    WAUNGANA NA CHADEMA KUKWAMISHA HOJA ZA WAZIRI MKULO NA JAJI WEREMA

    WABUNGE wa CCM jana waliongoza mashambulizi dhidi ya Serikali na kufanikisha kuondolewa kwa hoja mbili zilizowasilishwa na Waziri wa Fedha na Uchumi, Mustafa Mkulo na Mwanasheria Mkuu wa Serikali (AG), Jaji Frederick Werema.Hoja ya kwanza ya Serikali iliwasilishwa asubuhi na Waziri Mkulo ambaye alitaka Bunge liidhinishe punguzo la ushuru wa maji ya kunywa kutoka Sh69 kwa chupa hadi Sh12.

    Jana jioni, Jaji Werema aliwasilisha hoja ya mabadiliko ya Sheria Mbalimbali ikiwamo ya Bodi ya Mikopo. Hoja hizo zote ziligonga ukuta na kuondolewa bungeni hadi mkutano ujao.

    Mkulo

    Akiwasilisha azimio hilo, Mkulo alisema kutokana na ongezeko la ushuru, maji ya chupa yamepanda kwa kiwango kikubwa, hivyo kuwafanya watumiaji wengi ambao ni wananchi wa kawaida kushindwa kumudu bei na kutumia maji ambayo siyo salama na kuhatarisha maisha yao.

    “Ushuru wa bidhaa uliotarajiwa kukusanywa kwa kipindi cha Julai hadi Juni, 2012 kwa kiwango cha Sh69 kwa lita ni Sh15,549.3 milioni. Mapendekezo mapya ya kupunguza ushuru yatakusanya Sh2,704.2 milioni,” alifafanua Mkulo.

    Alisema punguzo hilo litasababisha nakisi ya Sh12,845.1 milioni na kwamba, kuanzia Julai hadi Desemba, mwaka jana tayari wamekusanya Sh6,730 milioni.

    “Hivyo, kwa kutumia kiwango kipya cha Sh12 kwa lita, nakisi ya mapato itapungua kutoka Sh8,819.3 milioni hadi Sh7,719.3 milioni,” alisema.

    Waziri Mkulo alipendekeza maeneo ya kuziba nakisi hiyo kuwa ni kupunguza posho, fedha zinazotumika kwenye makongamano, ununuzi wa magari, gharama za uendeshaji, ununuzi wa samani, mafunzo ya ndani na nje, safari za ndani na nje na ukarabati wa majengo.

    Serikali hivi sasa inatumia Sh360 bilioni kwa ajili ya posho, kati ya fedha hizo, Sh14 bilioni zinahusu wabunge.

    Mpango wa miaka mitano wa Serikali unaonyesha kupunguza posho na kutafuta njia bora za kulipana mishahara mizuri.

    Wabunge

    Hata hivyo, akichangia azimio hilo Mbunge wa Wawi, Hamad Rashid Mohamed (CUF), alisema Mamlaka ya Mapato Tanzania (TRA), inaonyesha wamekusanya mapato kwa asilimia 102, lakini makusanyo hayaonekani akidai kutolewa kwa maelezo ya ziada.

    “Tuna matatizo ya madaktari, wanafunzi, tuna matatizo chungu nzima, fedha tulizoidhinisha kwenye bajeti hazipelekwi kwenye halmashauri, haituingii akilini,” alisema.

    “ Kama una mapato ya ziada bado una matatizo, basi unahitaji maelezo ya ziada kuturidhisha,” alisema Hamad.

    Mbunge wa Buchosa, Dk Charles Tizeba (CCM), aliwashangaa baadhi ya wabunge kwa kuipongeza Serikali kwa usikivu wa kupeleka amri hiyo, huku akitaka waelezwe hasara iliyopatikana kwa ukaidi wa waziri kabla ya kupitisha.

