Court tells husband to pay ex-wife 8 million pesos for giving up career to run household

Local court orders a man to compensate his ex-wife with US$173,000, after she gave up her career to run their household and bring up their children.

A local court has ordered a man to pay his ex-wife eight million pesos (US$173,000) in compensation, because throughout their 30-year marriage she dedicated herself to running their household, Argentine outlets reported Monday.

Confirmation of the ruling was granted this week by the National Appeal Court, with the award benefitting a 70-year-old from Palermo identified only as M.L.

The woman, who holds a degree in economics, put aside her career in order to take charge of raising her children and domestic chores.

"The economic dependence of wives on their husbands is one of the central mechanisms through which women are subordinated in society," Judge Victoria Famá said in her ruling.

The magistrate set a "reasonable sum in order to balance the disparate economic situations of the spouses."

"After 27 years of marriage the accused abandoned his wife when she turned 60 years old, the age at which women obtain retirement benefits, being excluded from the labour market," the ruling said.

The couple formally separated in 2009 and divorced in 2011, although trial for her compensation – a measure introduced in the Civil Code of 2015 – only concluded being set now.

According to precedent, compensation can constitute a single payment, payment for rent, usufruct of certain goods or whatever other arrangement the parties agree to.

Clarín said Monday that the award was a record amount. Judge Famá said the award was higher as M.L. had given up her career in order to dedicate herself to child-rearing and running the household.
