Ujumbe wa Waangalizi wa Uchaguzi wa EU wawasilisha ripoti yake kamili ya uchaguzi wa tarehe 25 Oktoba pamoja na mapendekezo kwa ajili ya chaguzi zijazo Tanzania

Ujumbe wa Waangalizi wa Uchaguzi wa Umoja wa Ulaya (EU EOM) kwa Uchaguzi Mkuu Tanzania 2015, leo umewasilisha ripoti yake kamili iliyo na mapendekezo ya marekebisho ya kuboresha mchakato wa uchaguzi na kuongeza imani juu ya chaguzi zijazo, kwa washirika wake nchini.

Uchaguzi mkuu wa tarehe 25 Oktoba 2015, uliyofanyika Jamhuri ya Muungano wa Tanzania, ulionyesha dhamira ya Watanzania ya kuzingatia mfumo wa kikatiba na pia kuheshimu misingi ya kidemokrasia. Chaguzi zote mbili za tarehe 25 Oktoba, yaani za Muungano na Zanzibar, zilikuwa na ushindani mkali na kwa kiasi kikubwa ziliendeshwa vyema. Taasisi za usimamizi wa uchaguzi zilionyesha viwango vya kutosha vya kujiandaa pamoja na uwezo wa kuendesha hatua muhimu katika kuandaa uchaguzi, kuelekea na pia siku ya uchaguzi.

Kulikuwepo, hata hivyo, na mapungufu kadhaa yanayopaswa kuangaliwa kuhusu mfumo wa kiuchaguzi pamoja na utendaji wa mchakato wa uchaguzi kupitia Tume ya Taifa ya Uchaguzi (NEC) na Tume ya Uchaguzi Zanzibar (ZEC). Zaidi ya hayo, taasisi za usimamizi wa uchaguzi hazikuonyesha uwazi kamili juu ya michakato yao ya kufanya maamuzi.

Tathmini chanya juu ya kuaminika kwa uendeshaji wa uchaguzi siku ya uchaguzi ilihusu pia Zanzibar. Kufuatia uamuzi wa ZEC kufuta matokeo ya uchaguzi Zanzibar, EU EOM pamoja na waangalizi wengine wa kimataifa, katika tamko la pamoja, walielezea wasiwasi wao mkubwa na kuiomba ZEC iwasilishe ushahidi wa kuhalalisha uamuzi huo ambao haujawahi kutokea. Ushahidi huo haujawahi kuwasilishwa. EU EOM haikufanya uangalizi wa uchaguzi wa marudio wa tarehe 20 Machi 2016 Zanzibar kwa kuwa iliona ya kwamba mazingira hayakupelekea uchaguzi shirikishi, halisi na wa kuaminika.

Muangalizi Mkuu wa Ujumbe wa Waangalizi wa Uchaguzi wa EU, Bi Judith Sargentini, Mbunge wa Bunge la Ulaya, amerejea Dar es Salaam wiki hii ili kuwasilisha ripoti kamili kwa NEC, Serikali ya Jamhuri ya Muungano wa Tanzania, vyama vya siasa pamoja na vikundi vya uangalizi vya kitaifa.

Mapendekezo yaliyo ndani ya ripoti hiyo, ambayo baadhi yaliwasilishwa pia mwaka 2010, ni pamoja na haki ya wagombea binafsi kugombania katika uchaguzi wowote wa Muungano au Zanzibar; kuruhusu haki ya kupinga matokeo ya uchaguzi wa rais kisheria; haki ya vyama vya siasa kuunda umoja wa kiuchaguzi; kuangaliwa upya Sheria ya Makosa ya Mtandao ya 2015; kuendelezwa kwa muundo wa kudumu wa NEC katika ngazi za mikoa, na marekebisho ya mchakato wa uteuzi wa makamishna wa uchaguzi wa NEC na ZEC; na kuangaliwa upya mchakato wa uandikishwaji wa wapiga kura Zanzibar ili kuhakikisha ushirikishi zaidi pamoja na imani ya wapiga kura.

“Nina furahi sana kuwasilisha ripoti yetu kamili leo kwa kuwa inajumlisha yote tuliyoyaona wakati wa uangalizi wetu katika kipindi cha miezi mitatu ambapo ujumbe umekuwepo nchini, pamoja na mapendekezo ya kina kwa chaguzi zijazo. Umoja wa Ulaya unaendelea kusimamia dhamira yake ya kufanya kazi na washirika wake Tanzania kuimarisha mchakato wa kidemokrasia nchini, na utaendelea kutazama kwa karibu marekebisho ya kiuchaguzi nchini katika miezi na miaka ijayo,” alisema Bi Sargentini katika mkutano na waandishi wa habari Jijini Dar es Salaam.

