Nimegundua kwamba Tanesco wanajikuta matatizoni baada ya kuingia mikataba feki.
Tatizo nikwamba hawaelewi aidha lugha inayotumika au hawana kitengo maalum kinachopitia mikataba kabla ya kuwasilishwa kwa wahusika.
Mfano:
nilifanikiwa kupata tender ya kuuza token za Luku. Nilikabidhiwa mkataba nikausoma vizuri sana lakini Tanesco kama shirika la umma hawaelewi walichoandika katika mkataba wa LUKU. Tanesco wanalazimisha kila mwenye mkataba kulipa milioni 10 ili kuanza kuuza token za Luku lakini mkataba hausemi hivyo kwamba kila mtu mwenye mkataba lazima alipe hicho kiasi.
Mkataba unasema hivi; - Appendix A - Description of the services

5.1 The LUKU Agent shall purchase a MINIMUM LUKU units of the value of not less than one week average OR Tsh 10 million whichever is higher.

5.2 The Agent shall replenish LUKU units in the vending machine when the value of outstanding is 1/4 of the total units purchased.

Hizi sentence mbili katika huo mkataba, tanesco wanashindwa kuelewa kwamba muuzaji ndio anaeweza kujua kiasi anacho takiwa kununua na kuuza ndani ya wiki moja na sio tanesco kupanga kiasi cha 10m moja kwa moja kwa kila muuzaji.
Kwa lugha ya kimombo nikijaribu kufafanua;-

In that clause of Appendix A 5.1 there are two options which one should take note of;
i) the average value of not less than one week and
ii) 10 million whichever is higher

If you look at option one, you will find that a vender is being given a chance to come up with a figure to purchase tokens which will sustain for a week. Since his not required to purchase tokens on daily basis from Tanesco.
Option ii, if the sells of a vender are higher in a week and if his to purchase twice a week, then his entitled to purchase tokens of not less than 10 million or more.

Thus a vender is the one who can tell how much is required to purchase within a week in his area.

Lakini Tanesco wanalazimisha kila muuzaji anunue token za milioni kumi. Jamani hii huduma itawezekana kama tanesco wenyewe hawawezi kufikia kila mwananchi mwenye kutaka huduma ya token za Luku?

Ukiangalia kipengele cha pili 5.2 hapo juu; inasemekana kwamba neno REPLENISH linawachanganya tanesco. Tanesco wanalazimisha muuzaji kulipia 10m kila anapo nunua token za kuuza, kitu ambacho sio sahihi. kwavile mkataba unasema kiasi cha token kikibakia robo (1/4), muuzaji anatakiwa kujazilizia (replenish) kiasi kilicho pungua ili kirudi kama kilivyo kuwa mwanzo. Hii lugha inasemekana ningumu sana kwa Tanesco, nivyema mikataba yao iwekwe kwa kiswahili.

Faida iliotajwa kwenye mkataba ambayo ni 3% ilizingatia kiasi cha mauzo kwa wiki. ili muuzaji aweze to maintain his cash flow. Katika Tanzania nzima ni Dar pekee (baadhi ya vituo vya kuuza LUKU) wanao weza kuuza 10m ndani ya wiki mmoja. Mikoani na vijijini 10m unaweza kuuzia miezi 3 au hata 4. Ukizingatia faida ya 3%, muuzaji atajikuta kwamba yuko kwenye hasara kubwa.

Ndio maana nasisitiza mikataba ya Tanesco yote waiweke kwenye lugha wanayo ifahamu.
Badala kuwa kama chombo cha mafisadi.
Sehemu nyingi ambapo Tanesco wamefunga mita za Luku watanzania wanapata tatizo la kupata huduma ya tokens kutokana na huduma zao mbovu.
 
Hii ndiyo faida ya kuajiri/kuwaweka watoto wa akina fulani kwenye nafasi wasizo ziweza matokeo yake ndiyo hayo!
