Utumwa hospitali ya Aga Khan - sheria ya kazi yasemaje ?

    Je ni haki Wauguzi kama RN kufanya kazi masaa kumi na mbili kwa siku, siku sita kwa wiki kwa mshahara wa jumla wa Tshs. 300,000.00 kwa mwezi ? Kwa hesabu za haraka haraka ni kwamba analipwa Tshs. 1,000 kwa saa (chini ya dola moja !). Hiki ni kiwango wanacholipwa Waswahili tu. Jamani napata kwi kwi kwa hasira, je tuna sheria za kazi ? (masaa 72 kwa wiki bila overtime)

    Lete malinganisho na wafanyakazi wa hospitali zingine kama Muhimbili, Bugando, Bumbuli, KCMC....ili tuweze kujadili mjadala katika muktadha muafaka

    Tatizo si kuangalia hospitali zingine wanalipwaje,suala sheria mpya ya kazi na mahusiano kazini namba 6 ya mwaka 2004 inafuatwa?na kama haifuatwi kwanini wahusika hawachukuliwe hatua kama taratibu za nchi na sheria hii inavyosema na kuelekeza?

    Hawawezi kuchukuliwa hatua kama wafanyakazi hawajapeleka malalamiko yao panapohusika na kisha kufikisha mahakamani.

    nawashauri kama mnahisi mnaonewa basi mpo huru kabisa kufikisha shauri lenu sehemu za sheria na sheria itachukua mkondo wake. Kwani sheria ipo wazi kabisa.

    Hawawezi kuchukuliwa hatua kama wafanyakazi hawajapeleka malalamiko yao panapohusika na kisha kufikisha mahakamani.

    nawashauri kama mnahisi mnaonewa basi mpo huru kabisa kufikisha shauri lenu sehemu za sheria na sheria itachukua mkondo wake. Kwani sheria ipo wazi kabisa.

    Sina data za uhakika ila ni kwamba wanalipwa kwa viwango vya kimataifa ambavyo ni karibu dola kumi kwa saa sawa na Tsh. 10,000.00 !! Naomba mwenye hakika zaidi atupatie data.

    Sawa sawa kabisa.

    Gross salary siyo net salary - ni malipo ambayo hayajakatwa kodi na madai mengine na RN au Registered nurse ni mtu muhimu sana haspitalini. Nilipo bado natafuta data zaidi lakini kama yuko anayeweza kusaidia, JF ni tambarare.

    Ninavyoelewa wachache ambao wamejaribu kufanya hivyo wamenyamazishwa ama kwa kutishiwa au kufukuzwa kazi. Hivyo wengi wanaogopa hata kukohoa - kwanza hata hizo sheria sidhani kama wanazijua.

    Wana JF, ningekuwa na data za kuaminika ningezileta ila hapa nilipo imeniwia vigumu kufanya hivyo. Nawaomba wote wenye access na namna ya kuzipata kuhusu hii hospitali na nyingine zozote zile zinazowanyonya wananchi wazitoe. Ninavyojua ni kuwa kama mtu analazimika kufanya kazi zaidi masaa ya ziada yanayoruhusiwa kisheria, alipwe !!

    Kwa kwelu ..ni amsakitiko kuona wabongo tunanyaswa hivi. problem ni yule dr jaffer dharsee .. ambaye ni mbaguzi na pia ana roho mbaya siijui huyu ni mtanzania? mhindi lakini...siku moa nimem ona anamponda nurse mmoja..na lugha mbaya sana...

    Una maana gani unaposema "hao wahudumu"? I understand kwamba RN ni tofauti na medical attendants nk. ambao ndio tunawaita wahudumu

    Mkuu, matatizo ya Aga Khan ni makubwa na yanafahamika; pamoja na kunyamazishwa mimi nadhani wangeorodhesha justified allegations na wapeleke kila sehemu na hata humu ndani!!

    Pia nimejiuliza, Tanzania haina manesi wa kutosha, kwa nini wasiache kazi hapo wahamie hospitali nyingine?? maana serikali nayo imeboresha kiasi mafao ya manesi?

