    FITINA, majungu na vitisho, sasa vinaonekana kuwachosha baadhi ya viongozi wastaafu wa serikali, ambao wamekuwa wakitajwa kuwa wanaweza kufikishwa mahakamani wakati wowote kwa makosa waliyoyafanya wakati wakiwa viongozi wa umma.

    Hali hiyo ilidhihirika jana, wakati Waziri Mkuu mstaafu, Jaji Joseph Sinde Warioba, alipokuwa akizungumza na waandishi wa habari ofisini kwake Masaki, Dar es Salaam, na kueleza kuwa wanaotaka kumkamata wafanye hivyo haraka.

    Warioba ambaye aliwaita waandishi wa habari wa vyombo vitatu ofisini kwake kueleza kuchoshwa kwake na maneno ambayo yamekuwa yakisambazwa kuwa ni mmoja wa viongozi watakaofikishwa mahakamani kwa makosa ya kutumia ofisi za umma vibaya, aliwaeleza wana habari hao kuwa amechoshwa na maneno hayo ya uvumi na ameamua kueleza kile anachokijua kuhusu mambo anayotuhumiwa nayo.

    Alisema taarifa ambazo zimekuwa zikienezwa kwa kasi kwamba ataburuzwa mahakamani wakati wowote kwa tuhuma za kutafuna fedha za Mwananchi Gold Company si za kweli, na hata kama zina ukweli, yuko tayari kupandishwa kizimbani na kueleza ukweli wa kile anachokijua kuhusu kampuni hiyo.

    Akiongea taratibu, lakini kwa tahadhari, alisisitiza kuwa yuko tayari kukamatwa kwa sababu anaamini serikali ina nguvu ya kumkamata na yeye atajitetea mahakamani.

    “Nimewaita, lengo la kuwaita katika mkutano huu ni kueleza kwa mapana, Kampuni ya Mwananchi Gold Company Ltd, ilianzishwa na nani na kwa madhumumi gani. Hii ni kwa sababu kampuni hii imekuwa ikitizamwa vibaya na wananchi wakati ilianzishwa kwa ridhaa ya serikali.

    “Watanzania wengi wanaitizama kampuni hiyo kama ni ya kifisadi, wakati ukweli ni kwamba uamuzi wa kuanzishwa kwake ulikuwa wa serikali ambayo ilikuwa ikitekeleza sera yake ya kuwasaidia wachimbaji wadogo wadogo ili waweze kusafisha dhahabu zao hapa nchini na kuziuza kwa bei halali.

    “Ninasikitika kumekuwa na maneno mengi ya kupotosha kuhusu uanzishwaji wa kampuni hii na uamuzi wa serikali kulikalia kimya suala hili pasipo kueleza ukweli kuhusu kampuni hii, umenisikitisha zaidi,” alisema Jaji Warioba.

    Akizungumza kuhusu alivyoshiriki katika kuanzisha kampuni hiyo, alisema Kampuni ya uwakili ya Nyalali, Warioba & Mahalu, Law Associates, ambayo yeye ni mmoja wa mawakili wanaoimiliki, iliombwa na serikali kutoa huduma ya kisheria kusaidia kuundwa kwa kampuni hiyo.

    Alisema, kampuni yake ilifanya kazi hiyo kama ilivyoombwa na serikali na kuiwezesha kununua kiwanja cha ekari 30, kilichopo eneo la Vingunguti, jijini Dar es Salaam ambako kulifungwa mashine za kusafishia madini na ilizinduliwa rasmi na Rais mstaafu wa Awamu ya Tatu, Benjamin Mkapa, Desemba mosi mwaka 2005.

    Jaji Warioba alisema, kampuni hiyo ilianza kufanya kazi kwa kununua dhahabu kutoka kwa wachimbaji wadogo wa wilayani Geita, lakini baadaye alishangazwa na uamuzi wa serikali wa kukataa kuendeleza mradi huo uliokuwa na tija kwa taifa.

