DPP dismisses inflammatory charges against Tundu Lissu

Criminal Case No.208 / 2016 against Tundu Lissu and three others in Kisutu Court, has been dismissed by the DPP in accordance with Section 91 (1) of the Criminal Procedure Code.

All the suspects are free. In addition to Lissu, the other accused were Mawio Newspaper Editor, Simon Mkina, Jabir Idrisa and Jamana Company Publisher Ismail Mehbooh.

The defendants were jointly charged with five counts of aggravated burglary in violation of the 2002 Newspapers Act.

Patrick Mwita, the state's attorney general, Thomas Simba, the Chief Resident Magistrate in the Kisutu Resident Magistrate's Court, read the first and fifth charges.

Mwita claimed that the first charge was conspiracy to issue a provocative post, an offense allegedly committed between January 12 and 14, 2016 where; Idrissa, Mkina and Lissu in an undisclosed location in Dar es Salaam plotted to publish provocative statements.

In the fifth offense, defendant number one (Idrissa), number two (Mkina) and number four (Lissu), are accused of inciting fear among the public by publishing information "Chaos in Zanzibar" and that, it could spark war or bloodshed.

The second indictment is against Jabir, Mkina and Lissu, for allegedly publishing a provocative post in MAWIO Magazine, issue no. 182 dated 14-20 January 2016.

The third charge is against Ismail allegedly publishing a provocative post in the newspaper with the headline ‘Chaos in Z’bar’.

The fourth charge is against Ismail for allegedly publishing a newspaper without taking an oath to the Registrar of Newspapers.
