President Kibaki has warned against the politicisation of the anti-graft war, as a new session of Kenya's Parliament opened on Tuesday.

Speaking during the official opening of the Fourth Session of 10th Parliament on Tuesday, the President assured Kenyans of Government's commitment in the continued fight against the vice.

But he added: "We must not politicize or personalize the fight against corruption."

He called on all anti-corruption agencies to fast-track the conclusion of all pending corruption cases.

"The judiciary should also speed up the court process because speedy conclusion of corruption related cases is a key pillar in this fight." He said.

Also top on the President's speech to Parliament on Tuesday was the quest for a new constitution, where the President urged members of Parliament to forge "a national consensus" that would enhance unity among Kenyans during the referendum to be held later in the year.

The President commended the progress made by the Committee of Experts on the Constitution so far, as Kenyans looked forward towards a new constitution.

The consensus draft constitution is set to be presented to the Parliamentary Select Committee on Wednesday.

"Our country has sought to obtain a new constitution for the last two decades without success. But now we seem very close to this goal," he said.

During his speech to the House, President Kibaki also specifically urged MPs to promote national cohesion by making it a main agenda for the session.

He said Kenyans should resist the temptation to seek external solutions that can be found locally.

"Kenyans should trust the leadership of the country and abandon the temptation to look externally for solutions that can easily be found locally," He said.

"All Kenyans are looking upon us to champion a uniting agenda," he told the House.

He said differences between politicians could be solved amicably, appealing to the lawmakers "to avoid divisive partisan politics" and focus on the wellbeing of the country.

The President called on legislators to unite in passing laws that would speed up the reform process.

Earlier on in the day, the President held a meeting with Prime Minister Raila Odinga in a crucial show of unity. This was especially important after the political standoff between the two Kenya coalition leaders, precipitated by last week's controversial suspension of two Cabinet ministers over graft allegations.

A statement from State House said the two discussed a "wide range of issues touching on the Grand Coalition Government."

In Parliament, the President Kibaki spoke of the need to tackle the problem of poverty, telling the legislators to focus on investing in the education of the children and the youth.

He said "economic growth and shared prosperity" would ensure the creation of the much-needed opportunities for the people.

Noting the effect of politics on the economy, the President said it was important for Kenyan politics to promote stability and public confidence.

As a way to experience "real growth and success in the war against poverty," the President said policy initiatives must be taken, to reduce and maintain low interest rates.

This, he said, would enable Kenyans access affordable credit for investments in wealth creation and expansion of employment opportunities.

And, in response to the milk glut currently facing the country the President said he had instructed relevant government ministries to include powdered milk as part of the national food security reserve.

"We have instructed the Ministry of Special Programs and Livestock and Co-operatives to incorporate powder milk into the national food security reserves." he said

New laws

During this session, the President said the government would be tabling many Bills in Parliament, including those that would arise from the new constitution.

These include proposed laws, the Independent Policing Oversight Commission Bill and the Police Reforms Bill, both of which are expected to improve accountability and enhance the image of the Kenya Police.

The re-introduction of the Judicial Service Bill, which will entrench the independence of the judiciary, will tackle the need to improve efficiency and integrity of the judicial system.

A Bill providing a legal framework to enhance accountable and effective management at the Local Government is expected to be introduced, as well as another that seeks to prevent malpractices in General Elections as well as provide the procedures for conducting referendums, among others.

President's speech draws mixed reactions

US ambassador Michael Ranneberger faulted the Government on the war on graft, saying it lacked commitment to ending the vice.

Reacting to President Kibaki's speech during the State Opening of Parliament Tuesday, the envoy, however, said Kibaki's remarks were positive and hoped the Government would show commitment in fighting the vice.

"There is a lot of progress in constitutional review, police reforms but almost no action on corruption," said the ambassador.

Kibaki's take on reconciliation, he pointed out, was positive since it focused on unity.