    Alisema mradi uliokuwa ukiendeshwa na kampuni hiyo, ungeisaidia Benki Kuu ya Tanzania (BoT) kuhifadhi dhahabu hapa nchini na ungeisaidia serikali kujua kiasi cha dhahabu kinachopatikana hapa nchini kuliko ilivyo hivi sasa ambapo dhahabu inachimbwa na kusafirishwa nje ya nchi kwa ajili ya kusafishwa, jambo linalosababisha taifa kushindwa kujua kiasi kinachochimbwa na mchimbaji.

    “Uamuzi wa kuanzishwa kwa Kampuni ya Mwananchi Gold ulitokana na nia njema ya serikali, serikali iliamuru BoT na Shirika la Maendeleo la Taifa (NDC) na Kampuni ya MA-CE ya Italia kuunda kampuni hiyo. Baada ya uamuzi huo, serikali ilikuja kwenye ofisi yetu ya uwakili ya Nyalali, Warioba & Mahalu Law Associates ili tuisaidie kuipatia huduma ya kisheria kabla na baada ya kuundwa kwa kampuni hiyo.

    "Mimi nashangaa tunakwenda kusafisha dhahabu nje ya nchi wakati kiwanda cha kisasa cha kusafishia madini yote kipo pale Vingunguti, tena kilianzishwa kwa uamuzi wa serikali. Lakini cha kustaajabisha, kwa sababu za kisiasa tu kiwanda hiki kinapigwa vita usiku na mchana, wanaharibu mradi huu kwa mambo ya kisiasa tu, kisha wanaanza kutafuta mchawi wakati mchawi ni wao.

    “Nasisitiza kwamba mradi huu ni wa serikali na serikali ndiyo ilikuja kwenye ofisi yetu kutuomba tuisaidie huduma ya kisheria ya kuanzisha Kampuni ya Mwananchi Gold Company Ltd na ikairuhusu BoT kuingia kwenye biashara hiyo kwa sababu taasisi hiyo ina fedha. Lakini sasa serikali imeishinikiza BoT ijitoe katika mradi huo na wiki tatu zilizopita BoT iliwasilisha rasmi kwenye bodi ya wakurugenzi wa Kampuni hiyo ya Mwananchi kwamba imejitoa na hivyo sasa imebaki NDC peke yake,” alisema Jaji Warioba kwa masikitiko.


    Aliwataja wanahisa wa Kampuni ya Mwananchi Trust, ambayo ipo ndani ya Mwananchi Gold Company Ltd kuwa ni Umoja Entertainment, VNB, WM Holding inayomilikiwa na Yusuph Mushi, na CCM Trust Company.

    Alisema katika Kampuni ya Mwananchi Trust, aliyekuwa na hisa nyingi ni Chama Cha Mapinduzi (CCM) kilichokuwa na hisa 15.


    “Kwa hiyo, taarifa kwamba mimi nimetafuna fedha za mradi wa Mwananchi Gold Company Ltd si za kweli, sijatumia vibaya fedha za kampuni hiyo, kwani fedha zote tulizolipwa na BoT, ambayo ilitoa mkopo kwa mradi huo zipo kwenye maandishi na ushahidi upo wazi, ila nashangazwa sana, sijui kwa sababu za kisiasa mradi huu unapigwa vita,” alisema Jaji Warioba.

    Jaji Warioba alieleza kusikitishwa kwake na hatua ya serikali kuipiga vita moja kwa moja kampuni hiyo ambayo iliamua kuitoza kodi ya asilimia tatu, wakati ipo kwa mujibu wa sheria ya EPZ, inayotaka kampuni za aina hiyo zisilipe kodi.

    Alisema wakati serikali ikiipiga vita ya wazi kampuni hiyo, imekuwa ikitoa msamaha wa kodi kwa miaka mitano kwa kampuni za kigeni ambazo zipo nchini kwa ajili ya kuwekeza.


    Jaji Warioba alisema BoT iliikopesha kampuni hiyo dola milioni tano ili kuendesha mradi huo wa usafishaji wa dhahabu, kwamba fedha hizo ndizo anatuhumiwa yeye kupitia taarifa zinazoenezwa kwenye mitandao na baadhi ya vyombo vya habari kwamba alizitumia kiujanja ujanja kwa manufaa yake binafsi.

