The Court of Appeal in Dodoma yesterday set free the 27-year-old Deus Mallya who was earlier convicted of driving a car without a valid licence and driving recklessly, causing an accident that killed the then Member of Parliament for Tarime on the ticket of Chadema, Mr Chacha Wangwe. Court of Appeal Judges Harold Nsekela, Natalia Kimaro and Bernard Luanda quashed an earlier judgment passed by the Dodoma Resident Magistrates Court. The deputy Registrar of the Court of Appeal for the Central Zone, Mr Maxmillian Malewo, said one of the reasons for quashing the judgement was that the case was supposed to have been filed at Kongwa District Court and not at Dodoma Resident Magistrates Court. He said since the case involved a traffic accident and not murder it was supposed to be filed at a District Court and not at a Resident Magistrate Court. Mr Malewo said the contradiction would serve as an example in future cases where people are wrongly sentenced to serve jail terms. Malya was convicted on March 18, 2008, of driving a car without a valid licence and driving recklessly. He was sentenced to three years in jail by the then Dodoma District resident magistrate Thomas Simba. Following the judgement, Mallya appealed to the Court of Appeal. The accident that killed Mr Wangwe occurred on July 28, 2008, at Panda Mbili in Kongwa District in Dodoma Region. |
