Sheria ya ardhi inasemaje?

    Kuna eneo ambalo mwanzo tulikuwa tunalima kama shamba,hivi karibuni imeingizwa kwenye mpango wa viwanja vya mji.nilimfuata afisa ardhi anipimie viwanja eneo hilo akanijibu c lazima anipimie hapo,anataka kwenda kuniuzia eneo sehemu nyingine.naombeni msaada,sheria inasemaje?

    Eneo linapotangazwa kuwa la mipango miji basi zipo taratibu ambazo zinahitajika kufanyika,kwanza inabidi wananchi wapewe elimu ya kutosha juu ya upimaji wa maeneo katika huo mradi mpya, pili fidia ya haki, kamili na wakati inabidi kulipwa kwa waliokutwa na mradi huo, tatu mara baada ya fidia wananchi watatakiwa wapishe mradi na mara utakapokamilika wale wananchi wa eneo lile watapatiwa viwanja kwa kulipia gharama za upimaji zilizofanyika na waombaji wapya watapatiwa viwanja kwa bei itakayokuwa imepangwa na serikali. Upo uwezekano ukapatiwa eneo tofuati na eneo ambalo ulikuwa unalimiliki mwanzo kutokana na mpgango mji utakavyo kuwa umeelekeza.

    ni eneo ambalo ni kwa ajili ya viwanja, na maafisa ardhi wanatumia ubabe kwamba ni mali ya serikali. Who is mr government?na hilo eneo lilikuwa linamilikiwa na bab zetu toka zamani. Mi nataka kupimiwa viwanja eneo hilo,ni utaratb gani wa kufuata? Kama ni eneo lenye viwanja zaidi ya kumi,tunatakiwa kuachiwa viwanja vingapi? tunadhulumiwa!

    Eneo litakuwa la serikali mara baada ya taratibu za kuwalipa fidia kuwa zimekamilika, lakini pia kama wakazi mliokutwa na mradi hamna budi kupatiwa viwanja mara baada ya upimaji kumalizika, kila mtu atapatiwa kiwanja kimoja ila haitakuzui kuomba kviwanja vingine mara watakapotangaza uuzwaji wa viwanja. Ni matumaini yangu kuwa baada ya fidia utakuwa kwenye uwezo mzuri wa kiuchumi kuweza kununa hivyo viwanja vingien watakavyotoa offer

    thanks,lakini huku kwetu m2 akitaka eneo anaonesha sehemu anayotaka na kupimiwa.na moja ya shamba letu limeuzwa kwa mfumo huo.je ni sheria ipi inayoruhusu kulipwa fidia?

    Sheria ya Ardhi sasa imebadilika, kwa sasa huwezi kupewa hati miliki kama hakuna plan (mipango miji)

    pole kwa hiyoissue ambayo hata mimi imenikuta
    wanachofanya sasa watu wa Ardhi: wanaweka stop order na kuanza kupita kuonyesha mipaka ya mipango miji iko wapi,mathalani shamba langu lilitoa viwanja viwili na njia kubwa mbili, na kwa gharama za kila kiwanja ilikuwa 3200000Tsh, kwa hiyo kwa viwanja viwili ilinipasa kulipia 6400000Tsh.

    sasa katika fidia kulikuwa na Mihembe na mazao mengine pamoja na miti, na Ardhi yenyewe (serikali siku hizi imeanza kulipia Ardhi japo ni kidogo sana) kwa shamba langu lote niliwekewa hesabu ya 3154000Tsh kama fidia, na nikapewa option ya kuchukua kiwanja kimoja kwa 46000Tsh, kingine kwa bei ileile ya 3,200,000Tsh na hizo hela zinatakiwa ndani ya siku nane uwe umezilipa,

    nilifika mpaka kwa mkurugenzi na mwanasheria wa Ardhi lakini jibu likawa ni lilelile, niliporudi kuja kulipia nikakuta sehemu yangu keshauziwa mtu na yuko kwenye process ya kupewa hati, ninavyokwambia shamba langu nililonunua 1999 nimeamishwa na nipo sehemu nyingine kabisa na hakuna kesi

    na hili inatupasa tuwe makini sana unaweza kukunua shamba wa million zaidi ya kumi, lakini mipango miji ikija hilo hawalitambuhi unaweza kulipishwa kumi nyingine hivihivi

    Waheshimiwa tunaweza pata hizo ATTACHMENT ZA SHERIA MPYA ya ardhi? If yes tusaidiwe ili tuwe na uelewa zaidi kuhusu ardhi na hati miliki.