    Katika hali inayoonyesha kuchoshwa na tuhuma zinazosambazwa dhidi yake, Jaji Warioba alisema kuna viongozi wawili wazito kutoka serikalini ambao kwa nyakati tofauti walimfikia na kumweleza maneno tofauti.

    Alisema mmoja alimweleza kwamba TAKUKURU haina nia ya kumshitaki na mwingine alimweleza kuwa atashitakiwa bila TAKUKURU kujulishwa, taarifa alizoeleza kuwa zinamsababishia usumbufu mkubwa kutoka kwa ndugu, jamaa na marafiki, ambao wamekuwa wakimpigia simu na wakati mwingine wakifurika nyumbani kwake kupata ukweli wa jambo hilo.

    “Hivi nina kosa gani hadi taarifa hizi zinazagaa hivi? Ninaamini taarifa hizi hazisambazwi na watu wasio na mamlaka, ni watu wenye mamlaka kwenye taasisi za serikali ndio wamekuwa wakisambaza taarifa hizi, sasa ziwe za kweli au za uongo, nasema hivi, nimechoka na siogopi na hata leo wanaotaka kuja kunikamata waje.

    “Ila mimi ni msafi na nipo tayari kwa lolote, kwani hesabu za kampuni hii zipo sawa na ushahidi wa haya yote niliyowaeleza upo kwenye hizo nyaraka nilizowapatia,” alisema kwa sauti nzito Jaji Warioba.


    Hivi karibuni, baadhi ya vyombo vya habari, si Tanzania Daima Jumatano, vimekuwa vikiripoti habari kwamba Jaji Warioba anaweza kukamatwa na kuburuzwa mahakamani wakati wowote kwa kosa la kutumia fedha za kampuni hiyo kiujanja.

    Taarifa za kuwepo uwezekano wa Jaji Warioba kufikishwa mahakamani, zimekuja wakati baadhi ya waliokuwa viongozi waandamizi serikalini pamoja na wafanyabiashara mashuhuri hapa nchini wakiwa wamekwisha kufikishwa mahakamani kwa tuhuma za ufisadi na matumizi mabaya ya madaraka.

    hivi serekali ikiamua kuanzisha kampuni, hua inaanzishwa kwa mamlaka ya bunge au ndio hiyo inasajiliwa kwa mrajisi kinyemela. halafu role ya hao promoter na mawakili, warioba nk inaishia wapi? wao ndio wanaendelea kuiongoza au wanatakiwa kuwaachia wanahisa waendele na hiyo kazi. pila mbona sisi wananchi wahusika hatukuombwa kununua hisa, bali wamepeana huko huko kinyemela. na hizo kampuni zingine mbona warioba asitaje hao wamiliki wake badala ya kujificha nyuma ya pazi ya umoja entertainment etc etc.tatizo jingine, je bot kazi yao ni kutoa mikopo , na sio commercial bank, au kama ni ya serekali si ni treasury wanaotakiwa kutoa mitaji, na baada ya hapo ni benki au hiyo hiyo serekali kama ni 100% inamilikiwa na serikali? naona hapa mzee warioba anatakiwa aeleze ukweli ili asionekane ni fisadi. na kuhusu hii ngao ya nia njema, isiwe ni kivuli cha kuficha maovu, tumeona sehemu nyingi tu, inavyo tumika vibaya. sasa ndugu yangu warioba wewe ni mtu mwenye akili na uwezo wa kupambanua baya na jema, je hukuona nia mbaya waliokuwa nayo mafisadi? hivi na hiyo sourcing ya share holding ilifanyika kwa uwazi na kweli hau kirafiki?