    “Kwanza waziri (Mkulo), angetuambia kwa nini alikaidi ushauri wa kamati na hasara ambayo taifa limepata, wenzangu wamesema ni usikivu, lakini mimi sioni zaidi ya ukaidi, huu siyo mwenendo mzuri. Ushauri wa wabunge unakuwa na nia nzuri,” alisema Dk Tizeba.

    Dk Tizeba alishangaa marekebisho hayo kuhusu maji yanayozalishwa nchini pekee, ilhali mvinyo unaozalishwa nchini unatozwa Sh420 kwa chupa na unaotoka nje Sh122 na kumtaka Waziri Mkulo, atoe sababu ya mbao za nje kutozwa ushuru kidogo, huku mzigo zikibebeshwa zinazozalishwa nchini.

    Alitaka TRA kuacha urasimu na ulegelege kutokana na kutotanua vyanzo vya mapato.

    Mbunge wa Kalenga, William Mgimwa (CCM), alihoji iwapo maeneo yaliyopendekezwa kupangwa kwa ajili ya kufidia nakisi hiyo yalikuwa na ziada na kwamba, kama hakuna basi ni matatizo.

    “Kama TRA inakusanya asilimia 102 na kuna upungufu wa fedha, basi kuna tatizo na tunahitaji maelezo maana tuna takwimu za makusanyo, lakini hakuna maelezo ya matumizi,” alisema Mgimwa.

    Wengine waliochangia hoja hiyo ni Henry Shekifu (Lushoto), Leticia Nyerere (Chadema-Viti Maalumu) na Zaria Madabida (CCM-Viti Maalumu).

    Akijibu hoja mbalimbali za wabunge, Mkulo aliwasihi wabunge kutokwamisha hoja hiyo na kwamba, tayari maeneo mengine yamepunguziwa kasma.

    Baada ya Mkullo kujibu hoja, alisimama Dk Tizeba kwa kutumia kanuni ya 58, akitaka kutopitisha amri hiyo na kuitaka Serikali kwenda kuifanyia marekebisho mbalimbali.

    “Punguzo hilo halitamsaidia mlaji wa kawaida zaidi ya wenye viwanda kama waziri alivyokiri ameandikiwa na wenye viwanda… kwa hiyo itanufaisha wenyewe,” alisema Dk Tizeba.

    Naibu Spika wa Bunge, Job Ndugai, alikataa matumizi ya kanuni hiyo kwa madai ilikuwa haihusiani na hoja hiyo na kuamua kutumia kanuni ya 69 (2), inayompa mamlaka Spika kuhoji wabunge wanaokubali na wanaokataa.

    Hata hivyo, kwa mara ya kwanza katika historia ya kutumia kanuni hiyo, waliokataa hoja walishinda huku Ndugai akiitaka Serikali kwenda kujipanga upya.

    Jaji Werema
    Kwa upande wa Werema hoja yake ya Muswada wa Marekebisho ya Sheria 17 ikiwamo ya Bodi ya Mikopo, iligonga mwamba baada ya wabunge kutaka uondolewe kwanza upungufu uliomo katika sheria hizo.

    Hoja hiyo ilianza kukataliwa na mbunge wa Kigamboni, Dk Faustine Ndugulile aliyesema wao kama Kamati ya Huduma za Jamii, wanapinga moja kwa moja muswada huo kwa kuwa kamati yao haikuhusishwa.

    Alisema kwanza, Rasimu ya Sheria ya Bodi ya Mikopo ambayo iko katika marekebisho hayo, italeta mgogoro zaidi kwenye vyuo vikuu nchini.

    "Sheria hii inaleta ubaguzi kati ya watoto maskini na matajiri, hivyo mjadala huu uahirishwe hadi utakapopangwa upya. Naomba wenzangu mniunge mkono ili ijadiliwe katika kikao cha mwezi wa nne," alisema Dk Ndugulile na kisha kuungwa mkono na wabunge.

    Wakati Ndugai akitafakari hilo alimtaka mbunge wa Viti Maalumu CCM, Angela Kairuki kuendelea kuchangia na alipomaliza, mbunge wa Mkanyageni (CUF), Habib Mnyaa alijaribu kuokoa jahazi kwa kutaka hoja ya Dk Ndugulile iondolewe ili waendelee kujadili muswada huo.