Nominated MP Musa Sirma dismissed Kibaki's speech saying the President has reduced the fight against corruption to personal differences, witch hunting and tribalism.

Gichugu MP Martha Karua described the presidential speech as "rich in rhetoric" but empty on action. The former minister said the speech was a ‘public relations' exercise.

Agriculture Minister William Ruto said the speech captured the mood of the country.

Mandera Central MP and PSC chairman Abdikadir Mohammed said he was elated by the commendations by the President to his committee for the work done on constitutional review.

Water minister Charity Ngilu accused the Government of doing little to fight graft. Medical Services Minister Anyang' Nyong'o also dismissed Kibaki's assertion that Kenya's problems do not require foreign intervention or mediation.

That issue mkuu is a done deal. Raila na Ruto hawapatani hata kwa suluhu ya
upanga maana their paths are totally different. Raila ashaonyesha kua hana time
na mafisadi ambao wamejaa katika hii seriklai ya Kibaki. Kibaki naye anajulikana

The power politics in the coalition government played out in Parliament Wednesday morning after Members of Parliament disagreed over membership of the crucial House Business Committee.

The morning proceedings ended prematurely after only 30 minutes of acrimonious debate over who should sit in the 21-member committee that sets the House agenda.

Party whips had the previous night (Tuesday night) revised nominees to the committee to serve in the Fourth Session of Parliament.

While the PNU list remained unchanged, ODM reconstituted membership replacing three MPs among them Agriculture Minister William Ruto.

Mr Ruto, a deputy party leader, was replaced by ODM chairman Henry Kosgey (Industrialisation minister) while Medical Services Minister Anyang' Nyong'o took the place of ODM's party leader, Prime Minister Raila Odinga. Prof Nyong'o is ODM's Secretary general. Nyaribari Chache MP Robert Monda was also replaced by Bonchari MP Charles Onyancha.

Mr Ruto has recently been criticised by his party for appearing to show allegiance to its coalition rival, the Party of National Unity (PNU).

Parliament adjourned to the afternoon after a motion establishing the crucial committee was withdrawn to allow the political parties to consult.

Flawed

With the exception of Lands assistant minister Bifwoli Wakoli and at first ODM whip Jakoyo Midiwo, nearly all the other MPs present reckoned that the 21-member list presented to the House was flawed.

Chepalungu MP Isaac Ruto drew the first blood saying ODM's parliamentary group had "never met or discussed" the nominees to the HBC. Attempts by his whip, Mr Midiwo, accusing Mr Ruto of perennial absenteeism from the party's meetings were countered by Chachu Ganya (ODM, North Horr) who said the party had not met to discuss the names.

Deputy Speaker Farah Maalim, chairing, said the party problems had nothing to do with the chair, but apparently MPs were determined to reject the nominees.

Assistant minister Peter Munya, a PNU MP, also said his party had not agreed on the nominees: "A few individuals consult and totally ignore the rest of the members of that party."

"It sees that these people have not learnt that democracy is important," Mr Munya said amid foot-thumping in the House.

Another assistant minister Aden Duale was also up in arms saying "parties don't belong to individuals or the whips."

However, Mr Wakoli, in his lonely push to have the tabled names endorsed, said the MPs were being dishonest as it is they who had chosen the party leaders and if they weren't confident in the decisions the leaders made, then they ought to choose others.

"It will be very bad if we are going to bring our party differences on the floor of the House," Mr Wakoli said.

But this did not stop Imenti Central MP Gitobu Imanyara from asking the Grand Coalition Government's joint whips – George Thuo and Jakoyo Midiwo - to indicate the parties which had nominated members to the HBC.

"This is impunity… just because they got away with it (the list) the last time, they won't get away with it this time round," said Mr Imanyara.

This is in an apparent reference to the acrimony that has rocked the HBC formation in the past.

Mutito MP Kiema Kilonzo said MPs "refuse to be used as rubberstamps" and thus opposed the motion.

Igembe South MP Mithika Linturi, also the Kanu party whip, said his party had not been consulted.

