PRELIMINARY REPORT ON HUMAN RIGHTS ABUSES COMMITTED BY TANZANIAN ARMED FORCES IN ZANZIBAR SINCE JANUARY 26[SUP]TH[/SUP], 2001

Massacres in Zanzibar
Tanzanian police, riot police, army, navy (KMKM), secret police and other security forces have, since January 26[SUP]th[/SUP] 2001, engaged in a coordinated program to place Zanzibar under military rule and to inflict massive human rights violations on its people. Benjamin Mkapa should be held responsible in the eyes of the world for approving the use of live ammunition to kill dozens of peaceful demonstrators, and for the subsequent campaign of terror to punish Zanzibaris for daring to stand up for the principles of political pluralism and freedom of assembly. Armed forces have injured hundreds of people, shooting them in their homes, sinking boats carrying injured refugees, raping, and looting. We hope that all perpetrators of these atrocities will be brought to justice, both those who committed crimes and those who ordered them.
This report is a preliminary summary of available information from eye-witness accounts by refugees and other sources. Almost all of our leaders have been arrested, are in hiding, or have disappeared. Collecting information on human-rights abuses is very dangerous because our telephone calls are monitored, we are searched when we travel, and we are under surveillance by secret police and CCM officials. The government is attempting to cover-up and hide their actions, but the truth will be known. We are compiling these lists of victims in order to help their families and friends to know what happened to them. But we also hope that knowledge of the Tanzanian states persecution of its citizens will lead Tanzanians and others to insist on the need to safeguard democracy and basic human rights. Details of the eventsMkoani Pemba 27[SUP]th[/SUP] Jan 2001 (1) Many Riot Police and other security forces from mainland Tanzania & Zanzibar were observed on the main road coming from the Harbour.
(2) No food available in town, as all people are locked inside their homes. Mkoani town is virtually under curfew.28[SUP]th[/SUP] Jan 2001 (3) So far 18 severely injured people have been admitted to the
Mkoani Hospital. Among the 18, 4 are in serious condition, including:
(i) Ms. Tamasha Abdi Sheria of Utaani, Wete, who was shot by police, the bullet went through her buttocks and through her private parts.
(ii) Mr. Bakar Salum, shot by the police, the bullet went through his thigh and also damaged part of his urinary bladder. As a result, he has no control of his urine.
(4)Three other severely injured patients were brought in and admitted at Mkoani Referral hospital from Chake Chake and Wete, making the total number of seriously injured people to be 22. The four new patients are:
(i) Mr. Omar Hafidh , from Wete, whose leg was
smashed by a bullet.
(ii) Mr. Mussa Ali Hamad of Chasasa, Wete, is still in serious condition because of a bullet that penetrated his chest under his breast, got him so bad that he is still bleeding continuously and doctors have already instructed his relatives to refer him to Muhimbili Hospital in Dar-es-Salaam.
(iii) Hidaya Salim Habib (teenager) from Wete who was shot in the shoulder when she was inside her home.
(iv) Yahya Hamad of Chake Chake, who was shot by police in the upper abdomen.29[SUP]th[/SUP]Jan. 2001 (5)On the night of 29[SUP]th[/SUP] Jan 2001, all the 22 severely injured patients were forcefully interrogated and made to write and sign statements, against their will and in the absence of their lawyers.
The moment they finished signing those forced statements, police told them that they were all under arrest. The police remained inside the wards carrying their weapons, the action that prompted protest from the Chinese doctors who ordered the police out of the wards. Still determined to continue with their humiliation and psychological torture to the patients, police decided to take guard, fully armed, around the ward.
Since then, police have been demanding doctors to release the sick people so that the police could arrest them, prosecute them and take them to jail.30[SUP]th[/SUP] Jan 2001 (6)On 30[SUP]th[/SUP] Jan 2001, Mr. Mohd Salim (alias Mulla) together with Mr. Masoud Khamis Omar (alias Meya) and Mr. Mohd Adam were severely beaten-up by riot police while sitting on the verandah talking. While Mr. Meya and Mr. Moh'd Adam managed to escape after being beaten-up for some time, Mr. Mulla could not make it and he was immediately arrested. He was eventually released late in the evening but ordered to report back to the police the next day (31[SUP]st[/SUP] Jan 2001) along with the other two who had escaped police brutality.
(7)On the same day, 30[SUP]th[/SUP] 2001, police forcefully cut off the beard of Mr.Mohd Ali Mohd at Kipitacho area using a knife.
(8)Another incident involved Mr. Imu who was spared of humiliation but ordered not to be seen with beard the next day, otherwise he could be punished.
(9)On this day, 30[SUP]th[/SUP] Jan. 2001, police ordered the muadhin, the person responsible for the call-to-prayer at the mosque, not to make a prayer-call for the evening (Isha) prayer, (usually made soon after 8 p.m.), otherwise they would fix him. Not only was he told not to make the prayer-call, but he was also warned that if anyone was caught saying prayers in the mosque after 7 p.m., he (muadhin) would also be arrested and punished. This order put off every Muslim from going to Isha prayer as going there could mean risking the life of the muadhin.