    Kitendo hicho kilimfanya mbunge wa Kigoma Kaskazini, Zitto Kabwe (Chadema) kumtaka Naibu Spika atoe mwongozo wa hoja ya kwanza iliyoungwa mkono na wabunge wengine.

    Baada ya hapo alisimama Kaimu Mnadhimu wa Serikali, Dk Mary Nagu ambaye aliwaomba wabunge waiunge mkono hoja hiyo na kuwataka mawaziri wenzake kufanya hivyo, lakini pia jaribio hilo liligonga mwamba.

    Kitendo hicho kilimlazimu Jaji Werema kusimama na kuwaeleza wabunge kuwa inawezekana suala la Bodi ya Mikopo likaondolewa lakini, kwa kuwa wabunge ndiyo wenye uamuzi wa kutunga sheria, waamue wao.

    "Bado sijafukuzwa ujaji, huu ni mhimili muhimu sana, lakini kwa kauli zenu na tabia zenu tukienda hivi tunaweza kuuharibu. Nimekaa kwenye ujaji muda mrefu sijaona, najua kuna upepo unaendelea nje na ndani ya Bunge," alisema Jaji Werema na kuongeza: "…tuko tayari kupokea uamuzi wowote utakaotolewa unaoruhusiwa na kanuni," alisema Jaji Werema akiwa tayari kupokea mwongozo wa Spika.

    Hata hivyo, Mnadhimu wa Kambi ya Upinzani, Tundu Lissu alisimama na kumweleza Naibu Spika kuwa hoja iliyoko mbele ni moja ya kutokukubaliwa kujadiliwa kwa muswada huo hivyo aitolee uamuzi kama kanuni inavyotaka.

    "Hoja ya Ndugulile ni ya marekebisho mbalimbali na ndiyo hoja pekee iliyoko kwenye mjadala. Kama hoja ina mashiko unatakiwa uwaulize wabunge waamue. Hoja iondolewe kwa mujibu wa Kanuni ya 90 inayotaka iondolewe yote," alisema Lissu.

    Baada ya hoja ya Lissu, Ndugai alisimama na kueleza kuwa kanuni hiyo inataka mbunge anapotaka ifanyike hivyo ataje iahirishwe mpaka lini na kwa sababu gani kitu ambacho alieleza kuwa Dk Ndugulile alikitimiza.

    "Kutokana na hilo nitawahoji wanaokubali waseme ndiyo na wasiokubali waseme siyo," alisema Ndugai.

    Wabunge waliokubaliana na Dk Ndugulile walikuwa wengi hivyo Ndugai aliahirisha hoja hiyo hadi mkutano ujao wa Bunge hapo Aprili.

    Wabunge hao wamesema hawaridhishwi na mwenendo wa serikali ya Rais Kikwete kiasi cha kufikia hatua ya kutishia kupiga kura ya kutokuwa na imani naye. Wabunge hao pia walipendekeza Waziri wa Afya na Ustawi wa Jamii, Haji Mponda, Naibu Waziri Dk. Lucy Nkya na Katibu Mkuu wa wizara hiyo Blandina Nyoni watimuliwe kwa kusababisha mgomo wa madaktari uliochangia kuongezeka kwa vifo vya wagonjwa waliokosa huduma za kitabibu katika hospitali mbalimbali nchini.

    Wabunge hao waliichachamalia serikali katika kikao cha ndani cha wabunge wa CCM, kilichofanyika katika ukumbi wa Pius Msekwa mjini hapa, chini ya uenyekiti wa Waziri Mkuu Mizengo. Vyanzo vyetu vya habari kutoka ndani ya kikao hicho vilisema kuwa pamoja na mambo mengine, wabunge hao walionyeshwa kukerwa na mambo mawili makubwa yaliyofanywa na Rais Kikwete na kusababisha wabunge wake wa CCM waonekane wajinga mbele ya wenzao wa upinzani, hususan Chama cha Demokrasia na Maendeleo (CHADEMA).

