    SERIKALI imetia saini kuridhia itifaki za haki za wanawake, ikiwemo ya kuruhusu utoaji mimba nchini.

    Tanzania imeridhia mkataba huo, huku madhehebu mbalimbali ya dini yakipiga marufuku utoaji mimba, kwani ni kinyume cha mafundisho ya dini.


    Itifaki hiyo ambayo inasubiri kutungiwa sheria bungeni ili ianze kutekelezwa, imo katika Mkataba wa Haki za Binadamu na Haki za Wanawake barani Afrika na Itifaki ya Maputo.

    Itifaki ya Maputo inazipa wajibu nchi wanachama kuhakikisha kuwa, zinalinda na kuboresha afya za wanawake, hususan afya ya uzazi.

    Itifaki hiyo kwa mujibu wa uchunguzi, inaainisha haki mbalimbali za mwanamke, ikiwa pamoja na haki ya kuamua kuzaa au kutozaa, haki ya kuamua kupata watoto na nafasi ya mtoto mmoja hadi mwingine, pamoja na haki ya kuchagua njia ya uzazi wa mpango, ikiwemo kutoa mimba.

    Waziri wa Nchi, Sera, Uratibu na Bunge, Philip Marmo, alithibitisha kuridhia kwa itifaki hiyo katika barua yake yenye Kumb. Na. I/CFC.188/444/01 ya Januari 30 mwaka huu, kwenda kwa Mkurugenzi Mtendaji wa Shirika la Kutetea Uhai (PRO-LIFE), Tanzania, Emil Hagamu, aliyeiandikia barua serikali kuhoji uhalali wa Tanzania kuridhia itifaki hiyo.

    Katika barua hiyo, Hagamu alimwomba Rais Jakaya Kikwete, Waziri Mkuu, Mizengo Pinda na Spika wa Bunge, Samuel Sitta, kuingilia kati na kuzuia haraka mauaji ya watoto yanayoweza kutokea endapo Bunge litapitisha sheria ya utoaji mimba.

    Akifafanua kuhusu kuridhia kwa itifaki hiyo, Waziri Marmo katika barua yake ya majibu kwa PRO-LIFE ambayo Tanzania Daima ina nakala yake, alisema Itifaki ya Haki za watu na Haki za Wanawake Barani Afrika, Ibara ya 14, kipengele cha (2) C, kinasema:

    "Kwa kuangalia maudhui ya vipengele hivi kwa ujumla ni kweli inatoa tafsiri sahihi ya kuridhia utoaji mimba ili kukidhi vigezo kama inavyojieleza, ambavyo ni kwa mimba iliyosababishwa na shambulio la aibu kama vile kubakwa au kwa mimba inayohatarisha afya ya mwili na akili ya mama au uhai wa mtoto."

    Akirejea barua ya PRO-LIFE, Tanzania yenye kumbukumbu namba PLT/C-A/2009 ya Januari 5, mwaka huu, Waziri Marmo alikiri kuwa kweli Tanzania imeridhia itifaki hizo, lakini bado hazijatungiwa sheria.

    "Ni kweli Tanzania iliziwekea sahihi na kuridhia itifaki za Haki za Wanawake katika Mkataba wa Afrika wa Haki za Binadamu na Haki za Wanawake barani Afrika na Itifaki ya Maputo," alisema.

    Waziri Marmo katika barua hiyo kwa Mkurugenzi wa PRO-LIFE, ambaye pia ni Mratibu wa Human Life International (HLI) Kanda ya Tanzania, alisema japo Tanzania imeridhia itifaki hizo mbili, bado hakuna sheria iliyotungwa kusimamia au kuruhusu utoaji mimba.

    "Taratibu nchini Tanzania kama ilivyo kwa nchi nyingine ni kwamba, itifaki na mikataba ya kimataifa, haiwezi kuwa sheria ya nchi hadi zitakapotungiwa sheria za Bunge.

    "Isitoshe, lugha zinazotumika katika itifaki mbalimbali zinakuwa za jumla sana na tafsiri yake inaweza kupotoshwa kwa urahisi ikifanywa bila kufuata tafsiri ya vyombo husika vilivyopewa mamlaka ya kutoa tafsiri ya maana ya miandiko katika sheria ambayo hapa kwetu ni Mahakama," inasema sehemu ya barua hiyo.

