    VIONGOZI wa Umma 23 wanatarajiwa kusimama mbele ya Baraza la Maadili ya Viongozi wa Umma kwa ajili ya kujitetea kutokana na kukiuka Sheria Namba 13 ya Maadili ya Viongozi
    wa Umma kwa kutowasilisha tamko la rasilimali na madeni yao kwa Sekretarieti ya Maadili ya Viongozi wa Umma.

    Miongoni mwa viongozi hao wamo watendaji wakuu wa Ofisi ya Rais Ikulu, wakuu wa taasisi nyeti nchini, wakuu wa wilaya, mahakimu, madiwani, wakaguzi wa hesabu wa ndani na wakurugenzi watendaji wa Halmashauri za wilaya.

    Kwa mujibu wa orodha ya Sekretarieti hiyo kwa Baraza la Maadili, vigogo hao wanaotajwa kuitwa na watahojiwa ni Makamu Mkuu wa Chuo Kikuu cha Dar es Salaam, Profesa Rwekaza Mukandala, Mkuu wa Wilaya ya Kigoma Mjini, John Mongella na Mkaguzi Mkuu wa Hesabu wa
    Ndani wa Ikulu, Hammad Ntungwabona.

    Wengine ni Mhasibu Mkuu wa Ikulu Joseph Sanga, Mwandishi wa Habari Mkuu wa Waziri Mkuu, Said Nguba, Mkaguzi Mkuu wa Hesabu wa Ndani wa Shirika la Majisafi na Majitaka
    Dar es Salaam (Dawasco), Rosemary Lyamuya na Mkaguzi Mkuu wa Hesabu wa Ndani wa Taasisi ya Chakula na Lishe, Guido Leshabari.

    Aidha, orodha hiyo pia imewataja Hakimu Mkazi wa Mahakama ya Kisutu Gabriel Mirumbe, Hakimu wa Mahakama ya Mwanzo Endasak Katesh mkoani Manyara, Anthony Hamza, Hakimu Mahakama ya Mwanzo Mbulu Tharcisiusy Mwalulefu, Hakimu Mahakama ya Mwanzo
    Mpanda Adam Mteru, Hakimu Mahakama ya Mwanzo Geita, Geraz Mulugilwa na Hakimu Mahakama ya Mwanzo Geita, Sabato Bwire.

    Viongozi wengine watakahojiwa ni madiwani wa kata ya Nkome Geita, Kalema Chilatu, wa Rorya Yamo Kagose, Shinyanga Joseph Shoto, Mondo Kishapu John Ndama na diwani kutoka Halmashauri ya Monduli Arusha, Dorah Kipuyo.

    Aidha, tayari Baraza hilo limeanza kuwahoji baadhi ya viongozi wanaotuhumiwa kutorejesha fomu za tamko la rasilimali na madeni yao ambao ni Mkurugenzi Mtendaji wa Halmashauri
    ya Mbulu, Simon Mayeye, Mkuu wa Wilaya ya Singida Paschal Mabiti na Mbunge wa Rorya, Lameck Airo.

    Msaidizi wa Rais katika masuala ya Siasa, Rajab Luhwavi hakutokea katika kikao hicho Jumatatu, na Baraza limetoa amri ya kukamatwa kwake na Polisi na kufikishwa mbele yao kwa ajili ya mahojiano baada ya Sekretarieti ya Maadili ya Viongozi kutoa ombi hilo kwa mujibu wa Sheria ya Maadili ya Viongozi wa Umma.

    Akijitetea mbele ya Jopo la majaji watatu wastaafu ambao ni Mwenyekiti wa baraza hilo Jaji mstaafu Damian Lubuva, Jaji mstaafu Balozi Hamis Msumi na Katibu Mkuu mstaafu Jaji
    Deodatus Tibakwetura, Mabiti alikiri kutowasilisha fomu ya tamko lake la mwaka 2009 na kuliomba baraza hilo limsamehe kwa kuwa hatorudia tena.