    Kwa mujibu wa habari hizo, mambo hayo ni pamoja na suala la posho mpya za wabunge na jinsi Rais Kikwete alivyoamua kumgeuka Waziri Mkuu Mizengo Pinda na Spika wa Bunge, Anna Makinda, juu ya suala la posho za wabunge. Jambo jingine lililosababisha wabunge hao kumchambua Rais Kikwete ni suala la mabadiliko ya sheria ya Katiba ambapo mapendekezo mengi yaliyopitishwa na wabunge wa CCM bungeni yameondolewa baada ya Rais Kikwete kukubali mapendekezo ya CHADEMA.

    Miongoni mwa wabunge waomlipua Rais Kikwete katika kikao hicho, Beatrice Shelukindo (Kilindi), alieleza kutofurahishwa kwake na majibu ya Rais Kikwete kuhusu posho mpya za wabunge. Mbunge huyo machachari alisema kuwa anashangazwa na serikali ya Kikwete kutokuwa na mawasiliano na viongozi wenzake kiasi cha kutoa majibu yanayotofautiana katika jambo moja, hali ambayo imewashangaza wananchi wengi.
    Shelukindo alisema kauli ya Rais Kikwete kusema kwamba hajabariki posho mpya na kwamba hakuna mahali alipotia saini, imewaumbua Spika Anne Makinda na Waziri Mkuu Mizengo Pinda, ambao walitamka hadharani kwamba Rais tayari ameshabariki posho hizo.

    Shelukindo alisema pia kwamba Rais amewaudhi katika kushughulia sheria ya mabadiliko ya Katiba, kwani muswada ulioleta sheria hiyo ulipitishwa na wabunge wa CCM baada ya wabunge wa CHADEMA kuususia na kutoka bungeni, lakini baada ya Rais kukutana nao Ikulu, sasa Bunge zima linalazimika kuipitia sheria hiyo kuhalalisha mapendekezo yaleyale yaliyoletwa na CHADEMA. Shelukindo alisema binafsi anakerwa na tabia ya Rais Kikwete na Waziri Mkuu Pinda kuamua kutenda mambo kana kwamba hawawasiliani.

    Kwa mujibu wa chanzo chetu cha habari, Shelukindo alifikia mahali akatishia kuwa kama Rais ndiye tatizo, wabunge wana uwezo wa kupiga kura ya kutokuwa na imani naye. Hata hivyo, kauli hiyo nzito ilipingwa vikali na Mbunge wa Simanjiro Christopher Ole Sendeka ambaye alimtaka Shelukindo afute kauli yake na kuomba radhi kwani lengo la kumchambua Rais Kikwete na serikali yake, halina nia ya kumuangusha, bali kuisaidia serikali yake.

    Kutokana na kauli hiyo, Shelukindo aliomba radhi na kufuta kauli yake, lakini alisisitiza kuwa hakuwa na lengo baya. Sendeka alijikita kwenye suala la posho na kuwataka wabunge wenzake wa CCM kuachana nayo kwani inawajengea taswira mbaya mbele ya jamii. Alipendekeza kuundwa tume kuchunguza tuhuma za ufisadi katika Wizara ya Ujenzi inayoongozwa na John Magufuli ambapo inadaiwa kuwa zaidi ya sh bilioni 10 zimechotwa kulipia kampuni hewa ya ujenzi.