    Akizungumza na Tanzania Daima jana, Waziri Marmo alifafanua kuwa Tanzania imeridhia itifaki hiyo kama ilivyo kwa nchi nyingine.

    Hata hivyo alisema mchakato wa kutungia sheria bado unafanyiwa kazi ili kujua kama sheria hiyo ni muhimu kwa sasa nchini.

    "Kuridhia ni suala jingine, lakini tujiulize tuna mahitaji hayo kwa sasa? Ni sawa na kuwa na msitu wa miti mingi, halafu unajiuliza, je, nahitaji kupanda miti mipya kwa sasa?

    "Kwa hiyo niseme tu kwamba ni kweli serikali imeridhia kuingia na imesaini mkataba huo, lakini mchakato wa kupitisha sheria bado unafanyiwa kazi," alisema Waziri Marmo.


    Akizungumza na Tanzania Daima baada ya kupata barua ya ufafanuzi kutoka kwa Waziri Marmo, Hagamu alisema PRO-LIFE, Tanzania iliwaomba Waziri Mkuu na Spika wa Bunge, kumshauri Rais na wabunge kuwa makini ili wasiruhusu kupitishwa kwa sheria hiyo inayolenga kutekeleza maamuzi ya Itifaki ya Maputo (Maputo Protocol) yaliyopitishwa miaka miwili iliyopita.

    Akifurahia tamko hilo la serikali kuhusu kutoruhusu au kutunga sheria ya kuhalalisha utoaji mimba, Hagamu alisema utekelezaji wa Makubaliano ya Maputo yanayozilazimisha nchi zilizosaini kuridhia kuwapo kwa sheria hiyo, kunamaanisha kuruhusu umwagaji damu kwa kuwafanyia mauaji watoto ambao hawajazaliwa.

    Alisema endapo sheria hiyo itapitishwa, Watanzania wajiandae kushuhudia watoto ambao ni taifa la kesho, wakiangamizwa bila sababu za msingi huku wanawake wakiteseka kutokana na madhara ya utoaji mimba.

    "Utoaji mimba haujawahi kuleta manufaa yoyote katika nchi zilizowahi kupitisha sheria hiyo... Inabidi serikali na viongozi wote watambue wajibu mkubwa walio nao katika kulinda maisha ya watu wao tangu wakiwa tumboni, wakizaliwa, wakiwa vijana na hata wanapozeeka," alisema Hagamu.

    "Kwa kuwa haki ya mwanamke haipatikani kwa kumuua mtoto wake aliye tumboni, bali kwa kulinda hadhi yake ya umama, tunaitaka serikali kuachana kabisa na wazo la kutaka kuleta sheria hii ya mauaji kwa watu wasio na hatia wala uwezo wa kujitetea," alisema Hagamu.

    Tanzania ilisaini itifaki hiyo Novemba 5, 2003; Bunge likaridhia Machi 3, 2007 na rais kutia saini Mei 7, mwaka huohuo.


    Kati ya nchi 53 za Umoja wa Afrika, nchi 45 zimesaini itifaki hiyo na 25 tayari zimeridhia kupitia mabunge na Tanzania ni miongoni mwa nchi hizo 25.

    Hakuna mtu mwenye haki ya kutoa mimba. Mtu huyo, awe mwanaume au mwanamke, hakuna mwenye haki ya kuondoa uhai wa binadamu mwingine. Utaoji mimba ni makosa na ninaupinga na nitaupinga kwa nguvu zangu zote. Natamani watoaji mimba wote mama zao wangezitoa mimba zao...nyambaaaf kabisa. Mijitu inajitolea tu mimba unadhani inaenda haja kubwa....hivi wao mama zao wangezitoa hizo mimba zao leo hii wangekuwepo kweli hao watu? Na kwa nini mtu umnyime binadamu mwingine fursa ya kuishi na kuonja raha na karaha za dunia hii kama ulivyopewa hiyo fursa wewe na wazazi wako? Kwenye utoaji mimba hakuna cha haki ya mwanamke wala nini. Haki pekee iliyopo ni haki ya kiumbe hicho kilicho defenseless kulindwa. Hiyo ndio haki pekee.

    I oppose abortion and YES, I am against the death penalty also...now what?