    “Mimi ni kiongozi wa siku nyingi na naomba nitamke mbele ya baraza hili tukufu kwa ukweli wangu kuwa, tamko la mwaka 2007 na 2008 nilijaza na kuwasilisha kwa Mjumbe wa Sekretarieti ya Maadili Kipacha, na tamko la 2009 kwa kweli nilipitiwa sikuliwakilisha,”
    alisema Mabiti.

    Ethics tribunal starts hearing complaints

    TANZANIA Ethics Tribunal on Monday started hearing the complaints lodged by the Public Ethics Secretariat in which several high government profile officials were summoned.

    The public servant officials are accused of violating the Public Leaders Code of Ethics Act no 13 of 1995 requiring all high profile officials holding key positions in the country to declare their assets and liabilities before the public ethics secretariat.

    About 23 officials including the University of Dar es Salaam Vice-Chancellor, Professor Rwekaza Mukandala and the State House Chief Accountant, Mr Joseph Sanga, are expected to be arraigned before the tribunal this week.

    Also among them, President Jakaya Kikwete's political advisor, Mr Rajab Ruhwavi, was served with a sub-poena.

    Mr Ruhwavi was expected to be the first official to appear before the tribunal but in an unexpected turn of events, he failed to turn up without filing any reasons, a situation which culminated retired judge Damian Lubuva who was presiding over the session alongside other two retired judges, to issue a warrant of arrest.

    Judge Lubuva, who is the tribunal's chairperson, was responding to the request from the complainant, which is the Public Ethics Secretariat, represented by three lawyers led by Ms Getrude Cyriacus, the Chief Legal Officer of the secretariat.

    "I concur with the Lawyer's request as per section 24(4) which requires the tribunal to issue an arrest warrant in case the accused person fails to appear without any sound reasons, therefore I order responsible authorities to arrest and produce Mr Ruhwavi before the session here at Karimjee Hall", he said.

    Mr Luhwavi was summoned by the Ethics Secretariat to appear before the tribunal to respond as to why he declined to submit his declaration form as required by the law.

    This is the first session of the ethics tribunal since its inception last year by Tanzanian President, Mr Jakaya Kikwete. The session will proceed the whole week and reach its climax on Friday this week.

    Earlier yesterday, three top official were arraigned before the tribunal indicted with violating section 9 of Public leaders Code of Ethics Act no 13 of 1995.

    The leaders include Rorya Constituency Legislator Mr Lameck Airo, Singida District Commissioner Mr Paschal Mabiti and Mbulu District Executive Director Mr Simon Mayeye.

    Under section 9 every public leader shall, except where constitution or any other written law provides otherwise, submit to the commissioner of Ethics Secretariat a written declaration in prescribed form of all property or assets owned by, or liabilities owed to him, his spouse or unmarried minor children.

    The Rorya constituency MP and Mbulu District Executive Director (DED) denied the allegations. The former said he had no idea of PL1 forms which public officials use to declare their wealth, saying his District Director did not issue him the forms as they were in a long term conflict.

    Mr Airo is alleged to have refrained from submitting his declaration forms in 2008 and 2009 respectively when he was a councillor for Koryo Ward in Musoma Municipality.

    However, Singida District Commissioner Mr Paschal Mabiti pleaded guilty before the panel of three judges and requested the tribunal to forgive him saying he had realized his mistake and promised not to repeat it.

    According to Justice Lubuva, failure to comply with section 9 of the Act was against section 15(a) of the same law and the tribunal would judge accordingly and submit recommendation to the President of the United Republic of Tanzania for further steps.

