CPJ calls on Tanzania’s Magufuli to drop Kabendera charges, investigate Gwanda case

It's very wrong to call for dropping of charges when there is suspicion of one having committed crime(s). At best you can call for timeous expedition of the process and let the court decide if the suspect is guilty or not. Why should the charges be dropped; and why only this suspect? One has the right to exercise one's duties only if that is done within certain parameters, in cognisance of one's responsibilities. Why should a crime of money laundering, for instance, be dropped just because the suspect is an investigative journalist? Timing of the charges is irrelevant. It can be that investigations were on -going and arrest was awaiting gathering of enough evidence to bring to court. Give the government a break!

Poor and stupid CPJ. This is now absurd! When you wish seeing one person exonerated, you totally forget previous application for free justice. Leave the legal system free from government interferences! CPJ is the same that have been shouting against any signs of interfering with the country's legal system!

By appealing to the President, CPJ recognises the need for the same President to freely interfere with the country's legal system. If not, this statement sounds stupid.
Do we have free justice? From where do you count the free justice? Is it from the court or from unlawful police action to arrest and presecute the suspects?

I am 100% sure we do not have free justice instruments. The police who arrest and prosecute suspects has turned to a group of criminals to oppress citizens.

My prayers are with all who speak out against primitive actions happening on our lovely land Tanzania. May Almighty God continue giving them courage to shout and act against any kind of oppression and brutal actions against humanity and human rights which are the pillars of any civilized society.

ARRESTS SHOULD BE CARRIED ON COMPLETION OF INVESTIGATION

A suggestion has been made for the Police and other justice dispensing organs not to arrest suspects before investigations are completed in order to reduce the time they spend in remand prisons and that all offences must be bailable.

Three media bodies – the Media Council of Tanzania (MCT), Tanzania Editors Forum (TEF) and Union of Tanzania Press Clubs (UTPC) and Tanzania Defenders of Human Rights (THRDC) said in joint statement released on August 11, 2019 they fully support the recommendation made by the Chief Justice, Prof Ibrahim Juma on carrying out investigation first before suspects are arrested.

They also said the law must be state explicitly that after a certain period and investigation of alleged committed offence has not been completed, the case must be dismissed.

Kajubi Mukajanga the Executive Secretary of MCT, Onesmo Olenguruma the National Coordinator of THRDC, Deogratias Nsokolo , the President of UTPC and Deodatus Balile Vice Chairman of TEF also appealed in their joint statement that bail conditions suspects should be eased.

The National Assembly, they suggested should enact a legislation to allow all offences to be bailable.

The judiciary should be vested the authority to give bail and that our laws should not prevent bail but the courts should be able to determine their conditions depending on the on environment and magnitude of the case.

It was also suggested that a system of evidential hearing where the police would initiate a process of hearing evidence before a court and suspect would defend himself/herself and if the court is convinced that the suspect has a case to answer then it orders the suspect to be arrested.

This system it was argued would help reduce the time the police spend investigations while the accused is denied his basic rights of not being guilty until convicted and if evidence is complete it would also expedite conclusion of the case and justice would be delivered.

In the case of Erick Kabendera the investigative journalist whose arrest and indictment has stirred reactions from rights bodies and foreign embassies opposed to human rights abuse by authorities, the statement urged the government to come clean on his immigration status.

It also cautioned that the issues of citizenship should not be used to silence Tanzanians who question basic national issues.

Immigration officials have been asked to give back Kabendera’s passport and those of his wife and children if they failed to established that he is not citizen of Tanzania.

The Police should adhere to laws of the land in apprehending suspects ensuring the have access to lawyers and the close relatives, the statement said.

An appeal has also been made to practicing lawyers to take steps against the legislation on money laundering and economic sabotage especially on the question of bail.

At this juncture where the government through the Constitutional and Legal Affairs Ministry is reviewing the Justice and Criminal system, the overriding powers bestowed to the DPP should be challenged especially on exhibits and evidence in such cases.

There is a good approach of challenging unjustified legal settings. It can't happen by every one's shouting unfortunately, from a hide place. Masking yourself, writing insulting words, not criticism, feeling fine just because there is a whiteman paying and supporting you! That is no way of making good nation. I would similarly treat such people like any criminal person.

If we think the structured channel for proper legal shaping is wicked, let's use our power to enhance the quality of such instruments instead of attacking the president. Where is the parliament? Who votes for Parliamentarians, both ruling and the opposition no one convinces me that, they are of different qualities. They are all of the same quality. By the way, if truly Kabendera is a man behind those articles that appeared in the Economist magazine, he is simply useless, unreasonable. No one will change after such stupidly attack from a person less powered as he is.