    Sendeka alisema kuwa katika tuhuma hiyo inayohusisha vigogo wanaotaka kuwania urais, kati ya malipo ya mkandarasi kampuni ya CHICO-CRSG JV, sh bilioni 10 zimeongezwa kwa lengo la kuwanufaisha vigogo hao. Kuhusu sakata la mgomo wa madaktari, Sendeka alieleza kutoridhika kwake na jinsi serikali ilivyokuwa ikilishughulikia tatizo hilo. Hata hivyo Sendeka na baadhi ya wabunge walipendekeza Waziri wa Afya na Ustawi wa Jamii, Naibu wake na Katibu Mkuu, wajiuzuru kwa kusababisha kutokea kwa mgomo huo.

    mponda na lucy nkya siyo tatizo, tatizo ni blandina na mtasiwa, hawa ndio wamewashauri vibaya na kuwapa ripoti ya uongo tangu mwanzo, mgomo usingetokea kama wangesikiliza ushauri wa baadhi yawatendaji wa wizara, lakini nyoni na mtasiwa walikuwa wanasisitiza ati its for security reasons

    Kwanini wanafanya haya baada ya suala lao la nyongeza za posho kutopewa ridhaa na ikulu? Kwani serikali imeanza kuwa goi goi kiutendaji wiki hii?

    jk ni kigeugeu kama hamjui muulizeni mchungaji lowassa atawaambia jinsi walivyokubaliana aandike barua ya kujiuzulu kisha kikwete akatae, lakini jamaa barua ilipofika kwake barua akaikubali mchungaji akachanganyikiwa hadi leo hana hamu nae, ni mbayuwayu amechanganya akili za wabunge wa ccm, cdm na za kwake kidogo, sasa wale waliowazomea mp's wa cdm wakati wanatoka nje ilipokuwa sheria ya mabadiliko ya katiba jk kawaumbua, bado tutashuhudia vituko vingi ndani ya utawala huu wa kipekee, tungoje tuone.

    Lakini umesikia Ole sendeka? Huyu ndiye mbuge wa CCM ambaye mara nyingi anajali maslahi ya nchi na wananchi wanyonge. Mimi sio mpenzi wa CCM lakini huyu bwana huwa namkubali sana. Sio mnafiki, very considerate kwa maswala yanahuesu jamii yetu maskini.

    Miongoni mwa udhaifu unaoonekana wazi katika serikali yetu ni kushindwa kuwepo kwa mawasiliano kati ya viongozi wa safu ya juu wa serikali. sina hakika kama hili linatokea makusudi kwa kuangalia upepo unakwendaji au bahati mbaya japo sishawishiki kuamini ni bahati mbaya..

    Kwa yote hayo bado serikali inapaswa kujirekebisha kwa hili kwani kwa kutofanya hivo inazidi kupunguza CREDIBILITY kwa wananchi inaowaongoza.

    Leo sikutaka kuchangia chochote humu lakini kwa hapa imebidi nikuunge mkono,naomba watu tuwe wawazi,hawa wabunge wa ccm kwenye hiki kikao cha wabunge wao sijaona tatizo kubwa walilolifanya,kurekebisha ndiko kunakotaka ni bora tukaacha kukashifu kila kitu ilimradi kimetoka ccm,nchi hii si lazima iongozwe na chama fulani,hapana,tunachotaka ni mageuzi ya kweli katika kutatua matatizo ya wananchi na kuwaletea maendeleo.

    Humu tulikuwa tunataka viongozi wa wizara wawajibike kwani ni kweli mgomo huu wameuchukulia simple sana wakati watu wanaumia,suala la posho za wabunge limekuwa ni kero sana mimi mpaka hapa naanza kuona mwanga,tatizo langu kwao ni hili je utekelezaji utakuwepo kwa waliyoongea?

    The Parliamentary move to reject two government motions this week was influenced by what some legislators termed as ‘arrogance and disregard' shown by ministers and some top government officials,The Guardian on Sunday has learnt.

    According to some members of Parliament who spoke to the Guardian on Sunday, their displeasure due to the government's disregard of cautionary advice given in advance to ministers and other key officials was the reason for the embarrassment suffered by the executive early this week.

    A well placed source in the House said the government would not have suffered such embarrassing experience if it had been considerate to numerous calls from ruling party MPs.


    Finance Minister Mustafa Mkulo was the first to be put to the sword last Thursday as his proposed resolution to amend the Excise Management and Tariffs Act aimed at reducing tax charges on bottled and packed water produced in the country from Sh69 to Sh12 hit a snag.