    [​IMG] BARAZA la Maadili limetoa waraka wa kukamatwa kwa msaidizi wa Rais Jakaya Kikwete wa masuala ya siasa, Rajab Luhwavi, kwa kosa la kukaidi wito uliomtaka kuhudhuria vikao vya kutii maagizo ya baraza hilo.
    Kwa mujibu wa Mwenyekiti wa Baraza hilo ambalo limeanza vikao vyake jana jijini Dar es Salaam chini ya Jaji mstaafu Damian Lubuva, Luhwavi analalamikiwa na sekretarieti ya maadili ya viongozi wa umma kwa kushindwa kujaza fomu za rasilimali na madeni.
    Lubuva alisema waraka huo wamemkabidhi mlalamikaji (sekretarieti) ili wamtafute askari atakayewasaidia kukamkata Luhwavi na kumfikisha kwenye baraza hilo linaloendelea na vikao vyake katika Ukumbi wa Karimjee.
    "Tumejiridhisha na maelezo ya mlalamikaji kuwa mlalamikiwa alipelekewa wito wa kuitwa kwenye kikao cha leo, lakini hajatokea na hakuna sababu iliyotolewa, tunaagiza akamatwe aletwe mbele kwa siku tutakayoamua," alisema Lubuva.
    Kwa mujibu wa sheria ya maadili ya viongozi wa umma namba 13 ya mwaka 1995, kifungu cha 24 (4) baraza hilo lina mamlaka ya kutoa waraka wa kukamatwa kwa mtu anayekaidi wito wa kuitwa kwenye vikao vya baraza hilo.
    Alisema baraza hilo lililoundwa mwaka jana lina jukumu kubwa la kusikiliza mashauri ya viongozi waliokiuka sheria ya viongozi ya utumishi wa umma namba 13 ya mwaka 1995.
    Alibainisha kuwa sheria hiyo kifungu cha 9(1) inaweka bayana kuwa kiongozi wa umma anatakiwa kuorodhesha rasilimali alizonazo na madeni kila mwaka, siku thelathini baada ya kuchaguliwa, mwisho wa kutumikia wadhifa wake.
    Alibainisha kuwa kazi ya baraza hilo ni kusikiliza malalamiko ya ya sekretarieti ya maadili ya viongozi wa umma, walalamikiwa na baadaye hutoa mapendekezo kwa Rais Kikwete juu ya hatua za kuwachukulia wakosaji.
    Baraza hilo ambalo litaendesha vikao vyake hadi Aprili 15 mwaka huu, jana lilianza kuwahoji viongozi kadhaa akiwemo Mbunge wa Rorya, Lameck Airo.
    Mwingine aliyehojiwa ni Mkuu wa Wilaya ya Singida, Pascal Mabiti, ambaye alikiri kutowasilisha fomu hizo kwa mwaka 2009 kwa bahati mbaya na kuliomba baraza hilo limsamehe huku akiahidi kutorudia kosa hilo.
    Baraza hilo linatarajia pia kuwahoji viongozi 24 wakiwemo, Mkuu wa Wilaya ya Kigoma, John Mongela, Makamu Mkuu wa Chuo cha Dar es Salaam, Profesa Lwekeza Mkandala, Mhasibu Mkuu wa Ikulu, Joseph Sanga na Mkaguzi Mkuu wa Hesabu za Ndani za Ikulu, Hammad Ntungwabona.
    Naye Ofisa Sheria Mkuu wa Sekretarieti ya Maadili ya Umma, Gertrude Cyriacus, alisema kuwa malalamiko waliyowasilisha katika baraza hilo ni ya watumishi wa umma walioshindwa kujaza fomu za mwaka 2007, 2008 na 2009.
    Alisema kabla ya kufikisha malalamiko yao kwenye baraza hilo huwaandikia barua wahusika kuwakumbushia wajibu wao na iwapo jitihada hizo zitashindikana ndiyo hufikia hatua ya kupeleka suala hilo katika baraza la maadili.
    Leo baraza hilo linatarajia kusikiliza utetezi wa watumishi wafuatao; Said Nguba (mwandishi wa habari wa waziri mkuu), Joseph Sanga (Mhasibu Mkuu Ikulu), Rosemary Lyamuya (Mkaguzi Mkuu wa Hesabu za Ndani Dawasco) na Guido Leshabari (Mkaguzi Mkuu Hesabu za Ndani Taasisi ya Chakula na Lishe, Dar es Salaam).