    Ninachofahamu ni kuhusu suala Hospitiali ya A/Khan suala la kulipwa Mishahara Watummishi wa Taasisi Binafsi lilishavurugwa na Serikali baada ya kutangaza kwamba kila Kampuni au mwekezaji aangalie uwezekano wa kuwalipa Watumishi wake Mishahara lakini isiwe Chini ya Kima cha Chini cha Mshahara. kwa sasa Kima cha Chini cha Mshahara ni Tshs. 150,000/-

    Kwa hiyo kwa Mtumishi wa Taasisi Binafsi kulipwa kulipwa Tshs. 300,000 kwa mwezi itz Mshahara wa juu eti. Lakini ukiangalia Sheria ya Ajira na Mahusiano Kazini Namba 6 ya mwaka 2004 ambayo imechukua nafasi ya ile Sheria ya Mwaka 1964 ambayo ilikuwa inatiwa Sheria ya Usalama Kazini. Hii Sheria Mpya ilianza kutumika mwaka 2005. Lakini Kanuni zake zimetoka mwaka 2007. Kwa maana hiyo kulikuwa na Mkanganyiko wa Utekelezaji wa Sheria. Niwaambie tu kwa faida yenu ni kwamba Sheria za Kazi haziwezi kutekeleza kirahisi mpaka ziwepo kanuni zake. Hivyo ukiangalia Sheria hiyo imeruhusu majadiliano ya kiwango cha Mishahara kati ya Mwajiri na Mwajiriwa. Majadiliano hayo yanaweza kuihusisha pande nyingine ambayo ni Chama cha Wafanyakazi. kwa Sekta ya Afya wanayo TUGHE. Hiki ni Chama cha Wafanyakazi wa Serikali Kuu na Afya na Sheria ya Ajira na Mahusiano Kazini Na. 6 ya mwaka 2004 ikisomwa pamoja Kanuni zake za mwaka 2007 zote zinasisitiza uwepo wa majadiliano ya kiwango cha Mshahara kati ya Mwajiri na Mwajiriwa. Hata hivyo Sheria hiyo na Kanuni hizo zinasema wazi suala la malipo ya kufanya kazi kwa masaa ya ziada. Malipo ya Masaa ya ziada kwa mujibu wa Sheria hiyo na Kanuni zake yanatofautiana kulingana na sekta na sekta. kwa Mfano watu wenye kufanya kazi za "Shift" iwe usiku au Mchana. watu wa kwenye Migodi na Viwanda na Madaktari na Wauguzi ambao wao wanalipwa posho ya masaa ya ziada lakini pia wanamalip yao maalum yanayoitwa "on call allowance".

    Niwashauri watumishi hao wa A/Khan Hosptali kwenda kwenye vyombo vya Sheria au kwenye Makao Makuu ya TUGHE na kufuatilia haki zao. Lakini wasisahau suala la SOKO la ajira kwa sasa. Maana wewe unalalamikia mshahara wa Tshs. 300,000/= lakini kuna wenzako 100 ambao ni wataalam kama wewe au kuliko wewe wapo mlangoni wanagonga ili waweze kuajiriwa kwa Mshahara kama huo au hata wa Tshs. 200,000/- KAZI NJEMA

    Soko la ajira na uchumi huria bado waTz wengi hawajacope nalo jamani na pia uwezo wa wao hasa ufahamu wa mambo nje ya uuguzi ndo mdogo. Ukiangalia nje ya Tanzania lets say US na UK huyohuyo Registered Nurse analipwa $30-$55 kwa saa na ana taaluma hiyohiyo kwa level hiyohiyo ni suala la kufanya tests na kulipa fees na unapata sponsor ambaye anakutafutia kazi kwa fees na hapo you are done

    Kwa nini ung'ang'anie na kulia chini ya miti wala usichukue hatua? wanasema amua kubaki au chukua hatua ukae kimya!!