"Our leaders must demonstrate their resolve to push for democracy," he said. "It is very surprising when I find names here when our PG has never met."

He alluded to "political party dictatorship" for the choice of nominees to House.

Mr Thuo said the House has to "show direction" to the principals and asked that the motion be withdrawn. but Turkana Central MP Ekwee Ethuro said.

MPs' secret night meetings see Parliament adopting powerful House team list that excludes Ruto and allies.

A flurry of secret meetings saw reason prevail in Parliament where MPs finally unanimously voted to form the House Business Committee, breaking a deadlock that threatened to derail constitutional review.

The vote effectively locked out Prime Minister Raila Odinga's party deputy William Ruto and his allies from the HBC.

The fear of a public backlash ensuing from the looming paralysis of business barely a day after the House reopened, also nudged backbenchers to keep away from the ODM feud that triggered the crisis.

There had been a standoff over composition of HBC, largely fueled by ODM's action to drop Mr Ruto, the Agriculture Minister, who has become a fierce critic of the Prime Minister.

Ruto's supporters complained the Eldoret North MP was targeted for his differences with Raila and cited it as a sign of the party's intolerance to criticism. They enlisted the backing of PNU members on Wednesday to block the list.

HBC decides the agenda of the House and no business can proceed until it is constituted. ODM sought to edge out its dissenting members from the committee to avoid giving their rivals PNU an upper hand in setting the agenda of the House.

Yesterday, backbenchers - including those who had voted to block the controversial list on Wednesday - broke the deadlock, citing national interest. The list of 21 names was approved in its original form.

Speaker consulted

But reports indicate Ruto had earlier met Speaker Kenneth Marende in the morning. Government Whips George Thuo and Jakoyo Midiwo are also said to have consulted the Speaker separately, in meetings that may have played a part in averting further confrontation.

In Parliament the MPs pointed at the need to ensure constitutional review stays on course in line with the time frames set out in the Constitution of Kenya Review Act 2008.

The Parliamentary Select Committee on constitutional review is expected to table the proposed constitution in the House on Tuesday, for a month-long debate ahead of the referendum.

Had the HBC Motion been scuttled, it would have required six months before reintroduction, essentially beating the purpose for the early recall of the House to debate the proposed constitution.

"The chair of PSC has indicated he is ready to table the Draft Constitution on Tuesday, and there are fears constitutional review could be derailed if we do not set up this committee," said Imenti Central MP Gitobu Imanyara.

He was among members who had earlier opposed the proposal, saying the whips had not consulted party members when drawing up the list.

Ikolomani MP Bonny Khalwale stressed the need to embark on "important business of a new constitution" as he supported the Motion to approve the 21 nominees.

Dr Khalwale, however, asked the PM not to use his position to punish critics while telling Ruto - who was in the Chamber - he is "strong enough" to take up the grievance with relevant ODM organs.

The Public Accounts Committee chairman said he thought the greatest danger to constitutional review was differences "across parties" and not wrangling "within parties".

Fought back

Gichugu MP Martha Karua said those dissatisfied with the list could have proposed amendments since in the absence of such "I'm left with no option but to vote for the names before the House".

The former Justice Minister had at one time been struck off the list by PNU but she fought back with the help of backbenchers.

Others who supported approval of the names were Assistant Ministers Mwangi Kiunjuri, Ayiecho Olweny and Wilfred Machage.

On Wednesday when the new list was first tabled, Ruto's allies dramatically opposed ODM's replacement of the Agriculture Minister with party chairman Henry Kosgey.

The party wrangles saw business on the first day of the Tenth Parliament's Fourth Session stall, a day after President Kibaki told the House in his opening speech to avoid partisan politics and focus on the heavy legislative agenda.

ODM also replaced Raila in the committee, a move that is perceived as an attempt by the PM to avert a showdown in the House with Vice-President Kalonzo Musyoka over the leadership of Government Business in Parliament.
