Former Ugandan VP in jail on corruption charges

The Anti-Corruption Court was the scene of tears and drama as former Vice President Gilbert Bukenya was sent to Luzira Prison after he was committed to the High Court for trial and his bail cancelled. Prof. Bukenya is charged with abuse of office for his role in the award of a deal worth Shs9.4b to supply 204 executive vehicles four years ago during the Commonwealth Heads of Government Meeting to Motorcare.

Despite protests from Prof. Bukenya’s lawyer, Mr MacDusman Kabega, challenging the powers of the Inspector General of Government to commit his client, Magistrate Irene Akankwasa cancelled his bail and sent him to Luzira. “The accused person is hereby committed to High Court. His bail elapses and he is remanded to custody,” held Ms Akankwasa.
Hit by the reality of prison, Prof. Bukenya broke down, tears rolling down his cheeks.

On his Facebook page, in a comment posted minutes later, Prof. Bukenya cut a forlorn image: “My friends, I have been remanded to Luzira Prison as I have been committed to the High Court and my bail has been cancelled. However, my co-accused of Motorcare have been released without taking any plea and at no conditions. I will now start a new Prison chapter in Life and with your prayers, God will intervene.”

With Prof. Bukenya’s fate known, his supporters, who had thronged court, engaged security operatives in a heated exchange over which car the politician was to be transported in to prison. Court business came to a halt for about an hour as the head of the Very Important Persons Protection Unit (VIPPU), Mr Laban Muhabwe, struggled with Prof. Bukenya’s driver to retrieve the politician’s car keys.

Bukenya Gilibert is used as a shield and sacrifise by M7 and NRM because there is alot of corruption allegation and misuse of public fund against M7 and allies that have been left roaming arround than that of Bukenya.
We know some thieves that they led to colapse URA ,UCB saga,Cattledips project,Uganda Bus etc then people like Salim Saleh,Specioza Kazibwe,Tumwine,Basaja Balalaba,J.Odongo,Tumusiime,Moses Ali etc were also to face due procceses instead M7 and moundling filthy NRM led hypocratic cadres do turn a blind eye to these thieves.
We are sure that M7 his afraid of Bukenya because of his social and political capital in Buganda and Uganda that NRM and M7 has lost.
Time will tell.
 
The Anti-corruption Court has remanded former Vice President of Uganda, Prof. Gilbert Bukenya in Luzira prison today for allegedly misappropriating funds during his tenure as Vice President.

Bukenya faces charges of abuse of office and fraudulent practice in relation to the procurement of BMW cars and motorcycles for the 2007 Commonwealth Heads of Government Meeting in Kampala.

He is accused of causing a shs.7 billion loss to the government when he directly procured Chogm executive vehicles from Motor Care (U) Ltd without following a proper procurement procedure.


The contract had been earlier awarded to Spear Motors (U) Ltd which is owned by Ugandan Tycoon Gordon Wavamunno who is also the proprietor of WBS Television but Prof. Bukenya as the chairman of the Chogm organizing committee awarded it to Motor Care (U) Ltd without following direct procurement procedures.

had earlier challenged the case against him urging that the whole committee was responsible and he acted on behalf of the President but the constitutional court ruled that he has a case to answer

The Buganda parliamentary Caucus an umbrella body of Members of Parliament from the districts in Buganda Kingdom is now divided over the detainment of the former V P, Prof. Bukenya

While some caucus members went to see Prof. Bukenya at Luzira Prisons, the Masaka Municipality MP, Mathias Mpuuga declined to go saying that Bukenya has not been helpful to the Buganda Kingdom.
 
No wonder on what they say G.Bukenya was working for the whole Uganda then how comes the Banganda to blem him?This ethnic based political monster has been a threat towards national unity and stability, foremost I dnt see the rationale of Buganda kingdom to Uganda than to the Baganda.
If Ugandans want to make their nation succeed, ethinic base politics should be erased because we have seen the cost of ethnicised political parallels in Africa for centuries.
Back to the issue at stake is that, the bureau lacks independence because it does what M7 preffers..UGANDANS NEED A TRUE EMANCIPATION FROM kagutas legacies.

High court in Kampala has nullified the election of former Vice - President Gilbert Bukenya as Busiro north MP.

Justice Vincent Kibuuka delivered the judgment on Wednesday afternoon.

Bukenya’s his political rival, Hussein Kasta Bukenya petitioned court on April 4 on grounds that Bukenya of bribing voters.

He told court that the ex VP gave out sugar and soap to voters in the parishes of Buwanuka, in contravention with electoral laws.

Bukenya is in Luzira prison after he was remanded on Monday in relation to CHOGM. He has however applied for bail in the High Court.

Meanwhile, Bukenya’s lawyer has said that his client is unwell and has been advised to have bed rest.

After visiting his client incarcerated in Luzira Upper Prison in Kampala, Mcdusman Kabega told New Vision that Bukenya was not fine. However, when Kabega was asked what health problem Bukenya had, he said that he could not disclose.

Owing to his state, Kabega said, Bukenya could not attend a court ruling in case in which his election as Busiro MP was challenged. He added that his client would next week attend a bail application hearing at the Anti-Corruption Court in Kololo, Kampala.
 
There was confusion yesterday after a stormy Cabinet meeting chaired by President Museveni who attempted to secure former Vice President Gilbert Bukenya’s release but in vain. In a meeting that centred mainly on Prof. Bukenya’s imprisonment, Mr Museveni, citing a legal opinion from Attorney General Peter Nyombi, reportedly told ministers that Prof. Bukenya did not steal any public funds.

A Cabinet source told this newspaper last evening that Mr Museveni told his ministers that he had received a legal opinion from the AG about three weeks ago, which indicated that there was no evidence against the former VP, so he did not see the reason why Prof. Bukenya was in jail.

Mr Museveni also insisted that as he had told the ruling NRM Parliamentary Caucus two months ago, he believes that Prof. Bukenya has no case to answer. However, when he made the claim, the Judiciary was outraged and issued a statement denouncing what it felt was interference with its independence.
Mr Nyombi last night confirmed having given the opinion but declined to delve into the details. “It’s true I gave the opinion in June but the rest is not for discussion with you,” the AG said by telephone.

The Cabinet, after the remarks by the President later resolved that arrangements be made to have Prof Bukenya released.
It was not clear how the Cabinet wanted the former vice president released but Mr Nyombi is said to have met Prof. Bukenya’s lawyer McDusman Kabega, and delivered the Cabinet resolution, informing him to prepare to apply for bail.

But as Cabinet jostled to secure Prof. Bukenya’s release, it later emerged yesterday there was no judge to handle the bail application making the Cabinet efforts futile. Prof. Bukenya’s bail application had earlier been scheduled for October 11.
A team of lawyers led by Mr Kabega representing the former vice president were forced to drive off after waiting to no avail at the Anti-Corruption Court.
 
If this is not one of Museveni's tricks, Ugandan Judicial system (including the Anti-Corruption Commission) could be one of the best in East Africa.
 
M7 is playing his game but this time very well. He was the one who did not appoint Bukenya to any post and it was clear that he was paving a way to this dramatic move which left Prof to sleep in Luzira prison. Shame on M7 and his dirty tricks