    MSAIDIZI wa Rais Jakaya Kikwete, katika masuala ya Siasa, Rajabu Luhwavi jana alikamatwa na polisi na kufikishwa mbele ya Baraza la Maadili ya Viongozi wa Umma baada ya kukaidi wito uliomtaka kuhudhuria kikao cha baraza hilo Jumatatu iliyopita.

    Ilielezwa kwamba Aprili 11, mwaka huu, Luhwavi alitakiwa kufika kwenye Baraza hilo kueleza kwa nini hakujaza fomu kuonyesha mali zake katika kipindi cha mwaka 2009, lakini bila taarifa yoyote, hakufika.

    Hatua hiyo ililifanya Baraza hilo chini ya Mwenyekiti wake, Jaji Mstaafu Damian Lubuva akisaidiana na wajumbe, Jaji Mstaafu Hamisi Msumi na Gidious Tibakweitira, lililazimika kutumia dola kumleta Luhwavi mbele yake.
    Katika shauri hilo, Jaji Lubuva alimtaka Msaidizi huyo wa Rais, kueleza sababu zilizofanya ashindwe kufika mbele ya Baraza licha ya kuandikiwa barua na Sekretarieti ya Maadili ya Viongozi wa Umma.

    Katika utetezi wake, Luhwavi alisema hajawahi kupokea barua yoyote ya wito wa kufika mbele ya Baraza hilo: "Sikuwa na taarifa yoyote ya kuitwa mbele ya Baraza lako. Nimesikia kupitia vyombo vya habari kwamba natakiwa kukamatwa na polisi kufikishwa katika Baraza."

    Baada ya kutoa jibu hilo, msaidizi wa sekretarieti ya maadili, alionyesha 'dispatch book' iliyoonyesha kwamba barua ya wito kwa Luhwavi ilisainiwa na ofisa wa Ikulu Machi 18, mwaka huu.

    Hata hivyo, baada ya kuiangalia sahihi hiyo, Luhwavi alisema haikuwa yake wala ya katibu muhtasi wake... "Hii sahihi siifahamu. Siyo yangu wala katibu muhtasi wangu. Sielewi ni nani aliyesaini. Inawezekana walisaini walinzi wa getini, lakini kwangu, haikufika. Nimekula kiapo cha kuwa mwaminifu. Hii barua haikunifikia. Nafahamu umuhimu wa Baraza hili sikuwa na sababu ya kuacha kufika bila kutoa taarifa."

    Mmoja wa wanasheria wa sekretarieti hiyo alidai kwamba barua hiyo ilipelekwa Ikulu na Mwanasheria mwenzao, Hassani Mayunga na kusainiwa na Katibu Muhtasi wa Luhwavi.Jaji Lubuva alihoji iweje maofisa wenzake (Luhwavi) wa Ikulu wapate barua za wito lakini, yeye asipate?
    "Hapa inatushangaza, Ikulu maofisa wengine wamefika mbele ya Baraza, ina maana walipata barua za wito lakini wewe peke yako ndiyo hukuipata?" alihoji Jaji Lubuva.

    Alimtaka ofisa huyo kutorudia kitendo hicho akisema alitakiwa kuwa mfano kwa wengine kwa kuwa anatoka kwenye ofisi kubwa inayoheshimika."Nisingependa jambo hili kurudiwa siku nyingine. Leo umeletwa na polisi, ukirudia siku nyingine, tutachukua hatua zaidi za kisheria,"alisema Jaji Lubuva.Baada ya maelekezo hayo, Jaji Lubuva aliahirisha shauri hilo hadi Jumatatu ijayo siku ambayo mtuhumiwa huyo atatakiwa kujitetea.

    Mbali na Luhwavi, viongozi wengine waliofika mbele ya Baraza hilo jana ni Mkaguzi Mkuu wa Hesabu za Ndani Ikulu, Alhaji Hamadi Ntungwabona na Diwani wa Viti Maalumu, Halmashauri ya Wilaya ya Monduli, Dorah Kipuyo.
    Pamoja na hao, pia yumo Hakimu Mkazi wa Mahakama ya Kisutu, Gabriel Mirumbe na Hakimu wa Mahakama ya Mwanzo ya Endasak-Kateshi, mkoani Manyara.

