Mahakama ya Rufani ya Tanzania siku ya leo 05/08/2020 inatarajiwa kukata mzizi wa fitina kuhusu makosa yote kuwa na dhamana ama la!.

Ikumbukwe kuwa tarehe 18 May 2020 Mahakama kuu ya Tanzania ilikitangaza kifungu cha 148(5) cha Sheria ya Mwenendo wa Makosa ya Jinai, yaani The Criminal Procedure Act (CPA) kinachozuia dhamana kutolewa kwa watuhumiwa wa baadhi ya makosa kama vile uhujumu uchumi, madawa ya kulevya na mauaji ya kukusudia kuwa kinyume cha katiba. Kwa mujibu wa Mahakama Kuu kifungu tajwa kinapingana na Ibara ya 13(6)b na 15(2) za katiba ya Jamhuri ya muungano wa Tanzania ya mwaka 1977. Kesi hiyo ilikuwa imefunguliwa na Wakili Dickson Paulo Sanga.

Sambamba na kukitangaza kifungu hicho cha CPA kuwa batili Mahakama kuu ili ipatia serikali muda wa miezi 18 kufanya marekebisho ili makosa yote yawe na dhamana.

Kufuatia maamuzi hayo Mwanasheria Mkuu wa Serikali alikata rufaa kwenda Mahakama ya Rufani kupinga hukumu hiyo, ambapo hukumu ya rufaa hiyo itatolewa leo.

In a judgment delivered this morning, the court of Appeal of Tanzania has quashed the decision of the High Court in Dickson Sanga’s Case therefore declaring that section 148(5) of the Criminal Procedure Act is in compliance with the limitations set under the constitution of the United Republic of Tanzania.