(10)On this date, 30[SUP]th[/SUP] January, 2001, a convoy of riot police officers in full riot, gear arrested and dragged away two patients, Ms. Khadija Ali Juma of Chake Chake, and Mr. Ali Michael Babedi, from Mkoani Referral Hospital.Chake Chake Pemba 27[SUP]th[/SUP] to 29[SUP]th[/SUP] Jan 2001 (1)After beating-up and killing people with live bullets on the streets, Police and other Security forces engaged in breaking into peoples houses, severely beating up the occupants with police clubs and rifle-butts, raping women in some cases, smashing wardrobes and jewelry chests and finally looting jewelery, cash money, radios, TVs and other valuables. Most of the stolen jewelery is that which had been traditionally inherited from their ancestors generation after generation. Thus it is irreplaceable.
In the course of looting, police were saying loudly, You Pembans have no discipline as you had not witnessed revolution violence and hence we have come here to show you Pembans the real revolution.
Some of the houses that were looted of valuables were those of the following people:
(i) Mr. Juma Ngwali, at Machomane
(ii) Ms. Sharifa Mussa (Mrs.Marshed), at Mkanjuni (3) Mr. Suleiman Seif, at Mabatini
(iii)Mr. Suleiman Seif, at mabatini
(iv) Ms. Lulu (300,000 TShs were stolen)
(v) Mr. Rashid Seif
(2) The number of missing people is more than 40 for Chake Chake alone, and most of them are assumed dead.Wete, Pemba
27[SUP]th[/SUP] to 29[SUP]th[/SUP] Jan 2001 (1)On 27[SUP]th[/SUP] Jan 2001, there were 9 bodies in the mortuary of the Wete Hospital, 4 bodies inside the Limbani CUF branch, and 2 bodies inside the Mtemani branch.
(2)Mr. Salim (alias Fundi Salim) , who was accused of having washed the body of a family member who had been shot dead by Police earlier the same day, was arrested by Police at Chasasa, tortured and killed and then his body was dumped at the mortuary of the Wete Hospital. His death was instigated by the local CCM representative, the Sheha (local Headman), Mr. Ali Hamad (alias Mpemba Mwekundu) who had earlier asked police officers to punish him for washing and preparing (for burial) the body of a CUF member.
(3)Police officers were harassing injured patients inside Wete hospital wards to finish them-up, as they were heard boasting about. This Police man-handling forced many bullet-injured patients to seek refuge in forests and it is feared that many might have died of these bullet wounds.
(4)Those injured were barred by Police from being treated in Government Hospitals. In one incident, Riot Police officers stopped an ambulance and ordered the doctors to take out all patients, who were being transferred to Mkoani Hospital with severe injuries. When these police officers were asked why the patients should be unloaded while in such critical condition, they publicly said that they wanted to kill them. Fortunately, the doctors refused and told the police officers that they (doctors) would rather die than hand over those patients to the police officers.
(5)It is reported that two boats carrying injured refugees were sunk by police or navy, and all the passengers drowned. Passengers in a third boat witnessed the sinking caused by a police helicopter and reported it when they arrived in Mombasa. The sunk boats are estimated to have been carrying more than 50 people.
(6)At Mtambwe (Uchozini) many people were shot dead by Police and Navy officers as they were fleeing for their safety from the demonstration scene. Many dead bodies there, and of those who died in forests in different parts of Pemba have not been collected for burial as people are not allowed to go out of their houses, and this could trigger an outbreak of cholera and other diseases.
(7)Somebody (name withheld) witnessed a 60-year old man sitting at his home being shot at by police.
(8) Somebody (name withheld) witnessed a woman who was cooking in her homes kitchen being shot by police.
(9) Medical supplies in Pemba have been depleted.
(10)More than 30 shops have been broken into and looted of stock in Wete, including that of Mr. Masoud Ali Hamad.
(11)Humiliation and sufferings continues in Pemba, especially in Wete and Mkoani. People are still harassed and tortured.
(12) Ambulances are the only vehicles allowed on the road, and they are always followed by heavily-armed riot-police cars in Wete.30[SUP]th[/SUP] Jan 2001 (1) Road blocks between Chake Chake and Wete towns are still in place, all cars and passengers are searched and all knives found with passengers are confiscated. (Note: Pembans take with them knives as tools rather than weapons). Many passengers are harassed and humiliated.
(2) In Mtambwe area, 3 bodies have been found.
(3) A soldier by the name Ali Makame (alias Kijeshi) seconded to the office of the Regional Commissinor for Pemba North region, dared to rape the wife of another soldier (name withheld). It is suspected that the act was commited with the purpose of making the victim's husband believe that his wife was raped by his neighbours so that he could retaliate and harm and even kill the innocent neighbours.
(4)Police officers also looted food stuff, as much as they could carry at the Wete Market, and then they sprayed salt on the remaining food stuff which they could not carry on their lorries, so that the owners of would not be able to sell the commodities to any customers.