    Mkulu hapo na mimi nimeona kama wewe kuna siri anajaribu kuficha hapa, hivi kampuni ya serikali ilianzishwa kwa sheira hipi, kama ni Raisi alimua kwa nini aamue na wanahisa wawe ni hakina nani, au criteria ya kupata wanahisa ilikuwa ipi, je mkopo umerejeshwa au bado na riba yake ni kiasi gani, kwanini kampuni hajapewa administrator kama inataka kufilisika wakati mkopo haujalipwa?
    waandishi wa habari mlitakiwa kumuuliza zaidi huyu kiongozi kwani inaonekana anajua mengi zaidi na anayaficha.
    inawezekana ni mpango wa serikali wamemwambia wewe toa press release halafu sisi tutakaa kimya useme kampuni ni ya serikali, serikali inamiliki hisa kiasi gani na ina maamuzi ya aina gani kwenye hii kampuni, CCM kwanini waliingia kwenye mradi kama huu kwa kupitia mlango wa nyuma.
    mimi sina tatizo na CCM kuwepo kwenye hii kampuni lakini kwa kupitia mlango wa nyuma, share zilitangazwa lini, kama hazikutangazwa je bunge lilipitisha kuanzisha kampuni hii ya serikali?
    Nafikiri wakati umefika sasa watatwambia ukweli kuhusu Mwananchi Gold, Deep Kijani (CCM) Kagoda na mengineyo yanayosumbua wananchi.

    Lazima chiligati atajibu mapigo ndani ya siku mbili hizi..........na nnatabiri itakuwa ni hoja ya kukurupuka maana likely anweza kuwa hata yeye halijui jui vizzuri hii deal.

    MPs want gold firm grilled

    MWANANCHI Gold Company Limited, a private project heavily-funded by the Central Bank, could soon come under the scrutiny of Parliament.

    This follows a request by an opposition MP demanding that the contract of the gold refinery project be brought before Parliament. The Leader of the Opposition in Parliament, Mr Hamad Rashid Mohamed, also asked the government to submit to Parliament the contract of another company -- Meremeta Limited -- for scrutiny.

    Meremeta Limited is a 50-50 venture company formed in 1998 between the Government of Tanzania and Triennex, a South African company.

    Mr Rashid was asking a supplementary question following queries from lawmakers on the role of the Bank of Tanzania during the morning question-and-answer session. In his response, the Deputy Minister for Finance, Mr Mustafa Mkullo, promised to work on the MP’s request, at which the Speaker of the National Assembly, Mr Samwel Sitta, said he hoped the government would make good on its pledge.

    The BoT has just a 20 per cent stake in the Mwananchi gold project, although it has been virtually bankrolling the gold refinery.

    Other shareholders in the project are the National Development Corporation (15 per cent), Chimera Company Limited (20 per cent) and Mwananchi Trust Company Limited (45 per cent).

    The BoT Governor, Dr Daudi Ballali, has declined to comment on the Mwananchi gold project and directed our questions to the chairman of the company’s board of directors, former prime minister, Joseph Warioba.

    Mr Warioba told THISDAY that the refinery has been negotiating a bank loan of up to US$ 5 million (6bn/-) for additional capitalisation.

    Mystery has been surrounding the privately-owned gold refinery located at the Vingunguti industrial area in Dar es Salaam.

    The initial investment of around US$ 3 million has been almost entirely bankrolled by the Central Bank, according to our sources.

    The BoT has so far put up billions of shillings for the purchase of property for the refinery and other start-up costs.

    Budgets and schedules have spiralled in the refinery, which was officially commissioned by former President, Benjamin Mkapa, on December 1, last year.

    The company’s Managing Director, Mr Isaac Manyalla, told THISDAY that the refinery had already started operations. But the firm’s board chairman, Mr Warioba, maintains that the refinery would begin operations once it acquires the bank loan.

    ’’Operating costs are very high ... if you want to operate, you need adequate funds to buy raw materials,’’ Mr Warioba had told THISDAY in an interview.

    However, he said the loan had been delayed due to problems with collateral on the property of the gold refinery.

    Editorial Comment: Mwananchi Gold: The truth shall set you free

    Finally, Mwananchi Gold has come out of its shell of secrecy and spoken - loudly- against stories published by THISDAY and its sister paper - KULIKONI. According to a statement of the company published in several local dailies, what we have been saying is a pack of lies and should be ignored and the company has been so advised by those ’close to it’ It is a commendable move but one that begs a lot of questions.