    Mag3 Nilianza kuwa na huruma na kuanza kukurupusha mafaili kupata data zaidi, lakini kama watu hawajui sheria wanalalamika nini? Walijaribu kulalamika kwa kufuata sheria wasiyoijua? Mitanzania jamani aaaaaaaggggggggggghhhhh!!!!!

    Hao Agakhan scale yao inaendana na rangi ya mtu,hata ukienda kutibiwa kuna sehemu unatakiwa ujaze race,vivyo hivyo katika shule zao unapojaza form kuna kipengele cha race,na hata pale Shabani Robert secondary school ni vivyo hivyo.

    Kabla ya kutafuta mchawi wenu, anza kwa kujua Sekta yenu inatakiwa kulipa nini.Nakupa hint ifuatayo upate kianzio katika research yako:
    THE SETTING OF SECTORAL MINIMUM WAGES
    WAGE ORDER:
    The Minister for Labour, Employment and Youth Development, Hon. Captain (rtd) John Z. Chiligati (MP) on 16th November 2007 published a Wage Order vide Government Notice No. 223 of 2007 for the payment of newly established 8 sectoral minimum wages. The said wage order is cited as the Labour Institutions (Regulation of Wages and Terms of Employment) Order, 2007 and has been made under section 39(1) of the Labour Institutions Act ( No. 7 of 2004). With this wage order in place, having legal force, employers are now obliged to pay to their employeesÂ’ minimum wages as well as fringe benefits in respect of each sector with effect from 1st January 2008.
    Under the second schedule of this wage order, minimum wage for each sector (ranging from 65,000/= the lowest to 350,000/= the highest) are clearly provided for. In essence, these new rates of minimum wages have marked the end of the old, minimum wage (48,000/= for urban and 35,000/= for rural areas). In Health Services, Agricultural Services, and Commercial, Industrial and Trading Services, categories of employees (persons of above 18 years of age and persons of or above 15 years but below 18 years of age) and their minimum wage have been made.
    Part B of the same schedule consists of fringe benefits which are leave allowance, leave travel assistance, transport allowance, meal allowance, housing allowance, out of station allowance, and on transit allowance.
    This wage order has revoked the Regulation of Wages and Terms of Employment Order, 2002 (Government Notice No. 311 of 2002). Explanations as to what consists of Potential Commercial, Industrial and Trading Services, Micro, Small and Medium Enterprises in the wage order have been made at page 14 of the said Government Notice, that is, No. 223 of 2007.

    Watanzania bado hatujawa flexible kwenda na soko la ajira. Bado tuna ule mtazamo wa kufanya kazi hadi ustaafu sehemu moja tu utakuta watu wanalalamika chini ya miti na ndani ya nyumba zao ukiwaambia chukua hatua wanadai pensheni yangu ntaikosa. Haya mambo ndo yanawafanya hata waajiri wenyewe wasijali. Kada za afya sasa nafasi zimejaa kila mahali lakini wote wanalalamika tuuu. Mtazamo wangu siwezi kufanya kazi hadi ifukie mwajiri anakuzoea na anaona huna jipya tena unfanya routine tu matokeo yake ndo hayo anakuabuse kwa vile anajua uwezo wako wa kufikiri unaishia kulalamika then kazi yake unamfanyia. Kwa nini usubiri hadi mje kufikishana na mwajiri mahakamani?? Ukiona hana mafao dai akipuuzia tembea mbele. Siku zote hakikisha michango yako inakwenda kwenye mfuko wako wa pensheni basi ndo maana ya soko. Hawajajua kuwa ujuzi wako ndo shamba lako na mazao yako tafuta bei nzuri inayolipa sio uuze kwa hasara ukalilelie nyumbani labda kama hamna alternative. Ni hayo tu kwa sasa

    umaweza kwenda kuwaona watu wa CMA ofisi ya kazi, kwenye makutano ya barabara ya bibi titi na morogoro, pale wanaweza kuwapa ushauri mzuri juu ya masuala ya kazi