(5) Mr. Ali Mohd Juma (alias Ali Zungu) of Hodhi la Ngombe was arrested after all his vehicles had been smashed and destroyed by police.
(iii) Mr. Nassor, a seriously injured victim of police brutality shown groaning on ITV (a TV station in dar es salaam), is yet to be taken to hospital for treatment as the police still hold him at the Wete Police station.Micheweni, Pemba 30[SUP]th[/SUP] Jan 2001 (1)According to the Micheweni-hospital report, 14 injured people were treated there, out of which the following were referred to the Wete Hospital as their injuries were serious:

(2)Two big police lorries fully laden with severely beaten-up people who were arrested in Micheweni, under a heavy riot police guard with full riot gear, was seen roaming the streets of Wete.
(3)A group of people who were preparing a shroud for the burial of one of those earlier shot and killed by police were also shot at by the police and died.CUF HQUARTERS
27[SUP]th[/SUP] Jan 2001 (1) Mr. Maulid Makame, a member of the Central Committee of CUF, and Mr. Mohd Ali Yussuf, the CUF's Director for Human Rights, were arrested at their residences at around 3:00 a.m. in the morning, by heavily armed convoys of police.
(2) Among many people who were beaten-up and then violently arrested by police on the early morning hours of this day, 27[SUP]th[/SUP] Jan. 2001, were CUF leaders including Mr. Said Miraji the Deputy Youth Director of CUF, Mr. Rashid Nyange, Mr. Duni (the nephew of Mr. Juma Duni), and Hajjy Sadifa (leader and active member of CUF's Blue Guards).
These leaders, after they were dumped at the Madema police station, in Zanzibar town, were isolated from the group and were separately taken into secluded torturing chambers, where they were tortured each by a mob of more than eight policemen using police clubs, army boots and fists until they were unconscious.
A mob of more than eight policemen beat up, Mr. S. Miraji until he fell down helplessly when the mob decided to jump up and down on his body with their army boots on. At this stage he became unconscious and was assumed to be dead by the police mob. Mr. S. Miraji is admitted at the Mnazi Mmoja Hospital in Zanzibar, suffering from paralysis among other ailments and his condition was still serious as he can neither stand on his feet, nor can he fold his legs without the help of nurses.
(3) Most of those arrested on 27[SUP]th[/SUP] Jan, 2001, were taken to the Mwanakwerekwe Primary and District Courts. Their case is scheduled for hearing on 9[SUP]th[/SUP] Feb 2001.

29[SUP]th[/SUP] Jan 2001 (1) On 29[SUP]th[/SUP] Jan 2001, early in the morning, Mrs. Fatma Saleh was arrested at her home in Mchangani, in Zanzibar. Mrs Fatma works as a secretary at the CUF headquarters at Mtendeni, Zanzibar. 2[SUP]nd[/SUP] Feb. 2001
(1)In the evening of 2[SUP]nd[/SUP] Feb. 2001, the Commanding Officer for Zanzibar Town District (OCD), SP George Kizuguto accompanied by more than twelve riot police officers with full riot-gear, stormed the Casualty ward designated for the remandees and evicted by force all those admitted except four of them, who took them to unknown location. The list of those evicted included Mr. Duni and Hajjy Sadifa as well as one women. This action is thought to have been taken for the purpose of keeping all the seriously injured patients away from the eyes of the European Union Delegation currently visiting Unguja and Pemba Isles.
Reports from Kiinuamiguu Remand Prison say that CUF leaders who were being held there, and their followers, are tortured daily. It is reported from reliable sources that Mr. Maulid Makames arm was broken. Mr. Zahor Tamali, who suffers from diabetes, could not take it any more and he was admitted at the inside-prison dispensary with no medicine and food as the prison authorities have issued an order that food and medicine should not be brought for all the prisoners.
The following is a list of some of the victims who were physically abused by Police and those whose properties were looted by the Police in collaboration with other Security forces in Chake Chake, Pemba. The lists for other regions of Zanzibar will be published later.

This morning, at around 2:00 am, Police and KMKM (Zanzibar Navy) invaded Monduli Village, in Zanzibar town, storming into houses occupied by Pembans, guided by the local CCM representative, and beat up everybody inside those houses, then got away with money, jewelry and other valuable properties. Such ongoing targeting Pembans both in Pemba and Zanzibar Islands is certainly a case of gross human rights violations ordered by Benjamin Mkapa and his CCM party using Police and other Security forces.
Conclusion:
Arbitrary arrests, detentions, harassments, beatings and intimidations, and killings are still common in Zanzibar. Police and the security services are mounting a witch-hunt against CUF members and supporters, especially those of Pemban origin.
The Civic United Front requests all human rights institutions and other concerned organizations to contact the Tanzanian government or its representatives abroad, before the situation escalates into more bloodshed and violence. CUF also wishes to remind the International Community that the protection of human rights is a universal moral obligation, and that the failure to intervene will increase the sufferings of innocent people in Zanzibar.