Ripoti inatoa mapendekezo muhimu ya kufikiriwa na mamlaka husika, taasisi za usimamizi wa uchaguzi pamoja na wadau wengine wa uchaguzi. Mapendekezo hayo ni pamoja na yafuatayo:

Mfumo wa Kiuchaguzi:

● Kuruhusiwa kwa haki ya kugombania kama mgombea binafsi kwa ajili ya uchaguzi wowote wa Muungano au Zanzibar;

● Kuwepo kwa haki ya kulalama matokeo ya uchaguzi wa rais katika sheria;

● Sheria ya Makosa ya Mtandao ya 2015 itumike kwa uwiano ili kulinda haki ya kujieleza na haki ya kuwa na kesi isiyo na upendeleo;

Utendaji wa Uchaguzi:

● Kuangaliwa upya mipaka ya majimbo ili kuhakikisha usawa zaidi wa kura;

● Muundo huru na wa kudumu wa NEC katika ngazi za mikoa;

● Mabadiliko katika taratibu za uteuzi wa makamishna wa NEC na ZEC ili kuongeza imani juu ya uhuru wao;

Uandikishwaji Wapiga Kura:

● Kipindi kirefu zaidi cha kuonyeshwa orodha za wapiga kura za Muungano na Zanzibar;

● Kuangaliwa upya mchakato wa uandikishwaji wapiga kura Zanzibar ili kuhakikisha imani na ushirikishi zaidi;

Elimu kwa Wapiga Kura:

● Mazoezi ya elimu kwa wapiga kura yaliyoandaliwa vyema na kutekelezwa kwa wakati toka tume za uchaguzi;

Vyombo vya Habari:

● Kubadilishwa kwa Shirika la Utangazaji Tanzania (TBC) na Shirika la Utangazaji Zanzibar (ZBC) kuwa mashirika ya utangazaji ya huduma kwa umma;

● Marekebisho ya Sheria ya Mamlaka ya Mawasiliano Tanzania (TCRA) ya 2003 ili kuhakikisha uhuru wa TCRA;

Upigaji kura, kuhesabu na kuorodheshwa kwa matokeo:

● Kuboreshwa kwa mafunzo ya maafisa uchaguzi na watendaji wa vituo kuhusu taratibu;

Malalamiko na Rufaa:

● Maamuzi ya NEC na ZEC yaweze kupingwa mahakamani kipindi kizima cha mchakato. Wanaolalamika wasilazimishwe kusubiri hadi matokeo kutangazwa ili kutafuta njia ya kupata haki.

EU EOM ilikuwepo nchini kati ya tarehe 11 Septemba na 8 Desemba 2015, kufuatia mialiko toka Serikali ya Jamhuri ya Muungano wa Tanzania, Tume ya Taifa ya Uchaguzi na Tume ya Uchaguzi Zanzaibar.

Kwa ujumla, ujumbe ulituma waangalizi 141 nchini kote, toka Nchi zote 28 Wanachama wa EU, pamoja na Norway, Uswisi na Canada, na kuufanya kuwa ujumbe mkubwa kabisa wa waangalizi wa kimataifa katika uchaguzi huo. Ujumbe ulitathmini ni kwa kiasi gani mchakato wa uchaguzi ulizangatia ahadzi za kitaifa na za kikanda kuhusu uchaguzi, pamoja na sheria za Tanzania.

EU Election Observation Mission presents its final report on the 25 October elections including recommendations for future elections in Tanzania

The European Union Election Observation Mission (EU EOM) for Tanzania’s 2015 General Elections today submitted to Tanzanian partners its final report containing proposals for reforms to improve the electoral process and enhance voter confidence in future elections.

The 25 October 2015 general elections, held in the United Republic of Tanzania, showed the will of the Tanzanian people to adhere to the constitutional framework and to respect democratic principles. Both the Union and Zanzibar elections of 25 October were vigorously contested and largely well managed. The electoral management bodies showed sufficient levels of preparedness and competence in conducting key steps in organising the elections, in the run-up to and during election day.

There were, however, certain shortcomings that should be addressed concerning both the electoral framework and the administration of the electoral process by the National Electoral Commission (NEC) and the Zanzibar Electoral Commission (ZEC). Furthermore, the electoral management bodies did not provide for full transparency regarding their decision-making processes.

The positive assessment of the credibility of the conduct of elections on election day applied also to Zanzibar. Following the ZEC decision to annul the Zanzibar election results, the EU EOM and other international observer missions in a joint statement expressed their great concern and requested the ZEC provide evidence to justify this unprecedented decision. Such evidence has never been presented. The EU EOM did not observe the 20 March 2016 re-run in Zanzibar as it considered the conditions were not conducive to inclusive, genuine and credible elections.

The Chief Observer of the EU Election Observation Mission, Ms Judith Sargentini, a Member of the European Parliament, returned to Dar es Salaam this week to present the final report to the NEC, the government of the United Republic of Tanzania, political parties and national observer groups.

The recommendations in the report, some of which were also made in 2010, include the right of independent candidates to stand for any Union or Zanzibar election; the introduction in law of the right to challenge presidential election results; the right of political parties to register electoral coalitions; the revision of the Cybercrimes Act 2015; the development of a permanent independent structure of the NEC at regional level, and the reform of the appointment procedure for election commissioners of NEC and ZEC; and a review of the voter registration process in Zanzibar to ensure greater inclusivity and voter confidence.