    As if that was not enough, later in the evening session Attorney General Frederick Werema also became a victim of the MPs' uncooperative stance as his bill for the Written Laws (Miscellaneous Amendments) Act, No 2, 2012 was rejected.

    The parliamentarians argued that the two government motions contained numerous faults, a situation that revealed a lack of seriousness in preparation of the documents tabled before the House. It was finally decided that the two motions be re-tabled during the next sitting in April.


    " To anyone who was keen in the House it was very clear that the legislators mainly from CCM had decided not to pass the motions but nobody within the government cared about the obvious danger it (government) was facing. The ministers took it for granted – business as usual – and MPs were totally gutted," noted the MP, who opted not to be named.


    "On Wednesday, the day before the two motions were tabled, the leadership of the CCM caucus was informed of the looming MPs' decision and thus was advised to convene a meeting so as to clear the air," but nothing was done.


    However, this paper has learnt from well placed legislators within CCM that the party caucus meeting was hastily organized on Wednesday after the House business of the day only to be called off upon poor attendance, of less than 60 MPs. The party caucus is made up of the 286 CCM parliamentarians, therefore any number below 60 attending legislators is only about 20 percent of the MPs.


    For the first time since the re-introduction of multiparty politics in 1992, a large number of the legislature sounded loudly against government motions.


    Deputy Speaker Job Ndugai had tactically ensured that the decision be made through sound voting as to who were in favour of the motion or to the contrary.


    Ndugai, MP for Kongwa told this paper afterwards that it was clear that opposing voices were louder than the supporting voices and nothing could be done to rescue the executive from defeat.


    Having in mind the usual support to the motions but not sensed the House mood and its eventual clout, Minister Mkulo remained relaxed in a big smile as deputy Speaker Ndugai ruled that voting be done after Mkulo had responded to various matters raised by MPs during the debate.


    The caucus meeting held on Thursday saw some MPs even proposing that the minister should resign as they were angered by his admission that the proposed resolution to lower tax charges for bottled and packed water from Sh69 to Sh12 per litre was influenced by businessmen.


    The change of tariff would cause a budgetary deficit of Sh7.719 billion for the remaining part of the 2011/2012 financial year.


    "MPs were furious because all the key matters were discussed at the parliamentary standing committee for Finance and Economic Affairs but no changes were made. Then the House learned that influence came from businessmen," irate MPs noted.

    The minister told the House the Sh7.719 billion deficit would be endured by reducing recurrent expenditure Other Charges (OC) in eight areas: allowances, workshops, purchase of vehicles, purchase of furniture, running of office, training within and outside the country, local and out of the country trips as well as building refurbishments.

    CCM MPs were displeased that all these areas were copied from the opposition (Chadema) shadow budget speech for 2011/2012, which if implemented would paralyse government functions in various areas.


    Charles Tizeba (Buchosa-CCM) sparked off the eventual bitter decision by the House as he requested minister Mkulo to withdraw the motion since it had a number of faults.


    "Honourable Speaker as per Section 58 of the parliamentary standing orders this proposed resolution has to be withdrawn so that all the faults can be amended and be re-tabled later," said the MP, signaling as well the amendment of tariff was influenced by businessmen and not driven by sympathy for ordinary people.


    That came after nine MPs including Tizeba had debated strongly against the proposed Resolution, but among those only Zalina Madabida (Special Seats) had not seconded the motion. Deputy Speaker Ndugai decided that minister Mkulo should be allowed to windup by responding to all matters raised by legislators and a conclusion could be reached thereafter.

    For Attorney General Werema's bill aimed at amending 16 written laws, the black spot was the bill section relating to the Higher Education Students Loan Board (HESLB) which according to MPs' views the proposed amendments were unacceptable as they would deny loans and higher education to applicants from relatively poor families whilst benefiting the rich ones.


    Werema's attempt to have other amendment be made with exclusion of the review of the HESLB Act was strongly rejected by the House on grounds that the motion could not be passed piecemeal.