    Mwananchi Gold Company, which was formally inaugurated by the immediate former resident Benjamin William Mkapa in 2005 has not been known to be one that is transparent and that is a fact that we have, time and again, brought to the fore. The reason for this is paradoxically simple and complicated at the same time: the Bank of Tanzania has been bankrolling a project that the law does not allow it to be in.

    We have stated the facts and cited the opinion of legal experts and it all points to one fact: the project leaves a lot to be desired in the way it was conceived, structured and funded. We are talking about billions of shillings belonging to Tanzanians here which we feel a cheeky few are trying to use for personal gain. As it does not wash with us we had to speak for the voiceless.

    We must state categorically that the statement by the company has not addressed a number of issues which we think must be thoroughly explained. We understand that as a company it is the money that matters and not those who brings it. However, given the high social standing that those who are ’the body and soul’ of the company have, transparency is vital. This is not OPM (Other People’s Money) but Tanzanians’.

    The statement by Mwananchi Gold is, in our considered opinion, meant to mislead the public by avoiding the real issues and resorting to simplifying matters which should not be treated so. We have addressed the illegality of the Bank of Tanzania involving itself in the project only to be told by Mwananchi Gold that its involvement ’in the development of the gold refinery is associated with the tradition that links gold refineries with central banks’ Only one example has been cited - that of the Reserve Bank of zimbabwe owning a gold refinery.

    The point that Mwananchi Gold has missed here is that we are not talking about tradition but the law that governs the operations of the BoT. Expert opinion says that the old and the new Bank of Tanzania principal legislation does not allow the Bank to involve itself in commercial or industrial undertakings unless it is for the sole reason of recovering debts owed to it.

    We dare Mwananchi Gold not only to deny that it is both, a commercial and industrial undertaking, but also to give the correct legal position lest we have faltered.

    Mwananchi Gold has dared us to go to CCM while have stated that we have been there. We all know CCM and as its chairman President Jakaya Kikwete said, ’CCM ni vikao’ (CCM matters are decided in properly constituted meetings). Let us refresh Mwananchi Gold’s memory by stating that we quoted the immediate former Secretary General of CCM Phillip Mangula as well as Mzee Peter Kisumo, a trustee of the party.

    What we said is in one of the issues that Mwananchi Gold has associated with ’the frivolous’ -us. No, we are not. We are the tellers of the truth and the truth is never frivolous.

    We dare Mwananchi Gold to produce an instrument executed by CCM appointing the trustees of the Mwananchi Trust - the majority shareholders - and authorising the company (Mwananchi Trust) to purchase and hold shares in the Mwananchi Gold.

    We say this as we are reliably informed that even the CCM’s Central Committee is yet to be informed about the venture - so unlike CCM. We know the ploy is to drag in CCM so that we get cold feet, but this CCM is not that of yesteryears. We invite Mwananchi Gold to closely watch the way its chairman walks his talk.

    Given the massive ’investment’ in the undertaking, if Mwananchi Gold went headlong into the project without due diligence being carried out on its shareholders, it is solely responsible for getting its chestnuts out of the fire - we are not. Tell the truth Mwananchi Gold for it shall make you free.

    What we see here is a situation whereby the name of the artisanal and small scale miners has been used to set into motion a project that is meant to benefit a few but putting majority in harm’s way through illegal infusion of capital .

    We say, and we repeat, our law does not allow the BoT to go into ventures like this. Apparently the BoT was cajoled, whether by default or design, to bankroll a project that, four years down the line, has not shown any results but an incessant thirst for public funds. Are we supposed to bury our heads in the sand? No. Not THISDAY. We hold the truth dear and we say it - loudly and proudly.

    We wish to remind Mwananchi and the like-minded that our paper is run by well-trained professionals with diverse professionals who cannot be derailed by the simple-minded. When we took it upon ourselves to tell the truth, we meant it and we are doing it. The people will absolve us. Threatened legal action is most welcome, for those who are aggrieved have that legal right.

    Yes, CCM owns Mwananchi Gold, unsigned statement says

    MWANANCHI Gold Company Limited declared yesterday that the ruling Chama Cha Mapinduzi (CCM) has shares in the gold refinery.