    Akijibu tuhuma zinazomkabili, Ntungwabona alisema alijaza fomu na kuzituma katika Sekretarieti ya Tume ya Maadili lakini anashangaa kwamba hazikufika."Hivi hata kama fomu zangu hazikufika! Kwa nini hamkunijulisha kuhusu hilo wakati Ikulu na ofisi zenu ni jirani?" alihoji.Madai yake hayo yaliwafanya wanasheria wa tume hiyo kumtaka aonyeshe uthibitisho. Hata hivyo, hakuwa nao. Shauri hilo sasa linasubiri uamuzi.

    Kwa upande wake, Diwani Kipuyo alisema madiwani wote wa halmashauri hiyo walituma fomu zao kupitia kwa Mkurugenzi Mtendaji wa Halmashauri ya Wilaya hiyo."Mkurugenzi Mtendaji ndiye aliyetuletea fomu madiwani wote na tulipozijaza tulizipeleka kwake. Nashangaa kuambiwa kwamba fomu zangu, hazikufika kwenu," alisema.

    Baraza hilo leo linatarajiwa kuendelea kusikiliza mashauri ya viongozi kadhaa akiwamo Makamu Mkuu wa Chuo Kikuu cha Dar es Salaam, Profesa Rwekaza Mukandala.Baada ya kumaliza kusikiliza mashauri hayo, Baraza hilo litatoa mapendekezo yake kwa Rais ambaye ndiye mwenye mamlaka ya mwisho ya kutoa adhabu.

    THE Tanzania Ethics Tribunal on Wednesday postponed hearing against Political Advisor to President Jakaya Kikwete, Mr Rajabu Luhwavi after the latter claimed he was not aware of the summon. His matter will be heard on Monday.

    Mr Luhwavi was arraigned on Wednesday after he was served with an arrest warrant for failure to show up at the Tribunal.

    "I took oath to abide by laws of this country and to comply with lawful orders, there is no way I could have rejected the call," Mr Luhwavi told the Tribunal.

    The Tribunal was, however, surprised since the dispatch provided by the secretariat's legal officers indicated that the letter was delivered to Mr Luhwavi's office on March 18, this year.

    "The signature which appears in the dispatch is neither mine nor of my secretary, also my title is not indicated in the dispatch and this might have complicated the delivery as well," said Mr Luhwavi.

    The Tribunal Chairperson, retired Judge, Damian Lubuva who was presiding over the session alongside other two retired judges, who issued a warrant of arrest on Monday, said a mistake happening at such a high profile office was a serious occurrence which should not be repeated.

    The Secretariat Chief Legal Officer, Ms Getrude Cyriacus asked the Tribunal to give enough time to Mr Luhwavi to go through the complaints lodged against him.

    Mr Luhwavi is accused of violating the Public Leaders Code of Ethics Act no 13 of 1995, requiring all high profile officials holding key positions in the country to declare their assets and liabilities before the public ethics secretariat.

    In another development, the State House Internal Auditor, Mr Hammad Ntungwabona told the Tribunal that he was shocked by the complaints against him as he had already declared his assets and property in 2008 and 2009.

    Mr Ntungwabona, however, noted that he filled his 2008 forms in 2009 because he was in Mecca for pilgrimage by the time he was supposed to fill his forms and that the 2009's were filled in time and taken to State House's registry.

    The Monduli Special Seats Councillor, Ms Dorah Kipuyo, told the Tribunal that she had filled her forms and sent them to Munduli District Council's officer where they would later be sent to the secretariat.

    "I thought the forms had already reached the secretariat offices," she said.

    Ms Kipuyo, however, did not have any evidence to justify her claims and even after she was questioned several times by secretariat legal officers, she failed to provide tangible evidence.

