Sheria ya mfanyakazi kulipwa siku 7

    Habari zenu ndugu wana sheria.
    Napenda kujua juu ya hili suala. Nimepata kusikia kuwa mtu akipewa termination kazini eti kwa mujibu wa sheria ya kazi hapa nchini mtu huyo aliyepewa termination anatakiwa kulipwa siku 7 tu katika kila mwaka aliofanya kazi na hiyo kampuni.

    1.swali langu ni je hii sheria inafanya kazi hata katika mashirika ya kigeni?

    2. katika mashirika ya kigeni kama mfanyakazi si mtanzania yeye analipwa mwezi mmoja katika kila mwaka aliofanya kazi na kampuni, je hichi kifungu kinachowafanya wao walipwe hivo kipo katika sheria zetu za wizara ya kazi?

    3. kama hazipo wao wanalipwa kwa kufuata sheria zipi na kwanini?

    Mr Mak, pole kwa kuchelewa kupata majibu ya swala lako. Lakini naamini kuchelewa huku hakujaadhiri haki yako ya msingi yakikatiba ya kupata habari, ni kwa vile watu wapo busy hawakupitia kwenye ukurasa huu.

    Ni kwamba ulichosikia ni kitu kinaitwa Severance Pay (Kiinua Mgongo) ambacho kwa mujibu wa Sheria ya Kazi na Mahusiano Kazini kipo kwenye Section 42. Kisheria kama mfanyakazi amefukuzwa kwa utaratibu unaotakiwa (fair termination) Mwajiri halazimishwi kumlipa Severance Pay mfanyakazi. Ukiisoma vizuri sheria na marekebisho yake utagundua kuwa mtu ambaye anapaswa kulipwa pesa hiyo ni yule ambaye ameachishwa kazi for operational requirement na wala sio kwa kuretire sababu ya umri, au sababu zingine zozote.
    Hivyo ndivyo sheria inasema, lakini siku zote sheria inatoa minimum requirement, hapa inatakiwa unielewe vizuri. Sheria inatoa minimum requirement kwa maana mtu au mwajiri anatakiwa asishuke chini ya vitu vilivyotolewa kisheria. Mfano kwa swala hili la kiinua mgongo kama Mwajiri ataamua kuwalipa wafanyakazi wake wanapoacha kazi au anapowafukuza kazi, wanapofariki wakiwa kazini au vyovyote vile sheria inaruhusu. Na wapo waajiri wanafanya hivyo, kisheria wapo sawa kabisa ila hawataki kushuka chini ya sheria inavyotaka.

    Swali kwamba sheria inatumika kwa makampuni ya kigeni? YES, sheria hii ya Kazi na Mahusiano Kazini inatumika kwa waajiri wote Tanzania ukitoa Jeshi la Wananchi, Jeshi La Polisi, Jeshi la Magereza na National Services. Angalia Section 2 (1) imeeleza vizuri. Tena kwa uelewa tu ni kwamba hata Watumishi wa Serikali nao Sheria Hii inawahusu moja kwa moja. Nakumbuka kuna kipindi kulikua na discussion ndefu kuhusu hili na nilieleza vizuri sana na ni kwa jinsi gani watu wanazani Watumishi wa Serikali haiwahusu.

    Swala kwamba ktk kampuni za kigeni wafanyakazi ambao sio watanzania wanalipwa mwezi mzima ktk kila mwaka waliofanyakazi. Hii ni kama nilivyoeleza hapo juu, sheria inatoa minimum requirement na hapo inaonekana mwajiri anatoa juu zaidi kuliko sheria inavyotaka that is fine. Ila mwajiri hatakiwi kutoa chini ya sheria inavyotaka. Ila kwa mwajiri mwenye busara hawezi akawa anafanya hivyo kwa wafanyakazi kutoka nje halafu hafanyi hivyo kwa wafanyakazi watanzania. Kwangu hii naona kama ni unyanyasaji inatakiwa mwajiri aliangalie vizuri hilo. Kwani akipata chama cha wafanyakazi wenye kujua sheria vizuri hilo linaweza kumletea dispute.

    Nazani swali lako la tatu limejibiwa pia hapo juu, kwamba sheria inatoa minimum requirement - ukiweza kulipa zaidi ya sheria inavyotaka sio shida ila hutakiwi kulipa chini. Hiyo si tu katika maswala ya pesa ila hata maswala mengine ya kikazi mfano Likizo, zipo kampuni mfano kwenye migodi kwa mwaka wanapumzika zaidi ya siku 28 zilizotolewa na sheria.

    Nazani kwa maelezo yangu utakuwa umenipata kidogo, km kuna chakuongezea wenzangu wataongeza na mimi nikikumbuka nitaongeza ikibidi.

    Maelezo ni mazuri sana hata me nimewahi kupata ufafanuzi hii lakini kuna haja ya hizi sheria za kazi kubadilika!!