    In an unsigned media statement, the company stated that CCM Trust Company Limited, which is associated with the gold refinery, was owned by the ruling party.

    ’’We would like to declare that CCM Trust Company belongs to CCM, we dare them (THISDAY) to go to CCM and see if they will dispute that,’’ said the statement, which is not only unsigned but also bore no official seal or stamp.

    CCM Trust Company Limited holds a major stake in Mwananchi Trust Company, which owns 45 per cent of the shares in the gold refinery, making it the majority shareholder.

    In the three-page statement, Mwananchi gold roundly attacked THISDAY, its journalists and publishers for alleged malice, but admits that journalists from THISDAY interviewed its Board Chairman, former Prime Minister, Joseph Warioba, on several occasions.

    Investigations by THISDAY established that officials at the Business Registration and Licensing Authority (BRELA) had initially refused to register CCM Trust Company Limited until a letter of consent for the use of the name was obtained from the ruling party.

    Records at BRELA further show that Mr Warioba and businessman Yusuph Mushi are the subscribers, directors and first shareholders of CCM Trust Company Limited.

    A letter of consent said to have been signed by former CCM Secretary-General, Phillip Mangula, was submitted to BRELA to authorise the use of the ruling party’s name.

    Several senior CCM leaders, some of them preferring not to be named, say they are not aware of the existence of CCM Trust Company Limited and its involvement in the gold refinery.

    Our investigations further revealed that the ruling party’s Central Committee had not even been informed about the existence of such a company.

    Apart from being listed as shareholders of CCM Trust Company Ltd, the former PM and Mr Mushi already own other shares in the gold refinery through Umoja Entertainment and YM Holding Company respectively.

    The BoT has been heavily funding the privately-owned gold refinery, an undertaking described by legal analysts as illegal.

    The BoT has a 20 per cent stake in the gold refinery located at Vingunguti area in Dar es Salaam, with other shareholders being Mwananchi Trust Company (45 per cent), the National Development Corporation (15 per cent) and Chimera Company Limited (20 per cent).

    THE Bank of Tanzania has broken its own law by investing in the privately-owned Mwananchi Gold Company Limited, legal analysts said yesterday.

    ”BoT’s involvement in the Mwananchi project is in contravention of the repealed Bank of Tanzania Act of 1995 that preceded the Bank of Tanzania Act of 2006, which became operational this month,” said a legal expert familiar with Central Bank operations.

    According to the expert, the 1995 Act allowed the BoT by the provisions of Section 52(1)(a) to ”import, export, buy, sell, hold or otherwise deal in gold”.

    However, analysts maintain that the BoT could only do this in its own capacity and not as a shareholder or part of another entity with a separate legal personality.

    Citing the provisions of Section 60(1)(a) of the same Act, the experts noted that the law expressly prohibits the BoT to ”engage in trade, own or acquire any direct interest in any commercial, agricultural, industrial or similar undertaking except in the course of obtaining satisfaction for any debt due to the Bank”.

    ”The Mwananchi gold project is not only a private commercial venture, but also an industrial one as it is meant to process raw gold. As such, according to the law, BoT had no business being there”, said another expert.

    He added: ”Being a shareholder in the gold refinery, BoT acquired a ’direct interest’ in Mwananchi Gold Company and this is, by any interpretation, contrary to the law. And there was no debt to recover when BoT went in.”

    The new BoT Act of 2006 has similar provisions on the Bank’s involvement in gold dealings and prohibition on involvement in trade, commercial and industrial undertakings.

    The Bank of Tanzania has a 20 per cent stake in Mwananchi Gold Company Limited, which was officially commissioned by former President Benjamin Mkapa in December, last year.

    Apart from directly investing in the privately-owned company for its share capital, the Central Bank has been heavily funding the project from its inception.

    In the year 2003, the BoT had provided an interest-free loan to the National Development Corporation (NDC) amounting to $1,865,000 (around 2bn/-) for the purchase of the plot in Vingunguti area on the outskirts of the city where the refinery is located.

    Last year, the BoT was forced to come to the rescue of the gold refinery when it ran out of money to pay staff salaries.

