    Kampuni ya British Aerospace (BAE Systems) ya nchini Uingereza iliyoinyonya Tanzania kwa kuiuzia rada kwa bei kubwa kulinganisha na thamani yake halisi, imetozwa faini ya dola za Marekani milioni 400 (Sh. bilioni 535), baada ya kukiri kutumika rushwa katika ununuzi wa rada hiyo.
    Rada hiyo ilinunuliwa na Serikali ya Tanzania kwa Paundi milioni 28,000 (Sh. bilioni 70), baada ya baadhi ya mawakala kushirikiana na kampuni hiyo kuongeza thamani ya bei ya rada hiyo.

    Kwa mujibu wa taarifa iliyopatikana jana jioni kupitia Idhaa ya Kiswahili ya Shirika la Utangazaji la Uingereza (BBC), sehemu ya fedha za faini hiyo, zimeamriwa kurejeshwa Tanzania kutokana na kununuliwa kwa rada hiyo.
    Taarifa hiyo ilimkariri Mkurugenzi wa BAE Sytem, Dicky Oliver, akikiri kuwa walifanya makosa kutumika rushwa katika ununuzi wa rada hiyo, lakini akasema faini waliyotozwa ni kubwa mno, ambayo haijawahi kutokea katika historia ya Uingereza.

    Hata hivyo, taarifa hiyo ilimkariri Oliver akisema kwamba, amefurahishwa na adhabu hiyo kwa vile itakuwa imefunga mjadala unaohusu kashfa hiyo.
    Alisema amejifunza kutokana na adhabu waliyopewa na kuongeza kuwa wanaiachia serikali ya Tanzania kuwachukulia hatua watakayoona inafaa watu waliohusika katika kashfa hiyo. Mbunge wa Bariadi Magharibi, Andrew Chenge (CCM), anatuhumiwa kuhusika na kashfa hiyo alipokuwa Mwanasheria Mkuu wa Serikali (AG) wakati rada hiyo inanunuliwa.

    Gazeti la The Guardian la Uingereza liliwahi kuandika kuwa, katika uchunguzi wa Taasisi ya Kuchunguza Makosa Makubwa (SFO) ya Uingereza, iligundulika akaunti moja inayohusishwa na Chenge ikiwa na zaidi ya dola za Marekani milioni 1 (Sh. bilioni 1.2) iliyopo kwenye Kisiwa cha Jersey, nchini humo.

    Kwa mujibu wa gazeti hilo, SFO ilimchukulia Chenge kuwa mtu anayeweza kuwa shahidi muhimu katika uchunguzi wa zabuni ya ununuzi wa rada hiyo.
    Gazeti hilo liliandika kwamba, SFO inatarajia kuanza upya kufanya uchunguzi kuhusu fedha hizo ili kuangalia iwapo zina uhusiano na zile zinazoaminika kutolewa kwa njia ya rushwa wakati Tanzania iliponunua rada hiyo mwaka 2002.

    Uchunguzi wa awali ulionyesha kuwa moja ya mambo yaliyokuwa yanafuatiliwa ni kujua iwapo fedha zinazoaminika kuwa za Chenge, zina uhusiano na zile zilizotoka katika Kampuni ya BAE System.

    The Guardian katika habari yake hiyo, liliripoti kuwa, taarifa hizo zinakuja ikiwa ni miaka mitatu tangu Taasisi ya Kuzuia na Kupambana na Rushwa nchini (Takukuru) kwa kushirikiana na SFO na taasisi za uchunguzi za Uswisi na Jersey zilipoanza kuchunguza kuhusu kashfa nzima ya ununuzi wa rada.

    Gazeti hilo lilimkariri Chenge akikiri kwamba fedha hizo ni zake, ambazo baadaye alipohojiwa na waandishi wa habari jijini Dar es Salaam aliziita kuwa ni "Vijisenti".

    Hata hivyo, Waziri wa Nchi, Ofisi ya Rais (Utawala Bora), Sophia Simba, alipoulizwa na waandishi wa habari mjini Dodoma siku moja baada ya taarifa za Chenge kumiliki fedha hizo, alisema "Hata angeuza ng'ombe wake wote walioko Bariadi asingeweza kuwa na fedha kiasi hicho".

    Wakati akihojiwa na gazeti hilo, Chenge alitumia fursa hiyo kukanusha kuwapo kwa uhusiano wowote kati ya fedha hizo na kashfa nzima ya ununuzi wa rada, uliofanywa wakati yeye akiwa Mwanasheria Mkuu wa Serikali.

    "Jambo la wazi linalotaka kuonekana hapa ni kwamba mimi nilipokea kwa lengo la kujinufaisha mwenyewe fedha za rushwa kutoka BAE. Huu ni uongo," alisema Chenge.

