    Jamani nisaidiwe maelezo yanayofaa yakielezea utaratibu mzuri wa mgonjwa kazini aliyekwisha pewa likizo ya ugonjwa na bado ni mgonjwa nitumie utaratibu gani kumterminate? Najua Sec 32 ELRA inavyoeleza.... Nimepitia kidogo kanuni zinaelezea utaratibu kwa Mgonjwa aliyeumia kazini tu,... TAFADHALI WADAU.

    Utamlipa mwezi wa kwanza full pay,second month full pay,third half pay and thereafter you can proceed with termination.Ila angalizo ni kwamba,kama ugonjwa alionao unamwezesha kufanya shughuli nyingine sheria inazuia mtu wa namna hiyo asiwe terminated,badala yake apewe kazi nyingine yoyote iliyopo ambayo inaendana na hali aliyonayo.

    nadhani ni vema kukawepo na document kutoka kwa daktari inayoonesha kuwa muhusika hawezi/hataweza kutimiza majukumu yake ya kikazi kwa muda mrefu ujao kwa sababu ya ugonjwa alionao.

    Nadhani ni majibu Mazuri yanaendana na S. 32 ELRA na kwa upande wa kupewa kazi nyingine ninaona ktk Code of good practice S.19 inaelezea vizuri. Asane mkuu.

    Nadhani maana ya kifungu cha 32 cha Sheria ya Ajira na Mahusiano Kazini, 2004 ni kwamba kwenye mzunguko mmoja wa likizo (mwaka mmoja), mfanyakazi ana haki ya kupata likizo ya ugonjwa yenye malipo (paid sick leave) ya siku 126. Siku 63 za kwanza atalipwa mshahara mzima na siku 63 za pili atalipwa nusu mshahara. Na kwamba daktari aliyesajiliwa ndiye atakayethibitisha kuwa mfanyakazi ni mgonjwa kiasi cha kustahili likizo hiyo.

    Ili uweze kujua ni nini cha kufanya na ni lini ukifanye itakubidi usome kanuni ya 19, 20 na 21 za Kanuni za Utendji Bora, 2007. Kwa ujumla maamuzi utakayoyachukua ni lazima yatokane na taarifa ya daktari na ni lazima daktari athibitishe kuwa kiwango cha ugonjwa kitamfanya mwajiriwa ashindwe kufanya kazi kwa muda mrefu. Lakini nafikiri, wakati unajiuliza muda mrefu ni upi kwa maana ya utendaji bora (good practice) itakubidi urejee kifungu cha 32 cha Sheria ya Ajira na Mahusiano Kazini kama nilivyojaribu kueleza hapo juu.

    Kumbuka kuwa kuugua sio kufa, hivyo kwa mawazo yangu wewe kama mwajiri, badala ya kufikiria kumuachisha kazi mwajiriwa ambaye ni mgonjwa ungefikiria kumsaidia kulipia gharama za matibabu ili aweze kupona au kupata nafuu itakayomfanya aendelee na kazi. Hata hivyo, kama kweli wewe ni mwajiri nakupongeza maana likizo za ugonjwa ni nadra sana masikioni mwa watu kwenye sekta binafsi.
