She said further that two of the three giant Barrick Corporation mines as well as the GGM have started declaring profits and have paid corporate tax.
Corporate tax payment has been delayed mainly by an inclusion of a �15 percent additional capital allowance on unredeemed capital expenditure' clause in the Income Tax Act.

The 15 per cent additional capital allowance on unredeemed capital basically means the government is each year gifting the miners 15 per cent of the capital yet to be recovered by them.

This is to say the companies take much longer to recover their initial investment and hence, during all this period, they do not declare profits, so they do not pay corporate tax. Some key players in the mining industry this week told the Sunday Citizen that the controversial 15 per cent Clause was put in the Mining Act and mining contracts because the World Bank recommended it.
�We didn't ask the government to give it to us� we knew that this Clause was really hurting the country's economy by denying it more taxes from mining industry, but our hands were tied,'' a senior official from Tanzania Chamber of Mines told the Sunday Citizen this week.
The official further added: "It is only right for the government to abolish this Clause and we have no objection to that.''

Tax experts believe that without removing the controversial 15 percent Clause, no significant corporate tax would be paid during the lifespan of any gold mine.

Kwa hiyo basi kila mwananchi ataweza kupata ounce moja (1) kwa takriban miezi 23 au chini kidogo ya miaka miwili.

Je hivi ni kweli pamoja na vifaa vyetu butu hawa raia uchimbaji wao wangelikuwa wanapata ounce moja kila baada ya miaka miwili? Hii ni mali ya WTZ iweje leo wadhulumiwe na makampuni kutoka nje?

ARTICLE 2 AGREEMENT

2.1 This agreement shall constitute a "development agreement" within the meaning of section 10 of the Act and it adds to and modifies the terms and conditions of the Special Mining Licence as the context thereof may require.