    The Mtae Primary Court Magistrate, Mr Anthony Hamza was the last person to be heard in on Wednesday's hearings.

    The magistrate who works in Lushoto District, Tanga Region appeared smarter as he presented evidence plus the forms he filled and the dispatches.

    "I ask the Tribunal to see that the evidences that I have presented here have a power over the accusations lodged against me by the secretariat," he said.

    Unlike others, Mr Hamza did not receive any question from the secretariat legal officers who, when were asked by the judges to do so, simply said 'no question.'

    The Tribunal is presided over by retired Judges Damian Lubuva and Hamis Msumi and retired Permanent Secretary Deodatus Tibakwetura.

    THE Tanzania Ethics Tribunal on Wednesday postponed hearing against Political Advisor to President Jakaya Kikwete, Mr Rajabu Luhwavi after the latter claimed he was not aware of the summon. His matter will be heard on Monday.

    Mr Luhwavi was arraigned on Wednesday after he was served with an arrest warrant for failure to show up at the Tribunal.

    "I took oath to abide by laws of this country and to comply with lawful orders, there is no way I could have rejected the call," Mr Luhwavi told the Tribunal.

    The Tribunal was, however, surprised since the dispatch provided by the secretariat's legal officers indicated that the letter was delivered to Mr Luhwavi's office on March 18, this year.

    "The signature which appears in the dispatch is neither mine nor of my secretary, also my title is not indicated in the dispatch and this might have complicated the delivery as well," said Mr Luhwavi.

    The Tribunal Chairperson, retired Judge, Damian Lubuva who was presiding over the session alongside other two retired judges, who issued a warrant of arrest on Monday, said a mistake happening at such a high profile office was a serious occurrence which should not be repeated.

    The Secretariat Chief Legal Officer, Ms Getrude Cyriacus asked the Tribunal to give enough time to Mr Luhwavi to go through the complaints lodged against him.

    Mr Luhwavi is accused of violating the Public Leaders Code of Ethics Act no 13 of 1995, requiring all high profile officials holding key positions in the country to declare their assets and liabilities before the public ethics secretariat.

    In another development, the State House Internal Auditor, Mr Hammad Ntungwabona told the Tribunal that he was shocked by the complaints against him as he had already declared his assets and property in 2008 and 2009.

    Mr Ntungwabona, however, noted that he filled his 2008 forms in 2009 because he was in Mecca for pilgrimage by the time he was supposed to fill his forms and that the 2009's were filled in time and taken to State House's registry.

    The Monduli Special Seats Councillor, Ms Dorah Kipuyo, told the Tribunal that she had filled her forms and sent them to Munduli District Council's officer where they would later be sent to the secretariat.

    "I thought the forms had already reached the secretariat offices," she said.

    Ms Kipuyo, however, did not have any evidence to justify her claims and even after she was questioned several times by secretariat legal officers, she failed to provide tangible evidence.

    The Mtae Primary Court Magistrate, Mr Anthony Hamza was the last person to be heard in on Wednesday's hearings.

    The magistrate who works in Lushoto District, Tanga Region appeared smarter as he presented evidence plus the forms he filled and the dispatches.

    "I ask the Tribunal to see that the evidences that I have presented here have a power over the accusations lodged against me by the secretariat," he said.

    Unlike others, Mr Hamza did not receive any question from the secretariat legal officers who, when were asked by the judges to do so, simply said 'no question.'

    The Tribunal is presided over by retired Judges Damian Lubuva and Hamis Msumi and retired Permanent Secretary Deodatus Tibakwetura.

    MSAIDIZI wa Rais wa Masuala ya Siasa, Rajab Luhwavi amefikishwa mbele ya Baraza la Maadili ya Viongozi wa Umma chini ya ulinzi wa Polisi baada ya kutoitikia mwito wa baraza hilo wa Aprili 11, 2011 wa kujieleza kwa nini hakutoa tamko la mali na madeni yake kwa Sekretarieti ya Maadili ya Viongozi wa Umma.