    Nakubaliana na bwana Ngabu asilimia mia moja utoaji wa mimba ni kinyume na maadili ya kiafrika na hata baadhi ya dini zetu haziruhusu. Pia utoaji wa mimba hauna faida yoyote. By the way mkuu Ngabu ile Avatar yako ya mwanzo ilikuwa inamvuto mzuri.

    kabla hata ya hii, kanuni za kidaktari za sasa TZ zinaruhusu kutoa mimba ambayo ni hatari kwa uhai wa mama ama mtoto - na iwe imethibitishwa hivyo na madaktari wawili. kwa hiyo kitakachoongezeka hapo ni hiyo ya 'kubakwa'. na nyie mnaopinga kwa nguvu zote, hebu "hata kama ni midume" jiwekeni kwenye viatu vya mama anayebakwa, kibaya zaidi na kichaa- utakubali uendelee na mimba au mnaleta ukenge wenu!! 1) ulikuwa huna mpango pengine wa kuzaa muda ule 2) perhaps bado hata bado hujaolewa 3) magonjwa ya akili yanarithiwa! bado utakubali kuendelea na hiyo mimba?? ukiacha hayo, watu kibao wanakufa kwa kujaribu kutoa mimba kwa njia zisizo salama kwani wanataka iwe siri; kwa hiyo tunapoteza mama na mwana; bora kipi? niko upande wa YES for abortion kwa cases hizo- kubakwa, kuhatarisha uhai wa mama au mtoto

    Nafikiri sasa tanzania imefanya la maana sana....kuruhusu utoaji mimba...kwa sasa...kwani mimba sio hupatikana kwa shambulio la aibu au kubakwa tu...wengine kwa ajiri ya kufikiri namna ya kupata ndoa au kumshika mwanaume huamua kushika mimba...

    Kingine tunatapunguza watoto wa mitaani..kwani sasa itakuwa inatolewa officialy na sio kiwizi wizi..hapo sasa kutakuwa na vifaa na dawa za kufanya kazi hiyo....so vifo vya wadada,wamama walioko katika utoaji mimba hawatakuwa na off tena ya kutoa.Ni lipi bora...kuzaa mtoto na kushidwa kumlea...kisa uliogopa kutomleta dunia...????

    Hii itasaidi hata wanafunzi kuendelea na masomo...hapo tunaepusha watoto kufukuzwa shule kwa sababu za mimba....etc.Nyani ngabu..are u there.
    Tusipige tu kwa nia ya kupinga...sipendi tolea mfano nchi za nje...lakini wao kwa kuwa hii kiti walianza mapema ndio maana kuna minimal watu wanaoweza jihudumia kwa mahitaji ya msingi...kwa sasa haitaonekana faida yake...ten yrs ahead unaweza ona..pale mwanza watoto(chokolaa) watakavyo pungua...

    Abortions in the first stage of pregnancy should be completely by choice, though consultation and adequate education should be provided, and a formal recommendation to carry the pregnancy should be issued.

    Abortions in the second stage of pregnancy should only be done by the prescription from a qualified doctor and for medical reasons. Abortion in this stage should also be allowed if the pregnancy was the result of a rape.

    In the third stage, an abortion should be strictly allowed for medical resons ONLY, the most prominent of which are the threat of death for the mother or baby.

    Yes, i know that many Tanzanian will disagree with what i have said, but to the few that do agree, please comment on this thread and voice your support. To those that disagree i urge the same, although i can't promise that i will give your retorts any attention as i do not fancy debating with a person who has an empty head.

    Don't dump your religion, change it. Fight for what is right.

    (a)If it is confirmed by a team of specialized doctors on the basis of laboratory and technical tests that the fetus is severely abnormal, cannot be treated, and if he/she will be born he would suffer hardships in life as well as cause severe suffering for his/her family, then he may be aborted before four months of age (120 days). This is under the legal responsibility of doctors and parents to decide. This is the meaning of the fatwâ issued by the Islamic Law Committee of the Muslim World League in its twelfth session on 15/7/1410 AH, by majority opinion.

    (b)If pregnancy came about as a result of rape and is still within its first four months,then abortion will be allowed if it is determined that the pregnancy may effect the mother’s physical or psychological health by imposing upon her a situation that she cannot bear, especially in the absence of social support. This permissibility lessens gradually. It is more permissible in the early part of the four months - the first 40 days - then it will be in the second and third forty days.
    However, if the pregnancy resulted from consensual adultery, then it is impermissible for her to have an abortion, even at this early stage.The logic of this ruling is that the consequences of an unlawful act (adultery) should not be used as a pretext to make lawful something else that is unlawful (abortion), since indeed abortion is unlawful except under the most extraordinary circumstances. If this option were made lawful under such circumstances, it will be opening the doors to further abuses.
    Contemporary scholars have voiced their agreement on this issue in all of the many of the international Islamic Law conferences that have been convened.

