Elections 2010 Can NEC be sued for vote rigging architect?

Dear Lawyers in JF,

We all know that, once declared as a winner by the National Electoral Committee, there is no possibility to file a case against president on any issue regarding to violation of election procedures whatsoever.

However, there are many incidences everyone is familiar with proving that there had been some irregularities in the election process which simply means violation of Election Laws and other procedures

My question here is, regardless who is the architect of vote rigging (kuchakachua), is there no any legal possibility to sue the National Electoral Committee for ‘spearheading’ presidential and wabunges vote rigging??

If any, can’t CHADEMA take this as a starting point to deal with dirty game called Uchakachuaji by suing NEC and demand for a NEC that composed of members not president appointees? If this possible, may be this will serve a great deal than just talking ‘gibberish’ and murmur

Dealing with a person (say JK or any other) will not help much than dealing with institution (NEC) which in a ‘dark’, but easy to be seen, way has makusudi-kaly failed to impede vote rigging.

If a case is filed, am sure many people will come with many evidences linking NEC with vote rigging and deal with a root of the problem.

Please help me, and other JF members, about this matter
 
I am not a lawyer but by examining the relevant section of the constitution, it appears to me that all avenues of seeking a legal redress on this matter are closed because the law says once NEC announces the winner of the presidential race, no court is allowed to open up an inquiry on that matter. Given this position of the law it would be next to imposible to sue NEC as doing so, tantamounts to opening up an inquiry on presindential race contrary to article 41(7) of the constitution.
 
The otherside of the coin .How about constitutional challenge on the legality of the this controvesial provision?

Hicho kifungu cha 41(7) cha katiba kinatafsiriwa vibaya; kifungu kile kinasema hivi:
(7) Iwapo mgombea ametangazwa na Tume ya Uchaguzi
kwamba amechaguliwa kuwa Rais kwa mujibu wa ibara hii, basi
hakuna Mahakama yoyote itakayokuwa na mamlaka ya
kuchunguza kuchaguliwa kwake.
Kuna vitu viwili hapo ambavyo watu wanaotafsiri kifungu hicho wanashindwa kuviona. Kifungu hicho kinataka tume imtangaze mtu kuwa amechaguliwa kwa mujibu wa Ibara ya 41 ambayo pamoja na mambo mengine ni kuwa lazima awe amewashinda wagombea wengine kwaa kupata kura nyingi. Tume haiwezi kumtangaza mshindi wa pili kuwa mshindi halafu eti taifa linyamaze, vile vile tume haiwezi kumtangaza mtu kuwa mshindi kwa kutumia kura ambazo hakupata halafu eti taifa linyamaze; kwa mfano Kichuguu akipata kura kumi, tume haiwezi kutangaza kuwa kichuguu kapata kura milioni kumi kwa hiyo takuwa rais, halafu taifa linyamaze.

kifungu hicho hakizuii mahakama kuskiliza kesi zinazohuzu malalamiko ya uchaguzi. Kifungu kinazuia mahakama kuchunguza kuchaguliwa kwa rais. Kusikiliza malalamiko hakuna maana ya kuchunguza. Mlalamikaji ndiye anatakiwa kuchunguza, mahakama itasikiliza facts tu.

kifungu hicho hakizuii mahakama kuskiliza kesi zinazohuzu malalamiko ya uchaguzi. Kifungu kinazuia mahakama kuchunguza kuchaguliwa kwa rais. Kusikiliza malalamiko hakuna maana ya kuchunguza. Mlalamikaji ndiye anatakiwa kuchunguza, mahakama itasikiliza facts tu.

Mkuu Kichuguu nashukuru kwa haya maelezo maana siku zote hili jambo liliikuwa likinichanganya si kidogo!
 
Ni sawa katika hali halisi tume kwa mujibu wa kifungu hicho inalazika kumtaja yule tu aliyeshinda, lakini hata ikimtangaza aliyeshindwa kuwa mshindi bado kifungu hicho kinaipa tume kinga ya kutoshitakiwa. Kuhusu kufungua kesi ya kikatiba' kwangu mimi naona hilo linawezekana kwasababu kifungu hicho kinapingana na kifungu cha 13(6)(a) ambacho pamoja na mambo mengine kinataka chombo chochote chenye mamlaka ya kushughulikia haki za watu kitoe fursa ya mtu kusikilizwa na kukata rufaa ikibidi. Hata hivyo kulingana na hukumu ya mahakama ya rufani kwa suala la mgombea binafsi inaonekana mahakama imekwisha nawa mikono kwa masuala yonayohusu katiba.
 
Inawezekana katika International Courts ,iwapo mawakili wa vyama watashirikiana na mawakili wa bure ambao wanapatikana katika nchi za ulaya ,hapa inashitakiwa Tume au Serikali iliyopita ambayo iliongozwa na Jk.