    Kutokana na kutoitikia mwito huo, Mwenyekiti wa Baraza hilo, Jaji mstaafu Damian Lubuva ametoa onyo kali kwa kiongozi huyo na kumtaka asirudie tena tabia ya kutojitokeza pindi anapoitwa na iwapo itajitokeza tena hali hiyo, hataishia kusindikizwa na Polisi, bali atapelekwa kwenye vyombo vya sheria kwa hatua zaidi.

    Jumatatu wiki hii, baraza hilo lilitoa amri ya Luhwavi kufikishwa mbele yake chini ya Polisi kwa mujibu wa Sheria Namba 13 ya Maadili ya Viongozi wa Umma baada ya mawakili wa Sekretarieti ya Maadili, kutoa ombi kwa Baraza hilo kutokana na kiongozi huyo kutoitikia mwito wa kutakiwa kujitetea mbele yao.

    Akitoa utetezi wake baada ya kupelekwa kwa nguvu na Polisi, Luhwavi alianza kwa kuliomba
    radhi baraza hilo na kudai kuwa haikuwa kusudio lake kudharau baraza hilo isipokuwa hakupata barua ya mwito wa kumtaka afike mbele ya baraza hilo.

    "Kwanza naomba kwa kilichotokea natambua hadhi na kazi ya baraza hili na haikuwa kusudio
    langu," alisema Luhwavi na kubainisha kuwa hakufika Jumatatu kwa vile hakuwahi kupokea
    barua ya kuitwa kwake, isipokuwa alisikia kuwa ni mmoja wa viongozi watakaoitwa na kuhojiwa na baraza kwa kutojaza na kuwasilisha matamko ya mali na madeni yao kwa Sekretarieti ya Maadili kwa mujibu wa sheria.

    Alisema baada ya kupata taarifa hizo kwa mtu ambaye hakumtaja, aliwasiliana kwa njia ya simu na mmoja wa watumishi wa Sekretarieti ya Maadili aliyethibitisha kuwa ni kweli anatarajiwa kuhojiwa na baraza hilo siku yoyote Aprili na kwamba atatumiwa barua ya kuitwa shaurini.

    Hata baada ya Mwanasheria Mkuu wa Sekretarieti ya Maadili, Getrude Cyriacus, kusisitiza kuwa barua hiyo ilitumwa na kitabu cha kupokea barua kusainiwa na Katibu Muhtasi wa Luhwavi Machi 18, mwaka huu, Luhwavi alikanusha kusaini kitabu hicho na kwamba saini aliyooneshwa pia si ya Katibu Muhtasi wake.

    Akifunga mjadala huo, Jaji Lubuva alisema kitendo kilichotokea kwa Luhwavi kutohudhuria
    mwito wa baraza hilo hakipendezi na kwamba baraza hilo halijafurahishwa hasa kutokana na unyeti wa ofisi ya kiongozi huyo wa umma ambayo viongozi wake wanapaswa kuwa mfano kwa
    wengine.

    Baada ya ombi la Cyriacus, Lubuva aliahirisha shauri hilo hadi Aprili 18, mwaka huu, kutokana na Luhwavi kudai kuwa hakupata barua ya malalamiko dhidi yake ili kumpa nafasi ya kuyasoma na hivyo kujitetea.

    Ukiondoa Luhwavi, viongozi waliojitetea mbele ya baraza hilo jana ni Hakimu Mkazi wa Mahakama ya Kisutu Gabriel Mirumbe, Mkaguzi Mkuu wa Hesabu wa Ndani Ikulu Hammad Ntungwabona, Diwani wa Viti Maalum wilayani Monduli, Dorah Kipuyo na Hakimu Mahakama ya Mwanzo Mtae Lushoto, Anthony Hamza.

    Katika hatua nyingine, Spika wa Bunge Anne Makinda amewataka wabunge ambao hawajajaza
    fomu za kutangaza mali zao, wafanye hivyo haraka ili kuepusha hatua ya kufukuzwa ubungeni.

