Sir, The decision by Kenya’s Supreme Court to nullify that country’s recent presidential election is not only a momentous decision for democracy and the rule of law in Africa. Britain’s former colony can teach us a thing or two about the correct judicial response to suspected dishonesty in our own electoral process.
The dishonest campaign and the blatant flouting of our outdated electoral laws through the manipulation of big data and social media that led to the Leavers’ narrow victory should be good enough reason for our own Supreme Court to declare the referendum null and void. A fresh vote could then be called where the Leave campaign would be forced to retract some of their previously fraudulent claims, and show us, with a greater degree of clarity, how we are going to be better off outside Europe. The Remain camp could conduct a campaign that demonstrates the positives we derive from being in Europe, rather than focusing only on the real negative implications of our potential departure.