    Aidha, gazeti hilo lilimkariri Chenge akisema kuwa, wakati rada hiyo ilipokuwa ikinunuliwa, yeye alihusika kwa kiwango kidogo sana katika mchakato mzima, kwani jambo hilo lilishughulikiwa na wizara nyingine na uamuzi ukaidhinishwa na Baraza la Mawaziri.

    Alilazimika kujiuzulu uwaziri wa Miundombinu, baada ya kutolewa tuhuma dhidi yake za kumiliki kiasi hicho kikubwa cha fedha.

    Takukuru kwa upande wake imekuwa ikieleza umma kuwa inasubiri kupata maelekezo kutoka SFO ili ichukue hatua dhidi ya Chenge.
    Wakati Takukuru ikieleza hayo, Waziri Sophia alikaririwa na baadhi ya vyombo vya habari hivi karibuni akisema kwamba, SFO imemsafisha Chenge.

    Hata hivyo, baadaye taasisi hiyo ilikana kumsafisha mwanasiasa huyo dhidi ya kashfa hiyo.

    Serikali ya awamu ya tatu iliinunua rada hiyo ya gharama kubwa licha ya kutahadharishwa na aliyekuwa Waziri wa Ushirikiano wa Kimataifa wa Uingereza, Clare Short, kuwa rada hiyo ilikuwa ya gharama kubwa kwa nchi maskini kama Tanzania.

    BAE to pay $450m to end bribery case

    BAE Systems was on Friday night preparing to plead guilty to criminal charges and pay one of the biggest ever fines over alleged corporate bribery after striking a deal to end transatlantic corruption probes that have entangled it for years.
    The deal will cost the group almost $450m (£288m) – the bulk of it in the US – but should prevent it from being barred from government defence contracts in the US and elsewhere that underpin its business.

    The deal – in Britain’s biggest and most politically contentious corporate corruption case– immediately sparked debate over whether BAE had got off lightly after eight years of investigation in London and Washington.
    Under the settlement, the first co-ordinated transatlantic deal in a corporate bribery case, BAE has agreed to pay a $400m fine in the US and plead guilty to one charge of conspiring to make false statements to the government in connection with regulatory filings and undertakings.
    In Britain, the company is set to pay £30m and plead guilty to a minor accounting offence. Unlike the US, Britain has ruled out prosecuting any individuals.

    BAE said it accepted full responsibility for what it described as the “shortcomings” in its operations.
    Dick Olver, chairman, said the company had “systematically enhanced its compliance policies and processes” in the years since the conduct occurred. It had previously denied all wrongdoing.
    The penalties are among the three largest exacted by the US Department of Justice over corruption allegations, although BAE’s admitted failings are relatively light compared with those confessed by other companies that have paid big fines, such as Halliburton and Germany’s Siemens.
    While the UK settlement involves admissions of wrong-doing only in relation to the company’s sale of a radar system to Tanzania, the broader US deal covers central Europe as well as the company’s huge Saudi Arabian arms sales.
    The Department of Justice said its investigation was ongoing.
    The BAE case has had a high international profile since Tony Blair’s government drew heavy criticism three years ago for applying pressure that led the Serious Fraud Office to scrap its investigation into Saudi Arabian arms contracts worth tens of billions of pounds on grounds of national security.
    Campaign Against Arms Trade, the pressure group, said it was “shocked and angered” by the SFO settlement, which meant there would be “no opportunity to discover the truth behind alleged bribery and corruption in the many BAE deals”.
    BAE has always denied bribery.

    The difference between the US and the UK anti-corruption regime shows up in the fact that BAE will pay $400m to the Justice Department, but only £30m to the SFO. One reason is that the SFO’s prosecution only involved smaller bribery allegations. The US investigation, by contrast, covers a fuller panoply of BAE’s alleged dubious methods for securing contracts – including the infamous Al-Yamamah case, which the SFO dropped at the behest of Tony Blair in December 2006.

    Hivi kwanini na PCCB/au wizara ya Biashara Tanzania isiitoze faini kwa kuwaamuru hao BAE system kurudisha hicho cha Juu , ili wasi press charges against the BAE systems management/Company.
    Ikiwa Wamerekani wameweza na SFO wameweza, sisi tukiwa tumeumia tunaweza fanya Hivyo.

    I am very skeptical. Inawezekana there will be something for the media, lakini i do not see anything happening to anyone. Tutazugwa tu, au atafikishwa mtu mahakamani kesi itaahirishwa,sheria itakuwa twisted, itapigwa porojo and that will be it.

    Serikali ilisema wazi kuwa inawaogopa mafisadi, do not think there will be anything new.