    Kufikisha malalamiko ya Viongozi kuhusu tamko la mali na madeni kwenye Baraza la Maadili ni jambo jema. Lakini inaonyesha Sekretariat walikuwa hawajajipanga vilivyo kwani miongoni mwa watuhumiwa walikishawasilisha matamko yao katika njia zinazoaminika, ingawaje Mwanasheria mwendeshaji aliukana utaratibu sahihi wa serikali kama matumizi sahihi ya Masijala zake, hilo ni lake binafsi.
    Walikupo wengine ambao hawajawahi kutumiwa fomu wala kuandikiwa barua za kuwakumbusha; hivyo kuondoa dhana nzima ya tuhuma na kusalia ubishi: wa "ima tafsiri ya sheria au utaratibu uliotumika kupokea au kutuma". Hebu Kamishina wa Maadili igeukie Ofisi yako toa boriti hili la masijala yako pia imarisha daftari la Rasilimali na madeni ili kuondoa aibu iliyowakuta wanasheria wetu mahili wanaosoma mistari ya sheria bila kuhusianisha na hali halisi ya maisha tunamoishi na kufanyia kazi.

    MAKAMU Mkuu wa Chuo Kikuu cha Dar es Salaam, Profesa Rwekaza Mukandala jana alishindwa kufika mbele ya Baraza la Maadili ya Viongozi wa Umma, lililokaa kusikiliza mashauri ya viongozi walioshindwa kutangaza mali zao.

    Mwenyekiti wa Baraza hilo, Jaji mstaafu,Damian Lubuva, alisema kwa mujibu wa ratiba, Profesa Mukandala alitakiwa kufika mbele ya baraza hilo jana.Jaji Lubuva alisema juzi Profesa Mukandala alimpigia simu kumweleza kwamba asingeweza kufika mbele ya baraza hilo kama ilivyopangwa kwenye ratiba kwa kuwa ana shughuli maalum.

    "Kutokana na hali hiyo, sasa tumempangia siku ya Jumatatu ijayo ili atafika mbele ya baraza," alisema Jaji Lubuva.
    Profesa Mukandala na viongozi wengine wanadaiwa kushindwa kuwasilisha fomu katika Sekretarieti ya Tume ya Maadili ya Viongozi wa Umma, zinazoonyesha mali wanazozimiki kwa mujibu wa sheria.
    Waliofika jana mbele ya baraza hilo ni Diwani wa Kata ya Mondo, katika Halmashauri ya Wilaya ya Kishapu, John Ndama na Rose Komba ambaye ni Diwani wa Viti Maalumu katika Halmashauri ya Wilaya ya Mpanda.Wengine ni Thecisius Malulefu ambaye ni Hakimu wa Mahakama ya Mwanzo wa Mbulu na Adam Materu, Hakimu wa Mahakama ya Mwanzo katika Wilaya ya Mpanda.

    Katika utetezi wao, madiwani wote wawili walikiri kupokea fomu, kuzijaza na kuzirejesha katika sekretarieti kupitia kwa wakurugenzi wa halmashauri zao."Nilipewa fomu na Mkurugenzi Mtendaji wa Halmashauri ya Kishapu, nikajaza na kumrejeshea kama taratibu zetu zinavyosema lakini nimeshangaa kwamba hazikufika," alisema.

    Diwani wa Viti Maalumu katika Halmashauri ya Wilaya ya Mpanda, Komba alisema huo ni utaratibu wao kupitishia fomu kwa mkurugenzi mtendaji."Sasa kama hazikufika fomu kwenu nani alaumiwe wakati niliziwasilisha kwa mkurugenzi mtendaji," alihoji Komba.

    Kufuatia kauli hiyo wanasheria waliomba uthibitisho unaoonyesha kwamba waliwasilisha fomu hizo, lakini hawakuthibitisha.Hadi gazeti hili linaondoka katika viwanja vya Karimjee saa 7.00 mchana, viongozi wengine walikuwa wakiendelea kuhojiwa na baraza hilo.