    Ndg. tembelea web ya bunge nenda kwenye sehemu ya document then click there utapata vitu kama Hansard nenda kwenye Acts then kuna maelekezo. Kwa kuwa Sheria ya Ardhi ni ya Mwaka 1999 type huo mwaka zitakuja nyingi. Chagua Land Act No.4 of 1999. Sio sheria mpya kama wengi mpaka sasa imefanyiwa Amendment mara 2 mwaka 2004 na 2008.

    Unapokuwa umeshalipwa fidia eneo litakuwa sio lako tena. Na inabidi uombe kumilikishwa kama waombaji wengine sheria hailazimisha kuwa wafidiwa wapewe viwanja ila inaseme katika ugawaji Ardhi wapewe kipaumbele ( Land Regulations of 2002)

    Na hakuna nayekuzuia kumiliki hivyo viwanja kumi vyote isipokuwa tisa lazima utavilipia kwa beo ya soko wanayouziwa watu wengine wanaaomba wakati kimoja ndio hicho unalipia tu gharama ndogo ya kupima kama huyo ndugu aliyelipia 46,000. Lakini ukiwapata watu wa ardhi wanaoujua kutafsiri sheria vizuri watakuzuia kumiliki vyote kumi kwavile wanadai kuzuia land concentration ambayo inarushusu speculation. Kwa tafsiri rahisi ni kama vile kudhibiti uhodhi wa ardhi kwa ajili ya kuichuuza au kufanyia udalali kibiashara.

    kwanza kabisa huwa viwanja vya kumilikiwa kabla ya kupimwa huitwa squatter na vinapotangazwa kuingia katika mipango miji huamia katika granted right of occupancy na baada ya kupimwa wamiliki hushauliwa kubadili hati kutoka ardhi inayomilikiwa kimila kwenda katika hati miliki. Pale unaposhindwa ndipo huunzwa kwa wengine. Ni ushauri kwa juu juu ila natumai utakusaidia

    Unajua nini, usiende kwenye hizo ofisi za manispaa idara ya ardhi kwa mdomo, ni watata sana hao watu and it is the most corrupt public office. Andika barua kwa mkurugenzi wa manispaa/mji ukiomba kupatiwa umiliki (hatua ya kwanza huwa ni letter of offer) deliver your letter with dispatch kwa ajili ya kumbukumbu subiri uone watakujibu nini kama ndio eneo limeshawekwa chini ya mipango miji au la. fuatilia kwa karibu uone mwisho wake ukiona wanakuzungusha kwenye majibu yao jua kuna utapeli tafuta mwanasheria watwange demand letter ukiwataka wakumilikishe ardhi yako wakikataa wapeleke kwa pilato.

    Ardhi ni mali ya uma/watz wote ila under the trusteeship of the president....mtu binafsi tz anaweza kuazimishwa tu ardhi ila haijawa fully privatized kama zile za kenya na uganda....kwa minajiri hiyo ndugu yangu, kwenye ardhi yako kama hakuna mti wowote, hakuna kibanda chochote, ni shamba tuuuu tupu, selikali inaweza ikalichukua bure kwasababu haujadevelop hiyo ardhi, naina kitu cha thamani ambacho wanatakiwa wakupe compensation....hata wakikupatia shukuru Mungu. kungekuwa na miti ya miembe au ya mbao etc, ungeweza kutathmin mti mmoja ungekuzalishia nini na wangekupatia pesa....wanapokuja kunyang'anya ardhi ndo maana huwa wanakuja na watathmini kabisa....kama hujadevelopp iyo ardhi, wanaichukua ya kwao na hawana cha kukulipa.....yaani unawarudishia. jua iyo ardhi si mali yako, ila kile kilichopo juu yake ndicho kinaweza kuwa chako, either nyumba, miti ya matunda, mazao etc....kama kuna kitu juu yake utapata compensation, kama huna chochote ardhi uliicha tupu, inabidi uwarudishie wenye nayo (umma wa tz)...

    Wakuu mimi nilikuwa na kesi ya ardhi na serikali ya kijiji fulani na kesi hiyo imeisha na nimeshinda. Imetolewa amri ya siku 14 na mahakama kijiji kikabidhi kwangu ardhi hiyo na kama hawatafanya hivyo basi dalali wa mahakama atakuja kunikabidhi kwa gharama za serikali ya kijiji.

    Siku 14 zimeisha laikini dalali anataka mimi ndo ni gharamie halafu ndo nidai serikali inirudishia hizo gharama. Nimekubaliana na hilo sijui kama ni sawa ila nimewaambia wanipe gharama halisi ambazo nitaweza kujustify mahakamani kama nitafungua madai dhidi ya serikali ya kijiji. Baada ya kuwaambia hivyo inaonekana wanasita je nifanyeje?
