MALAWI'S high court has thrown out President Joyce Banda's application to block the release of election results, as counting continued at a snail's pace three days after the chaotic vote began.
Banda's People's Party (PP) had alleged that "figures that are coming from the districts tally centres are not matching with the number of voters from different polling stations because the system has been hacked," according to a court affidavit.
But in the ruling obtained by AFP on Friday, Judge Mike Tembo rejected the bid as "premature since official results are not yet out."
Banda on Thursday claimed "serious irregularities" in this week's highly charged election, saying people had voted multiple times, ballots had been tampered with, presiding officers arrested, and the computerised voter counting system had collapsed.
However, observers have so far noted "considerable organisational shortcomings" but little sign of rigging.
The country's electoral commission chief Maxon Mbendera earlier rebuffed Banda's request for an audit of the votes, telling AFP the president's claims were a sign of her "desperation".
Three days after Tuesday's vote no official results have been released and the southern African country's 28 districts are sending results manually via fax and email.
By midday on Friday only 12 percent of the votes had been counted, according to Mbendera, who added that the presidential polls were being prioritised.
Around 7.5 million people were eligible to cast their ballots for a new president, lawmakers and local government councillors in the fifth democratic polls since the end of decades of one-party rule in 1994.
"The arrival of results has been slow, but we have captured into our system over 12 percent of the poll. We are expanding staff to speed up data entry," Mbendera told a news conference.
He pledged to have final results within eight days of the start of the vote, with the first figures expected when tallying reached 30 percent of the ballots.
"We will not be hurried to announce the results. We want to ensure we are exact and every complaint is resolved," he said, adding that 135 complaints had been received.
Voting was extended from Tuesday through to Thursday when delays of up to 10 hours prompted riots in the commercial capital Blantyre, where the army was deployed.
This is the first major electoral test for the 64-year-old president, who came to power when her predecessor, Bingu wa Mutharika, died in office two years ago.
Unconfirmed results in local media say Peter Mutharika, brother of the late president, is in the lead.
A Banda-allied junior minister committed suicide on Thursday, apparently under the impression he had lost his constituency.
After Mutharika's corruption-tainted rule, Banda initially was a darling of the West as one of Africa's rare women leaders.
But her government has since been ensnared in a $30 million (22 million euros) government corruption scandal dubbed "Cashgate" that has seen foreign donors freeze badly needed aid.
Former foreign minister Mutharika, 74, was allowed to run in the election despite facing a trial for treason after allegedly trying to prevent Banda from taking power.
 
President of Malawi Dr Joyce Banda has nullified the whole electoral process with effect from Saturday, May 24 2014.
Citing Section 88(2) of the Malawi Constitution which stipulates that the President shall provide executive leadership in the interest of national unity in accordance with this Constitution and the laws of the Republic, President Joyce Banda said in light of this section, it was her duty to protect the Malawian republic after noting that the electoral process had numerous irregularities that many could bear testimony to.
“The Mec chairman himself admitted having discrepancies in the electoral process. For instance, some centers registered twice the numbers of initial registered voters,” she said speaking live on Zodiak Broadcasting Station
She said it was not in her interest to stand for presidency in the elections to follow, she just wanted to give Malawians an opportunity to fairly elect a leader of their choice.
Experts said the Constitution does not give the president the mandate to nullify the elections. Asked to comment on this mandate Joyce Banda said the matter is up to the Attorney General to clarify.
Malawi Law Society said President Joyce Banda had no legal mandate to stop the electoral process and call for a fresh election in 90 days.
MLS President Mandala Mambulasa said legally, the Malawi Electoral Commission (MEC) cannot be challenged on the electoral process until final results are released.
“She has no constitutional mandate to suspend vote counting,” he said
Addressing his staff, Mec Chairperspn Maxn Mbendera urged them to continue working,
“We have a duty to give Malawians the results and so stick with me and God bless you.”
Constitutional Law expert Professor Edge Kanyongolo told the press the President has no powers to suspend elections with Section 88 Subsection 2 of the Malawi Constitution which President Joyce Banda quoted earlier after calling for the suspension of the elections and calling for fresh ones where she said she will not contest.
“”I am puzzled, i am struggling to see how the cited section 88(2) gives the President the power to do that, it only gives her general power but not specific powers over election,”he said

Hatimaye Tume ya uchaguzi nchini Malawi imeanza kutoa matokeo ya uchaguzi mkuu uliofanyika nchini humo jumanne iliyopita.

Matokeo hayo ambayo ni asilimia 30 tu ya kura ambazo zimehesabiwa hadi sasa yanaonyesha kuwa mgombea wa chama kikuu cha upinzani Democratic Progressive Party-DPP Profesa Peter Mutharika anaongoza kwa kura 683,621 akifuatiwa na Dr Joyce Banda wa Peoples Party kwa kura 372,101

Mgombea Urais wa chama kikongwe cha kisiasa nchini humo, Malawi Congress Party MCP Mchungaji Dr Lazarus Chakwera anashika nafasi ya tatu kwa kujipatia kura 289,145 huku Atupele Muluzi wa United Democratic Front- UDF akikusanya kura za wamalawi 269,250

Mwandishi wa BBC Baruan Muhuza ambaye anafuatilia uchaguzi huo nchini humo, amesema mwenyekiti wa tume hiyo Jaji Mackson Mbendera aliwaambia waandishi wa habari mjini Blantyre usiku wa kuamkia leo kuwa tume yake kwa pamoja na wawakilishi wa vyama vya siasa wamethibitisha matokeo hayo.

Wakati huo huo Mahakama nchini humo imezuia uamuzi wa bodi ya wakurugenzi wa shirika la utangazaji la Malawi MBC kumlazimisha Mkurugenzi Mkuu Dr Benson Tembo kwenda likizo ya lazima na haraka.

Uamuzi huo umefuatia baadhi ya wanasheria kutoka kamisheni ya wanasheria wa Lilongwe kuweka zuwio mahakamani kupinga uamuzi wa bodi ya shirika hilo.

Itakumbukwa kuwa ijumaa asubuhi Dr Tembo alipewa barua ya kumtaka aende likizo ya lazima kutokana na madai kuwa ameshindwa kufuata maelekezo ya mwajiri wake ambaye ni serikali.

Miongoni mwa madai hayo ni pamoja na vyombo vya shirika hilo ikiwemo television na radio za taifa kuendelea kutoa matokeo ya uchaguzi ambayo hayajathibitishwa na Tume ya uchaguzi.

Pia MBC ilishindwa kurusha moja kwa moja matangazo ya mkutano wa Rais Joyce Banda na waandishi wa habari mjini Lilongwe siku ya alhamis, ambapo Dr Banda alikuwa akitoa maelekezo kwa tume ya uchaguzi kuanza kuhesabu kura kwa kutumia mikono na kuzuia kutoa matokeo kutokana na udanganyifu uliojitokeza.