    Following a request from the Chairman of the company’s Board of Directors, former Prime Minister, Joseph Warioba, who is also one of the shareholders in the project, the BoT injected a further $ 95,000 (around 100m/-) as a loan to the private, commercial project contrary to its own law.

    In a letter dated March 10, 2005, Mr Warioba made an urgent plea to the BoT Governor, Dr Daudi Ballali, for the loan, using share certificates as collateral.

    The involvement of the Central Bank in the privately owned project does not only end in bankrolling its operations.

    The BoT also seconded one of its senior officers, Mr Isaac Manyalla, to run the gold refinery as its managing director.

    There has been confusion over the status of a mystery company using the name of the ruling Chama Cha Mapinduzi (CCM) that is tied up to the gold refinery.

    Top CCM leaders say they are not aware about the existence of the company that owns a substantial amount of shares in the project.

    Our investigations revealed that Mr Warioba and businessman Yusuph Mushi, who already own shares in the gold refinery, were also listed as subscribers, directors and first shareholders of the mystery CCM Trust Company Limited.​

    Mashtaka yatakuwa kujiandikisha kama wao ni CCM Trust wakati CCM haikuwapa ruhusa hiyo. CCM kama ingetaka kuwa na hisa au trust wangeweza kufanya kwa namna tofauti. Aulizwe Makalla kama wanaitambua CCM Trust Company ya kina Warioba na Mushi. I bet my last nickel kwamba CCM watawaruka!

    Kwa sababu sidhani kama watapata dondoo za kikao chochote kilichounda au kuidhinisha CCM trust kufanya kazi na Mwananchi Gold.

    Jamani Warioba aliwaita waandishi wa Habari ili awaeleze ufahamu wake kuhusu tuhuma zinazosemwasemwa mitaani na katika baadhi ya vyombo vya habari. Sasa alichokisema ndicho alichokuwa tayari kukisema. Ndio maana anasema, kama kuna kushitakiwa yuko tayari kujibu mashitaka hayo wakati wowote.

    Ndugu zangu, Jaji Warioba ni mtu makini sana. NI mtu anaefikiri kabla ya kusema. Na anasema kinachojitosheleza. Anapotaja Makampuni yenye uwekezaji katika hiyo MWANANCHI Gold anajua anachokisema. Kama unavyojua, Kampuni ina wamiliki wake, na wamiliki wanaweza kuwepo leo, kesho wakauza share zao. Hawezi kutaja tu moja kwa moja wamiliki wa hizo kampuni bila kuwa makini. Yeye kama Jaji anajua umuhimu wa kuhifadhi taarifa za watu (Kama Waziri Mkuu mstaafu, anaijua Katiba). Haikuwa nia yake kwenye kikao kile kisema majina ya watu wowote.

    Pili ushiriki wake na Kampuni yake ameusema bayana. Kama unavyojua, Memorandum and Articles of Association za Kampuni yoyote huandaliwa na wana sheria. Kampuni yake ilipewa kazi ya kufanya hivyo, pamoja na ushauri mwingine wa kisheria endapo utahitajika wakati wowote kabla na baada ya kuanzishwa kwa Kampuni hiyo (hii ameisema vizuri katika taarifa hapo juu Sijaona mahali anaposema alikuwa mwendeshaji wa Kapuni hiyo (labda kama kuna mtu anaweza kunisaidia hilo).

    Wakuu, nadhani mnajua pia kuwa Serikali imepewa mamlaka na Katiba kupitia Bunge kuanzisha Taasisi, na taratibu zimewekwa za kufanya hivyo. Serikali pia inaweza kuwa na wabia wengine (binafsi au Taasisi za serikali) katika kufikia matarajio ya uanzishwaji wa Taasisi hizo.

    Nilidhani mngeshitushwa zaidi na taarifa ya kudidimizwa kwa MWANCHI GOLD ambayo inaelekea ilikuwa na nia ya kuhakikisha rasilimali (madini) yetu yanasafishwa hapa hapa nchini na kutuhakikishia kuwa hatuporwi mali hizo. Mimi kwangu ni jambo la kushtua sana kusikia serikali inakusudia kwa nguvu zote kuua shirika/Kampuni muhimu kama hiyo.