“I am very pleased to present our final report today as it brings together the findings of all our observations over the three-month period the mission was in Tanzania, as well as comprehensive recommendations for future elections. The European Union remains committed to work with Tanzanian partners on strengthening the democratic process of the country, and will continue to take a keen interest in electoral reform here in the coming months and years,” said Ms Sargentini at a press conference in Dar es Salaam.

The report makes key recommendations for consideration by authorities, the election management bodies and other election stakeholders. They include the following:

Legal Framework:

The introduction of the right to stand as an independent candidate for any election in the Union or Zanzibar;

The establishment in law of the right to petition presidential election results;

The Cybercrimes Act 2015 should be applied proportionately so as to protect freedom

of expression and the right to a fair trial;

Election Administration:

A review of constituency boundaries to ensure greater equality of the vote;

A permanent independent structure of the NEC at regional level;

Changes to the appointment procedure for commissioners of NEC and ZEC so as to

increase confidence in their independence;

Voter Registration:

A longer period for the display of Union and Zanzibar voters’ lists;

A review of the Zanzibar voter registration process to ensure greater confidence and

inclusivity;

Voter Education:

Well-planned and timely executed voter education initiatives from the election commissions;

Media:

The transformation of the Tanzania and Zanzibar Broadcast Corporations into public service broadcasters;

The amendment of the Tanzania Communication Regulatory Authority (TCRA) Act 2003 to ensure the independence of the TCRA;

Voting, counting and the tabulation of results:

• Improved training for electoral officers and polling station staff on procedures;

Complaints and Appeals:

• Decisions of the NEC and the ZEC should be able to be challenged in court throughout the entire process. Aggrieved parties should not have to wait until the announcement of results to seek recourse to justice.

The EU EOM was present in Tanzania between 11 September and 8 December 2015, following invitations from the Government of the United Republic of Tanzania, the National Electoral Commission and the Zanzibar Electoral Commission.

In total, the mission deployed 141 observers across the country from all 28 EU Member States, as well as Norway, Switzerland and Canada, making it the largest international observation mission for the elections. The mission assessed the extent to which the electoral process complied with international and regional commitments for elections, as well as with Tanzanian law. ● Kuruhusiwa kwa haki ya kugombania kama mgombea binafsi kwa ajili ya uchaguzi wowote wa Muungano au Zanzibar;

Kazi ya mwangalizi wa uchaguzi ni kuangalia kuwa uchaguzi umefanyika kwa mujibu wa sheria na taratibu za nchi husika sio kuja na vitu vingine vya kutunga kutoka hewani.

Sheria zetu na taratibu za uchaguzi hatuna hata moja ya kuruhusu mgombea binafsi!!! Kwa hiyo wao wameona watunge kitu ambacho hakiko kwenye sheria zetu wala taratibu na kukiingiza kwenye ripoti ya uchaguzi!!!! Hawakuletwa kutunga vitu vipya!!!

Hawa walikuwa waangalizi wa uchaguzi au nini? Hawakutakiwa kuliweka hilo wameamua tu wachomekee ili mradi kuonekane kulikuwa na kasoro wakati hiyo siyo kasoro kwa mujibu wa taratibu na sheria zilizopo haipo.

Yaani Dunia nzima inajua kua uchaguzi wa Zanzibar ulikwenda vizuri tarehe 25/10/2015 ila wao CCM wakingozwa na Mharibifu wao Jecha hawalioni hili
 
Umoja wa Ulaya (EU), umeiasa Tanzania kufanya mabadiliko kadhaa ya mifumo yake ya Uchaguzi, ikiwemo kuruhusu matokeo ya Urais kuhojiwa mahakamani. EU imetoa Ripoti yake ya Uchaguzi Mkuu wa 2015 na kuiwasilisha kwa Tume ya Uchaguzi (NEC), Serikali na Vyama vya Siasa.

Mapendekezo hayo, yanakuja wakati ambao Vyama vya a Upinzani, pamoja na wachambuzi wa masuala ya kisiasa nchini, wamekuwa wakishauri Serikali kubadilisha baadhi ya vifungu vya Sheria ya Uchaguzi, ili kuwezesha matokeo kuhojiwa mahakamani. Aidha, Wapinzani nchini wamekuwa wakililia zaidi Tume Huru ya Uchaguzi.

Kwa kuwa, Mapendekezo hayo yamekabidhiwa kwa wadau wote wa Uchaguzi, ni matarajio ya Watanzania kuwa, wadau hao watafikia muafaka kwa mustakabali mwema wa Nchi yetu.

Safi kabisa!

Mimi nashauri nchi zenye mambo ya hovyo hovyo kama kupuuza demokrasia na kutumia vibaya fedha za umma wazinyime hata misaada kama walivyofanya kwa Zambia majuzi kutokana na serikali kushindwa kutoa majibu ya audit report ya fedha za umma.

Africa needs to be recolonised and should be recolonised in this way.