    Jamani nadhani pia serikali ilijibu vizuri kwamba kwa mfumo wetu wa sheria , protocol/convention or any international law ikiridhiwa na bunge haiwi sheria mpaka itungiwe sheria na bunge, na hapo ndipo mshike mshike ulipo.

    Kukubaliana na hiyo protocol haina maana kuwa utoaji mimba umerushusiwa nchini, nadhani hapo inabidi tuwe clear kabisaaaaa

    Sheria ikitungwa (ikiwepo sababu) ndipo tutajua mbivu na mbichi ni zipi

    As kwa nini wameridhia hii protocol, hilo siwezi kujua maana inavoonekana mambo yalienda kiutawala zaidi na sidhani kama kwa hili huwa kuna public consultation.

    Kwa upande wangu niseme tu kuwa sikubaliani na utoaji mimba, na hasa kuhalalisha kwa sheria, na sababu wameshazieleza au wengi wetu tunazijua so thats my stand.

Utoaji wa mimba sio tatizo ila tatizo ni jinsi gani ya kuhakikisha nani ni muhusika katika kutoa hizo mimba,hapa nina maanisha madaktari,sio hata Manesi wapewe ruhusa ya kuwatoa watu mimba,Mimi nadhani ni move nzuri so serikali ijipange kuhakikisha inatekelezeka kwa manufaa ya Taifa na wananchi wake,watu wanaozungumzia kuua,jamani bila watu fulani kufa hakuna maendeleo,je kipindi mumelala usiku mukaota kule sio kuua? mimba ni step tu,kama ilivyo kujichua au kutumia mipira.
    Kazi kwenu,mi nawahi Chaomian sasa.....

    Hiyo sheria intakuwa kinyume na Katiba ambayo kimsingi inatoa haki ya kuishi na mtu anayekatisha maisha ya mwenzake anakiuka Katiba (Sheria mama) kwa hiyo hiyo sheria ni batili kabla haijapitishwa.

    Are you sure of what you are talking about? Do you know the differences between pregnancy, sperms, condoms, killing?

    I can anticipate that we have a long way to go.

    Napinga kwa nguvu zote kuingia kwenye itifaki za kijinga kama hizi na haswa za utoaji Mimba eti ni kulinda haki ya Mwanamke, je?huyo mtoto anayeuwawa nani analinda haki zake?

    Haki za mtoto ziko wapi? haki ya mwanaume aliyetoa mbegu zake iko wapi?

    Unapozungumzia mtoto ina maana ni stages ambazo ni Sperms->Pregnancy->Kiumbe na unapozungumzia njia za kupanga na uzazi unazungumzia Condoms,Abortion nk.
    Pia unapozungumzia kuua ina maana ni kitendo cha kuondoa uhai wa binadamu,je binadamu ni nani? Sasa mtu anayetumia condom naye anaondoa uhai wa binadamu kwani kuna pisibility yale manii yangeleta mtoto,unaweza kusema kuwa si kila manii huleta mtoto pia kumbuka si kila mimba hutoa mtoto. Mkubwa liangalie hili kwa maono yako kama wewe,usiingize midini hapo.Kwani hizo si tamaduni zako,nakumbuka Niliwahi kuongea na bibi yangu akaniambia kuwa wao zamani walikuwa wanakunywa majani ili kutoa mimba,sasa ikaja midini na kuwaingilia mababu zetu.Hivyo basi hii kutoa mimba ilikuwa kwenye mila zetu.
    Wakubwa,kuna mtu yeyote anayeweza kunieleza athari za utoaji mimba kama ukifanyika kwa ufanisi? Huku china unapanga foleni kwenda kutoa mimba,hospitali zinajitangaza kwa kutoa mimba,kitu gani bwana.

    mimi ninaunga mkono wanaotoa mimba wakipatikana wangolewe na kizazi chote abaki bila kizazi aendeleee kukata starehe mbele kwa mbele ili asije pata tena mimba nyingine akaendela kuua.