    Inaelekea judge Warioba ameshaanza kupata joto ya jiwe. Huo mradi una kila aina ya ufisadi, asubiri na yeye Kisutu kama kweli atafikishwa huko. Dhahabu ichimbwe kanda ya ziwa, wao wasafishe Dar Es Salaam?

    Kelele za nini? Kama atapelekwa mahakamani si asubiri siku ifike?

    Tanzania kuna viongozi walikuwa wanafuja mali za wananchi wakiamini ni sawa kwasababu walikuwa na baraka za serikali.

    Kundi lingine ninalolipigia kelele mimi ni hao wanaotumia mabilioni kujifanya wanaenda kutibiwa nje kumbe ni ulaji tu. Inabidi wao pia serikali iwachunguze na kujua kama kweli hayo mabilioni yalienda kwenye matibabu. Watu walikuwa viongozi wa nchi lakini wanaongoza kwa kutoa receipts fake.

    Halafu bado yuko kwenye board moja na prof. Mahalu?

Akanijibu kuwa huna haja ya barua kama wewe unamfahamu kigogo wa ssm akikupa kinoti utapata wala hakuna cha usaili.     Ninaona wazi kuwa Waryoba yuko matatani kabisa, ndiyo maana anaanza juhudi za ku-premepty serikali. Huenda hakuwa na nia mbaya na wala hakula pesa za kampuni hiyo, ila aliingizwa mkenge na wabaya wake hasa baada ya kuwa ametoa ripoti yake kuhusu kero ya rushwa halafu ripoti hiyo ikakaliwa na serikali. Ripoti ile ilikuwa imegusa maslahi ya watu ambao bado walikuwa na power serikalini. Inawezekana ndio walimuskia mtego wa kupaka rangi ya kifisadi kwenye mikono yake.

    Anapodai kuwa yeye alitoa ushauri wa kisheria tu ili kuanzisha kampuni ile lakini kumbe yeye ndiye aliyekuwa mwenyekiti wa bodi ya kampuni hiyo ambayo ilipewa pesa na benki kuu zikayeyuka, basi hapo kuna swali kubwa linalohitaji majibu, na yeye kama mwenyekiti wa bodi ndiye anayetakiwa kutoa majibu hayo. Hata kama hela ziliozotolewa na BoT zililiwa na wengine, bado yeye kama kiongozi wa kampuni ndiye anayebeba lawama.

    Hiyo conflict of interest babu kubwa, mwenyekiti wa board, shareholder na kampuni yake ndio inatoa ushauri wa kisheria. Hivi judge Warioba kweli hilo hakuliona wala hakuona ni tatizo?

    Sasa naamini kabisa kuna mambo mengi ambayo yana utata na ambayo kwa mzee mwaminifu kama Jaji Warioba angepumzika na kuacha mambo yajiendee kwani hata sualala kumshitaki ni tata sana kwani halina maslahi kwa Taifa kwa sasa kama hawatawashitaki kina Rostam, Lowassa, Manji, Karamagi, Chenge na wote waliochota mabilioni ya fedha za nchi hii na si Warioba ambaye ametumika tu kwa kuwa kwake mwanasheria na mwana CCM

    a. Kampuni ya Nyalali, Warioba na Mahula (mmoja aliwahi kuwa Jaji Mkuu, mwingine Waziri Mkuu, na mwingine Balozi) inaweza vipi kufanya biashara na taasisi kama Benki Kuu bila kuwa na aina fulani ya insider information n.k? At that time ilikuwa ni muda gani tanu Nyalali atoke Ujaji Mkuu?

    b. CCM hata kama imetoa baraka ya jina hilo kutumiwa iweje leo iwe ina hisa? Huko Brela rekodi za CCM Trust Company zinasemaje? Huu yawezekana kuwa ndiyo ushahidi wa kwanza kuwa CCM kama chama kinahusika na ufisadi badala ya madai kuwa ni 'mtu mmoja mmoja'.
